target.version.series="4d0b56d0-a89e-498b-b9ce-e650a4f6c4b1" check="valid">Act</legref>, <legref jurisd="QLD" type="act" refid="sec.85" target.doc.id="act-1974-076" target.version.series="4d0b56d0-a89e-498b-b9ce-e650a4f6c4b1" check="valid" target.guid="_54314adf-e525-4087-b41c-1ea3e62a4edc">s&#160;85</legref></heading><subclause id="sec.3-ssec.1" guid="_63b09fc8-39a3-482f-a148-2dc61f613967" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <legref jurisd="QLD" type="subordleg" refid="sec.85" target.doc.id="UNKNOWN" check="invalid">section&#160;85</legref> of the <legref jurisd="QLD" type="subordleg" target.doc.id="UNKNOWN" check="invalid">Act</legref>, a mortgage is a prescribed mortgage if it is a mortgage over residential land and the mortgagor’s home is on the land.</txt></block></subclause><subclause id="sec.3-ssec.2" guid="_cc58efa9-8adc-427c-830c-49c8a77132ea" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For <intref refid="sec.3-ssec.1" check="valid" target.guid="_63b09fc8-39a3-482f-a148-2dc61f613967">subsection&#160;(1)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-para1.a" guid="_31b9cf9f-91c0-4d1d-9ead-b45a037a839f" provision.type="other"><no>(a)</no><block><txt break.before="0">it does not matter that a residence is also used for a business purpose if the residence is primarily used as the mortgagor’s home; and</txt></block></li><li id="sec.3-ssec.2-para1.b" guid="_4aa6a2ba-35b4-46d4-b81a-611abd15a916" provision.type="other"><no>(b)</no><block><txt break.before="0">the residence does not stop being the mortgagor’s home only because the mortgagor stopped using the residence as the mortgagor’s home—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-para1.b-para2.i" guid="_0e58ceda-08ca-4909-b3e2-603be9f0c875" provision.type="other"><no>(i)</no><block><txt break.before="0">when the default occurred; or</txt></block></li><li id="sec.3-ssec.2-para1.b-para2.ii" guid="_915ea65d-2941-44c4-81e9-499550cee43c" provision.type="other"><no>(ii)</no><block><txt break.before="0">within 6 months before the default occurred.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.3-ssec.3" guid="_f723b568-8a75-4cdb-bb78-aab6e06229a9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-ssec.3-def.default_" guid="_491af5d8-ac98-4a8e-a0ab-55a010217f77" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.3-def.default" guid="_982aab6e-4867-429f-8643-2b4392caa9f4" type="definition">default</defterm> means the default that gives rise to the power of sale mentioned in <legref jurisd="QLD" type="subordleg" refid="sec.83" target.doc.id="UNKNOWN" check="invalid">section&#160;83</legref> of the <legref jurisd="QLD" type="subordleg" target.doc.id="UNKNOWN" check="invalid">Act</legref>.</txt></definition><definition id="sec.3-ssec.3-def.home_" guid="_1fe5bc83-edf3-449f-aff2-a9f672504fbc" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.3-def.home" guid="_8ce4922f-9024-47e0-bc43-276ca2ee578d" type="definition">home</defterm>, of a mortgagor, means a residence that is occupied by the mortgagor as the mortgagor’s principal place of residence.</txt></definition><definition id="sec.3-ssec.3-def.residence_" guid="_c7242986-811d-45b4-a9a2-f2b733bba5e5" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.3-def.residence" guid="_1eab8ea9-514f-4d67-b9b8-571f9eabd58a" type="definition">residence</defterm> means a building, or part of a building, that is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.3-def.residence-para1.a" guid="_10ef758e-0557-4013-b97b-227c06f92185" provision.type="other"><no>(a)</no><block><txt break.before="0">fixed to land; and</txt></block></li><li id="sec.3-ssec.3-def.residence-para1.b" guid="_df362ac2-2fac-49ce-8bea-fee6abf66930" provision.type="other"><no>(b)</no><block><txt break.before="0">designed, or approved by a local government, for human habitation by a single family unit; and</txt></block></li><li id="sec.3-ssec.3-def.residence-para1.c" guid="_dc36d10e-866e-4f84-a2d0-e3cc732bdd1d" provision.type="other"><no>(c)</no><block><txt break.before="0">used for residential purposes.</txt></block></li></list></definition><definition id="sec.3-ssec.3-def.residentialland_" guid="_2ec0cc1c-f927-4a3d-a14b-f27b8e5d1021" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.3-def.residentialland" guid="_6d64fb92-85db-4a7c-b26e-a93ba0e6e60f" type="definition">residential land</defterm> means land, or the part of land, on which a residence is built, and includes the curtilage attributable to the residence if the curtilage is used for residential purposes.</txt></definition></deflist></block></subclause></clause><clause
