				<block>
					<txt break.before="1">This regulation commences on 1 September 2016.</txt>

				<heading id="sec.3-he" guid="_c21df316-9ead-4fcc-abc5-c2935ee2727b">Definition</heading>
				<block>
					<txt break.before="1">In this regulation—</txt>

				<heading id="sec.4-he" guid="_52d1a191-bef8-4b3d-bc13-b380872f634d">Service of summons to appear before an examiner</heading>
				<subclause id="sec.4-ssec.1" guid="_c454a953-72b4-4647-9d10-85b0669d1d38" affected.by.uncommenced="0" provision.type="other">
					<no>(1)</no>
					<block>
						<txt break.before="1">This section prescribes the ways of serving a summons for section 23(1) and (2) of the Act.</txt>
					</block>
				</subclause>
				<subclause id="sec.4-ssec.2" guid="_f5fcec20-eafb-45f3-849e-6be7fcf3b31c" affected.by.uncommenced="0" provision.type="other">
					<no>(2)</no>
					<block>
						<txt break.before="1">If the person named in the summons is a natural person—</txt>
						<list number.type="manual" unnumbered.indent="0">
							<li id="sec.4-ssec.2-para1.a" guid="_761550c1-3216-4ee2-ace6-da35dc0feb52" provision.type="other">
								<no>(a)</no>
								<block>
									<txt break.before="1">tendering a copy of the summons to the person, or if on tender of the copy the person refuses to accept it, putting it down in the presence of the person or leaving it at or upon the place or premises where the person is; or</txt>
								</block>
							</li>
							<li id="sec.4-ssec.2-para1.b" guid="_51ca093d-504d-486f-b1cc-271fe86a4b71" provision.type="other">
								<no>(b)</no>
								<block>
									<txt break.before="1">if service in the way mentioned in paragraph (a) is not practicable—</txt>
									<list number.type="manual" unnumbered.indent="0">
										<li id="sec.4-ssec.2-para1.b-para2.i" guid="_d0a3d5b7-2cbd-4ae0-9740-1dbe9178ee98" provision.type="other">
											<no>(i)</no>
											<block>
												<txt break.before="1">leaving a copy of the summons at the last known or usual place of residence or business of the person with another person who is, or is reasonably believed to be, more than 16 years and is, or is reasonably believed to be, residing, or employed, at that place; or</txt>
											</block>
										</li>
										<li id="sec.4-ssec.2-para1.b-para2.ii" guid="_27092920-13c7-4504-a3f6-7604514d96b1" provision.type="other">
											<no>(ii)</no>
											<block>
												<txt break.before="1">sending a copy of the summons by registered post or certified mail to the person at the last known or usual place of residence or business of the person or at the last known or usual postal address of the person; or</txt>
											</block>
										</li>
									</list>
								</block>
							</li>
							<li id="sec.4-ssec.2-para1.c" guid="_5bcc881c-c49c-4a40-b8c4-0482f5671abf" provision.type="other">
								<no>(c)</no>
								<block>
									<txt break.before="1">if a judge has, subject to subsection (4), given a direction that the summons should be served in this way—</txt>
									<list number.type="manual" unnumbered.indent="0">
										<li id="sec.4-ssec.2-para1.c-para2.i" guid="_06701067-e012-417c-843f-f18ab9c0eb74" provision.type="other">
											<no>(i)</no>
											<block>
												<txt break.before="1">leaving a copy of the summons with another person identified in the direction, being a person who, in the opinion of the judge, is likely to bring the contents of the summons to the notice of the person; or</txt>
											</block>
										</li>
										<li id="sec.4-ssec.2-para1.c-para2.ii" guid="_4ee69971-c535-4e9b-90aa-df423c7162b3" provision.type="other">
											<no>(ii)</no>
											<block>
												<txt break.before="1">sending it by registered post or certified mail to an address stated in the direction, being the address of a place that the judge has reasonable grounds to believe to be a place frequented by the person.</txt>
											</block>
										</li>
									</list>
								</block>
							</li>
						</list>
					</block>
				</subclause>
				<subclause id="sec.4-ssec.3" guid="_c52cb3ac-f5d8-4c9b-9d5a-eac94b85f830" affected.by.uncommenced="0" provision.type="other">
					<no>(3)</no>
					<block>
						<txt break.before="1">If the person named in the summons is a body corporate—</txt>
						<list number.type="manual" unnumbered.indent="0">
							<li id="sec.4-ssec.3-para1.a" guid="_5412f4df-e7f5-4898-9ebf-00aaa267a4a4" provision.type="other">
								<no>(a)</no>
								<block>
									<txt break.before="1">tendering a copy of the summons to a person who is, or is reasonably believed to be, an officer of, or in the service of, the body corporate and is, or is reasonably believed to be, more than 16 years at the head office, a registered office, a principal office or a principal place of business of the body corporate; or</txt>
								</block>
							</li>
							<li id="sec.4-ssec.3-para1.b" guid="_7dfd449f-f134-41c0-86d5-f580536034cc" provision.type="other">
								<no>(b)</no>
								<block>
									<txt break.before="1">if on tender of the copy under paragraph (a) the person refuses to accept it, leaving it at or upon the premises; or</txt>
								</block>
							</li>
							<li id="sec.4-ssec.3-para1.c" guid="_530ba583-3274-462f-b415-e0e1baabb549" provision.type="other">
								<no>(c)</no>
								<block>
									<txt break.before="1">sending a copy of the summons by registered post or certified mail to the head office, a registered office, a principal office or a principal place of business of the body corporate or at a postal address of the body corporate.</txt>
								</block>
							</li>
						</list>
					</block>
				</subclause>
				<subclause id="sec.4-ssec.4" guid="_d2aed911-6b46-4c53-a893-48ff596fc5d4" affected.by.uncommenced="0" provision.type="other">
					<no>(4)</no>
					<block>
						<txt break.before="1">A judge must not give a direction referred to in subsection (2)(c) in relation to the service of a summons on a person unless the judge is satisfied upon information given in writing by an examiner, that—</txt>
						<list number.type="manual" unnumbered.indent="0">
							<li id="sec.4-ssec.4-para1.a" guid="_a339088d-8071-4ded-850f-3f6ba82623d5" provision.type="other">
								<no>(a)</no>
								<block>
									<txt break.before="1">service of the summons on the person in a way mentioned in subsection (2)(a) or (b) has not been, or is not likely to be, successful; and</txt>
								</block>
							</li>
							<li id="sec.4-ssec.4-para1.b" guid="_1ffa20d2-b034-49c4-91e8-2fa5905e11e7" provision.type="other">
								<no>(b)</no>
								<block>
									<txt break.before="1">there is a likelihood that service of the summons in a way mentioned in subsection (2)(c) would result in the summons coming to the notice of the person.</txt>
								</block>
							</li>
						</list>
					</block>
				</subclause>
				<subclause id="sec.4-ssec.5" guid="_8e60d10f-7a07-4add-a96b-39643fee1c83" affected.by.uncommenced="0" provision.type="other">
					<no>(5)</no>
					<block>
						<txt break.before="1">In this section—</txt>

										<no>(a)</no>
										<block>
											<txt break.before="1">a judge of the Federal Court; or</txt>
										</block>
									</li>
									<li id="sec.4-ssec.5-def.judge-para1.b" guid="_d3287d35-63ac-4569-a031-ee7e3ea7943b" provision.type="other">
										<no>(b)</no>
										<block>
											<txt break.before="1">a judge of a court of the State.</txt>
										</block>
									</li>

				<heading id="sec.5-he" guid="_4368d495-c80a-46c5-a61a-aed8966ca3ed">Warrant for arrest of witness—Act, s 24</heading>
				<block>
					<txt break.before="1">A warrant issued under section 24(1) of the Act for the apprehension of a person must be in the same form, with necessary changes, as the form of warrant prescribed under the Commonwealth regulation, regulation 8.</txt>
				</block>
			</clause>
			<clause id="sec.6" guid="_b1c82bd7-8468-45fa-8e0e-2e2ffe392f30" affected.by.uncommenced="0" spent.amends="0" provision.type="other">
				<no>6</no>
				<heading id="sec.6-he" guid="_be21a320-40d3-4848-8fc3-3df71a33d0e0">Search warrant—Act, s 29</heading>
				<block>
					<txt break.before="1">A warrant issued by an issuing officer under section 29 of the Act must be in the same form, with necessary changes, as the form of warrant prescribed under the Commonwealth regulation, regulation 4.</txt>
				</block>
