title</heading><block><txt break.before="1">This Act may be cited as the <legref jurisd="QLD" type="act" target.doc.id="act-2003-057" target.version.series="3f346b16-0363-475e-a51e-30882d0db57c" check="valid"><name emphasis="yes">Child Protection (International Measures) Act 2003</name></legref>.</txt></block></clause><clause id="sec.2" guid="_7b1607b8-574e-4e51-94db-7c649ecea660" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_7fefbc13-097f-4b54-99f0-72b8c674a276">Commencement</heading><block><txt break.before="1"><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Schedule&#160;3</intref> commences on a day to be fixed by proclamation.</txt></block></clause><clause id="sec.3" guid="_914df49b-945a-4d23-93d2-9adcfed9318f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_184a222f-e134-4e3a-b296-1519b1709388">Main purposes of Act</heading><block><txt break.before="1">The main purposes of this Act are to recognise—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.a" guid="_63478240-8f6c-49d5-8c7d-8f0490827bad" provision.type="other"><no>(a)</no><block><txt break.before="0">the importance of international co-operation for the protection of children; and</txt></block></li><li id="sec.3-para1.b" guid="_29be256a-d151-48de-931a-7f09e4fcb882" provision.type="other"><no>(b)</no><block><txt break.before="0">the need to avoid conflict between the legal systems of different countries about the jurisdiction, applicable law, recognition and enforcement of measures for the protection of children; and</txt></block></li><li id="sec.3-para1.c" guid="_77e25b59-fce1-4c30-9219-925b250aed11" provision.type="other"><no>(c)</no><block><txt break.before="0">that a child’s best interests are a primary consideration in relation to a measure for protecting the person of the child or a measure for protecting the child’s property.</txt></block></li></list></block></clause><clause id="sec.4" guid="_918364e8-1018-4998-958b-b9378264b7f9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_7083f412-a253-4bdd-9f90-8b1302abf5f2">Application of Act</heading><subclause id="sec.4-ssec.1" guid="_31b8dc1d-a916-45e2-949b-926d92908992" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act does not apply to a matter to which the Child Protection Convention does not apply under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;4</intref> of the Convention.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_fae90317-956c-4915-bd72-23515267d2f6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">This Act does not apply in relation to matters dealt with under an arrangement with New Zealand under the <legref jurisd="QLD" type="act" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" check="valid"><name emphasis="yes">Child Protection Act 1999</name></legref>, <legref jurisd="QLD" type="act" refid="ch.7" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_adc824d2-bedf-45b0-83f8-644abe8c34d0" check="valid">chapter&#160;7</legref>, <legref jurisd="QLD" type="act" refid="ch.7-pt.1" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_cd484a1e-e7e8-4748-a8a3-48a44756b8ee" check="valid">parts&#160;1</legref> to <legref jurisd="QLD" type="act" refid="ch.7-pt.6" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_73516f82-6361-4f87-973f-a891058c8fd4" check="valid">6</legref>.</txt></block></subclause><subclause id="sec.4-ssec.3" guid="_3a6faa83-c0c0-4704-98cc-834ccf1a0f8e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">To the extent that this Act and an arrangement referred to in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(2)</intref> are inconsistent in providing for the exercise of jurisdiction by a Queensland authority or a competent authority in a Convention country, this Act prevails.</txt></block></subclause><subclause id="sec.4-ssec.4" guid="_d8de760c-ed22-4311-932c-8de95950517c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In addition to measures to which the Child Protection Convention applies under <intref refid="sec.53" check="invalid">Article&#160;53</intref>, this Act applies to a measure taken in another country before the Convention has entered into force for that country if, at all relevant times that action is taken under this Act in relation to the measure, the Convention is in force for that country and Australia.</txt></block></subclause></clause><clause id="sec.5" guid="_bb013a21-d6ba-47eb-8325-ab2e69d99b5c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_f9876cd2-382b-4216-a444-3f0d032aa058">Act binds all persons</heading><block><txt break.before="1">This Act binds all persons, including the State.</txt></block></clause><clause id="sec.6" guid="_7cb10c7e-b156-4463-a91c-7ea89bfade81" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_74b61a85-999b-41fd-8945-4c7e0b5478d4">Definitions</heading><subclause id="sec.6-ssec.1" guid="_860ecbc1-6698-4a7b-be33-1e6f570a8712" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The dictionary in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">schedule&#160;4</intref> defines particular words used in this Act.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_d350fc91-838b-4536-84e9-ac28907e1d5f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Unless the contrary intention appears, expressions used—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a" guid="_e04963ee-81ab-4518-9327-4060087bfe44" provision.type="other"><no>(a)</no><block><txt break.before="0">in this Act; or</txt></block></li><li id="sec.6-ssec.2-para1.b" guid="_815d33b9-4188-43d5-95ff-443e9d4c9121" provision.type="other"><no>(b)</no><block><txt break.before="0">in regulations made for the purposes of this Act;</txt></block></li></list></block><block><txt break.before="1">have the same meaning as they have in the Child Protection Convention.</txt></block></subclause></clause><clause id="sec.7" guid="_fc1dac2d-dd1f-4bf0-b337-acaf0a9c4cfb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_05a12197-cdf2-4428-afa0-3caff4ee70e2">Circumstances in which Queensland court may exercise jurisdiction</heading><subclause id="sec.7-ssec.1" guid="_fdf7e3be-fd91-4799-a93e-b0212d7c7013" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If, under this Act, a Queensland court may exercise jurisdiction for a matter, the court may exercise the jurisdiction for the matter—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_a0cbfde2-5ee4-4d32-aad6-893007a4df22" provision.type="other"><no>(a)</no><block><txt break.before="0">on application by the department, litigation director or public trustee; or</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_ace5206e-3fa1-4072-907c-aed6f0efe1c4" provision.type="other"><no>(b)</no><block><txt break.before="0">on its own initiative.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_833a3bf3-f16a-4460-921c-bb2f9a321df2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For this Act, department, litigation director and public trustee may make applications to a Queensland court.</txt></block></subclause><subclause id="sec.7-ssec.3" guid="_fa1608da-770c-46e3-9398-10b3e98bb246" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Subsections&#160;(1)</intref> and <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(2)</intref> are not limited by, and do not limit, a provision made by or under this Act or another Act that states other persons may make an application under this Act or otherwise make a request to a Queensland court.</txt><note id="sec.7-ssec.3-note" guid="_515cc95d-d5a5-453b-add3-65dd5c3f8e6f" type="example"><heading id="sec.7-ssec.3-note-he" guid="_afb47d07-a2dd-460d-a12b-26b0f3808f5c">Example for <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(3)</intref>—</heading><block><txt break.before="1">As mentioned in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;16</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(iii)</intref>, a Queensland authority may exercise jurisdiction in relation to a child habitually resident in a Convention country only if the Queensland authority is requested to assume the jurisdiction by, or at the invitation of, a competent spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_ecf96140-cd9e-46bd-a548-1b657c43b889">Application of part</heading><subclause id="sec.8-ssec.1" guid="_d31af574-9dec-4760-ab08-d20b6b3b5372" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This part applies only if an issue under Queensland law is whether a Queensland court, the department or the litigation director, as opposed to any of the following authorities, is to take measures directed to the protection of the person of a child—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_e5f7e800-3ee2-4226-861e-49172e27b72d" provision.type="other"><no>(a)</no><block><txt break.before="0">a central authority or competent authority of a Convention country;</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_f2e613ca-158a-41a0-84df-dddee472dd22" provision.type="other"><no>(b)</no><block><txt break.before="0">a competent authority of a non-Convention country.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_4bf89ad3-e049-4f3f-abf0-01dc2e404e10" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">This part does not apply if an issue under Queensland law is whether a Queensland court, the department or the litigation director, as opposed to another competent authority of Australia, is to take measures directed to the protection of the person of a relating to jurisdiction for the person of a child</heading><subclause id="sec.9-ssec.1" guid="_5ea71d33-6bd2-4017-ae9c-c86c1231f9b5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a Queensland authority has jurisdiction under Queensland law, apart from this Act, for a Queensland personal protection measure in relation to a child.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_f7d75d22-a47b-4718-92a3-9ee43a02fc0d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Queensland authority may exercise jurisdiction for a Queensland personal protection measure only in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_db71e0dd-46e6-4bec-ab42-0aa4b0521b20" provision.type="other"><no>(a)</no><block><txt break.before="0">a child who is present and habitually resident in Australia; or</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_cd484063-97d6-4959-9dc1-773a557d0db6" provision.type="other"><no>(b)</no><block><txt break.before="0">a child who is present in Australia and habitually resident in a Convention country, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.b-para2.i" guid="_43dd7dc7-4890-4290-bb75-3fa99a31feb0" provision.type="other"><no>(i)</no><block><txt break.before="0">the child’s protection requires taking the measure as a matter of urgency; or</txt></block></li><li id="sec.9-ssec.2-para1.b-para2.ii" guid="_8c570d72-64e5-4c27-89e8-76a36e5ebeac" provision.type="other"><no>(ii)</no><block><txt break.before="0">the measure is provisional and limited in its territorial effect to Australia; or</txt></block></li><li id="sec.9-ssec.2-para1.b-para2.iii" guid="_7f204a28-0dae-40c6-adb7-ca262a7fa8c5" provision.type="other"><no>(iii)</no><block><txt break.before="0">the child is a refugee child; or</txt></block></li><li id="sec.9-ssec.2-para1.b-para2.iv" guid="_26036cac-5ebd-4fcf-a348-5d4bda53471a" provision.type="other"><no>(iv)</no><block><txt break.before="0">a request to assume jurisdiction is made to a Queensland court or the department by a competent authority of the country of the child’s habitual residence; or</txt></block></li><li id="sec.9-ssec.2-para1.b-para2.v" guid="_fa9b042d-220c-4ff2-aedb-727cd7cdce0f" provision.type="other"><no>(v)</no><block><txt break.before="0">a competent authority of the country of the child’s habitual residence agrees to a Queensland court or the department assuming jurisdiction; or</txt></block></li></list></block></li><li id="sec.9-ssec.2-para1.c" guid="_79ee2fd7-4544-4117-b4e2-937ee2106abb" provision.type="other"><no>(c)</no><block><txt break.before="0">a child who is present in a Convention country, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.c-para2.i" guid="_18c3e829-a6f2-4a2b-b6aa-25ee929d28e8" provision.type="other"><no>(i)</no><block><txt break.before="0">the child is habitually resident in Australia; or</txt></block></li><li id="sec.9-ssec.2-para1.c-para2.ii" guid="_e64a1ba8-2bc5-4a92-aa54-b391e06854ca" provision.type="other"><no>(ii)</no><block><txt break.before="0">the child has been wrongfully removed from or retained outside Australia and Queensland authorities keep jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;7</intref> of the Child Protection Convention; or</txt></block></li><li id="sec.9-ssec.2-para1.c-para2.iii" guid="_5ac8d173-8577-4f6a-bf60-2c0ff2dbf4c7" provision.type="other"><no>(iii)</no><block><txt break.before="0">a request to assume jurisdiction is made to a Queensland court or the department by a competent authority of the country of the child’s habitual residence or country of refuge; or</txt></block></li><li id="sec.9-ssec.2-para1.c-para2.iv" guid="_b7d69aba-9c6d-4a33-a73b-d56ffedc4d72" provision.type="other"><no>(iv)</no><block><txt break.before="0">a competent authority of the country of the child’s habitual residence or country of refuge agrees to a Queensland court or the department assuming jurisdiction; or</txt></block></li></list></block></li><li id="sec.9-ssec.2-para1.d" guid="_21a3e4e4-89ae-49e0-931c-70eb913d6c30" provision.type="other"><no>(d)</no><block><txt break.before="0">a child who is present in Australia and is a refugee child; or</txt></block></li><li id="sec.9-ssec.2-para1.e" guid="_acf14ab1-0a5a-475b-9a8a-7864dbd761a9" provision.type="other"><no>(e)</no><block><txt break.before="0">a child who is present in a non-Convention country, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.e-para2.i" guid="_b6f8d9c7-6f39-4ce4-96d5-ef5fe7312b67" provision.type="other"><no>(i)</no><block><txt break.before="0">the child is habitually resident in Australia; or</txt></block></li><li id="sec.9-ssec.2-para1.e-para2.ii" guid="_4d2c9424-d32d-415f-833b-6f55fea87eed" provision.type="other"><no>(ii)</no><block><txt break.before="0">the child is habitually resident in a non-Convention country and is an Australian citizen; or</txt></block></li></list></block></li><li id="sec.9-ssec.2-para1.f" guid="_48fbafe3-e4ec-4ea1-9cba-d088e84167ae" provision.type="other"><no>(f)</no><block><txt break.before="0">a child who is present in Australia, if the child is habitually resident in a non-Convention country.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_e942d009-71ec-43df-9e05-bbfc43936808" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Queensland authority may only exercise jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(ii)</intref> if the measure is not incompatible with a foreign measure already taken by a competent authority of a Convention country under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Articles&#160;5</intref> to <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">10</intref> of the Child Protection Convention.</txt></block></subclause><subclause id="sec.9-ssec.4" guid="_1a8047e1-2614-4d06-9f9f-9885f5656e85" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt id="sec.11-ssec.1" guid="_e00e3ec1-9e28-4637-9721-37ce2b3349c3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to the exercise of jurisdiction by a Queensland authority under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;9</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(iii)</intref> to <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(v)</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.c" check="invalid">(c)</intref>.</txt></block></subclause><subclause id="sec.11-ssec.2" guid="_5f8a2272-cb68-4bbc-a07b-e9758a7f486f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the Queensland authority is a Queensland court, before the court exercises the jurisdiction, it must order the department—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.a" guid="_53bcbae2-b09a-484d-bda6-f1a3684783e2" provision.type="other"><no>(a)</no><block><txt break.before="0">to use the department’s best efforts to consult with the competent authorities in the Convention country to find out whether measures relating to the protection of the person of the child have been sought from the competent authorities; and</txt></block></li><li id="sec.11-ssec.2-para1.b" guid="_d1d0d490-0420-4946-9d44-17d534a2a5f3" provision.type="other"><no>(b)</no><block><txt break.before="0">to report to the court about the outcome of those efforts.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.3" guid="_5c0d7bcc-e68d-4183-8883-d8aa9cec14ee" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the Queensland authority is the department, before the department exercises the jurisdiction, the department must use its best efforts to consult with the competent authorities in the Convention country—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.3-para1.a" guid="_18f84ada-8839-43d9-8f6b-673846465992" provision.type="other"><no>(a)</no><block><txt break.before="0">to find out whether measures relating to the protection of the person of the child have been sought from the competent authorities; and</txt></block></li><li id="sec.11-ssec.3-para1.b" guid="_8bd5d66c-d4df-4bf9-933b-45f91b5e790a" provision.type="other"><no>(b)</no><block><txt break.before="0">to decide the most appropriate course of action.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.4" guid="_d5f882a5-7370-43db-ad9e-693642376471" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the Queensland authority is the litigation director, before the director exercises the jurisdiction, the director must be satisfied the department has used its best efforts to consult with the competent authorities in the Convention country to find out whether measures relating to the protection of the person of the child have been sought from the competent authorities.</txt></block><historynote><txt break.before="1"><b>s&#160;11</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2016-023" guid="_13e22db2-6abf-4828-b3a2-591c5b976086" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland authority other than the litigation director may, if it considers that it is in the child’s best interests, accept or reject a request made under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;8</intref> of the Child Protection Convention by a competent authority of a Convention country for the Queensland authority to assume jurisdiction to take a Queensland personal protection measure relating to the child.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_afdeef83-aa37-410d-99a4-859d2be8f7d2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the Queensland authority is a Queensland court, the court may order the department to do both of the following in a way that the department considers appropriate—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a" guid="_f12c506b-4817-444a-bc75-ec6d0ba86aa3" provision.type="other"><no>(a)</no><block><txt break.before="0">to request, under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;9</intref> of the Child Protection Convention, that a competent authority of a Convention country agree to the Queensland court assuming jurisdiction to take a Queensland personal protection measure relating to the child;</txt></block></li><li id="sec.12-ssec.2-para1.b" guid="_fcee925e-df30-4c42-be1e-58b1012ee25e" provision.type="other"><no>(b)</no><block><txt break.before="0">to report to the court about the outcome of the request.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.3" guid="_0e5ead93-906c-4625-9395-c59f73bc753c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Queensland court may only make the order under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(2)</intref> if it considers that it is better placed than the competent authority to assess the child’s best interests.</txt></block><historynote><txt break.before="1"><b>s&#160;12</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2016-023" jurisdiction</heading><subclause id="sec.13-ssec.1" guid="_3767a18b-803f-4645-9a8c-114ccba783c3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland court may order the department to request, in a way the department considers appropriate, a competent authority described in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;8</intref>, paragraph 2 of the Child Protection Convention—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.a" guid="_5a171235-b532-4174-9544-717d1a8c0997" provision.type="other"><no>(a)</no><block><txt break.before="0">to assume jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;8</intref> of the Convention for protecting the person of a child; and</txt></block></li><li id="sec.13-ssec.1-para1.b" guid="_df106d06-ea33-4362-8f88-29e507360a2a" provision.type="other"><no>(b)</no><block><txt break.before="0">as the competent authority considers necessary, to take measures to protect the person of a child; and</txt></block></li><li id="sec.13-ssec.1-para1.c" guid="_0274f291-4df8-4f21-aab5-d953e84ff7a6" provision.type="other"><no>(c)</no><block><txt break.before="0">to report to the court about the outcome of the request.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.2" guid="_03c0d155-5bb8-4ee6-a40e-3f113b36843c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In addition, the Queensland court may make any other order it considers necessary for an order under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.13-ssec.3" guid="_fb8c7d0c-823e-4c53-bc3e-070c8b92e357" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Queensland court may only make the order under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(1)</intref> if the court considers that the competent authority is better placed to assess the child’s best interests.</txt></block></subclause><subclause id="sec.13-ssec.4" guid="_ed567764-cb6a-4011-93ad-1dfbf02095d4" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Queensland court may accept or reject a request under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;9</intref> of the Child Protection Convention made by a competent authority of a Convention country described in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;8</intref>, paragraph 2 of the Convention, for the competent authority to assume jurisdiction to take a measure for protecting the person of the child.</txt></block></subclause><subclause id="sec.13-ssec.5" guid="_9dee36c4-9c69-406c-97a5-ebe72d1cdb82" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the competent authority assumes jurisdiction under the request, a Queensland court must not exercise jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;9</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(a)</intref>, <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(iii)</intref> to <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(v)</intref>, <intref refid="sch.4-def.Queenslandauthority-para1.c" check="invalid">(c)</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.d" check="invalid">(d)</intref>, while the competent authority continues to exercise its jurisdiction.</txt></block></subclause></clause><clause id="sec.14" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland personal protection measure relating to a child that is taken in response to a particular situation by a Queensland authority exercising jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;9</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(i)</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(ii)</intref> lapses if a foreign personal protection measure relating to the child, that is taken in response to the same situation, is recognised by registration under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;25</intref>.</txt></block></subclause><subclause id="sec.14-ssec.2" guid="_9537ca4c-63c1-4fe0-b3dc-a2f0ecdf4708" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A Queensland personal protection measure relating to a child that is taken in response to a particular situation by a Queensland authority exercising jurisdiction in a case of urgency, or in the taking of a measure of a provisional character, lapses if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-ssec.2-para1.a" guid="_77c53e11-1c86-46e1-8a2a-e521c956271c" provision.type="other"><no>(a)</no><block><txt break.before="0">a measure for protecting the person of the child, that is taken in response to the same situation, is taken by a competent authority of a non-Convention country; and</txt></block></li><li id="sec.14-ssec.2-para1.b" guid="_8a381c7f-8d1e-4b13-b565-b1a960f85b50" provision.type="other"><no>(b)</no><block><txt break.before="0">the measure is recognised under Queensland law or under the law of another id="sec.15-ssec.1" guid="_5602183d-1558-4e8f-bf78-deb717b2b048" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This part applies only if an issue under Queensland law is whether a Queensland court or the public trustee, as opposed to any of the following authorities, is to appoint, or determine the powers of, a guardian of a child’s property—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.1-para1.a" guid="_a2413c8a-a67f-4d56-8f2d-c366f5908e6a" provision.type="other"><no>(a)</no><block><txt authority has jurisdiction under Queensland law, apart from this Act, for a Queensland property protection measure in relation to a child.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_e6ecc400-1d1e-434b-8f42-4f38dff20298" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Queensland authority may exercise jurisdiction for a Queensland property protection measure only in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.a" guid="_c74453b8-ab05-4f9b-a043-e12974a22e38" provision.type="other"><no>(a)</no><block><txt break.before="0">a child who is habitually resident in Australia; or</txt></block></li><li id="sec.16-ssec.2-para1.b" guid="_08d7014e-2d24-41c0-8e14-78c307765820" provision.type="other"><no>(b)</no><block><txt break.before="0">a child who is habitually resident in a Convention country, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.b-para2.i" guid="_9533e8e6-943e-4944-9108-0e3bf7703471" provision.type="other"><no>(i)</no><block><txt break.before="0">the protection of the child’s property in Australia requires taking the measure as a matter of urgency; or</txt></block></li><li id="sec.16-ssec.2-para1.b-para2.ii" guid="_81b34d0c-90d4-4e56-866a-f055048f6862" provision.type="other"><no>(ii)</no><block><txt break.before="0">the measure is provisional and limited in its territorial effect to property in Australia; or</txt></block></li><li id="sec.16-ssec.2-para1.b-para2.iii" guid="_8c9e6cfa-cb01-4811-8bfa-d21b91ef99cd" provision.type="other"><no>(iii)</no><block><txt break.before="0">a request to assume jurisdiction is made to the Queensland authority by, or at the invitation of, a competent authority of the country of the child’s habitual residence or country of refuge; or</txt></block></li><li id="sec.16-ssec.2-para1.b-para2.iv" guid="_32c70e99-6f2c-4568-abde-278fac934106" provision.type="other"><no>(iv)</no><block><txt break.before="0">a competent authority of the country of the child’s habitual residence or country of refuge agrees to the Queensland authority assuming jurisdiction; or</txt></block></li><li id="sec.16-ssec.2-para1.b-para2.v" guid="_85210bde-ae97-48a1-9855-a7695bdafb68" provision.type="other"><no>(v)</no><block><txt break.before="0">the child has been wrongfully removed from or retained outside Australia and Queensland authorities keep jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;7</intref> of the Child Protection Convention; or</txt></block></li></list></block></li><li id="sec.16-ssec.2-para1.c" guid="_34d483b0-e273-47ae-95c3-f2a846171ba7" provision.type="other"><no>(c)</no><block><txt break.before="0">a child who is present in Australia and is a refugee child; or</txt></block></li><li id="sec.16-ssec.2-para1.d" guid="_a98e1062-f0bd-4807-9a4a-dabf57b8a64a" provision.type="other"><no>(d)</no><block><txt break.before="0">a child who is present in a non-Convention country, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.d-para2.i" guid="_8737d68f-dc17-456c-aef9-b0326c556a46" provision.type="other"><no>(i)</no><block><txt break.before="0">the child is habitually resident in Australia; or</txt></block></li><li id="sec.16-ssec.2-para1.d-para2.ii" guid="_47397ad5-b220-49e5-8c7c-63e8978f3826" provision.type="other"><no>(ii)</no><block><txt break.before="0">the child is habitually resident in a non-Convention country and is an Australian citizen; or</txt></block></li></list></block></li><li id="sec.16-ssec.2-para1.e" guid="_81f68fef-8a44-4e17-bbeb-8a01e20f084b" provision.type="other"><no>(e)</no><block><txt break.before="0">a child who is present in Australia, if the child is habitually resident in a non-Convention country.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.3" guid="_bbecf4d7-2c86-46c5-af08-1fa181a8195d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Queensland authority may only exercise jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(ii)</intref> if the measure is not incompatible with a foreign measure already taken by a competent authority of a Convention country under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Articles&#160;5</intref> to <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">10</intref> of the Child Protection Convention.</txt></block></subclause><subclause id="sec.16-ssec.4" guid="_560020df-baf4-432b-a4e6-8e32045e5417" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">sections&#160;17</intref>, <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">18</intref> and <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" country</heading><block><txt break.before="1">A Queensland authority must not, other than in a case of urgency, exercise jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;16</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(a)</intref>, <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.b" retained outside a Convention country; and</txt></block></li><li id="sec.17-para1.b" guid="_f6753e38-e6c8-4d00-838c-ad79768d1b66" provision.type="other"><no>(b)</no><block><txt break.before="0">an authority of the Convention country keeps jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;7</intref> of the Child Protection Convention.</txt></block></li></list></block></clause><clause id="sec.18" guid="_a644d0d4-adfe-4562-a99e-954049ed0c5f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>18</no><heading id="sec.18-he" guid="_319c4a0a-a71d-4396-8520-9c6ffe0f6085">Limitations when prior proceedings pending in a Convention country</heading><subclause id="sec.18-ssec.1" guid="_7d51092a-cdc4-4138-bee3-240c95309d5f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to the exercise of jurisdiction by a Queensland authority under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;16</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(a)</intref>, <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(iii)</intref> to <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(v)</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.c" check="invalid">(c)</intref>.</txt></block></subclause><subclause id="sec.18-ssec.2" guid="_a1c9a9a9-3265-4e14-81a1-c7367be46bae" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Queensland authority must not exercise that jurisdiction to take a Queensland property protection measure relating to a child if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a" guid="_039f95ad-98e8-451e-bcb8-7bf80ac96fa1" provision.type="other"><no>(a)</no><block><txt break.before="0">a corresponding measure has been sought from a competent authority of a Convention country and it was sought—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a-para2.i" guid="_813b00c2-6384-468c-ae8a-8d616a26e34f" provision.type="other"><no>(i)</no><block><txt break.before="0">if the Queensland authority is a Queensland court—before the proceedings were started in the court; or</txt></block></li><li id="sec.18-ssec.2-para1.a-para2.ii" guid="_8de4da5b-a0e0-4dd5-982f-bc1d34124bb9" provision.type="other"><no>(ii)</no><block><txt break.before="0">if the Queensland authority is the public trustee—before the public trustee exercises the jurisdiction; and</txt></block></li></list></block></li><li id="sec.18-ssec.2-para1.b" guid="_1cc545cf-aaa3-4eae-a18f-96c3aebb24af" provision.type="other"><no>(b)</no><block><txt break.before="0">any of the following applies—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.b-para2.i" guid="_ec7921cd-3410-4b65-8801-3ebaca55e905" provision.type="other"><no>(i)</no><block><txt break.before="0">the child is habitually resident in the Convention country;</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.ii" guid="_47a86dc8-6756-4e2a-8038-17d375387885" provision.type="other"><no>(ii)</no><block><txt break.before="0">the child is present in the Convention country and is a refugee child;</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.iii" guid="_2f5f0fc1-3265-4d64-bde3-d5ac0a9b3f5e" provision.type="other"><no>(iii)</no><block><txt break.before="0">a request to assume jurisdiction is made to a competent authority of the country of the child’s habitual residence or country of refuge;</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.iv" guid="_fd551b4f-9c0c-44dd-a99d-682f9363a0fa" provision.type="other"><no>(iv)</no><block><txt break.before="0">a competent authority of the country of the child’s habitual residence or country of refuge agrees to the competent authority assuming jurisdiction;</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.v" guid="_b97013ba-bd7a-4895-b171-5d92092830ab" provision.type="other"><no>(v)</no><block><txt break.before="0">the competent authority of the Convention country is exercising jurisdiction in proceedings concerning the divorce or separation of the child’s parents or the annulment of their marriage (but see <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(3)</intref>);</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.vi" guid="_8925454b-5290-40a8-bf75-e241d670e55a" provision.type="other"><no>(vi)</no><block><txt break.before="0">the child has been wrongfully removed from or retained outside the Convention country and a competent authority of the Convention country keeps jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;7</intref> of the Child Protection Convention.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.18-ssec.3" guid="_e7a27947-43ef-43ff-a7f0-f8e5632625d1" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Subsection&#160;(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(v)</intref> only applies (subject to <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(4)</intref>) if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.3-para1.a" guid="_ece8b0c7-738e-42ef-ad67-bde5303c24ef" provision.type="other"><no>(a)</no><block><txt break.before="0">one or both of the child’s parents are habitually resident in the Convention country when the proceedings referred to in that subparagraph are started; and</txt></block></li><li id="sec.18-ssec.3-para1.b" guid="_eace1f4f-d032-4787-972e-212f0531645b" provision.type="other"><no>(b)</no><block><txt break.before="0">one or both of the parents have parental responsibility for the child; and</txt></block></li><li id="sec.18-ssec.3-para1.c" guid="_c949e468-1141-43ee-847b-9c20f7786eee" provision.type="other"><no>(c)</no><block><txt break.before="0">the jurisdiction of the competent authority of the Convention country to take the measure is accepted by the parents and each other person with parental responsibility for the child; and</txt></block></li><li id="sec.18-ssec.3-para1.d" guid="_69993e50-63b1-4436-9b09-436ed4295d1e" provision.type="other"><no>(d)</no><block><txt break.before="0">the exercise of jurisdiction to take the measure is in the best interests of the child; and</txt></block></li><li id="sec.18-ssec.3-para1.e" guid="_e1e9af43-5a95-4da3-b432-ec17b128e46c" provision.type="other"><no>(e)</no><block><txt break.before="0">the proceedings on the application for divorce or separation of the child’s parents or the annulment of their marriage have not been finalised.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.4" guid="_f7cba56b-65a7-4fb8-a8f5-f7c530c056be" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0"><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Subsection&#160;(2)</intref> does not apply if the competent authority of the Convention country has declined jurisdiction or is no longer considering taking the measure sought.</txt></block></subclause></clause><clause id="sec.19" guid="_1b93db6c-d6c7-4361-b46d-140f0e59f180" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sec.19-he" guid="_1ef9ca07-74a1-4f07-994f-f9089edd365f">If Queensland authority is asked to assume jurisdiction</heading><subclause id="sec.19-ssec.1" guid="_4b45c285-799d-4403-a9c8-f62e43e744d4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland court may, if it considers that it is in the child’s best interests, accept or reject a request made under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;8</intref> of the Child Protection Convention by, or at the invitation of, a competent authority of a Convention country for the Queensland court to assume jurisdiction to take a Queensland property protection measure relating to the child.</txt></block></subclause><subclause id="sec.19-ssec.2" guid="_5fa19b41-e443-4e02-ada7-609e96731998" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A Queensland court may order, or invite the parties to proceedings before the court to ask, the department or the public trustee to do both of the following in a way that the department or the public trustee considers appropriate—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.2-para1.a" guid="_5cbe803c-8218-47a2-9869-96ea2f922947" provision.type="other"><no>(a)</no><block><txt break.before="0">to request, under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;9</intref> of the Child Protection Convention, that a competent authority of a Convention country agree to the Queensland court assuming jurisdiction to take a Queensland property protection measure relating to the child;</txt></block></li><li id="sec.19-ssec.2-para1.b" guid="_a1cfd118-892e-4203-bfd4-8ee1a0dbe9db" provision.type="other"><no>(b)</no><block><txt break.before="0">to report to the court about the outcome of the request.</txt></block></li></list></block></subclause><subclause id="sec.19-ssec.3" guid="_1e85f1d2-38a6-46f3-bb93-8a5e9a6ea6b4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The public trustee must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.3-para1.a" guid="_5df25f3e-8db4-4a21-bc8c-c21046b650d2" provision.type="other"><no>(a)</no><block><txt break.before="0">apply to a Queensland court, under the <legref jurisd="QLD" type="act" target.doc.id="act-1978-073" target.version.series="193b0178-f1bf-4fc4-abc8-c5dd1ec8a47d" check="valid"><name emphasis="yes">Public Trustee Act 1978</name></legref>, for an order that the public trustee may accept a request, under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;9</intref> of the Child Protection Convention, for the public trustee to assume jurisdiction to take a Queensland property protection measure relating to the child that the public trustee consider necessary; or</txt></block></li><li id="sec.19-ssec.3-para1.b" guid="_0a5b41b2-00a4-4e0a-ad92-314e7555f85f" provision.type="other"><no>(b)</no><block><txt break.before="0">reject the request.</txt></block></li></list></block></subclause><subclause id="sec.19-ssec.4" guid="_f626eb2a-4a26-4f9b-8280-ae72b4ad4bea" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Queensland court may only—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.4-para1.a" guid="_1d221a5f-66d2-4bab-a7bc-9d2e2924620b" provision.type="other"><no>(a)</no><block><txt break.before="0">make the order, or issue the invitation, under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(2)</intref> if it considers that it is better placed than the competent authority to assess the child’s best interests; or</txt></block></li><li id="sec.19-ssec.4-para1.b" guid="_62ee8241-2552-47ed-917c-bf5e588daffd" provision.type="other"><no>(b)</no><block><txt break.before="0">make the order under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(3)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(a)</intref> if it considers that the public trustee is better placed than the competent authority to assess the child’s best interests.</txt></block></li></list></block></subclause></clause><clause id="sec.20" guid="_bf1ecad2-b157-41c2-a463-739446c66677" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.20-he" guid="_58aa6dac-3c1f-4975-b5fb-62631c1fd59f">Limitation if a competent authority of a Convention country is asked to assume jurisdiction</heading><subclause id="sec.20-ssec.1" guid="_c681fa49-bd4b-47d5-8b81-80e71cfdf7c9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland court may order, or invite the parties to proceedings before the court to ask, the department or the public trustee to request, in a way the department or the public trustee considers appropriate, a competent authority described in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;8</intref>, paragraph 2 of the Child Protection Convention—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.1-para1.a" guid="_90cd5d00-78b6-408d-ad42-e1d111c649b9" provision.type="other"><no>(a)</no><block><txt break.before="0">to assume jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;8</intref> of the Convention for appointing, or deciding the powers of, a guardian of the child’s property; and</txt></block></li><li id="sec.20-ssec.1-para1.b" guid="_4571fff4-e8d8-4df2-ba1a-d04e957ce5d7" provision.type="other"><no>(b)</no><block><txt break.before="0">as the competent authority considers necessary, to take a measure appointing, or deciding the powers of, a guardian of the child’s property; and</txt></block></li><li id="sec.20-ssec.1-para1.c" guid="_59f0d9c1-05c9-43e5-a318-5524da936d9f" provision.type="other"><no>(c)</no><block><txt break.before="0">to report to the court about the outcome of the request.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.2" guid="_70e44163-51dd-41b8-99d5-e50341ff40dd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In addition, the Queensland court may make any other order it considers necessary for an order under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.20-ssec.3" guid="_34756728-140b-4f60-9ac2-6f95a9dac2d0" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Queensland court may only make the order or issue the invitation under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(1)</intref> if the court considers that the competent authority is better placed to assess the child’s best interests.</txt></block></subclause><subclause id="sec.20-ssec.4" guid="_8232652d-1abc-4f45-8cca-fcc55da1935e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Queensland court may accept or reject a request under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;9</intref> of the Child Protection Convention made by, or at the invitation of, a competent authority of a Convention country described in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;8</intref>, paragraph 2 of the Convention, for the competent authority to assume jurisdiction to take measures for the protection of the child’s property.</txt></block></subclause><subclause id="sec.20-ssec.5" guid="_f5bf7201-844e-400b-b4b1-bfcbe5fda42b" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the competent authority assumes jurisdiction under the request, a Queensland court must not exercise jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(iii)</intref> to <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(v)</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.c" check="invalid">(c)</intref> while the competent authority continues to exercise its jurisdiction.</txt></block></subclause></clause><clause id="sec.21" guid="_84dd8e58-4f8d-4b8c-a7a4-7faf17c797d6" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_94194e4f-4718-4014-826b-def4cf0635e6">When a certain Queensland property protection measure lapses</heading><subclause id="sec.21-ssec.1" guid="_d231e572-6c47-4ce3-a33e-d2d111600e25" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland property protection measure relating to a child that is taken in response to a particular situation by a Queensland authority exercising jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;16</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(i)</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(ii)</intref> lapses if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.1-para1.a" guid="_23b58db4-9630-4077-b19f-e1b356c953c7" provision.type="other"><no>(a)</no><block><txt break.before="0">a foreign property protection measure relating to the child, that is taken in response to the same situation, is taken by a competent authority of a Convention country; and</txt></block></li><li id="sec.21-ssec.1-para1.b" guid="_a72b1818-e50a-4e20-a6c9-fc0452c6bb35" provision.type="other"><no>(b)</no><block><txt break.before="0">any of the following applies—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.1-para1.b-para2.i" guid="_98d2d6e9-ed54-41e3-9f9e-1bd968d39af8" provision.type="other"><no>(i)</no><block><txt break.before="0">the child is habitually resident in the Convention country;</txt></block></li><li id="sec.21-ssec.1-para1.b-para2.ii" guid="_bc791464-66c8-4d64-bd4b-7df0deb45273" provision.type="other"><no>(ii)</no><block><txt break.before="0">the child is present in the Convention country and is a refugee child;</txt></block></li><li id="sec.21-ssec.1-para1.b-para2.iii" guid="_14e83135-87bc-4ef2-a064-2463cffe4b7c" provision.type="other"><no>(iii)</no><block><txt break.before="0">a request to assume jurisdiction is made to the competent authority of the Convention country by, or at the invitation of, a competent authority of the country of the child’s habitual residence;</txt></block></li><li id="sec.21-ssec.1-para1.b-para2.iv" guid="_faf07b2d-47b2-4dec-95ba-0bb48c7d1502" provision.type="other"><no>(iv)</no><block><txt break.before="0">a competent authority of the country of the child’s habitual residence agrees to the competent authority of the Convention country assuming jurisdiction;</txt></block></li><li id="sec.21-ssec.1-para1.b-para2.v" guid="_7ed24113-ca86-46cf-8ca1-8ecd3844fc3c" provision.type="other"><no>(v)</no><block><txt break.before="0">a competent authority of the Convention country is exercising jurisdiction in proceedings concerning the divorce or separation of the child’s parents or the annulment of their marriage (but see <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(2)</intref>);</txt></block></li><li id="sec.21-ssec.1-para1.b-para2.vi" guid="_a3f2412f-8c82-496d-8f4f-a07a51fa1dc0" provision.type="other"><no>(vi)</no><block><txt break.before="0">the child has been wrongfully removed from or retained outside the Convention country and a competent authority of the Convention country keeps jurisdiction under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;7</intref> of the Child Protection Convention.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.21-ssec.2" guid="_673eb3ef-5f8f-4d04-b243-6225e39b8ca2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Subsection&#160;(1)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(b)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(v)</intref> only applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.2-para1.a" guid="_cbb78167-574e-4dad-b698-408bf489ddbf" provision.type="other"><no>(a)</no><block><txt break.before="0">one or both of the child’s parents are habitually resident in the Convention country when the proceedings referred to in that subparagraph are started; and</txt></block></li><li id="sec.21-ssec.2-para1.b" guid="_adc42051-1a2a-4038-9c0d-f4912cff9cb8" provision.type="other"><no>(b)</no><block><txt break.before="0">one or both of the parents have parental responsibility for the child; and</txt></block></li><li id="sec.21-ssec.2-para1.c" guid="_d3696d35-9b0a-47ef-99e8-f1df6f3d8172" provision.type="other"><no>(c)</no><block><txt break.before="0">the jurisdiction of the competent authority of the Convention country to take the measure is accepted by the parents and each other person with parental responsibility for the child; and</txt></block></li><li id="sec.21-ssec.2-para1.d" guid="_51e5e5c6-29ee-4292-b89f-dade0cf46ba4" provision.type="other"><no>(d)</no><block><txt break.before="0">the exercise of jurisdiction to take the measure is in the best interests of the child; and</txt></block></li><li id="sec.21-ssec.2-para1.e" guid="_f2b0551e-70af-4597-88a5-af4e63815539" provision.type="other"><no>(e)</no><block><txt break.before="0">the proceedings on the application for divorce or separation of the child’s parents or the annulment of their marriage have not been finalised.</txt></block></li></list></block></subclause><subclause id="sec.21-ssec.3" guid="_9aa8e195-6f21-4781-b0ba-ed334bfa1fc6" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A Queensland property protection measure relating to a child that is taken in response to a particular situation by a Queensland authority exercising jurisdiction in a case of urgency, or in the taking of a measure of a provisional character, lapses if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.3-para1.a" guid="_b1ee6acc-f9d5-4b91-b9fb-ec559a2b3006" provision.type="other"><no>(a)</no><block><txt break.before="0">a measure for the appointment, or the determination of the powers, of a guardian for the child’s property, that is taken in response to the same situation, is taken by a competent authority of a non-Convention country; and</txt></block></li><li id="sec.21-ssec.3-para1.b" guid="_6fff5c9c-d9e3-4bfc-84c3-95740d768ab0" provision.type="other"><no>(b)</no><block><txt break.before="0">the measure is recognised under Queensland law or under the law of another State.</txt></block></li></list></block></subclause></clause></part><part id="pt.4" guid="_2c5fa07d-27c2-4716-b1ef-6a6c05179ec9" affected.by.uncommenced="0"><no>Part 4</no><heading id="pt.4-he" guid="_0b951959-5cd3-44c3-b56b-ccddb7e8ff8f">Applicable law</heading><clause id="sec.22" guid="_f57456b6-d079-4504-8e93-920a564f3981" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>22</no><heading id="sec.22-he" guid="_39e16cb4-f6f7-49f0-a9fc-45b8651f3359">Applicable law generally</heading><subclause id="sec.22-ssec.1" guid="_a8bda07a-8e8a-42f8-ae7a-1b02dfb1604d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a Queensland authority exercising jurisdiction under <intref refid="pt.2" target.guid="_eb53be97-b92c-47a1-aa0f-f269be92bd66" check="valid">part&#160;2</intref> or <intref refid="pt.3" target.guid="_fd52517e-8ef1-47df-82a2-15afc7429d5f" check="valid">3</intref>.</txt></block></subclause><subclause id="sec.22-ssec.2" guid="_590dd9e0-e99a-4993-9968-32c3d7438acf" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Queensland authority must apply Queensland law in exercising that jurisdiction, other than choice of law rules.</txt></block></subclause><subclause id="sec.22-ssec.3" guid="_04f393a9-57dd-402c-ab32-c8cffcaf40a9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, the Queensland authority may in exceptional circumstances apply or take into account the law of another country with which—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.3-para1.a" guid="_9bccfb17-affc-4c58-b7f9-23f492d9d8fe" provision.type="other"><no>(a)</no><block><txt break.before="0">a child has a substantial connection; or</txt></block></li><li id="sec.22-ssec.3-para1.b" guid="_267fdec8-208f-47f2-98ab-e8680c8b3633" provision.type="other"><no>(b)</no><block><txt break.before="0">a child’s property is substantially connected;</txt></block></li></list></block><block><txt break.before="1">if the Queensland authority considers the protection of the person of the child, or the child’s property, requires the guid="_4b0ccedc-8f04-48e3-a978-fbc98e00c1ec">Recognition of foreign measures and their enforcement in Queensland</heading><clause id="sec.23" guid="_43a26e73-64bd-4797-87ed-07cdc40284e1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>23</no><heading id="sec.23-he" guid="_a5173db4-4203-4973-bae7-e63f55337208">Action on receipt of foreign personal protection measure</heading><subclause id="sec.23-ssec.1" guid="_26b490a8-8fe1-4bb0-bf4e-8f6a6646b5c2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the department is given either of the following documents, together with a request for the department to take an action under the Child Protection Convention—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.1-para1.a" guid="_fbbed0d4-8220-4f09-9e84-e75b63520aae" provision.type="other"><no>(a)</no><block><txt break.before="0">a document that is a foreign personal protection measure relating to a child;</txt></block></li><li id="sec.23-ssec.1-para1.b" guid="_ba56b02d-8677-4091-abe4-0011abe85144" provision.type="other"><no>(b)</no><block><txt break.before="0">a document that, although it is not a foreign personal protection measure relating to a child, states details of a foreign personal protection measure relating to a child.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.2" guid="_490786eb-99e5-48c6-8ee0-b720dc8357ef" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">After consulting with the competent authority of the country in which the foreign personal protection measure was taken, the department must do one of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.2-para1.a" guid="_d54a084b-5a4c-4035-b8ff-ee061d35f0f1" provision.type="other"><no>(a)</no><block><txt break.before="0">give the foreign personal protection measure to a registrar of a Queensland court for recognition of the measure by registration under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;25</intref>;</txt></block></li><li id="sec.23-ssec.2-para1.b" guid="_03bfdb3d-85a2-4b31-ba3f-c3ad68e185e3" provision.type="other"><no>(b)</no><block><txt break.before="0">give the foreign personal protection measure to the Commonwealth central authority together with a request for the Commonwealth central authority to take action under the Child Protection Convention, including, for example, registration of the foreign measure under the <legref jurisd="CTH" type="act" target.doc.id="act-1975-053" target.version.series="C2004A00275" check="valid"><name emphasis="yes">Family Law Act 1975</name> (Cwlth)</legref>;</txt></block></li><li id="sec.23-ssec.2-para1.c" guid="_55f9e862-a786-45f7-a007-8faeac20ccab" provision.type="other"><no>(c)</no><block><txt break.before="0">exercise the department’s jurisdiction under <intref refid="pt.2" target.guid="_eb53be97-b92c-47a1-aa0f-f269be92bd66" check="valid">part&#160;2</intref>;</txt></block></li><li id="sec.23-ssec.2-para1.d" guid="_072b2ed4-45d2-4a6e-a86c-b3a99ea64b7a" provision.type="other"><no>(d)</no><block><txt break.before="0">refer the matter to the litigation director for the director to exercise the director’s jurisdiction under <intref refid="pt.2" target.guid="_eb53be97-b92c-47a1-aa0f-f269be92bd66" check="valid">part&#160;2</intref>;</txt></block></li><li id="sec.23-ssec.2-para1.e" guid="_0e664301-9911-4ffa-b8b9-72ab82a97dde" provision.type="other"><no>(e)</no><block><txt break.before="0">apply to a Queensland court for the court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.2-para1.e-para2.i" guid="_24ae0637-6219-40d6-8138-aa8916c1682a" provision.type="other"><no>(i)</no><block><txt break.before="0">to exercise the court’s jurisdiction under <intref refid="pt.2" target.guid="_eb53be97-b92c-47a1-aa0f-f269be92bd66" check="valid">part&#160;2</intref>; or</txt></block></li><li id="sec.23-ssec.2-para1.e-para2.ii" guid="_7c64a469-7817-4560-94e1-30843df47e91" provision.type="other"><no>(ii)</no><block><txt break.before="0">to decide whether or not the court should refuse recognition of the foreign measure under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(3)</intref>;</txt></block></li></list></block></li><li id="sec.23-ssec.2-para1.f" guid="_1042c20e-0c66-4c40-934e-15441b2fde6a" provision.type="other"><no>(f)</no><block><txt break.before="0">agree with the competent authority that the department will not do anything.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.3" guid="_a2862bbb-9b5c-489a-b251-587552e607c4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A Queensland court may order a foreign personal protection measure relating to a child be refused recognition on any of the following grounds—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.3-para1.a" guid="_9206cda7-5c0c-43cd-8b89-bed30d94e851" provision.type="other"><no>(a)</no><block><txt break.before="0">the competent authority of the Convention country did not have jurisdiction under the Child Protection Convention for taking the foreign personal protection measure;</txt></block></li><li id="sec.23-ssec.3-para1.b" guid="_6a8b9cf9-5d61-4efa-8f17-eb51ae93d902" provision.type="other"><no>(b)</no><block><txt break.before="0">in taking the foreign personal protection measure, the competent authority of the Convention country is taken to have acted contrary to the fundamental principles of procedure under Queensland law as mentioned in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(4)</intref>;</txt></block></li><li id="sec.23-ssec.3-para1.c" guid="_869643be-6363-4fb0-a044-b68e0ec1f2f7" provision.type="other"><no>(c)</no><block><txt break.before="0">recognition of the foreign personal protection measure is contrary to public policy in Queensland having regard to the child’s best interests;</txt></block></li><li id="sec.23-ssec.3-para1.d" guid="_92606092-ce77-4337-ad78-a2e47068ff43" provision.type="other"><no>(d)</no><block><txt break.before="0">if the foreign personal protection measure were recognised by registration under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;25</intref>, there would be no appropriate means of enforcing the measure under Queensland law;</txt></block></li><li id="sec.23-ssec.3-para1.e" guid="_d8ceb0fe-0b8d-4d01-986b-6448ff1222eb" provision.type="other"><no>(e)</no><block><txt break.before="0">the foreign personal protection measure is incompatible with a later measure taken in a non-Convention country in which the child habitually resides and, if the later measure were a foreign personal protection measure, it could not be refused recognition under <intref refid="sec.23-ssec.3-para1.b" target.guid="_6a8b9cf9-5d61-4efa-8f17-eb51ae93d902" check="valid">paragraph&#160;(b)</intref> or <intref refid="sec.23-ssec.3-para1.c" target.guid="_869643be-6363-4fb0-a044-b68e0ec1f2f7" check="valid">(c)</intref>;</txt></block></li><li id="sec.23-ssec.3-para1.f" guid="_bfa7ecdc-75d1-4202-80b2-8976a4e6dc28" provision.type="other"><no>(f)</no><block><txt break.before="0">the foreign personal protection measure places the child in a foster family or institutional care in Queensland and the competent authority did not obtain the department’s consent to the placement before taking the measure.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.4" guid="_530d6f65-9709-4f43-ab1c-1df95fcc010d" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A competent authority is taken to have acted contrary to the fundamental principles of procedure under Queensland law if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.4-para1.a" guid="_0c6188e1-c17a-475c-957f-c07cc930f62b" provision.type="other"><no>(a)</no><block><txt break.before="0">the competent authority did not give the child, or a person with parental responsibility for the child, an opportunity to be heard before taking the foreign personal protection measure; and</txt></block></li><li id="sec.23-ssec.4-para1.b" guid="_9c372cb3-7879-4770-8492-509fc114b740" provision.type="other"><no>(b)</no><block><txt break.before="0">the competent authority did not take the foreign personal protection measure as a matter of urgency.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.5" guid="_22b3812d-8afc-4f42-b1f1-3e33d1d816c0" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A person who is interested in the following may apply to the court to be joined as a party to the proceeding—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.5-para1.a" guid="_befd2cce-fa5d-4bf6-98fc-9ecd0108bd14" provision.type="other"><no>(a)</no><block><txt break.before="0">an application to a Queensland court made by the litigation director following a referral by the department under <intref refid="sec.23-ssec.2" target.guid="_490786eb-99e5-48c6-8ee0-b720dc8357ef" check="valid">subsection&#160;(2)</intref><intref refid="sec.23-ssec.2-para1.d" target.guid="_072b2ed4-45d2-4a6e-a86c-b3a99ea64b7a" check="valid">(d)</intref>;</txt></block></li><li id="sec.23-ssec.5-para1.b" guid="_43b99e63-c434-4522-a4cc-c1883605231a" provision.type="other"><no>(b)</no><block><txt break.before="0">an application to a Queensland court made by the department under <intref refid="sec.23-ssec.2" target.guid="_490786eb-99e5-48c6-8ee0-b720dc8357ef" check="valid">subsection&#160;(2)</intref><intref refid="sec.23-ssec.2-para1.e" target.guid="_0e664301-9911-4ffa-b8b9-72ab82a97dde" check="valid">(e)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.6" guid="_cb3eb9d8-f822-46c0-8ac1-fd6ae2264e4d" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">If—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.6-para1.a" guid="_1dfc7587-abb2-4a0a-9d67-1d5747558a1e" provision.type="other"><no>(a)</no><block><txt break.before="0">under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(2)</intref><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(a)</intref> the department gives a foreign personal protection measure relating to a child to a registrar of a Queensland court; and</txt></block></li><li id="sec.23-ssec.6-para1.b" guid="_6b8b7e75-3aa6-471b-a50e-7591b9b27baf" provision.type="other"><no>(b)</no><block><txt break.before="0">the measure authorises the performance of a medical procedure or treatment on the child that is a procedure or treatment for which a parent does not, under Queensland law, have authority to consent;</txt></block></li></list></block><block><txt break.before="1">the measure must be accompanied by a Family Court declaration that recognition of the measure is not contrary to public policy having regard to the child’s best interests.</txt></block></subclause><subclause id="sec.23-ssec.7" guid="_5f5a4d68-264b-447b-b1e2-9c59dc15a0bd" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">In this section—</txt><deflist><definition provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the department is given either of the following documents, together with a request for the department to take an action under the Child Protection Convention—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.1-para1.a" guid="_fcae723c-88e4-44d3-aa92-aea1d04c10b8" provision.type="other"><no>(a)</no><block><txt break.before="0">a document that is a foreign property protection measure relating to a child;</txt></block></li><li id="sec.24-ssec.1-para1.b" child, states details of a foreign property protection measure relating to a child.</txt></block></li></list></block></subclause><subclause id="sec.24-ssec.2" guid="_f55c3319-338d-4747-9914-e23f36270ee0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The department must consider whether the foreign property protection measure includes a provision directed to protecting the person of the child.</txt></block></subclause><subclause id="sec.24-ssec.3" guid="_a3924d62-a80a-44c8-9790-5d119b568599" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the department considers the foreign property protection measure includes a provision directed to protecting the person of the child, the department must deal with the measure under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;23</intref> as if it were a foreign personal protection measure.</txt></block></subclause><subclause id="sec.24-ssec.4" guid="_a2affd2f-8bdc-4748-b59c-b71c916f2c22" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the department does not consider the foreign property protection measure includes a provision directed to protecting the person of the child, the department must give the measure to a registrar of a Queensland court for recognition of the measure by registration under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;25</intref>.</txt></block></subclause></clause><clause id="sec.25" guid="_7ff1b6f5-23d4-4db8-ba4c-e348f27fe2d9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>25</no><heading id="sec.25-he" guid="_562f9d80-3ef1-4e9f-84d1-1e69be14437a">Recognition of foreign measures in Queensland courts</heading><subclause id="sec.25-ssec.1" guid="_2f5e4a69-f3a6-4f7a-96cd-e10956e69805" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A registrar of a Queensland court must register a foreign measure given to the registrar by the department under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;23</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">24</intref>.</txt></block></subclause><subclause id="sec.25-ssec.2" guid="_d3250ab7-479a-474c-ab20-75adbd095b6d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A foreign measure registered under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(1)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-ssec.2-para1.a" guid="_1c0ea6a6-88eb-4013-b66a-6635a126b971" provision.type="other"><no>(a)</no><block><txt break.before="0">has the same force and effect as a Queensland personal protection measure or a Queensland property protection measure (as appropriate); and</txt></block></li><li id="sec.25-ssec.2-para1.b" guid="_0b6c9327-c3eb-4573-ae49-e81af545eee0" provision.type="other"><no>(b)</no><block><txt break.before="0">prevails over an earlier measure in force in Queensland to the extent the foreign measure is inconsistent with the earlier measure.</txt></block></li></list></block></subclause><subclause id="sec.25-ssec.3" guid="_993b382b-e516-4c75-ad0b-8fa0716cb847" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">An interested person may take legal proceedings in a Queensland court to enforce a foreign measure registered under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.25-ssec.4" guid="_89c679f4-6d81-4f4f-a384-c740185d648b" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0"><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">(3)</intref> are subject to the cancellation of the registration of the foreign measure under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;26</intref>.</txt></block></subclause></clause><clause id="sec.26" guid="_ce98d854-d870-498e-bfb8-9e49e337201e">Cancellation of registered foreign measure and related matters</heading><subclause id="sec.26-ssec.1" guid="_56335279-0289-49c8-9109-c8b1c3d58b9f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An interested person may apply to a Queensland court to cancel the registration under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;25</intref> of a foreign measure relating to a child.</txt></block></subclause><subclause id="sec.26-ssec.2" guid="_3634c019-e144-4ffd-82de-72202fff873f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Queensland court may cancel the registration of the foreign measure if any of the following applies—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.2-para1.a" guid="_f8ddf729-7f79-4777-8789-b1e7e3f39f06" provision.type="other"><no>(a)</no><block><txt break.before="0">for a foreign measure that is a foreign personal protection measure—the Queensland court may take a Queensland personal protection measure relating to the child under <intref refid="pt.2" target.guid="_eb53be97-b92c-47a1-aa0f-f269be92bd66" check="valid">part&#160;2</intref>;</txt></block></li><li id="sec.26-ssec.2-para1.b" guid="_9f0a4192-51c3-48f1-b512-d5347f199f94" provision.type="other"><no>(b)</no><block><txt break.before="0">for a foreign measure that is a foreign property protection measure—the Queensland court may take a Queensland property protection measure relating to the child under <intref refid="pt.3" target.guid="_fd52517e-8ef1-47df-82a2-15afc7429d5f" check="valid">part&#160;3</intref>;</txt></block></li><li id="sec.26-ssec.2-para1.c" guid="_0f231523-420c-4da5-a037-ef552651b4c7" provision.type="other"><no>(c)</no><block><txt break.before="0">the relevant competent authority responsible for taking the foreign measure did not have jurisdiction, under the Child Protection Convention, for taking the measure;</txt></block></li><li id="sec.26-ssec.2-para1.d" guid="_7e4fd523-8779-4a7d-ad76-aefe0b176223" provision.type="other"><no>(d)</no><block><txt break.before="0">in taking the measure, the relevant competent authority is taken to have acted contrary to the fundamental principles of procedure under Queensland law as mentioned in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(3)</intref>;</txt></block></li><li id="sec.26-ssec.2-para1.e" guid="_4173a796-145f-4b3e-a5c1-6bea097b528a" provision.type="other"><no>(e)</no><block><txt break.before="0">recognition or enforcement of the measure in Queensland is contrary to public policy taking into account the child’s best interests;</txt></block></li><li id="sec.26-ssec.2-para1.f" guid="_a5231e0a-b316-4fc5-ac0c-77d76c30805e" provision.type="other"><no>(f)</no><block><txt break.before="0">for a foreign measure that is a foreign property protection measure—there are no appropriate means of enforcing the measure under Queensland law.</txt></block></li></list></block></subclause><subclause id="sec.26-ssec.3" guid="_54d47c45-84ba-48b8-9c8a-5980881d0c64" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The relevant competent authority is taken to have acted contrary to the fundamental principles of procedure under Queensland law if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.3-para1.a" guid="_a549a0ec-64e2-4fe5-ae43-50039a31924a" provision.type="other"><no>(a)</no><block><txt break.before="0">the competent authority did not give the child, or a person with parental responsibility for the child, an opportunity to be heard before taking the foreign measure; and</txt></block></li><li id="sec.26-ssec.3-para1.b" guid="_694113c2-44c9-40c1-be73-43664858dc64" provision.type="other"><no>(b)</no><block><txt break.before="0">the competent authority did not take the foreign measure as a matter of urgency.</txt></block></li></list></block></subclause></clause><clause id="sec.27" guid="_d2d38a8c-d121-4a34-995b-ec5965049973" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>27</no><heading id="sec.27-he" guid="_795f2547-61a7-42d8-8412-f534d5ea67f6">Matters relevant for Queensland court in proceeding under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">s&#160;23</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">26</intref></heading><subclause id="sec.27-ssec.1" guid="_96c02f60-44e8-442c-bdfd-81f41599e16e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a proceeding in a Queensland court under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;23</intref> or <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">26</intref> about a foreign measure.</txt></block></subclause><subclause id="sec.27-ssec.2" guid="_378fb7f0-2dcd-4fef-b3c4-1248a24a4c9c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Queensland court is bound by findings of fact on which the competent authority of the Convention country based its jurisdiction.</txt></block></subclause><subclause id="sec.27-ssec.3" guid="_2c538cb9-f571-42d9-8ec6-20294133c7d7" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Subject to <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">section&#160;26</intref>, the Queensland court must not review the merits of the measure.</txt></block></subclause><subclause id="sec.27-ssec.4" guid="_7153c8ef-d097-4c1a-865b-c66b3e18acf7" affected.by.uncommenced="0" guid="_baf16e12-f548-4c36-b2d6-c7bbb92b46e7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">After consulting with the central authority or a competent authority of a Convention country, the department may give a Queensland personal protection measure relating to a child to the central authority of the Convention country for recognition and enforcement of the Queensland personal protection measure in the Convention country.</txt></block></subclause><subclause id="sec.28-ssec.2" guid="_57cd1278-306f-4d9f-b0c4-04e1542abc6d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The department may give a Queensland property protection measure relating to a child to the central guid="_939159d5-cdd4-4a3c-a508-1ea89a51fa40" provision.type="other"><no>(b)</no><block><txt break.before="0">to help in the implementation of Queensland measures, foreign measures and measures of non-Convention countries directed to protecting children or their property; and</txt></block></li><li id="sec.30-ssec.1-para1.c" guid="_6c7836f0-5011-4a01-81d7-ab5df7180bf8" provision.type="other"><no>(c)</no><block><txt break.before="0">to consider taking, applying for or referring to the litigation director to consider applying for, a Queensland measure relating to a child—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.30-ssec.1-para1.c-para2.i" guid="_91527763-429a-408c-8f2d-6e725bab5ec2" provision.type="other"><no>(i)</no><block><txt break.before="0">at the request of a competent authority of another country if the measure is a Queensland personal protection measure; or</txt></block></li><li id="sec.30-ssec.1-para1.c-para2.ii" guid="_b6a6ba6b-7183-46c4-be13-1d9052a77272" provision.type="other"><no>(ii)</no><block><txt break.before="0">at the request, or at the invitation, of a competent authority of another country if the measure is a Queensland property protection measure; and</txt></block></li></list></block></li><li id="sec.30-ssec.1-para1.d" guid="_0646eaac-c0ba-4b6b-8753-1fa67a52d025" provision.type="other"><no>(d)</no><block><txt break.before="0">to exchange information, subject to appropriate confidentiality provisions; and</txt></block></li><li id="sec.30-ssec.1-para1.e" guid="_b7120493-beba-48c7-ada6-18b394c471cc" provision.type="other"><no>(e)</no><block><txt break.before="0">to provide information on laws and services; and</txt></block></li><li id="sec.30-ssec.1-para1.f" guid="_48e57b57-742d-4d43-a0a0-3fab6bb5b746" provision.type="other"><no>(f)</no><block><txt break.before="0">to help in locating children; and</txt></block></li><li id="sec.30-ssec.1-para1.g" guid="_ba923b9c-d257-4496-8e14-1b0eb813806c" provision.type="other"><no>(g)</no><block><txt break.before="0">to provide reports on the situation of particular children; and</txt></block></li><li id="sec.30-ssec.1-para1.h" guid="_fa64cae9-208c-459d-852d-53f9e5ee7fa7" provision.type="other"><no>(h)</no><block><txt break.before="0">to apply to Queensland courts for orders in response to requests from competent authorities in Convention countries—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.30-ssec.1-para1.h-para2.i" guid="_7894de62-4bd6-4990-9af4-5bfc7db77e3f" provision.type="other"><no>(i)</no><block><txt break.before="0">to transfer or receive jurisdiction; or</txt></block></li><li id="sec.30-ssec.1-para1.h-para2.ii" guid="_bd1d3b02-ad8e-43ed-a32a-90c0e2361b1b" provision.type="other"><no>(ii)</no><block><txt break.before="0">to take measures directed to protecting the person of Act 1999</name></legref> may be made by the litigation director if a referral is made to the director under the <legref jurisd="QLD" type="act" target.doc.id="act-2016-023" guid="_e58c9371-50b3-4f47-9ff9-acc1eebdae0d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland authority must obtain the consent of a competent authority of a Convention country before placing a child in a foster family, or in institutional care, in the Convention country.</txt></block></subclause><subclause id="sec.31-ssec.2" guid="_dec7dc42-e63e-4f6b-8d13-ef833624c6cd" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland authority must inform a competent authority of another country about any information the Queensland authority may have about any serious danger to a child—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.1-para1.a" guid="_fcfaac54-05bc-48aa-9fc4-fc51a9364af1" provision.type="other"><no>(a)</no><block><txt break.before="0">whose residence has moved from Queensland to the other country; or</txt></block></li><li id="sec.32-ssec.1-para1.b" guid="_ad4eb38a-00af-4aac-a65d-830af3721fc3" provision.type="other"><no>(b)</no><block><txt break.before="0">who is present in the other country.</txt></block></li></list></block></subclause><subclause id="sec.32-ssec.2" guid="_bac52698-5be8-4767-b4c8-5a3791461d27" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Subsection&#160;(1)</intref> has effect despite any obligation of confidentiality imposed on the Queensland authority or a person by a Queensland law or anything else (including a contract or professional ethics).</txt></block></subclause><subclause id="sec.32-ssec.3" guid="_a75b3929-8990-49d0-84fe-5273ff156754" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person is not liable in civil or criminal proceedings, and is not to be considered to have breached any professional ethics, in respect of the provision of information under <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.32-ssec.4" guid="_876a2f3f-e98f-4948-8d17-979e33e9286f" affected.by.uncommenced="0" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">subsection&#160;(1)</intref> is not admissible in any—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.4-para1.a" guid="_ad7f3931-9d7c-438e-82e0-cab6a209b4fa" provision.type="other"><no>(a)</no><block><txt break.before="0">court (whether or not exercising jurisdiction under this Act); or</txt></block></li><li id="sec.32-ssec.4-para1.b" guid="_9b905b8c-0aa7-4ac1-9184-c7a40f675f40" provision.type="other"><no>(b)</no><block><txt break.before="0">tribunal or other body concerned with professional ethics;</txt></block></li></list></block><block><txt break.before="1">except where that evidence is given by the person who provided the information.</txt></block></subclause><subclause id="sec.32-ssec.5-def.Queenslandauthority_" guid="_bf7c157e-17f6-4a35-ba1d-0763d037721b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.32-ssec.5-def.Queenslandauthority" guid="_f803cf14-6cf4-47d2-9ded-c1fd63ed7b39" type="definition">Queensland authority</defterm> includes a person carrying out duties, performing functions or exercising powers as—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.5-def.Queenslandauthority-para1.a" guid="_29d29140-7655-41cf-9c45-895585558aac" provision.type="other"><no>(a)</no><block><txt break.before="0">a member of the court personnel; or</txt></block></li><li id="sec.32-ssec.5-def.Queenslandauthority-para1.b" guid="_4e87f36f-a6fd-41c3-bd00-9f8791d5210d" provision.type="other"><no>(b)</no><block><txt break.before="0">a public service employee of the department or public trustee.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.33" guid="_e185a427-f565-4fa9-b37b-8537af60283a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>33</no><heading id="sec.33-he" guid="_5bcce8d3-396d-4e1d-95c9-f2577519f8ee">Proceedings etc. for contact</heading><subclause id="sec.33-ssec.1" guid="_367685c4-ba43-4713-8309-8ea962bc99d5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Queensland court hearing proceedings concerning contact with a child must admit into evidence and consider the findings (if any) of a competent authority of a Convention country on the suitability of a parent to have contact with the child.</txt></block></subclause><subclause id="sec.33-ssec.2" guid="_c0871198-3ece-4fb9-a93d-759e6dcd9a55" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A Queensland court may adjourn the proceedings concerning contact with a child pending the outcome of a request by a parent of the child to a competent authority of a Convention country for a finding on the suitability of the parent to have contact with the child.</txt></block></subclause><subclause id="sec.33-ssec.3" guid="_e24f7e96-4fc3-4f92-979b-0ca53e257c0d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">On the application of a parent who is an Australian resident seeking to obtain or keep contact with a child, a Queensland court may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.33-ssec.3-para1.a" guid="_82e5f3a5-94d8-4a81-afd5-4c2b72492e13" provision.type="other"><no>(a)</no><block><txt break.before="0">admit evidence; and</txt></block></li><li id="sec.33-ssec.3-para1.b" guid="_e3234695-59b2-468a-9020-aa30413635b7" provision.type="other"><no>(b)</no><block><txt break.before="0">make a finding on the suitability of that parent to have contact with the child; and</txt></block></li><li id="sec.33-ssec.3-para1.c" guid="_be5541c8-71b0-4e02-8d09-c66e0e85899d" provision.type="other"><no>(c)</no><block><txt break.before="0">specify conditions on which the contact is to be given.</txt></block></li></list></block></subclause><subclause id="sec.33-ssec.4" guid="_cfdf675a-6bac-4667-a55d-6552176da1fe" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In considering a matter concerning contact with a child, the department—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.33-ssec.4-para1.a" guid="_d7e4aefe-1780-4fe5-ade2-0baa1fc978fa" provision.type="other"><no>(a)</no><block><txt break.before="0">must consider evidence and the findings (if any) of a competent authority of a Convention country on the suitability of a parent to have contact with the child; and</txt></block></li><li id="sec.33-ssec.4-para1.b" guid="_2351501e-1b44-40ff-b696-a013b127a7ad" provision.type="other"><no>(b)</no><block><txt break.before="0">may postpone considering the matter pending the outcome of a request by a parent to a competent authority of a Convention country for a finding on the suitability of the parent to have contact with the child.</txt></block></li></list></block></subclause></clause><clause id="sec.34" guid="_4fa97abd-55fe-4fbc-83b1-31e0b947d5d0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>34</no><heading id="sec.34-he" guid="_8d51df39-d0f5-4843-b709-ce002ee4cde5">Giving information to central authorities and competent authorities in Convention countries</heading><subclause id="sec.34-ssec.1" guid="_fcb62e82-0f1a-4d6e-a753-dc49ff914750" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.34-ssec.1-para1.a" guid="_26fad659-d1a1-4f81-9902-66d094970cfd" provision.type="other"><no>(a)</no><block><txt break.before="0">a court; and</txt></block></li><li id="sec.34-ssec.1-para1.b" guid="_d3f2fdf4-36f3-4764-b1d3-b97fa733a2ad" provision.type="other"><no>(b)</no><block><txt break.before="0">the Commonwealth central authority; and</txt></block></li><li id="sec.34-ssec.1-para1.c" guid="_c29b1e71-e67c-4b32-a830-052e8690ecbd" provision.type="other"><no>(c)</no><block><txt break.before="0">central authorities of Australia appointed as mentioned in <intref refid="sch.4-def.Queenslandauthority-para1.b" target.guid="_90c2424d-bfc8-4810-be8e-51f701a020f8" check="valid">Article&#160;29</intref>, paragraph 2, of the Child Protection Convention; and</txt></block></li><li id="sec.34-ssec.1-para1.d" guid="_5e9d14d0-2d8a-44ba-a115-2c0203fc911a" provision.type="other"><no>(d)</no><block><txt break.before="0">other competent authorities of Australia.</txt></block></li></list></block></subclause><subclause id="sec.34-ssec.2" guid="_756ee2ef-9d06-4ee9-b4db-e34b28cba30b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If it would be consistent with this Act or the Child Protection Convention to do so, a Queensland authority may give information to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.34-ssec.2-para1.a" guid="_b27950c3-ddf0-41c3-bc59-384697d3b031" provision.type="other"><no>(a)</no><block><txt break.before="0">a court or an authority of Australia to which this section applies; or</txt></block></li><li id="sec.34-ssec.2-para1.b" guid="_a1543ef1-81e8-438f-a00d-d25e42399016" provision.type="other"><no>(b)</no><block><txt break.before="0">a central authority or other competent authority of a Convention provision.type="other"><no>35</no><heading id="sec.35-he" guid="_92354822-731a-45a8-a2ed-85baa6b755d1">Helping person in relation to Queensland measure</heading><subclause id="sec.35-ssec.1" guid="_3aebd0be-f928-4be1-95c2-122ad7223990" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person who is to exercise parental responsibilities under a Queensland measure may apply to a Queensland authority for information about the particular way in which the person may exercise the person’s responsibilities under the Queensland measure.</txt></block></subclause><subclause id="sec.35-ssec.2" guid="_2ded113e-c89d-4024-a07d-2cec8370d868" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Queensland authority may, by written notice, give information to the person about the powers conferred on the person as a parent under the Queensland measure.</txt></block></subclause></clause><clause id="sec.36" guid="_4bf723aa-1626-4379-9ea1-58751517b9e1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>36</no><heading id="sec.36-he" guid="_bdd995f0-d270-4a86-9e50-ff58ebaa87fa">Helping person in relation to foreign measure</heading><subclause id="sec.36-ssec.1" guid="_37f7d6e0-45eb-4c7a-87ed-7957446bf2f1" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An interested person who wants to ask a competent authority of another country to vary or cancel a foreign measure may apply to the department for help in sending the request to the authority.</txt></block></subclause><subclause id="sec.36-ssec.2" guid="_2deaa747-eadb-4ff5-87c3-a729c413a192" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The department may help the interested person in relation to sending the
