								<txt break.before="1">If a provision of this part is inconsistent with a term of a funding agreement—</txt>

										<no>(a)</no>

						<block>
							<txt break.before="1">A funded provider must use the funding or receipts that the funded provider receives for a housing service in a way that complies with the funding agreement for the service.</txt>
						</block>
					</clause>

						<subclause id="sec.8-ssec.1" guid="_3ad19b22-2600-44c2-ab19-6a0d7e06b1fd" affected.by.uncommenced="0" provision.type="other">
							<no>(1)</no>
							<block>
								<txt break.before="1">This section applies if—</txt>
								<list number.type="manual" unnumbered.indent="0">

										<no>(a)</no>
										<block>
											<txt break.before="1">a funding agreement with a funded provider is in force; and</txt>
										</block>
									</li>
									<li id="sec.8-ssec.1-para1.b" guid="_151c9e8a-007e-411b-9cfb-6c1d21b7f9a2" provision.type="other">
										<no>(b)</no>
										<block>
											<txt break.before="1">the funded provider—</txt>
											<list number.type="manual" unnumbered.indent="0">
												<li id="sec.8-ssec.1-para1.b-para2.i" guid="_656e96f2-621e-4340-869a-e73b6739576b" provision.type="other">
													<no>(i)</no>
													<block>
														<txt break.before="1">is required, under the funding agreement, to spend an amount comprised of receipts for a housing service within a stated period; and</txt>
													</block>
												</li>
												<li id="sec.8-ssec.1-para1.b-para2.ii" guid="_17e0dce5-2f96-4d10-ae65-e029e4b540b4" provision.type="other">
													<no>(ii)</no>
													<block>
														<txt break.before="1">has not spent the amount by the end of the period.</txt>
													</block>
												</li>
											</list>
										</block>
									</li>
								</list>
							</block>
						</subclause>
						<subclause id="sec.8-ssec.2" guid="_271c9370-5569-46b9-bfe0-76c4d5a611ab" affected.by.uncommenced="0" provision.type="other">
							<no>(2)</no>
							<block>
								<txt break.before="1">The chief executive may, by written notice, require the funded provider to pay the amount to the chief executive.</txt>
							</block>
						</subclause>
						<subclause id="sec.8-ssec.3" guid="_e7af15d5-7bad-4266-8c12-117151564b6a" affected.by.uncommenced="0" provision.type="other">
							<no>(3)</no>
							<block>
								<txt break.before="1">The funded provider must pay the amount to the chief executive within 8 weeks after the day the funded provider receives the written notice.</txt>
							</block>
						</subclause>
					</clause>

						<heading id="sec.9-he" guid="_911fe8b8-59df-401d-a625-7dbf6fb82b79">Returning accumulated unspent receipts</heading>
						<subclause id="sec.9-ssec.1" guid="_b61b30c4-f254-4c7b-a48c-73ba7ea5b01e" affected.by.uncommenced="0" provision.type="other">
							<no>(1)</no>
							<block>
								<txt break.before="1">This section applies if—</txt>
								<list number.type="manual" unnumbered.indent="0">

										<no>(a)</no>
										<block>
											<txt break.before="1">a funding agreement is in force; and</txt>
										</block>
									</li>
									<li id="sec.9-ssec.1-para1.b" guid="_70087689-7bda-429c-9725-b72f7ed4a80f" provision.type="other">
										<no>(b)</no>
										<block>
											<txt break.before="1">the funding agreement relates to a funded property; and</txt>
										</block>
									</li>
									<li id="sec.9-ssec.1-para1.c" guid="_b542b9e9-8c2b-420a-9a71-b46f39a416ce" provision.type="other">
										<no>(c)</no>
										<block>
											<txt break.before="1">the funded provider is not required, under the funding agreement, to pay the chief executive amounts, consisting of receipts for a housing service, that the funded provider has not spent, either—</txt>
											<list number.type="manual" unnumbered.indent="0">
												<li id="sec.9-ssec.1-para1.c-para2.i" guid="_8c674585-1aa4-4693-8b81-53e9ca5bcc72" provision.type="other">
													<no>(i)</no>
													<block>
														<txt break.before="1">while the funding agreement is in force; or</txt>
													</block>
												</li>
												<li id="sec.9-ssec.1-para1.c-para2.ii" guid="_3fdcb0dc-49e9-476d-9fea-36497e934a4c" provision.type="other">
													<no>(ii)</no>
													<block>
														<txt break.before="1">when the funding agreement ends.</txt>
													</block>
												</li>
											</list>
										</block>
									</li>
								</list>
							</block>
						</subclause>
						<subclause id="sec.9-ssec.2" guid="_1f82f4a5-bf82-47e8-9eaf-a809914a0eab" affected.by.uncommenced="0" provision.type="other">
							<no>(2)</no>
							<block>
								<txt break.before="1">The chief executive may, by written notice (a <defterm id="sec.9-def.paymentnotice" guid="_70a3f042-931b-4d21-8c34-6faec8816ec6" type="definition">payment notice</defterm>) given within 12 months after the end of a financial year (the <defterm id="sec.9-def.noticeyear" guid="_a7a745ec-d245-439f-83b9-643857581d82" type="definition">notice year</defterm>), require the funded provider to pay an amount of not more than an amount equal to the accumulated unspent receipts to the chief executive.</txt>
							</block>
						</subclause>
						<subclause id="sec.9-ssec.3" guid="_3263ebe5-5b4a-484f-8df5-ae126d791f31" affected.by.uncommenced="0" provision.type="other">
							<no>(3)</no>
							<block>
								<txt break.before="1">If the funded property to which the funding agreement relates was not acquired, constructed or improved wholly using receipts, the accumulated unspent receipts amount must be reduced by the offset percentage.</txt>
							</block>
						</subclause>
						<subclause id="sec.9-ssec.4" guid="_2d426a02-199a-474f-ac54-8a1c4fcaa7ae" affected.by.uncommenced="0" provision.type="other">
							<no>(4)</no>
							<block>
								<txt break.before="1">The funded provider must pay the amount stated in the payment notice to the chief executive within 8 weeks after the day the funded provider receives the written notice.</txt>
							</block>
						</subclause>
						<subclause id="sec.9-ssec.5" guid="_b3fb26a1-c808-43f6-a93d-8b968dad4829" affected.by.uncommenced="0" provision.type="other">
							<no>(5)</no>
							<block>
								<txt break.before="1">In this section—</txt>
								<txt break.before="1">
									<defterm id="sec.9-def.accumulatedunspentreceipts" guid="_8b1d1477-a54b-498e-955e-0851500aba4d" type="definition">accumulated unspent receipts</defterm> means an amount equal to the receipts amount less—</txt>
								<list number.type="manual" unnumbered.indent="0">
									<li id="sec.9-ssec.5-para1.a" guid="_5a66c099-d595-4fba-91fc-ffcd50f39617" provision.type="other">
										<no>(a)</no>
										<block>
											<txt break.before="1">the spent amount; and</txt>
										</block>
									</li>
									<li id="sec.9-ssec.5-para1.b" guid="_dcc9703e-fbef-4935-af40-a374051892cd" provision.type="other">
										<no>(b)</no>
										<block>
											<txt break.before="1">the repaid amount.</txt>
										</block>
									</li>

											<heading id="sec.9-ssec.5-def.offsetpercentage-note-he" guid="_41a3a08b-b87f-454c-a572-9a0c5d4f83fb">Example—</heading>
											<block>
												<txt break.before="1">A funding provider acquires a property for $1,000,000, using $750,000 of receipts and $250,000 of the provider’s own money. The offset percentage is 25%.</txt>
											</block>
										</note>
										<txt break.before="1">
											<defterm id="sec.9-ssec.5-def.receiptsamount" guid="_f3bc9a4b-1182-4b04-b886-d92cd95f6707" type="definition">receipts amount</defterm> means the amount of receipts, other than funding, for the housing service received by the funded provider, as at the end of the notice year.</txt>
										<txt break.before="1">
											<defterm id="sec.9-ssec.5-def.repaidamount" guid="_d4381c63-83ab-4908-bacc-9a50426209d6" type="definition">repaid amount</defterm> means the amount of receipts, other than funding, the funded provider has paid to the chief executive as at the end of the notice year.</txt>
										<txt break.before="1">
											<defterm id="sec.9-ssec.5-def.spentamount" guid="_322eb9c5-4344-4721-ad0b-d85c9cab94a6" type="definition">spent amount</defterm> means the amount of receipts, other than funding—</txt>

											<li id="sec.9-ssec.5-def.offsetpercentage-para1.a" guid="_e671c3bc-4454-4e6a-be53-bbe0664793ee" provision.type="other">
												<no>(a)</no>
												<block>
													<txt break.before="1">the funded provider has spent, as allowed under the funding agreement, as at the end of the notice year; or</txt>
												</block>
											</li>
											<li id="sec.9-ssec.5-def.offsetpercentage-para1.b" guid="_2580ab4d-8529-4e90-a529-5bd28cd20439" provision.type="other">
												<no>(b)</no>
												<block>
													<txt break.before="1">the funded provider has retained, with the written approval of the chief executive, as at the end of the notice year.</txt>

						<block>
							<txt break.before="1">A funded provider must not use funded property as security for a loan unless—</txt>

									<no>(a)</no>
									<block>
										<txt break.before="1">the funded provider is—</txt>
										<list number.type="manual" unnumbered.indent="0">
											<li id="sec.10-para1.a-para2.i" guid="_7aaea222-b43b-454b-a573-bc696a7d42ee" provision.type="other">
												<no>(i)</no>
												<block>
													<txt break.before="1">a registered provider; and</txt>
												</block>
											</li>
											<li id="sec.10-para1.a-para2.ii" guid="_0dec0a0b-7a00-459e-87ee-9a9b983b6562" provision.type="other">
												<no>(ii)</no>
												<block>
													<txt break.before="1">a company registered under the Corporations Act; and</txt>
												</block>
											</li>
										</list>
									</block>
								</li>
								<li id="sec.10-para1.b" guid="_a0b9c67e-e8fa-4587-bdfa-474d60555ff2" provision.type="other">
									<no>(b)</no>
									<block>
										<txt break.before="1">the chief executive gives the funded provider written approval to use the funded property as security for the loan.</txt>
									</block>
								</li>

					</clause>

						<heading id="sec.11-he" guid="_cb8925f6-2127-437a-bad7-84bae4885b47">Financial statements for ancillary housing service</heading>
						<subclause id="sec.11-ssec.1" guid="_6ecc0172-3983-4b55-b32f-2a88e6ee4e8d" affected.by.uncommenced="0" provision.type="other">
							<no>(1)</no>
							<block>
								<txt break.before="1">This section applies to a funded provider that receives funding for an ancillary housing service.</txt>
							</block>
						</subclause>
						<subclause id="sec.11-ssec.2" guid="_108b1f52-95f4-43ee-b2e6-a0185d883765" affected.by.uncommenced="0" provision.type="other">
							<no>(2)</no>
							<block>
								<txt break.before="1">The funded provider must prepare annual financial statements for each financial year in which the funded provider receives the funding.</txt>
							</block>
						</subclause>
						<subclause id="sec.11-ssec.3" guid="_b1b5b1c8-d74e-42bc-98d8-1e592962679d" affected.by.uncommenced="0" provision.type="other">
							<no>(3)</no>
							<block>
								<txt break.before="1">The annual financial statements must be in the form, and contain the information, that the <legref jurisd="QLD" type="act" target.doc.id="UNKNOWN" check="invalid">Act</legref> establishing the funded provider requires.</txt>
							</block>
						</subclause>
						<subclause id="sec.11-ssec.4" guid="_147baca2-2e44-4611-a5b8-0698f383c735" affected.by.uncommenced="0" provision.type="other">
							<no>(4)</no>
							<block>
								<txt break.before="1">If the chief executive requests a copy of the annual financial statements, the funded provider must comply with the request.</txt>
							</block>
						</subclause>
						<subclause id="sec.11-ssec.5" guid="_36d051d0-4be1-438e-9566-e6b1ecd3e846" affected.by.uncommenced="0" provision.type="other">
							<no>(5)</no>
							<block>
								<txt break.before="1">The funded provider must comply with this section even if the funded provider—</txt>

									<li id="sec.11-ssec.5-para1.a" guid="_8bc85400-e6e0-4adf-a3bb-9b3cdcaa2d2f" provision.type="other">
										<no>(a)</no>
										<block>
											<txt break.before="1">does not provide, or is not required to provide, the service for the whole of the financial year; or</txt>
										</block>
									</li>
									<li id="sec.11-ssec.5-para1.b" guid="_3778419a-d2fd-4916-9665-cac7a396d6be" provision.type="other">
										<no>(b)</no>
										<block>
											<txt break.before="1">stops providing the service before fully complying with this section.</txt>
										</block>
									</li>

						</subclause>
					</clause>
					<clause id="sec.12" guid="_c0ad1262-1da9-4cc1-bdae-93928fb8b81e" affected.by.uncommenced="0" spent.amends="0" provision.type="other">

						<heading id="sec.12-he" guid="_f582fee8-a528-4921-892d-83ffbe5666b1">Asset management plans</heading>
						<subclause id="sec.12-ssec.1" guid="_1aeeb24e-1c3c-43d5-ad85-d4d32993a57e" affected.by.uncommenced="0" provision.type="other">
							<no>(1)</no>
							<block>
								<txt break.before="1">A funded provider must keep, and implement, a management plan (an asset management plan) for each of the provider’s funded property.</txt>
							</block>
						</subclause>
						<subclause id="sec.12-ssec.2" guid="_2df62271-1b58-4c5a-bf64-0c184adf17f4" affected.by.uncommenced="0" provision.type="other">
							<no>(2)</no>
							<block>

									<no>(b)</no>

												<no>(i)</no>

													<txt break.before="1">letters of administration of the purchaser’s estate have not been granted in Queensland within 6 months after the purchaser’s death; and</txt>

											<li id="sec.28-ssec.3-para1.b-para2.ii" guid="_c6b381ca-75b7-4c87-b6b5-677d03c16dff" provision.type="other">
												<no>(ii)</no>
												<block>
													<txt break.before="1">the gross value of the purchaser’s estate in Queensland on the day of the purchaser’s death is not more than $150,000; and</txt>
												</block>
											</li>
											<li id="sec.28-ssec.3-para1.b-para2.iii" guid="_4c57bb0e-d890-493e-9aca-601c92e4849f" provision.type="other">
												<no>(iii)</no>
												<block>
													<txt break.before="1">the chief executive believes the person has a right to obtain a grant of representation; or</txt>
