target.guid="_7419fd4c-9b56-4a90-9539-c2fc53029a4d" check="valid">sections&#160;3</intref> and <intref refid="sec.4" target.guid="_ebabf095-4b21-4523-baba-9019fc2b2a54" check="valid">4</intref> and <intref refid="ch.2" target.guid="_1356450f-4c3f-4a7f-aaf5-756fb9e3fe28" check="valid">chapter&#160;2</intref>, <intref refid="ch.2-pt.1" target.guid="_ce07fb31-ae33-4f70-91d0-197b1144791c" check="valid">part&#160;1</intref>, commences on a date to be fixed by proclamation.</txt></block></clause><clause id="sec.3" guid="_7419fd4c-9b56-4a90-9539-c2fc53029a4d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_2937780b-8400-4885-9620-20e73bf6c646">Purpose</heading><block><txt break.before="1">The purpose of this Act is to enact ancillary provisions, including transitional provisions, relating to the enactment of the <legref jurisd="QLD" type="act" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid"><name emphasis="yes">Personal Property Securities Act 2009</name> (Cwlth)</legref>.</txt></block></clause><clause id="sec.4" guid="_ebabf095-4b21-4523-baba-9019fc2b2a54" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_2d69d380-04d6-490d-a617-6820d7ca9c5a">Definitions</heading><block><txt break.before="1">In this Act—</txt><deflist><definition id="sec.4-def.account_" guid="_f6d4d208-f8ac-4386-a606-a750ef5d9caa" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.account" guid="_e3dbace9-8872-499f-98f0-a10cb1e6a3fa" type="definition">account</defterm> has the meaning given by the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>, <legref check="invalid" jurisd="QLD" type="act">section&#160;10</legref>.</txt></definition><definition id="sec.4-def.applicationclosingtime_" guid="_8f7f0be8-e471-4984-80ea-ebc7f17a4bd7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.applicationclosingtime" guid="_7a4c4a79-c610-4d77-937e-8c1b14cfd102" type="definition">application closing time</defterm>, for an application under a Queensland register Act, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.applicationclosingtime-para1.a" guid="_1b372a49-858f-46d7-a04a-e63f50e52c50" provision.type="other"><no>(a)</no><block><txt break.before="0">if the application is made online—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.applicationclosingtime-para1.a-para2.i" guid="_3a386302-17f7-46dc-9ca0-2aca7ddb1f19" provision.type="other"><no>(i)</no><block><txt break.before="0">5.00pm on the last business day immediately before the registration commencement time; or</txt></block></li><li id="sec.4-def.applicationclosingtime-para1.a-para2.ii" guid="_346c1408-7203-4095-8450-bba5ea749cda" provision.type="other"><no>(ii)</no><block><txt break.before="0">an earlier day prescribed by regulation; or</txt></block></li></list></block></li><li id="sec.4-def.applicationclosingtime-para1.b" guid="_c8293a4b-5b47-44ba-bc96-5cf14d30ed90" provision.type="other"><no>(b)</no><block><txt break.before="0">if the application is made on paper—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.applicationclosingtime-para1.b-para2.i" guid="_5dbb99b3-fb7e-404b-a4e8-7a15593c2f98" provision.type="other"><no>(i)</no><block><txt break.before="0">5.00pm on the day before the last business day immediately before the registration commencement time; or</txt></block></li><li id="sec.4-def.applicationclosingtime-para1.b-para2.ii" guid="_a0550c70-14f9-4cde-8c36-4010c113c8d4" provision.type="other"><no>(ii)</no><block><txt break.before="0">an earlier day prescribed by regulation.</txt></block></li></list></block></li></list></definition><definition id="sec.4-def.attaches_" guid="_be501345-695b-4926-851e-1de51a43b161" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.attaches" guid="_c8994247-6c47-4ee1-a804-facc0155cb3b" type="definition">attaches</defterm>, in relation to a security interest, has the meaning given by the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>, <legref jurisd="CTH" refid="sec.19" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="invalid" type="act">section&#160;19</legref>.</txt></definition><definition id="sec.4-def.chattelpaper_" guid="_ebdbe8a8-a605-4bb5-a34e-cb862c2b1aec" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.chattelpaper" guid="_141153cf-9328-4fe8-9e17-20e110ecbc3c" type="definition">chattel paper</defterm> has the meaning given by the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>, <legref jurisd="CTH" refid="sec.10" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="invalid" type="act">section&#160;10</legref>.</txt></definition><definition id="sec.4-def.circulatingasset_" guid="_e7feb6b8-3ecd-431a-b349-e4e7dec6f6ad" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.circulatingasset" guid="_ff8c6dd4-619b-4d91-b66b-6bf98239cff5" type="definition">circulating asset</defterm> has the meaning given by the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>, <legref jurisd="CTH" refid="sec.340" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="invalid" type="act">section&#160;340</legref>.</txt></definition><definition id="sec.4-def.grantor_" guid="_0b6b50bf-81b1-48bb-9921-65867d4b8b7e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.grantor" guid="_274ca6ef-96f4-4e92-9f02-5acfadf3ec35" type="definition">grantor</defterm> has the meaning given by the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>, <legref jurisd="CTH" refid="sec.10" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="invalid" type="act">section&#160;10</legref>.</txt></definition><definition id="sec.4-def.perfected_" guid="_fe54a3eb-72b2-49c4-9b06-981bb90268ae" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.perfected" guid="_4eefae8a-5d87-4366-9139-eefa7e72fda8" type="definition">perfected</defterm>, in relation to a security interest, has the meaning given by the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>, <legref jurisd="CTH" refid="sec.21" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="invalid" type="act">section&#160;21</legref>.</txt></definition><definition id="sec.4-def.personalproperty_" guid="_da9a32e7-6c8f-4146-83bc-cf835b12b78d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.personalproperty" guid="_7bd3922a-93c2-45b6-b705-68bfa06cdf07" type="definition">personal property</defterm> has the meaning given by the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>, <legref jurisd="CTH" refid="sec.10" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="invalid" type="act">section&#160;10</legref>.</txt></definition><definition id="sec.4-def.PPSAct_" guid="_b8fcbbee-376e-4b64-9b8c-86e7892fd5dd" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.PPSAct" guid="_e93b1756-7949-44d4-9628-bcd18fd5e236" type="definition">PPS Act</defterm> means the <legref jurisd="CTH" type="act" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid"><name emphasis="yes">Personal Property Securities Act 2009</name> (Cwlth)</legref>.</txt></definition><definition id="sec.4-def.PPSregister_" guid="_75c5a7e7-cc92-4421-8173-fba9fad378f8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.PPSregister" guid="_a7649b54-aef2-4bd5-bb34-0df730dfcd39" type="definition">PPS register</defterm> means the Personal Property Securities Register under the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>.</txt></definition><definition id="sec.4-def.PPSregistrar_" guid="_9db2da9c-035b-4fa4-a749-ce060dbfb4bf" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.PPSregistrar" guid="_592c6999-2d92-4140-bd15-c1749dd0345f" type="definition">PPS registrar</defterm> means the Registrar of Personal Property Securities under the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>.</txt></definition><definition id="sec.4-def.Queenslandregister_" guid="_2695db98-5021-4195-a65b-92d19abb266f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.Queenslandregister" guid="_6f091ef1-d6ac-478c-84e5-3084144a8268" type="definition">Queensland register</defterm> means any of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.Queenslandregister-para1.a" guid="_e76a8a60-3e4f-4a55-bd40-83e9dc264c99" provision.type="other"><no>(a)</no><block><txt break.before="0">the register of security interests kept under the <legref jurisd="QLD" type="act" target.doc.id="act-1955-016" target.version.series="e440bf17-38e4-4295-b992-0a6680d44b0e" check="valid"><name emphasis="yes">Bills of Sale and Other Instruments Act 1955</name></legref>;</txt></block></li><li id="sec.4-def.Queenslandregister-para1.b" guid="_09ac6849-4647-4ceb-ad15-3f1c70e0bf2f" provision.type="other"><no>(b)</no><block><txt break.before="0">the register of cooperative charges kept under the <legref jurisd="QLD" type="act" target.doc.id="act-1997-039" target.version.series="5a5d62c6-3768-42bb-9840-f3626d117093" check="valid"><name emphasis="yes">Cooperatives Act 1997</name></legref>;</txt></block></li><li id="sec.4-def.Queenslandregister-para1.c" guid="_1f604f4b-16d9-49b9-96e7-264e510d18e0" provision.type="other"><no>(c)</no><block><txt break.before="0">the register of liens kept under the <legref jurisd="QLD" type="act" target.doc.id="act-1931-037" target.version.series="291812f4-9fa2-4aa5-90de-7cea2943884f" check="valid"><name emphasis="yes">Liens on Crops of Sugar Cane Act 1931</name></legref>;</txt></block></li><li id="sec.4-def.Queenslandregister-para1.d" guid="_eff3d71d-a8b5-4577-b5b2-9ef44f3108ad" provision.type="other"><no>(d)</no><block><txt break.before="0">the register of security interests kept under the <legref jurisd="QLD" type="act" target.doc.id="act-1986-024" target.version.series="2502e2fd-3886-48ee-97cf-2f9e57a0443a" check="valid"><name emphasis="yes">Motor Vehicles and Boats Securities Act 1986</name></legref>.</txt></block></li></list></definition><definition id="sec.4-def.QueenslandregisterAct_" guid="_4a5afbaa-19ec-4b06-b34d-67410cc9492f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.QueenslandregisterAct" guid="_c6b84da6-0161-4729-bc5e-8be3f37f71e6" <legref jurisd="CTH" refid="sec.306" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="invalid" type="act">section&#160;306</legref>.</txt></definition><definition id="sec.4-def.securityinterest_" guid="_6b5fbe3b-9832-4bdb-b18f-b08ea57d5f77" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.securityinterest" guid="_5be9833a-99e8-48c2-b101-9db95ad95c48" type="definition">security interest</defterm> has the meaning given by the <legref jurisd="CTH" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="valid" type="act"><name emphasis="no">PPS Act</name></legref>, <legref jurisd="CTH" refid="sec.12" target.doc.id="act-2009-130" target.version.series="C2009A00130" check="invalid" type="act">section&#160;12</legref>.</txt></definition></deflist></block></clause><clause id="sec.5" guid="_7d71e2f6-835a-4acb-a120-680aa8a841f0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_20bcf875-26a8-4cdc-a3d8-d75c81e92b78">References to charges and fixed and floating charges</heading><subclause id="sec.5-ssec.1" guid="_8a8d0491-9cfc-4da0-9429-7ed6ccfeb622" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a reference in an Act or other document to a charge, fixed charge or floating charge over property, but only to the extent that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_b37d44ba-11dd-4b76-8c01-806f0dcccf99" provision.type="other"><no>(a)</no><block><txt break.before="0">the charge referred to is attached to personal property; and</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_543bbc9b-6475-4e8e-8659-af8ab6a3865a" provision.type="other"><no>(b)</no><block><txt break.before="0">title in the personal property to which the charge is attached is in the grantor; and</txt></block></li><li id="sec.5-ssec.1-para1.c" guid="_9d9bb55b-e950-4da3-907a-50adb7821dd4" provision.type="other"><no>(c)</no><block><txt Act</name></legref> applies.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_701f23f1-c2e0-4963-b175-87bcb17ee1e7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, this section does not apply to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_b73f070d-09a8-4c01-a192-2b33317fdd8a" provision.type="other"><no>(a)</no><block><txt break.before="0">a reference to a charge, a fixed charge or a floating charge if the charge referred to is a perfected security interest that is provided for by a transfer of an account or chattel paper; or</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_6e693e01-9e79-4268-be88-8f078e4bca03" provision.type="other"><no>(b)</no><block><txt break.before="0">any other reference, or class of reference, prescribed under a regulation, to a charge, fixed charge or floating charge.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.3" guid="_27755afa-bc73-4e11-bac9-347e0fe0b92a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">On and from the registration commencement time—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a" guid="_b305c6a2-e2d1-4e9c-9916-32b72815c287" provision.type="other"><no>(a)</no><block><txt break.before="0">a reference to a charge over property is taken to be a reference to a security interest that is attached to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a-para2.i" guid="_3f474356-82eb-4b0b-8243-ace22a0974df" provision.type="other"><no>(i)</no><block><txt break.before="0">a circulating asset; or</txt></block></li><li id="sec.5-ssec.3-para1.a-para2.ii" guid="_ebc71d93-63ed-4b52-99e0-793dcfc3cff6" provision.type="other"><no>(2)</no><block><txt break.before="0">Despite the repeal, <legref refid="sec.18I" target.doc.id="act-1955-016" check="invalid" jurisd="QLD" type="act">section&#160;18I</legref> continues to apply to the registration of the interest.</txt></block></subclause><subclause id="sec.23-ssec.3" guid="_0286580a-1cc6-4e0d-9a2c-98048c455906" provision.type="transitional"><no>58</no><heading id="sec.58-he" guid="_f8c6df14-475e-420e-a0f2-f21ffb236b44">Show cause notices about improperly registered security interests</heading><subclause id="sec.58-ssec.1" guid="_08bba440-522e-493f-bced-788ea1657355" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to the following type="act">section&#160;18A</legref><legref refid="sec.18A-ssec.2" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">(2)</legref> of the existing Act, if the period stated in the notice had not expired before the repeal (an <defterm id="sec.58-ssec.1-def.existingshowcausenotice" guid="_5f00afd6-a9d9-4514-a9c3-2d9dfc4a69e3" type="definition">existing show cause notice</defterm>);</txt></block></li><li id="sec.58-ssec.1-para1.b" guid="_ab3e014e-7f8d-41c6-b84d-a9c3c5aa9a06" provision.type="other"><no>(b)</no><block><txt break.before="0">the proposed removal by the chief executive of the particulars of a security interest included in the register following the giving of a notice under <legref refid="sec.18A" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;18A</legref><legref refid="sec.18A-ssec.5" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">(5)</legref> of the existing Act, if the person had a right to apply to a Magistrates Court for an order maintaining the registration immediately before the repeal (an <defterm id="sec.58-ssec.1-def.existingappealdecision" guid="_81879754-066c-4985-a6db-0156a546f96c" type="definition">existing appeal decision</defterm>);</txt></block></li><li id="sec.58-ssec.1-para1.c" guid="_71fd1982-acbc-4961-bea5-a059aeb0d583" provision.type="other"><no>(c)</no><block><txt break.before="0">an application to a Magistrates Court for an order maintaining the registration of the security interest that is pending, but not finally decided, immediately before the repeal (an <defterm id="sec.58-ssec.1-def.existingappeal" guid="_fa859f77-f59c-4412-848e-6beb389b5298" type="definition">existing appeal</defterm>).</txt></block></li></list></block></subclause><subclause id="sec.58-ssec.2" guid="_3d3dc65e-6808-4d8e-a559-6513da965430" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Despite the repeal of <legref refid="sec.18A" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;18A</legref> of the existing Act, the following provisions apply—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.58-ssec.2-para1.a" guid="_b6769098-d95f-4978-89d0-bfeee075c2ad" provision.type="other"><no>(a)</no><block><txt break.before="0">the chief executive may deal with the existing show cause notice under <legref appeal decision may be the subject of an application to a Magistrates Court and may be dealt with by the court under the existing Act;</txt></block></li><li id="sec.58-ssec.2-para1.c" guid="_8345e492-b8e9-4516-8725-d6f1c861b317" provision.type="other"><no>(c)</no><block><txt break.before="0">an existing appeal may be decided by the Magistrates Court under the existing Act;</txt></block></li><li id="sec.58-ssec.2-para1.d" guid="_0a57370a-4370-4ac6-8cb0-1946dd165a94" provision.type="other"><no>(d)</no><block><txt break.before="0">as soon as practicable after the chief executive decides whether the interest is a security interest, the chief executive must give the PPS registrar written notice of the decision.</txt></block></li></list></block></subclause></clause><clause id="sec.59" guid="_d97ce277-63f0-4267-9d9a-03060ebf80d7" affected.by.uncommenced="0" spent.amends="0" jurisd="QLD" type="act">section&#160;20</legref> of the existing Act, if the period stated in the notice had not expired before the repeal (also an <defterm id="sec.59-def.existingshowcausenotice" guid="_37059c7b-4a4f-423c-9114-a6ea188f0f35" type="definition">existing show cause notice</defterm>).</txt></block></subclause><subclause id="sec.59-ssec.2" guid="_49d76210-da54-4f74-a85b-c02edf7b363e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Despite the repeal of <legref refid="sec.20" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;20</legref> of the existing Act, the following provisions apply—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.59-ssec.2-para1.a" guid="_ef4df94e-9d98-4b7d-ad6a-f2d97da41bcc" provision.type="other"><no>(a)</no><block><txt break.before="0">the chief executive may deal with the existing show cause notice under <legref refid="sec.20" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;20</legref>;</txt></block></li><li id="sec.59-ssec.2-para1.b" guid="_b9ef4c5f-3384-4f53-a598-13ae8383815b" provision.type="other"><no>(b)</no><block><txt break.before="0">as soon as practicable after the chief executive decides whether the registration should have been cancelled, the chief executive must give the PPS registrar written notice of the decision.</txt></block></li></list></block></subclause></clause><clause id="sec.60" guid="_fe6f2de9-1dde-4bb3-bcd8-dcc8b1fd4262" affected.by.uncommenced="0" spent.amends="0" provision.type="transitional"><no>60</no><heading id="sec.60-he" guid="_873c18c3-b775-4386-bac7-27548eae13b7">Inspection of register</heading><subclause id="sec.60-ssec.1" guid="_9856499a-843f-44f2-a454-5c94a3abff9e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Despite the repeal, <legref refid="sec.23" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;23</legref> of the existing Act continues to apply for a period of 2 years after the repeal in relation to particulars included in the former register in the period starting 7 years before the repeal and ending at the repeal.</txt></block></subclause><subclause id="sec.60-ssec.2" guid="_e9761db7-3bf4-4a90-9fce-897898f620fe" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A regulation may prescribe a fee for inspecting the former register.</txt></block></subclause><subclause id="sec.60-ssec.3" guid="_e98413a7-03b7-40df-bca3-0aea1e00ad75" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive must keep a copy of the information contained in the former register, as it existed immediately before the repeal, for 7 years after the repeal.</txt></block></subclause><subclause id="sec.60-ssec.4" guid="_b7367534-e7db-440e-8b19-ed0bf9cee15e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For <legref refid="sec.23" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;23</legref><legref refid="sec.23-ssec.1" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">(1)</legref><legref refid="sec.23-ssec.1-para1.a" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">(a)</legref> of the existing Act, the office of the department at Brisbane is prescribed as an office of the department where the register may be inspected.</txt></block></subclause><subclause id="sec.60-ssec.5" guid="_e290d7e0-54c1-49ba-a0ff-28d6a07899ea" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.60-ssec.5-def.formerregister_" guid="_830d0282-cef1-49b1-8391-1e269b7ced66" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.60-ssec.5-def.formerregister" guid="_e52d00bb-31ea-4008-82e3-9692fa291691" type="definition">former register</defterm> means the register of security interests required to be kept under <legref refid="sec.6" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;6</legref> of the existing Act.</txt></definition></deflist></block></subclause></clause><clause id="sec.61" guid="_354d07bd-6ebf-4405-b750-c5e498e9e2bb" affected.by.uncommenced="0" spent.amends="0" provision.type="transitional"><no>61</no><heading id="sec.61-he" guid="_0796d6c2-8897-4edb-9ef7-97ba456d6e3c">Applications for compensation for loss</heading><subclause id="sec.61-ssec.1" guid="_692d6dff-0dd4-4d1e-aa2d-72c335671aa4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Subsection&#160;(2) applies if a person who is the holder of a security interest that is mentioned in <legref refid="sec.28" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;28</legref><legref refid="sec.28-ssec.1" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">(1)</legref> of the existing Act and extinguished under <legref refid="sec.26" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;26</legref><legref refid="sec.26-ssec.1" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">(1)</legref> of the existing Act before the repeal suffers loss because of the extinguishment.</txt></block></subclause><subclause id="sec.61-ssec.2" guid="_d7faca0d-6127-45f9-988b-b408866c0a5f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Despite the repeal, the person may apply for payment of compensation under <legref refid="sec.28" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;28</legref> of the existing Act.</txt></block></subclause><subclause id="sec.61-ssec.3" guid="_6877c693-bf07-41b1-9afc-ef30a424abd4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Subsection&#160;(4) applies if a person who is the holder of a security interest extinguished under <legref refid="sec.30" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;30</legref><legref refid="sec.30-ssec.2" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">(2)</legref> of the existing Act before the repeal suffers loss because of the extinguishment.</txt></block></subclause><subclause id="sec.61-ssec.4" guid="_7f0aeed6-e57d-4f65-8307-2daa24503d72" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Despite the repeal, the person may apply for compensation under <legref refid="sec.30" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;30</legref><legref refid="sec.30-ssec.4" target.doc.id="act-1986-024" check="invalid" property</heading><subclause id="sec.62-ssec.1" guid="_0aaca98a-2d86-4891-b89e-1a9df33d4ad4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, before the repeal, there was an exercise or purported exercise of a power under a declared provision mentioned in <legref refid="sec.30ZB" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;30ZB</legref><legref refid="sec.30ZB-ssec.1" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">(1)</legref> of the existing Act.</txt></block></subclause><subclause id="sec.62-ssec.2" guid="_32c3ac4a-4da1-451b-97d8-1cbe6ce9c59f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Despite the repeal, a person whose property was damaged because of the exercise or purported exercise of the power may apply for compensation under <legref refid="sec.30ZB" target.doc.id="act-1986-024" check="invalid" jurisd="QLD" type="act">section&#160;30ZB</legref> of the existing Act.</txt></block></subclause></clause><clause id="sec.63" guid="_fda261fc-551f-47dc-a2df-e4c520f3e8ea" affected.by.uncommenced="0" spent.amends="0" provision.type="transitional"><no>63</no><heading id="sec.63-he" guid="_fab32f61-5dda-4a33-beb3-d100ac4659e3">Protection from liability</heading><subclause id="sec.63-ssec.1" guid="_58c2035a-d162-4d99-935c-b112a7460da2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A public service employee continues to incur no civil liability after the repeal for an act done, or omission made, honestly and without negligence in the performance or purported performance of functions under the existing Act if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.63-ssec.1-para1.a" guid="_861d310b-3ade-41d9-8875-cfab7074c296" provision.type="other"><no>(a)</no><block><txt break.before="0">the act was done or the omission was made before the repeal; or</txt></block></li><li id="sec.63-ssec.1-para1.b" guid="_1752158f-20e3-4edb-866a-e6a404b46d0d" provision.type="other"><no>(b)</no><block><txt break.before="0">the act was done or the omission was made after the repeal in relation to a matter that was authorised to be done under this division after the repeal.</txt></block></li></list></block></subclause><subclause id="sec.63-ssec.2" guid="_9e3771b2-c9f9-4937-be48-8c3d6d67e58c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If subsection&#160;(1) prevents a civil liability attaching to before the repeal in relation to a provision of the existing Act that continues, under this division, to have effect after the repeal continues to have effect as a delegation under this
