id="sec.3-def.examinationofwitnesses" guid="_54d928a8-fc70-4358-909d-345f9320dd14" type="definition">examination of witnesses</defterm> means an examination of witnesses in relation to an indictable offence, being a sexual offence, commenced after the commencement of this Act and taken pursuant to the <legref jurisd="QLD" type="act" target.doc.id="act-1886-017" target.version.series="506b5b47-5bcd-438c-b6a7-27cb65143289" check="valid"><name emphasis="yes">Justices Act 1886</name></legref>.</txt></definition><definition id="sec.3-def.executiveofficer_" guid="_aaf327c9-655b-4bf0-80f3-3eafa0ead1d8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.executiveofficer" guid="_4f8b8c1d-24a9-4c07-8175-80f79ef48b48" type="definition">executive officer</defterm>, of a corporation, means a person who is concerned with, or takes part in, the corporation’s management, whether or not the person is a director or the break.before="1">The following rules shall apply in relation to any examination of witnesses or trial in relation to a sexual offence whether or not the examination or trial relates also to a charge of an offence other than a sexual offence against the same or any other defendant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-para1.1" guid="_c0bf7781-a461-4c13-a252-43b73eade589" provision.type="other"><no>1</no><block><txt break.before="0">The court shall not receive evidence of and shall disallow any question as to the general reputation of the complainant with respect to chastity.</txt></block></li><li id="sec.4-para1.2" guid="_d259e222-36f2-4fc0-88a2-72e3fbfdb996" provision.type="other"><no>2</no><block><txt break.before="0">Without leave of the court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-para1.2-para2.a" guid="_a411a868-7f64-45fb-961a-bf81a821841a" provision.type="other"><no>(a)</no><block><txt break.before="0">cross-examination of the complainant shall not be permitted as to the sexual activities of the complainant with any person; and</txt></block></li><li id="sec.4-para1.2-para2.b" guid="_4d0b2b18-5915-4dbc-bc77-059a9ec734fc" provision.type="other"><no>(b)</no><block><txt break.before="0">evidence shall not be received as to the sexual activities of the complainant with any person.</txt></block></li></list></block></li><li id="sec.4-para1.3" guid="_f8ecc926-18ca-436c-ad5d-8cb3d5590548" provision.type="other"><no>3</no><block><txt break.before="0">The court shall not grant leave under <intref refid="sec.2" check="invalid">rule&#160;2</intref> unless it is satisfied that the evidence sought to be elicited or led has substantial relevance to the facts in issue or is proper matter for cross-examination as to credit.</txt></block></li><li id="sec.4-para1.4" guid="_80ffe1a7-24a6-4609-acf6-6f2170d2a608" provision.type="other"><no>4</no><block><txt break.before="0">Evidence relating to or tending to establish the fact that the complainant has engaged in sexual activity with a person or persons must not be regarded as having substantial relevance to the facts in issue only because of any inference it may raise about general disposition.</txt><note id="sec.4-para1.4-note" guid="_791c8a38-eb65-4c5b-86d8-7704c89fa494" type="example"><heading id="sec.4-para1.4-note-he" guid="_b8b9d1b7-de1f-41ea-a6d8-8571fc5aaa01">Example of inference about general disposition—</heading><block><txt break.before="1">an inference that the complainant, because of having engaged in conduct of a sexual nature, is more likely to have consented to the conduct involved in the offence</txt></block></note></block></li><li id="sec.4-para1" guid="_5b825149-1fee-4107-a6cc-54f828cae362" provision.type="other"><block><txt break.before="1">Without prejudice to the substantial relevance of other evidence, evidence of an act or event that is substantially contemporaneous with any offence with which a defendant is charged in an examination of witnesses or a trial or that is part of a sequence of acts or events that explains the circumstances in which such an offence was committed shall be regarded as having substantial relevance to the facts in issue.</txt></block></li><li id="sec.4-para1.5" guid="_148b76f2-a719-450b-be79-c25ad5b997c4" provision.type="other"><no>5</no><block><txt break.before="0">Evidence relating to or tending to establish the fact that the complainant has engaged in sexual activity with a person or persons is not proper matter for cross-examination as to credit unless, because of special circumstances, the court considers the evidence would be likely to materially impair confidence in the reliability of the complainant’s evidence.</txt></block></li><li id="sec.4-para1-oc.2" guid="_0fa0186f-68e4-4833-a2ea-38706807f3d1" provision.type="other"><block><txt break.before="1">The purpose of this rule is to ensure that a complainant is not regarded as less worthy of belief as a witness only because the complainant has engaged in sexual activity.</txt></block></li><li id="sec.4-para1.6" guid="_7f7e7dbc-a662-49a0-b282-6b506f8ee6ad" provision.type="other"><no>6</no><block><txt break.before="0">An application for leave under <intref refid="sec.2" check="invalid">rule&#160;2</intref> shall be made in the absence of the jury (if any) and, if the defendant so requests, in the absence of the complainant and shall be determined after the court has allowed such submissions or evidence (sworn or unsworn) as the court considers necessary for the determination of the application.</txt></block></li></list></block><historynote><txt break.before="1"><b>s&#160;4</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-1989-017" applies in relation to an examination of witnesses, or a trial, in relation to a sexual offence.</txt></block></subclause><subclause id="sec.4A-ssec.2" guid="_560ab536-e1a5-4481-8dbd-b519db25fbfc" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Evidence of how and when any preliminary complaint was made by the complainant about the alleged commission of the offence by the defendant is admissible in evidence, regardless of when the preliminary complaint was made.</txt></block></subclause><subclause id="sec.4A-ssec.3" target.guid="_560ab536-e1a5-4481-8dbd-b519db25fbfc">subsection&#160;(2)</intref> derogates from the power of the court in a criminal proceeding to exclude evidence if the court is satisfied it would be unfair to the defendant to admit the evidence.</txt></block></subclause><subclause id="sec.4A-ssec.4" guid="_d4de5c22-272b-4e8f-a913-65c49fd4cbf3" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If a defendant is tried by a jury, the judge must not warn or suggest in any way to the jury that the law regards the complainant’s evidence to be more reliable or less reliable only because of the length of time before the complainant made a preliminary or other complaint.</txt></block></subclause><subclause id="sec.4A-ssec.5" guid="_b36a056b-cea4-4661-8f99-c89217ada271" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Subject to <intref refid="sec.4A-ssec.4" check="valid" target.guid="_d4de5c22-272b-4e8f-a913-65c49fd4cbf3">subsection&#160;(4)</intref>, the judge may make any comment to a jury on the complainant’s evidence that it is appropriate to make in the interests of justice.</txt></block></subclause><subclause id="sec.4A-ssec.6" guid="_1f79883d-d91d-4256-b870-7fae5a4a09ac" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.4A-ssec.6-def.complaint_" guid="_a9376542-ee3a-4894-ba61-d8676c26d336" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4A-ssec.6-def.complaint" guid="_a5509900-f904-4dc8-8931-2b246434a614" type="definition">complaint</defterm> includes a disclosure.</txt></definition><definition id="sec.4A-ssec.6-def.preliminarycomplaint_" guid="_419bb79b-7ab6-47c6-8f7f-1b448f68e720" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4A-ssec.6-def.preliminarycomplaint" guid="_f7407dc5-86d3-4867-9a6e-4faf517d19d1" type="definition">preliminary complaint</defterm> means any complaint other than—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4A-ssec.6-def.preliminarycomplaint-para1.a" guid="_4044ff28-83b5-44c1-8682-9606a36aa2d5" provision.type="other"><no>(a)</no><block><txt break.before="0">the complainant’s first formal witness statement to a police officer given in, or in anticipation of, a criminal proceeding in relation to the alleged offence; or</txt></block></li><li id="sec.4A-ssec.6-def.preliminarycomplaint-para1.b" guid="_db03b9dd-4a88-4187-abad-f9d2fd4196db" provision.type="other"><no>(b)</no><block><txt break.before="0">a complaint made after the complaint mentioned in <intref refid="sec.4A-ssec.6-def.preliminarycomplaint-para1.a" check="valid" target.guid="_4044ff28-83b5-44c1-8682-9606a36aa2d5">paragraph&#160;(a)</intref>.</txt></block></li></list><note id="sec.4A-ssec.6-def.preliminarycomplaint-note" guid="_66a2fd87-92d5-44df-9c29-5307944c035a" type="example"><heading id="sec.4A-ssec.6-def.preliminarycomplaint-note-he" guid="_d62d267a-a821-4168-86e8-f210bae67a5d">Example—</heading><block><txt break.before="1">Soon after the alleged commission of a sexual offence, the complainant discloses the alleged commission of the offence to a parent (<defterm id="sec.4A-ssec.6-def.preliminarycomplaint-def.complaint1" guid="_cf59e3c3-a536-49a4-a2ff-21fd1b6c020b" type="definition">complaint 1</defterm>). Many years later, the complainant makes a complaint to a secondary school teacher and a school guidance officer (<defterm id="sec.4A-ssec.6-def.preliminarycomplaint-def.complaints2and3" guid="_52a8a484-6efc-4b02-a0a1-0e3ae7f9faef" type="definition">complaints 2 and 3</defterm>). The complainant visits the local police station and makes a complaint to the police officer at the front desk (<defterm id="sec.4A-ssec.6-def.preliminarycomplaint-def.complaint4" guid="_4aa1e2fb-9fe2-4eb1-9126-1e55410e868f" type="definition">complaint 4</defterm>). The complainant subsequently attends an appointment with a police officer and gives a formal witness statement to the police officer in anticipation of a criminal proceeding in relation to the alleged offence (<defterm id="sec.4A-ssec.6-def.preliminarycomplaint-def.complaint5" guid="_06360632-36ab-4a01-b0c4-589dfb9ba98a" type="definition">complaint 5</defterm>). After a criminal proceeding is begun, the complainant gives a further formal witness statement (<defterm id="sec.4A-ssec.6-def.preliminarycomplaint-def.complaint6" guid="_ff0b2173-2305-45fe-ae7c-8905bde8f17c" type="definition">complaint 6</defterm>).</txt></block><block><txt break.before="1">Each of complaints 1 to 4 is a preliminary complaint. Complaints 5 and 6 are not preliminary complaints.</txt></block></note></definition></deflist></block></subclause><historynote><txt break.before="1"><b>s&#160;4A</b> ins <legref jurisd="QLD" complainant is giving evidence in any examination of witnesses or trial, the court shall cause to be excluded from the room in which it is then sitting all persons other than the following—</txt><list break.before="0">where the complainant is under or apparently under the age of 17 years—the parent or guardian of the child unless, in the court’s opinion, the presence of that person would not be in the child’s interests;</txt></block></li><li id="sec.5-ssec.1-para1.h" guid="_0573c099-f028-4a05-8882-2c6478eb62f4" provision.type="other"><no>(h)</no><block><txt break.before="0">any person who makes application to the court to be present and whose presence, in the court’s opinion—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.h-para2.i" target.doc.id="act-1986-020" target.version.series="591f88fd-8a19-4573-8e3f-8c58be43de4d" check="valid"><name emphasis="yes">Criminal Law (Rehabilitation of Offenders) Act 1986</name></legref>, <legref jurisd="QLD" type="act" refid="sec.9A" target.doc.id="act-1986-020" target.version.series="591f88fd-8a19-4573-8e3f-8c58be43de4d" check="valid" id="sec.8-ssec.2" guid="_1a3a4ea9-44ce-46ca-a326-9072bd3facf0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.7" check="valid" target.guid="_51ad677e-d480-4b10-9074-16e310525236">Section&#160;7</intref> does not apply to a report made concerning an examination of witnesses that reveals any particular referred to in that section of a defendant therein who as a result of the examination is committed for trial or sentence upon a charge of a sexual offence if the report is made after the committal order is made and does not reveal any such particular of any other defendant therein who is not so committed.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_9ea04cdc-9175-4f11-becc-3ad233934241" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.8-ssec.3-def.relevanteducationentity_" guid="_da6b81ad-44b3-4c23-9d6c-f7d730159378" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-ssec.3-def.relevanteducationentity" guid="_a5e4bb4c-51e5-47e6-a14b-91908d22596a" type="definition">relevant education entity</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-def.relevanteducationentity-para1.a" guid="_eb7afd16-849d-4190-941c-ac4106b1f962" provision.type="other"><no>(a)</no><block><txt break.before="0">the department in which the <legref jurisd="QLD" type="act" target.doc.id="act-2006-039" target.version.series="1e1a0ed5-f492-44f9-ba49-f9194ef5fefb" check="valid"><name emphasis="yes">Education (General Provisions) Act 2006</name></legref> is administered; or</txt></block></li><li id="sec.8-ssec.3-def.relevanteducationentity-para1.b" guid="_9b6acd52-0ccb-4495-aae4-1d3fedeb75ac" provision.type="other"><no>(b)</no><block><txt break.before="0">TAFE Queensland established under the <legref jurisd="QLD" type="act" target.doc.id="act-2013-027" target.version.series="a6a04c7c-e740-462a-9d65-8e376723cfe8" check="valid"><name emphasis="yes">TAFE Queensland Act provision.type="other"><no>9</no><heading id="sec.9-he" guid="_7f6bd179-a2e3-44f8-a834-dfe105d813e4">Act affords additional protection</heading><block><txt break.before="1"><intref refid="sec.6" check="valid" target.guid="_79ae6c3b-de46-4486-9fe0-4d53491aedcc">Sections&#160;6</intref> and <intref refid="sec.7" check="valid" target.guid="_51ad677e-d480-4b10-9074-16e310525236">7</intref> shall be construed to be in addition to and not to prejudice any other provision or rule of law directed towards the protection of witnesses or other persons in an examination of witnesses or a trial from identification.</txt></block></clause><clause id="sec.10" guid="_855fd68e-dae1-439c-bda9-f361e330f083" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_59596edf-5735-464d-a5b9-d51767bfb239">When other publication of complainant’s or defendant’s identity is prohibited</heading><subclause id="sec.10-ssec.1" guid="_d800b094-5f92-4385-972b-20f5f5e33262" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person who, by a statement or representation made or published otherwise than in a report concerning an examination of witnesses or a trial, reveals the name, address, school or place of employment, or any other particular that is likely to lead to the identification, of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_01da0c8a-e470-4c4b-abb7-fccb210a7aae" provision.type="other"><no>(a)</no><block><txt break.before="0">a complainant, at any time; or</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_f3ab125d-6fb2-4e40-b91d-b5caa5544f2a" provision.type="other"><no>(b)</no><block><txt break.before="0">a defendant charged with a prescribed sexual offence to which the statement or representation relates, before the defendant is committed for trial or sentence upon that charge;</txt></block></li></list></block><block><txt break.before="1">commits an offence except where the statement or representation is made or published for an authorised purpose referred to in <intref refid="sec.11" check="valid" target.guid="_f4231887-0692-4bf3-9135-1fc1393ebab3">section&#160;11</intref>.</txt></block><penalty id="sec.10-ssec.1-pen" guid="_6b066081-35e4-44a6-8048-3a69dd423774"><block><txt break.before="1">Maximum penalty—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-pen-para1.a" guid="_c9af0558-3ca3-469d-baba-4863498ffb38" provision.type="other"><no>(a)</no><block><txt break.before="0">for an individual—100 penalty units or 2 years imprisonment; or</txt></block></li><li id="sec.10-ssec.1-pen-para1.b" guid="_afcff650-dcf6-42ce-b017-bfd16427c2aa" provision.type="other"><no>(b)</no><block><txt break.before="0">for a corporation—1000 penalty units.</txt></block></li></list></block></penalty><note id="sec.10-ssec.1-note" guid="_538729f4-0383-4a8f-b567-c5e30173a7c4" type="example"><heading id="sec.10-ssec.1-note-he" guid="_78301ef9-8295-4116-988e-1395468f0de9">Note—</heading><block><txt break.before="1">If a corporation commits an offence against this provision, an executive officer of the corporation may be taken, under <intref refid="sec.12" check="valid" target.guid="_4f14e0e7-eb51-4dba-b9af-67285c8b9f66">section&#160;12</intref>, to have also committed the offence.</txt></block></note></subclause><subclause id="sec.10-ssec.2" guid="_76ece277-9fc3-4ada-a061-efe8b7ee533a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">It is a defence to a proceeding for an offence against <intref refid="sec.10-ssec.1" check="valid" target.guid="_d800b094-5f92-4385-972b-20f5f5e33262">subsection&#160;(1)</intref><intref refid="sec.10-ssec.1-para1.a" check="valid" target.guid="_01da0c8a-e470-4c4b-abb7-fccb210a7aae">(a)</intref> for a person to prove that, before the relevant statement or representation was made or published—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.a" guid="_aebb2d09-e518-4ff8-be80-38601655c978" provision.type="other"><no>(a)</no><block><txt break.before="0">the complainant authorised in writing the making or the publishing of the statement or representation; and</txt></block></li><li id="sec.10-ssec.2-para1.b" guid="_3866c27e-da90-4287-8e63-f866571ecdb8" provision.type="other"><no>(b)</no><block><txt break.before="0">when the complainant authorised the making or the publishing of the statement or representation, the complainant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.b-para2.i" guid="_9019c82f-22da-4fc0-a94b-bc01b74070da" provision.type="other"><no>(i)</no><block><txt break.before="0">was at least 18 years; and</txt></block></li><li id="sec.10-ssec.2-para1.b-para2.ii" guid="_ea39bba6-dcf1-4a3c-a260-cc1cde219735" provision.type="other"><no>(ii)</no><block><txt break.before="0">had capacity to give the authorisation.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.10-ssec.3" guid="_cc8db4f5-a12b-4706-af4d-68ca8d777f2c" affected.by.uncommenced="0" guid="_40fd8d80-14ed-41ed-a9a5-06033cf6cd70" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For the purposes of <intref refid="sec.10" check="valid" target.guid="_855fd68e-dae1-439c-bda9-f361e330f083">section&#160;10</intref> an authorised purpose is one authorised by or pursuant to this section.</txt></block></subclause><subclause id="sec.11-ssec.2" guid="_e7a1ffac-c267-481b-9a37-f7cd3e29a652" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The following purposes are authorised by this section—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.a" guid="_3c50b87c-b450-4e4b-a935-72ea95b80eaf" provision.type="other"><no>(a)</no><block><txt break.before="0">the purpose of an investigation into the complaint made by or on behalf of a complainant;</txt></block></li><li id="sec.11-ssec.2-para1.b" guid="_7ad72966-aff2-4565-a911-7e13ab25a780" provision.type="other"><no>(b)</no><block><txt break.before="0">the purpose of preparing for or conducting an examination of witnesses or a trial or a proceeding on appeal arising from a trial.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.3" guid="_0f03802e-6ce8-4deb-bdac-26d59cea654a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If, before the commencement of an examination of witnesses or a trial, a defendant makes application to a judge of the Supreme Court for a direction pursuant to this subsection and satisfies the judge that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.3-para1.a" guid="_8869b24e-19b3-4de8-8ae6-d2206d01d1b7" provision.type="other"><no>(a)</no><block><txt break.before="0">the direction is required for the purpose of inducing persons to come forward who are likely to be needed as witnesses at the examination or trial; and</txt></block></li><li id="sec.11-ssec.3-para1.b" guid="_57e5d097-4e85-4062-af08-87d98009cbd6" provision.type="other"><no>(b)</no><block><txt break.before="0">the conduct of the applicant’s defence at the examination or trial is likely to be substantially prejudiced if the direction is not given;</txt></block></li></list></block><block><txt break.before="1">the judge shall direct that <intref refid="sec.10" check="valid" target.guid="_855fd68e-dae1-439c-bda9-f361e330f083">section&#160;10</intref><intref refid="sec.10-ssec.1" check="valid" target.guid="_d800b094-5f92-4385-972b-20f5f5e33262">(1)</intref> shall not, by virtue of an accusation that alleges a sexual offence and is specified in the direction, apply in relation to a complainant or defendant specified in the direction.</txt></block></subclause><subclause id="sec.11-ssec.4" guid="_592a7677-e8d6-45ae-a5be-3ecd5484f2c8" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If a person who has been convicted of a sexual offence and has given notice of appeal to the Court of Appeal against the conviction or notice of an application for leave to so appeal applies to that court or to a judge of the Supreme Court for a direction pursuant to this subsection and satisfies the court or judge that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.4-para1.a" guid="_3f7a5860-62d5-460a-aee9-71c10be590d5" provision.type="other"><no>(a)</no><block><txt break.before="0">the direction is required for the purpose of obtaining evidence in support of the appeal; and</txt></block></li><li id="sec.11-ssec.4-para1.b" guid="_45f1ceea-852c-416a-9e78-dc5358a76ea2" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant is likely to suffer substantial injustice if the direction is not given;</txt></block></li></list></block><block><txt break.before="1">the court or judge shall direct that <intref refid="sec.10" check="valid" target.guid="_855fd68e-dae1-439c-bda9-f361e330f083">section&#160;10</intref><intref refid="sec.10-ssec.1" check="valid" target.guid="_d800b094-5f92-4385-972b-20f5f5e33262">(1)</intref> shall not, by virtue of an accusation that alleges a sexual offence and is specified in the direction, apply in relation to a complainant specified in the direction.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;11</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2008-055" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_27960938-7f6a-40b9-835f-9ab76d828cc4">Executive officer may be taken to have committed offence</heading><subclause id="sec.12-ssec.1" guid="_d85abfa9-5752-46ab-b312-dd7a9126d3da" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If a corporation commits an offence against a deemed executive liability provision, each executive officer of the corporation is taken to have also committed the offence if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.a" guid="_2d5dfd5e-d610-40c7-b8cb-0c0297ba35fb" provision.type="other"><no>(a)</no><block><txt break.before="0">the officer authorised or permitted the corporation’s conduct constituting the offence; or</txt></block></li><li id="sec.12-ssec.1-para1.b" guid="_809d892b-e65e-49c5-9b0d-7b417364f24f" provision.type="other"><no>(b)</no><block><txt break.before="0">the officer was, directly or indirectly, knowingly concerned in the corporation’s conduct.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.2" guid="_216c4fbf-976c-40f6-98e1-aed4b5470ffd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The executive officer may be proceeded against for, and convicted of, the offence against the deemed executive liability provision whether or not the corporation has been proceeded against for, or convicted of, the offence.</txt></block></subclause><subclause id="sec.12-ssec.3" guid="_7e23906d-f954-4724-8d09-231d575d08b1" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">This section does not affect either of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.3-para1.a" guid="_d2db64f9-aae9-4968-a39c-a937f74e9f2b" provision.type="other"><no>(a)</no><block><txt break.before="0">the liability of the corporation for the offence against the deemed executive liability provision;</txt></block></li><li id="sec.12-ssec.3-para1.b" guid="_ce36983c-5b6f-4820-80cf-b84f56c0fdfe" provision.type="other"><no>(b)</no><block><txt break.before="0">the liability, under the <legref jurisd="QLD" type="act" target.doc.id="act-1899-009" target.version.series="19dc3aee-7313-4ba8-a7f6-7abf0c19b425" check="valid"><name emphasis="no">Criminal Code</name></legref>, <legref jurisd="QLD" type="act" refid="ch.2" target.doc.id="act-1899-009" target.version.series="19dc3aee-7313-4ba8-a7f6-7abf0c19b425" check="invalid">chapter&#160;2</legref>, of any person, whether or not the person is an executive officer of the corporation, for the offence against the deemed executive liability provision.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.4" guid="_cf4eff53-42f3-48a2-a9d4-29d3cdcb17eb" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.12-ssec.4-def.deemedexecutiveliabilityprovision_"
