type="definition">Imperial enactment</defterm> includes any Act passed by the Imperial Parliament.</txt></definition></deflist></block></clause></part><part id="pt.2" guid="_640feccc-df0c-4057-98c7-0101e923914c" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_5aca655a-002b-4c8f-a3b1-fa8d663e7539">Imperial enactments preserved or terminated</heading><clause id="sec.5" guid="_eb5380ed-ee30-4d3c-974b-93ed342e9428" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_559dca9a-99aa-42f9-86bf-ce7b7fe67de4">Preserved Imperial enactments</heading><block><txt break.before="1">Each Imperial enactment specified in <intref refid="sch.1" target.guid="_2e886e6b-8c30-472e-803b-7ada48227977" check="valid">Schedule&#160;1</intref> shall, from the commencement of this Act, continue to have the same force and effect (if any) as it had in Queensland immediately prior to the commencement of this Act.</txt></block></clause><clause id="sec.6" guid="_8c9f99e0-96e1-4e10-a9ed-85dc959cb6a5" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_7b58b294-cc14-400f-8823-6f7fb6d825f6">Imperial enactments not affected</heading><block><txt break.before="1">Nothing in this Act affects any Imperial enactment specified in <intref refid="sch.2" target.guid="_c232bfaa-8e74-4bfb-9649-ccfe0b67094b" check="valid">Schedule&#160;2</intref> or any other Imperial enactment which independently of the provisions of the Imperial Act 9 George 4 <legref jurisd="QLD" type="act" check="invalid">Chapter&#160;83</legref> (<legref jurisd="QLD" type="act" check="invalid"><name emphasis="yes">Australian Courts Act 1828</name></legref>) is made applicable to Queensland by express words or necessary intendment of any Imperial enactment.</txt></block></clause><clause id="sec.7" guid="_85bbc3c4-9278-4465-9ecb-0957b183dad3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_9bd745eb-3ab0-4f42-b04d-bb30fd5dba18">Termination of application of Imperial enactments</heading><block><txt break.before="1">Subject to this Act, the application in and for Queensland of all Imperial enactments (commencing with the Statute of Merton, 20 Henry 3 A.D. 1235–6) in force in England at the time of the passing of the Imperial Act 9 George 4 <legref jurisd="QLD" type="act" check="invalid">Chapter&#160;83</legref>, is terminated.</txt></block></clause></part><part id="pt.3" guid="_8953797e-b50d-4ef8-824c-4af385b45263" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_3007b591-8cec-4cde-a374-90745dabc4be">Substitution of Queensland law for certain Imperial enactments</heading><clause id="sec.8" guid="_49c45adf-edf8-48f3-863f-8838be288db0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_d818f166-004c-43fb-a7df-24094db93030">No insurance to be made by persons having no interest</heading><subclause id="sec.8-ssec.1" guid="_cb096c5b-2986-4f37-ad65-c0293fa108d6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">No insurance shall be made by any person on the life of any person or on any other event whatsoever wherein the person for whose use or benefit or on whose account the policy is made has no interest, or by way of gaming or wagering.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_ec977ae8-355f-4089-a304-cb22027022db" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><heading id="sec.8-ssec.2-he" guid="_bebc1276-1deb-4c4a-9ddb-1c166af32eb0">Every insurance made contrary to this subsection shall be void</heading><block><txt break.before="1">It shall not be lawful to make any policy on the life of any person, or on any other event whatsoever, wherein the person effecting the policy has no interest, without inserting in that policy the names of the persons interested therein, or for whose use or benefit or on whose account that policy was made.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_3503d69f-a251-4e25-864e-05077e511538" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In all cases where there is an interest in the life or other event the subject of the insurance, no greater sum shall be recovered or received from the insurer than the amount or value of the interest.</txt></block></subclause><subclause id="sec.8-ssec.4" guid="_4dbd31d3-a83d-4f3a-8845-8f3b9ef4518a" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Nothing in this section shall extend to insurance made by any person on ships or goods, or to contracts of indemnity against loss by fire or loss by other events whatsoever.</txt></block></subclause></clause><clause id="sec.9" guid="_6837268f-da70-4fc7-b6a1-101d8d36fedd" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_bad1f6f7-c60a-4015-9604-0d38927b3ecd">Avoidance of wagering or gaming contracts of marine insurance</heading><subclause id="sec.9-ssec.1" guid="_91c07ee9-b7d5-460d-aefd-b3069e495a95" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Every contract of marine insurance by way of gaming or wagering is void.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_c1ccf7d5-f0c6-4e4b-b458-635cbf6be6d4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A contract of marine insurance is deemed to be a gaming or wagering contract—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_098ad48e-3552-4977-a835-9701c7755827" provision.type="other"><no>(a)</no><block><txt break.before="0">where the assured has no insurable interest, and the contract is entered into with no expectation of acquiring such an interest; or</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_2fa4e3c4-af49-4005-a4dc-8632312f5767" provision.type="other"><no>(b)</no><block><txt break.before="0">where the policy is made ‘interest or no interest’, or ‘without further proof of interest than the policy itself’, or ‘without benefit of salvage to the insurer’, or subject to any other like term.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_019e0213-f799-4a8a-868a-da076c3e669a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, where there is no possibility of salvage, a policy may be effected without benefit of salvage to the insurer.</txt></block></subclause></clause><clause id="sec.10" guid="_206e0a5c-3eaa-4aab-85f7-a15608505981" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_72d08198-a7f1-4ae7-a76a-45129fcc299a">Contracts of marine insurance must be embodied in policy</heading><subclause id="sec.10-ssec.1" guid="_18698480-e983-4abc-a90a-7855aa89c0d1" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Subject to the provisions of any other Act, a contract of marine insurance is inadmissible in evidence in an action for the recovery of a loss under the contract unless it is embodied in a marine policy in accordance with this Part.</txt></block></subclause><subclause id="sec.10-ssec.2" guid="_82aadb19-c667-49ac-b2b8-b0cd9064d29f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The policy may be executed and issued either at the time when the contract is concluded or afterwards.</txt></block></subclause></clause><clause id="sec.11" guid="_91bc9ad6-7544-435c-ba1a-9680925a2f9a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_4b39fe14-4269-408c-8bc6-92e64e68c614">What policy of marine insurance must specify</heading><block><txt break.before="1">A marine policy must specify—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-para1.a" guid="_d5d3a181-eec6-49ed-b801-54ede8a0ddfe" provision.type="other"><no>(a)</no><block><txt break.before="0">the name of the assured, or of some person who effects the insurance on the assured’s behalf; and</txt></block></li><li id="sec.11-para1.b" guid="_3d76ca41-1fbb-418c-9eb8-24ca85f84045" provision.type="other"><no>(b)</no><block><txt break.before="0">the subject-matter insured and the risk insured against; and</txt></block></li><li id="sec.11-para1.c" guid="_9278af81-a74f-44f2-8bb0-9a6477afe42c" provision.type="other"><no>(c)</no><block><txt break.before="0">the voyage, or period of time, or both as the case may be, covered by the insurance; and</txt></block></li><li id="sec.11-para1.d" guid="_02282c19-e51c-4898-bed3-90477050a8f0" provision.type="other"><no>(d)</no><block><txt break.before="0">the sum or sums insured; and</txt></block></li><li id="sec.11-para1.e" guid="_d13b457e-adf9-451c-8286-c63ed764adcd" provision.type="other"><no>(e)</no><block><txt break.before="0">the name or names of the
