guid="_63076573-392e-4117-95aa-dbd212b6559b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <legref type="subordleg" refid="sec.66" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;66</legref><legref type="subordleg" refid="sec.66-ssec.2" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(2)</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>, the code of professional conduct consists of the provisions of <intref refid="sch.1" target.guid="_d315b743-bafc-4c40-9afd-9d414dab179b" check="valid">schedule&#160;1</intref> together with—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.1-para1.a" guid="_e80f56f3-61ea-401c-88e3-973881622058" provision.type="other"><no>(a)</no><block><txt break.before="0">if the board approves a document for inclusion in the code (the <defterm id="sec.2-ssec.1-def.approveddocument" guid="_7553df04-3d34-4eff-9d77-b69367786c2f" type="definition">approved document</defterm>)—the approved document; or</txt></block></li><li id="sec.2-ssec.1-para1.b" guid="_699de34e-f1e2-4a38-a091-c9ab7f31b43e" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—the API code.</txt></block></li></list></block></subclause><subclause id="sec.2-ssec.2" guid="_6b9d729f-8218-4e27-aeb1-f5d1552a5f1e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">To the extent of any inconsistency between a provision of <intref refid="sch.1" target.guid="_d315b743-bafc-4c40-9afd-9d414dab179b" check="valid">schedule&#160;1</intref> and a document mentioned in <intref refid="sec.2-ssec.1" target.guid="_63076573-392e-4117-95aa-dbd212b6559b" check="valid">subsection&#160;(1)</intref>, the provision of <intref refid="sch.1" target.guid="_d315b743-bafc-4c40-9afd-9d414dab179b" check="valid">schedule&#160;1</intref> prevails.</txt></block></subclause><subclause id="sec.2-ssec.3" guid="_3e7a394c-ea73-41c5-89cb-5936da87123a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If <intref refid="sec.2-ssec.1" target.guid="_63076573-392e-4117-95aa-dbd212b6559b" check="valid">subsection&#160;(1)</intref><intref refid="sec.2-ssec.1-para1.a" target.guid="_e80f56f3-61ea-401c-88e3-973881622058" check="valid">(a)</intref> applies, the board must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.3-para1.a" guid="_8bade77b-3502-4f09-919d-25f9abc07245" provision.type="other"><no>(a)</no><block><txt break.before="0">publish the approved document on the board’s website; and</txt></block></li><li id="sec.2-ssec.3-para1.b" guid="_877f98e5-316a-44ee-a992-a1778b8f7607" provision.type="other"><no>(b)</no><block><txt break.before="0">keep copies of the approved document available for inspection at the board’s office by members of the public during business hours; and</txt></block></li><li id="sec.2-ssec.3-para1.c" guid="_ebdb2836-2ce7-4cbc-bcbc-e90ac62a7787" provision.type="other"><no>(c)</no><block><txt break.before="0">give registered valuers written notice of the approval of the document, or any amendment of it, and the day it takes effect.</txt></block></li></list></block></subclause><subclause id="sec.2-ssec.4" guid="_f1a3ee1f-61d1-4d05-8783-0fbaf605cca4" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The day stated in the notice must be at least 30 days after the board gives registered valuers notice of the approval or amendment.</txt></block></subclause><subclause id="sec.2-ssec.5" guid="_9358c5f5-b0b0-41d4-bfd0-335dec2a45dc" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The approved document, or any amendment of it, takes effect as part of the code of professional conduct from the day stated in the notice.</txt></block></subclause><subclause id="sec.2-ssec.6" guid="_e11023a0-a66d-48ee-b4b9-72ac9dbab6e9" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.2-ssec.6-def.APIcode_" guid="_26b2dc1c-66af-4883-b7dc-d8284f4b6e5d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2-ssec.6-def.APIcode" guid="_e131ed88-850c-4cee-a657-bea281fd29e2" type="definition">API code</defterm> means the Code of Professional Conduct published by the Australian Property Institute with an effective date of 15 June 2015.</txt><note id="sec.2-ssec.6-def.APIcode-note" guid="_e92681c9-4fbc-4910-9e8a-4226503b687c" type="example"><heading id="sec.2-ssec.6-def.APIcode-note-he" guid="_48d5afba-08ea-48a9-8d24-47872c3d3cf1">Note—</heading><block><txt break.before="1">The API Code is available on the Australian Property Institute's website.</txt></block></note><historynote><txt guid="_61c9f0c1-9c81-4921-a09a-623e2f51c25a">Prescribed institutes—<legref target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" check="valid" jurisd="QLD" type="act">Act</legref>, <legref refid="sec.30" target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" target.guid="_6a0f5660-a5e3-4aca-bdb6-6363be24df7f" check="valid" jurisd="QLD" type="act">ss&#160;30</legref> and <legref refid="sec.36B" target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" target.guid="_1bcae052-40f6-4c52-9724-86195806ced6" check="valid" jurisd="QLD" type="act">36B</legref></heading><block><txt break.before="1">For <legref type="subordleg" refid="sec.30" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">sections&#160;30</legref><legref type="subordleg" refid="sec.30-para1.b" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(b)</legref><legref type="subordleg" refid="sec.30-para1.b-para2.i" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(i)</legref> and <legref type="subordleg" refid="sec.36B" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">36B</legref><legref type="subordleg" refid="sec.36B-ssec.1" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(1)</legref><legref type="subordleg" refid="sec.36B-ssec.1-para1.b" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(b)</legref> and <legref type="subordleg" refid="sec.36B-ssec.1-para1.c" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(c)</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>, each of the following entities is a prescribed institute—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.a" guid="_89ca50cf-59cb-40cd-a864-5714ffc7badd" provision.type="other"><no>(a)</no><block><txt break.before="0">the Australian Property Institute;</txt></block></li><li id="sec.3-para1.b" guid="_acc956e2-1eb0-4edb-9cb2-0fa1e68dd652" provision.type="other"><no>(b)</no><block><txt break.before="0">the Property Institute of New Zealand;</txt></block></li><li id="sec.3-para1.c" guid="_e2297383-2794-4571-9d7e-65f48e4f4b54" provision.type="other"><no>(c)</no><block><txt break.before="0">the Royal Institution of Chartered Surveyors;</txt></block></li><li id="sec.3-para1.d" guid="_cd5d4be0-9184-496c-8a1e-a526b1ccd9e0" provision.type="other"><no>(d)</no><block><txt break.before="0">the Singapore Institute of Surveyors and Valuers.</txt></block></li></list></block></clause><clause id="sec.4" guid="_7ee42c99-940a-4e0a-b73c-0a387badd325" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_e03c029c-1fb8-4b29-8e86-49347f23c904">CPD—<legref target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" check="valid" jurisd="QLD" type="act">Act</legref>, <legref refid="sec.36B" target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" target.guid="_1bcae052-40f6-4c52-9724-86195806ced6" check="valid" jurisd="QLD" type="act">s&#160;36B</legref></heading><subclause id="sec.4-ssec.1" guid="_d0a88bd3-dd25-4657-b7cc-0645cadc614c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <legref type="subordleg" refid="sec.36B" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;36B</legref><legref type="subordleg" refid="sec.36B-ssec.1" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(1)</legref><legref type="subordleg" refid="sec.36B-ssec.1-para1.a" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(a)</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>, CPD is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.1-para1.a" guid="_dac9be97-d7e4-4d49-9e6b-c1f2ab8958e6" provision.type="other"><no>(a)</no><block><txt break.before="0">if a registered valuer gives the board the exemption information—nothing; or</txt></block></li><li id="sec.4-ssec.1-para1.b" guid="_cfb75dc0-9ab2-4eed-823e-0aca0fe2a371" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—at least 10 hours spent on 1 or more of the following types of activities the board considers suitable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.1-para1.b-para2.i" guid="_31d5a799-84f0-4e82-865b-f5e6fa4d0e59" provision.type="other"><no>(i)</no><block><txt break.before="0">attending seminars, conferences, workshops, field days or addresses about property matters, conducted by professional organisations, industry bodies or employers;</txt></block></li><li id="sec.4-ssec.1-para1.b-para2.ii" guid="_d655f489-fb0c-4276-9e4f-9ad0a92f445d" provision.type="other"><no>(ii)</no><block><txt break.before="0">preparing and presenting papers about property matters;</txt></block></li><li id="sec.4-ssec.1-para1.b-para2.iii" guid="_cfdb36d6-a73e-47e6-838c-ada8053b42f2" provision.type="other"><no>(iii)</no><block><txt break.before="0">writing and circulating or publishing articles about property matters;</txt></block></li><li id="sec.4-ssec.1-para1.b-para2.v" guid="_d7e90ded-5eb0-49c4-9151-310ee1ea8e78" provision.type="other"><no>(v)</no><block><txt break.before="0">undertaking formal education about property matters;</txt></block></li><li id="sec.4-ssec.1-para1.b-para2.vi" guid="_d9dfa5d3-1a99-4126-bd82-cd2015e82958" provision.type="other"><no>(vi)</no><block><txt break.before="0">undertaking informal education about property matters by perusing appropriate journals or similar documents.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.4-ssec.2" guid="_2ea4ced3-9f53-42fa-82e8-0d192d9b208c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, a registered valuer must undertake the CPD mentioned in <intref refid="sec.4-ssec.1" target.guid="_d0a88bd3-dd25-4657-b7cc-0645cadc614c" check="valid">subsection&#160;(1)</intref><intref refid="sec.4-ssec.1-para1.b" target.guid="_cfb75dc0-9ab2-4eed-823e-0aca0fe2a371" check="valid">(b)</intref> at least every second year.</txt></block></subclause><subclause id="sec.4-ssec.3" guid="_6eb28ffc-59f1-4d76-ac0f-6baf0bd60aeb" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The board must, before 1 May in each year, give each registered valuer written notice of the type of CPD the board considers suitable for the renewal of the valuer’s registration for the financial year beginning on 1 July of the following year.</txt></block></subclause><subclause id="sec.4-ssec.4" guid="_709a5963-676f-4745-9e1a-033ac523fcd8" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.4-ssec.4-def.exemptioninformation_" guid="_86ab7d83-b859-4616-8869-426aa2afa4c8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-ssec.4-def.exemptioninformation" id="sec.4-ssec.4-def.exemptioninformation-para1.a" guid="_082d4131-898f-4acc-8468-07b089e5c49a" provision.type="other"><no>(a)</no><block><txt break.before="0">at least 2 valuation reports completed during the previous 12 months;</txt></block></li><li id="sec.4-ssec.4-def.exemptioninformation-para1.b" guid="_92352a25-a5d0-422f-aa4a-d8ba46b01d9e" provision.type="other"><no>(b)</no><block><txt break.before="0">reasons for not undertaking CPD in those months.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.5" guid="_08c78998-028d-47d1-903e-1bf2a61ddb0b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_7c930c55-65f3-4896-9e4d-b1c0dc89fccf">CPD—<legref target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" check="valid" jurisd="QLD" type="act">Act</legref>, <legref refid="sec.42FA" target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" target.guid="_f0533cd8-5feb-42d3-bb7d-0958b70a20d1" check="valid" jurisd="QLD" type="act">s&#160;42FA</legref></heading><subclause id="sec.5-ssec.1" guid="_1af553c1-42ab-48cf-8388-97538aff8588" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <legref type="subordleg" refid="sec.42FA" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;42FA</legref><legref type="subordleg" refid="sec.42FA-para1.b" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(b)</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>, the amount of CPD is 5 hours spent on 1 or more of the following types of activities the board considers suitable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_44614492-ba82-445d-bcaa-a475d9ef1b37" provision.type="other"><no>(a)</no><block><txt break.before="0">attending seminars, conferences, workshops, field days or addresses about retail rental valuation, conducted by professional organisations, industry bodies or employers;</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_fdb7ec2f-1f2b-4cc2-8f38-61f9862012c6" provision.type="other"><no>(b)</no><block><txt break.before="0">preparing and presenting papers about retail rental valuation;</txt></block></li><li id="sec.5-ssec.1-para1.c" guid="_c208b2b8-26d5-4f9e-bf05-c8987f4de5f8" provision.type="other"><no>(c)</no><block><txt break.before="0">writing and circulating or publishing articles about retail rental valuation;</txt></block></li><li id="sec.5-ssec.1-para1.d" guid="_f122815c-bce7-4bd7-abcf-1b465dc6d675" provision.type="other"><no>(d)</no><block><txt break.before="0">undertaking formal education about retail rental valuation;</txt></block></li><li id="sec.5-ssec.1-para1.e" guid="_7ff2f96b-0082-4516-8b74-2270cc19c56b" provision.type="other"><no>(e)</no><block><txt break.before="0">undertaking informal education about retail rental valuation by perusing appropriate journals or similar documents.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_2d988363-3007-49f8-bab5-5179cbb9386b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The board must, before 1 May in each year, give each registered valuer who is recorded as a specialist retail valuer written notice of the type of CPD the board considers suitable for the renewal of the valuer’s recording for the financial year beginning on 1 July of the following year.</txt></block></subclause></clause></part><part id="pt.4" guid="_a88d3e68-48b4-403f-a7b7-7d114ed30f27" affected.by.uncommenced="0"><no>Part 4</no><heading id="pt.4-he" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_99d0b90b-6dc1-457b-9209-db971f1937aa">Fees</heading><block><txt break.before="1">The fees payable under the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref> are stated in <intref refid="sch.2" target.guid="_dbb69f8e-ce1c-462e-9416-6ca96a0d9baa" a valuation for which the valuer does not have the experience, other than under the supervision of another valuer who has the experience.</txt><note id="sch.1-sec.6-note" guid="_4980d250-087e-438d-82f0-c2a94f022700" type="example"><heading id="sch.1-sec.6-note-he" guid="_366eb65f-4ae3-47ff-9eef-b52d0114c1af">Example—</heading><block><txt break.before="1">A registered valuer must not make a valuation of a commercial property unless the valuer is, or makes the valuation under the supervision of, a registered valuer who has experience making valuations of commercial valuation must include the following in the report—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.1-sec.7-ssec.1-para1.a" guid="_82187fb0-ad7a-4d75-9cb3-5aad7a1f3413" provision.type="other"><no>(a)</no><block><txt break.before="0">details of the valuer’s qualifications relevant to the valuation;</txt></block></li><li id="sch.1-sec.7-ssec.1-para1.b" guid="_a1ce8018-0be8-4ed1-96a6-eefeba71fd16" provision.type="other"><no>(b)</no><block><txt break.before="0">the valuer’s number in the register;</txt></block></li><li id="sch.1-sec.7-ssec.1-para1.c" guid="_19d1c056-e0d8-4c37-9528-bcbad7e5bc09" provision.type="other"><no>(c)</no><block><txt break.before="0">the date each inspection relevant to the valuation was carried out by the valuer;</txt></block></li><li id="sch.1-sec.7-ssec.1-para1.d" guid="_fa2301e0-4960-4f50-a3a8-bd489321e555" provision.type="other"><no>(d)</no><block><txt break.before="0">the date the valuation was
