<legref jurisd="QLD" type="act" target.doc.id="act-2003-014" target.version.series="6a9656f1-be2e-4ae1-a0f5-e95066de3893" check="valid"><name emphasis="yes">Cremations Act 2003</name></legref>.</txt></block></clause><clause id="sec.2" guid="_885ab9f6-7a63-47bf-ae47-ac5e930e91b6" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_d61c599e-dc22-4abd-90c6-6b229c0a6a54">Commencement</heading><block><txt break.before="1">This Act commences on the day that the <legref jurisd="QLD" type="act" target.doc.id="act-2003-013" target.version.series="3362462b-5eb7-4e25-9a34-6b5105d33efe" check="valid"><name emphasis="yes">Coroners Act 2003</name></legref> commences.</txt></block></clause><clause id="sec.3" guid="_acc32cb3-b0b1-42d4-95f1-f4a00c780ea7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_b26065db-980a-4223-a5cf-1118ac58993c">Definitions</heading><block><txt break.before="1">The dictionary in the schedule defines particular words used in this Act.</txt></block></clause><clause id="sec.4" guid="_ecf6fd9f-1980-46db-a1fb-60f5dfe1768a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_3004c670-1f09-44cf-9682-a62666ec4969">Cremations this Act does not apply to</heading><block><txt break.before="1">This Act does not apply to the cremation of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-para1.a" guid="_d15f310c-4708-44ca-aeac-142fb819b7f4" provision.type="other"><no>(a)</no><block><txt break.before="0">human remains that have been buried for 1 year or more; or</txt></block></li><li id="sec.4-para1.b" guid="_2aeef2e1-635b-4451-bd2d-ca1920b9b1df" provision.type="other"><no>(b)</no><block><txt break.before="0">parts of a human body taken during a medical procedure or autopsy; or</txt></block></li><li id="sec.4-para1.c" guid="_35e33956-b0b7-434e-9867-a9a03e38fa72" provision.type="other"><no>(c)</no><block><txt break.before="0">Aboriginal human remains as defined in the <legref jurisd="QLD" type="act" target.doc.id="act-2003-079" target.version.series="fc7bb3af-5376-4136-a8d6-1a69e49e6a29" check="valid"><name emphasis="yes">Aboriginal Cultural Heritage Act 2003</name></legref> or Torres Strait Islander human remains as defined in the <legref jurisd="QLD" type="act" target.doc.id="act-2003-080" target.version.series="7c79158a-af67-4def-af3f-6f57b2084e9c" check="valid"><name emphasis="yes">Torres Strait Islander Cultural Heritage Act 2003</name></legref>.</txt></block></li></list></block><historynote><txt break.before="1"><b>s&#160;4</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2009-032" target.version.series="8c10054c-ccff-479f-ab38-38c19ebf53d0" valid.date="as.made" check="valid">2009 No.&#160;32</legref> <legref jurisd="QLD" type="act" refid="sec.64" target.doc.id="act-2009-032" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_3964c492-8275-4fbe-b234-b51db5838fa1">Permission required for cremation</heading><block><txt break.before="1">A person must not cremate human remains unless the person has a permission to cremate the remains, in the approved form, that was issued by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.a" guid="_0abdb611-a3fa-4a4a-ae57-e180c7d4c434" provision.type="other"><no>(a)</no><block><txt break.before="0">if an autopsy of the remains was conducted under the <legref jurisd="QLD" type="act" target.doc.id="act-1958-032" target.version.series="7884390e-ceb3-4bfe-b0ab-b86953499ae2" check="valid"><name emphasis="yes">Coroners Act 1958</name></legref> or <legref jurisd="QLD" type="act" target.doc.id="act-2003-013" target.version.series="3362462b-5eb7-4e25-9a34-6b5105d33efe" check="valid"><name emphasis="yes">Coroners Act 2003</name></legref>—the coroner who ordered the autopsy or, if that coroner is unavailable, another coroner; or</txt></block></li><li id="sec.5-para1.b" guid="_f7dbd994-e7b5-4242-95f6-de9a872b0285" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—an independent doctor.</txt></block></li></list></block><penalty id="sec.5-pen" guid="_268119fd-ae00-42e0-8ac1-4e8275cbacfc"><block><txt break.before="1">Maximum penalty—140 penalty units.</txt></block></penalty></clause><clause id="sec.6" guid="_9bcbb25a-ffd8-45d8-831e-601d13df232d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_187d5a65-f300-4fbf-b172-2ad6640dabbb">Getting permission to cremate</heading><subclause id="sec.6-ssec.1" guid="_3ea99cac-5885-4dd8-926b-0ddd379c31ea" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The following persons may apply for a permission to cremate the human remains of a deceased person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_e068fc76-3ec9-4c55-8860-456023320001" provision.type="other"><no>(a)</no><block><txt break.before="0">a close relative of the deceased person, either personally or through an agent;</txt><note id="sec.6-ssec.1-para1.a-note" guid="_1213952b-e52c-4821-818f-cd2b8dc8a26f" type="example"><heading id="sec.6-ssec.1-para1.a-note-he" guid="_c0f244c2-d1a0-4999-af22-ef0e8d2e0bf4">Example of an agent—</heading><block><txt break.before="1">a funeral director</txt></block></note></block></li><li id="sec.6-ssec.1-para1.b" guid="_76da103c-b400-4274-8985-fdd58d23d15e" provision.type="other"><no>(b)</no><block><txt break.before="0">a personal representative of the deceased person, either personally or through an agent;</txt><note id="sec.6-ssec.1-para1.b-note" guid="_88942ca1-9046-47f7-a4c7-c4dbaa174326" type="example"><heading id="sec.6-ssec.1-para1.b-note-he" guid="_d8d7d527-6178-4768-b0fb-03779e7afa6c">Note—</heading><block><txt break.before="1">Under the <legref jurisd="QLD" type="act" target.doc.id="act-1954-003" target.version.series="3cfb010e-ce09-4afd-baf6-bd10d22741a7" check="valid"><name emphasis="yes">Acts Interpretation Act 1954</name></legref>, <legref jurisd="QLD" type="act" refid="sch.1" target.doc.id="act-1954-003" target.version.series="3cfb010e-ce09-4afd-baf6-bd10d22741a7" check="invalid">schedule&#160;1</legref>, a <defterm guid="_04f7f0c8-8c6d-4fc0-9da5-65a3ffecfcf1" type="mention">personal representative</defterm> of a deceased person is the executor or administrator of the deceased person’s estate.</txt></block></note></block></li><li id="sec.6-ssec.1-para1.c" guid="_b08cffa4-cb4d-490b-9cc3-b60275a0e873" provision.type="other"><no>(c)</no><block><txt break.before="0">if no-one mentioned in <intref refid="sec.6-ssec.1-para1.a" target.guid="_e068fc76-3ec9-4c55-8860-456023320001" check="valid">paragraph&#160;(a)</intref> or <intref refid="sec.6-ssec.1-para1.b" target.guid="_76da103c-b400-4274-8985-fdd58d23d15e" check="valid">(b)</intref> applies for a permission to cremate—another adult, either personally or through an agent, who has a satisfactory explanation as to why those persons did not apply and why the adult is applying.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_20063030-31c3-4ebb-b2b8-90cf01ce01b5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The application must be made in the approved form.</txt></block></subclause><subclause id="sec.6-ssec.3" guid="_1aceabff-4d89-4c31-8a46-b1cb47b33ddd" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The way that an application may be sent to the coroner or independent doctor includes by fax or other electronic means.</txt></block></subclause><subclause id="sec.6-ssec.4" guid="_84582ef6-f2e7-4cdc-834b-3727212ffba0" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the application is made to an independent doctor, the application must be accompanied by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.4-para1.a" guid="_c118343e-46e2-4a98-9f75-4538f18bbd24" provision.type="other"><no>(a)</no><block><txt break.before="0">a copy of the cause of death certificate, and unless <intref refid="sec.6-ssec.5" target.guid="_54dd94b2-ce6d-4d6c-a722-5fbbb2460f22" check="valid">subsection&#160;(5)</intref> applies, a cremation risk certificate, issued for the deceased person; or</txt></block></li><li id="sec.6-ssec.4-para1.b" guid="_fc8ae107-1742-41ea-9091-a0e0f251e928" provision.type="other"><no>(b)</no><block><txt break.before="0">a certificate that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.4-para1.b-para2.i" guid="_e0ff8128-0932-446a-9a81-70d5eb2c81e8" provision.type="other"><no>(i)</no><block><txt break.before="0">authorises the release of the body; and</txt></block></li><li id="sec.6-ssec.4-para1.b-para2.ii" guid="_88eb2387-a643-42e5-9429-92d4e5d41c4a" provision.type="other"><no>(ii)</no><block><txt break.before="0">is given by a person who appears to the independent doctor, after appropriate inquiry, to be a coroner, or to hold a position equivalent to a coroner, at the place where the death happened.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.6-ssec.5" guid="_54dd94b2-ce6d-4d6c-a722-5fbbb2460f22" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">For <intref refid="sec.6-ssec.4" target.guid="_84582ef6-f2e7-4cdc-834b-3727212ffba0" check="valid">subsection&#160;(4)</intref><intref refid="sec.6-ssec.4-para1.a" target.guid="_c118343e-46e2-4a98-9f75-4538f18bbd24" check="valid">(a)</intref>, the application need not be accompanied by a cremation risk certificate if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.5-para1.a" guid="_698509cf-3a9b-49ac-a015-af3865bd4b26" provision.type="other"><no>(a)</no><block><txt break.before="0">the cause of death certificate is not a Queensland cause of death certificate; and</txt></block></li><li id="sec.6-ssec.5-para1.b" guid="_aa943a2a-045d-47f4-a4da-e8a74c9c5c73" provision.type="other"><no>(b)</no><block><txt break.before="0">a cremation risk certificate has not been issued for the deceased person.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.6" guid="_f13fdeed-a08b-4c86-8738-b16492642c8d" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A coroner may issue a permission to cremate, in the approved form, only if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.6-para1.a" guid="_fa61c493-f5d5-4e88-b26d-7138ed4e6640" provision.type="other"><no>(a)</no><block><txt break.before="0">the coroner or another coroner has authorised the release of the body; and</txt></block></li><li id="sec.6-ssec.6-para1.b" guid="_5d16e37b-470a-4da7-84b6-92602b09e1f1" provision.type="other"><no>(b)</no><block><txt break.before="0">the coroner receives confirmation from the doctor who performed the autopsy that the doctor is reasonably satisfied the human remains do not pose a cremation risk.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.7" guid="_2926f411-9bba-431e-85d3-330e4d4c2928" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">Human remains pose a <defterm id="sec.6-def.cremationrisk" guid="_605ec61b-9381-4f83-be33-c68aff7e0964" type="definition">cremation risk</defterm> if the remains contain something that, if cremated, might expose someone to the risk of death, injury or illness.</txt><note id="sec.6-ssec.7-note" guid="_e85ccbb6-2cd9-42d9-9afa-a06c549cfb9a" type="example"><heading id="sec.6-ssec.7-note-he" guid="_2bcfe5bf-032f-4a21-a8e8-435d282aef7c">Example of something that might expose someone to risk of death, injury or illness—</heading><block><txt break.before="1">a cardiac pacemaker or radioactive implant</txt></block></note></block></subclause><subclause id="sec.6-ssec.8" guid="_8007d572-0d10-47fa-a732-2b0e0704c23d" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">An independent doctor may issue a permission to cremate, in the approved form, only if the doctor, after examining the human remains and making any necessary inquiries, is reasonably satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.8-para1.a" guid="_034270ce-bb3d-40aa-aff6-58be5b1723aa" provision.type="other"><no>(a)</no><block><txt break.before="0">the human remains do not pose a cremation risk; and</txt></block></li><li id="sec.6-ssec.8-para1.b" guid="_8da61e88-8e89-4749-a17f-f2cdf5efc725" provision.type="other"><no>(b)</no><block><txt break.before="0">the deceased person’s death is not a reportable death under the <legref jurisd="QLD" type="act" target.doc.id="act-2003-013" target.version.series="3362462b-5eb7-4e25-9a34-6b5105d33efe" check="valid"><name emphasis="yes">Coroners Act 2003</name></legref>.</txt></block></li></list></block><penalty id="sec.6-ssec.8-pen" guid="_a3c22b76-9340-4f56-8d14-134a3a5fdf7c"><block><txt break.before="1">Maximum penalty—80 penalty units.</txt></block></penalty></subclause><subclause id="sec.6-ssec.9" guid="_fb336c00-e085-44c8-9009-4271880f858e" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">The way that a permission to cremate may be sent to the applicant, or a person nominated by the applicant on the application, includes by fax or other electronic means.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;6</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2013-039" valid.date="as.made" check="invalid">s&#160;111</legref> <legref jurisd="QLD" type="act" refid="sch.4" target.doc.id="act-2013-039" valid.date="as.made" check="invalid">sch&#160;4</legref></txt></historynote></clause><clause id="sec.7" guid="_73c3391d-0f82-4755-8637-a6aedf53c315" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_07c783c0-c21e-4510-8909-4a3b99ac2455">Deceased person’s wish to be cremated</heading><subclause id="sec.7-ssec.1" guid="_ce443fea-22bd-46cd-8b72-a3a5a0d0d503" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a deceased person’s personal representative—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_276226ee-69ff-483f-802a-29d4448613ee" provision.type="other"><no>(a)</no><block><txt break.before="0">is arranging for the disposal of the deceased person’s human remains; and</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_1430e735-f65f-4ee3-a731-21746ea36506" provision.type="other"><no>(b)</no><block><txt break.before="0">knows that the deceased person has left signed instructions for his or her human remains to be cremated.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_86ede7ca-156d-437e-9e10-1875eaea4cc0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The deceased person’s personal representative must ensure that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-para1.a" guid="_8d80fd61-6842-42d3-9e2f-186eb94a1bae" provision.type="other"><no>(a)</no><block><txt break.before="0">an application for permission to cremate is made; and</txt></block></li><li id="sec.7-ssec.2-para1.b" guid="_e3bb4cd0-1fe9-4823-a0a8-83013428eb34" provision.type="other"><no>(b)</no><block><txt break.before="0">if the permission to cremate is issued, the deceased person is cremated in accordance with the signed instructions.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.3" guid="_a430c0d0-8a27-4b46-afb8-7ff51a0b6be9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">This section overrides the common law to the extent that it—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.3-para1.a" guid="_40d64e23-e061-4ba0-b022-d6ec92c18d92" provision.type="other"><no>(a)</no><block><txt break.before="0">allows a person to direct the person’s personal representative to cremate the person’s human remains; and</txt></block></li><li id="sec.7-ssec.3-para1.b" guid="_7bbf9282-2d87-4d8a-9b0d-676ff3a3ed94" provision.type="other"><no>(b)</no><block><txt break.before="0">qualifies a personal representative’s right to decide how to dispose of the deceased person’s human remains.</txt></block></li></list></block></subclause></clause><clause id="sec.8" guid="_103b0561-7c17-4234-baed-ede1408124ff" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_6d3386d6-0413-4586-9d18-8e111079b9e6">Objections to cremation</heading><subclause id="sec.8-ssec.1" guid="_a2c50d1c-5d2b-4ae8-a76b-578c8bf98e0b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section does not apply if the deceased person has left signed instructions that his or her human remains be cremated.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_3eadf4f9-19cf-4507-967a-9f31f4c069b8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A coroner or independent doctor must not issue a permission to cremate if the coroner or independent doctor is aware that any of the following persons object to the cremation—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.2-para1.a" guid="_85c59879-255e-432b-9327-19a752a8c40e" provision.type="other"><no>(a)</no><block><txt break.before="0">a spouse, adult child or parent of the deceased person;</txt></block></li><li id="sec.8-ssec.2-para1.b" guid="_6a285684-6e56-4e68-a6eb-d00ee64fbc2d" provision.type="other"><no>(b)</no><block><txt break.before="0">a personal representative of the deceased person.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.3" guid="_ae124a08-6b32-4cd1-bced-7dd95929df6f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The person in charge of a crematorium must not allow a deceased person’s human remains to be cremated at the crematorium if the person in charge is aware that any of the following persons object to the cremation—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-para1.a" guid="_a5816fbf-52ee-450e-86d5-8ad8580a66d5" provision.type="other"><no>(a)</no><block><txt break.before="0">a spouse, adult child or parent of the deceased person;</txt></block></li><li id="sec.8-ssec.3-para1.b" guid="_451c891a-c0dd-4ce1-9cff-f684f975b088" provision.type="other"><no>(b)</no><block><txt break.before="0">a personal representative of the deceased person.</txt></block></li></list></block><penalty id="sec.8-ssec.3-pen" guid="_a44bf73c-ce88-4a08-a57f-d6a625fab2eb"><block><txt break.before="1">Maximum penalty—100 penalty units.</txt></block></penalty></subclause><subclause id="sec.8-ssec.4" guid="_a3f984ec-9df5-4bfc-a877-ce7b6ecbbb10" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0"><intref refid="sec.8-ssec.3" target.guid="_ae124a08-6b32-4cd1-bced-7dd95929df6f" check="valid">Subsection&#160;(3)</intref> applies even if the person in charge has received a permission to cremate.</txt></block></subclause><subclause id="sec.8-ssec.5" guid="_6633bfc6-24cb-48fa-82ea-f0fd551a1339" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">This section overrides the common law to the extent that it qualifies a personal representative’s right to decide how to dispose of the deceased person’s human affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a coroner or independent doctor reasonably suspects that the coroner or independent doctor, or the coroner’s or independent doctor’s spouse, may receive a benefit because of a person’s death.</txt></block></subclause><subclause id="sec.9-ssec.2" break.before="0">must label the ashes in accordance with the requirements prescribed under a regulation; and</txt></block></li><li id="sec.11-ssec.1-para1.b" guid="_2d7f72b5-b54f-402c-acb5-0aed52fc5793" provision.type="other"><no>(b)</no><block><txt break.before="0">must not dispose of the ashes except in accordance with any reasonable written instructions
