s 3 def LCCH establishment measure ins 2014 SL No. 206 s 3member contribution rate means the rate at which the member must make contributions to the scheme under the deed, as a condition of the member’s membership of the scheme.s 3 def member contribution rate ins 2017 SL No. 105 s 10 (2)NDIS means the National Disability Insurance Scheme under the National Disability Insurance Scheme Act 2013 (Cwlth).s 3 def NDIS ins 2018 SL No. 36 s 3non-casual employee means an employee other than a casual employee.permanent employee means a non-casual employee other than a temporary employee.POB Pty Ltd transfer day means the day when Port of Brisbane Pty Ltd ACN 143 384 749 ceases to be a wholly-owned subsidiary of Port of Brisbane Corporation Limited ACN 124 048 522 on the sale of the shares in Port of Brisbane Pty Ltd to a purchaser.s 3 def POB Pty Ltd transfer day ins 2010 SL No. 332 s 3police recruit means a person who holds a position in the Queensland Police Service as a police recruit.QFS superannuation scheme means the superannuation scheme that, immediately before the commencement of the Superannuation and Other Legislation Amendment Act 1997, part 6, was operated under the Fire and Rescue Service Act 1990.s 3 def QFS Superannuation scheme amd 2014 Act No. 17 s 184 sch 1 pt 4 Notes—1The Superannuation and Other Legislation Amendment Act 1997, part 6 commenced on 30 June 1997.2The short title of the Fire and Rescue Service Act 1990 was amended by the Public Safety Business Agency Act 2014 and is now the Fire and Emergency Services Act 1990.

s 7 sub 2017 SL No. 105 s 118General membership matters(1)This section applies to employees of a unit of the State public sector mentioned in schedule 2, column 1 who are mentioned in column 2 for the unit.(2)Schedule 2 states the following for the employees—(a)the membership category or categories for which the employee is eligible;Note—See section 22A of the deed for the membership category to which an employee belongs on becoming a member of the scheme.(b)any conditions applying to the employee’s membership of the scheme;(c)for an employee other than a core government employee—whether the employee’s membership of the scheme is compulsory.Note—For a core government employee, see part 3AA, division 1 of the Act.
s 8 sub 2015 SL No. 76 s 3; 2017 SL No. 105 s 11Division 2Other provisions about eligibilitypt 2 div 2 hdg ins 2017 SL No. 105 s 119Eligibility for State 72 category(1)This section applies if a person who is a member in the State 72 category—(a)ceases to be a 1972 officer; and(b)either—(i)within 1 month after ceasing, again becomes a 1972 officer; or(ii)made an election under section 35(2) of the 1972 Act before the repeal of that Act or makes an election under section 191(2) of the deed, and again becomes a 1972 officer.
(2)The person is eligible for membership in the State 72 category until 3 months after the time the person again became a 1972 officer.(3)In this section—1972 Act means the repealed State Service Superannuation Act 1972.1972 officer means a person who would be an officer within the meaning given by the 1972 Act if that Act had not been repealed.s 9 sub 2017 SL No. 105 s 1110Eligibility for police 74 category(1)This section applies if a person who is a member in the police 74 category—(a)ceases to be a 1974 member; and(b)made an election under section 33(2) of the 1974 Act before the repeal of that Act or makes an election under section 299(2) of the deed; and(c)again becomes a 1974 member.
(2)The person is eligible for membership in the police 74 category until 3 months after the time the person again became a 1974 member.(3)In this section—1974 Act means the repealed Police Superannuation Act 1974.1974 member means a person who would be a member within the meaning given by the 1974 Act if that Act had not been repealed.s 10 sub 2017 SL No. 105 s 1111Retrospective eligibility(1)This section applies if schedule 2 is amended—(a)to declare the membership categories for which all or particular employees of a unit of the State public sector not already mentioned in schedule 2, column 1 are eligible; or(b)to declare, for a unit of the State public sector already mentioned in schedule 2, column 1—(i)another category of membership for which an employee of the unit already mentioned in column 2 is eligible; or(ii)the membership categories for which other employees of the unit are eligible.
(2)An employee of a unit of the State public sector to whom the declaration applies is eligible for membership in a category the subject of the declaration for the period of the employee’s employment with the unit starting on or after the following day (the eligibility start day)— (a)if column 5 states the eligibility start day for the employee—the eligibility start day;(b)otherwise—the day the employee started employment with the unit.
(3)The eligibility start day for an employee of a unit of the State public sector may be a day before the amendment of schedule 2 commences.s 11 sub 2017 SL No. 105 s 11Division 3Other conditions of membershippt 2 div 3 hdg ins 2017 SL No. 105 s 1112Insurance(1)This section applies to membership in the basic accumulation or comprehensive accumulation category of an employee of a unit of the State public sector mentioned in schedule 2, column 1.(2)Amounts held for the employee in the scheme must be applied towards prescribed insurance for the employee under the deed, unless the employee elects, under the deed, not to have the insurance.(3)In this section—prescribed insurance means—(a)for a non-casual employee—income protection insurance and insurance in case of death or total and permanent disablement; or(b)for a casual employee—insurance in case of death or total and permanent disablement.
s 12 sub 2017 SL No. 105 s 11Part 3Transitional provisionpt 3 hdg sub 2017 SL No. 105 s 1113Eligibility for basic accumulation category for former accumulation category members(1)This section applies to a person who—(a)on the commencement is a member in the basic accumulation category for the person’s employment; and(b)is eligible for membership in the basic accumulation category for the employment only because of the operation of repealed section 18.
