<legref target.doc.id="act-1994-051" target.version.series="ae419a07-c3fe-499d-8a72-5d2e4fb45074" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Consumer Credit (Queensland) Act 1994</name></legref>, <legref refid="sec.4" target.doc.id="act-1994-051" target.version.series="ae419a07-c3fe-499d-8a72-5d2e4fb45074" check="invalid" jurisd="QLD" type="act">section&#160;4</legref> commences.</txt></block></clause><clause id="sec.3" guid="_8d588a55-1d74-40ab-ba07-fbbe23e6eeea" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_57e5de3a-18ee-4653-85de-2d227e38a3df">Definitions and dictionary</heading><block><txt break.before="1">The dictionary in the <intref refid="sch" target.guid="_ee552b5d-66e5-4767-81ef-b96746b28415" check="valid">schedule</intref> defines particular words used in this Act.</txt></block></clause><clause id="sec.4" guid="_68a9621d-2238-4966-ab1f-e5dc1ce7e5ea" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_c655ac1d-5310-40cd-a061-7014dcda33aa">Purpose of Act</heading><subclause id="sec.4-ssec.1" guid="_8a184317-5c0f-4e27-b4d2-03a0bd867a44" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The purpose of this Act is to provide some protection to farmers against the enforcement of mortgages over equipment they use to carry out their farming businesses.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_05999458-ef7c-43cd-a092-02a9424d9f53" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The purpose is to be achieved mainly by providing for—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.2-para1.a" guid="_a5743248-9067-4ae6-94b9-20156f56c01d" provision.type="other"><no>(a)</no><block><txt break.before="0">a mortgagee to give at least 30 days notice before exercising a right to take possession of, or sell, farm equipment; and</txt></block></li><li id="sec.4-ssec.2-para1.b" guid="_097974d5-3bc9-4aad-b5aa-cb95a42e6069" provision.type="other"><no>(b)</no><block><txt break.before="0">the court to make an order allowing a farmer to keep possession of equipment, for up to 1 year, if the equipment is used to carry out the farmer’s farming business and the court considers, among other things, that the farmer has a reasonable prospect of being able to remedy any default.</txt></block></li></list></block></subclause></clause><clause id="sec.5" guid="_ce3f24ef-2a96-40e5-9f7f-c8eb7018a1c7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_6ab0b8f6-b894-4432-826f-92749f24bf00">Application of Act</heading><subclause id="sec.5-ssec.1" guid="_29554f73-1d70-4d46-82df-a80062a66990" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act applies to all persons including the State and, so far as the legislative power of the State permits, the Commonwealth and the other States.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_8efd2467-2cf4-45eb-beff-7291232ea93c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, this Act applies in relation to a mortgage only if the mortgagor (or, if there is more than 1, each mortgagor) is an individual.</txt></block></subclause><subclause id="sec.5-ssec.3" guid="_6585b022-df96-421b-a3ee-c8da3ab94139" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Also—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a" guid="_56fd88ec-a785-4687-9c2b-70d761d843d5" provision.type="other"><no>(a)</no><block><txt break.before="0"><intref refid="pt.2" target.guid="_20c08788-32d6-4fcf-b9fa-cfac95bf7f4f" check="valid">part&#160;2</intref> does not apply in relation to a mortgage to which the National Credit Code applies; and</txt></block></li><li id="sec.5-ssec.3-para1.b" guid="_bd9641e0-948d-4f0b-8480-28c3de3ccfca" provision.type="other"><no>(b)</no><block><txt break.before="0">this Act does not apply in relation to a mortgage to which the the repealed <legref jurisd="QLD" type="act" target.doc.id="act-1987-052" target.version.series="b1863413-0d39-4705-a2b3-5662a987be3a" check="valid"><name emphasis="yes">Credit Act 1987</name></legref> as continued applies.</txt><note id="sec.5-ssec.3-para1.b-note" guid="_b35b7626-35b3-4e26-bd65-68797d6f0499" type="example"><heading id="sec.5-ssec.3-para1.b-note-he" guid="_60fd351c-e4c7-4852-b831-6b372f04a6f6">Note—</heading><block><txt break.before="1">The provisions of the <legref jurisd="QLD" type="act" target.doc.id="act-1987-052" target.version.series="b1863413-0d39-4705-a2b3-5662a987be3a" check="valid"><name emphasis="yes">Credit Act 1987</name></legref> are continued by the <legref jurisd="QLD" type="act" target.doc.id="act-2010-016" target.version.series="fd941e64-9ff6-4fa0-93f3-99b767857b70" check="valid"><name emphasis="yes">Credit (Commonwealth Powers) Act 2010</name></legref>, <legref jurisd="QLD" type="act" refid="sec.15" target.doc.id="act-2010-016" target.version.series="fd941e64-9ff6-4fa0-93f3-99b767857b70" target.guid="_7b11335e-a40f-4ae6-b76f-83172959b519" check="valid">section&#160;15</legref>.</txt></block></note></block></li></list></block></subclause><historynote><txt break.before="1"><b>s&#160;5</b> amd <legref jurisd="QLD" type="act" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_b780f55c-6e78-4ced-892a-f0989a2a0f32">Courts with jurisdiction under this Act</heading><subclause id="sec.6-ssec.1" guid="_a1fc938d-c3a7-4602-a06e-fa5424b20945" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The jurisdiction expressed to be exercisable by the court under this Act in relation to a mortgage is exercisable by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_70b39d19-0599-4c16-90b4-8801a2a4b08b" provision.type="other"><no>(a)</no><block><txt break.before="0">if proceedings in relation to the mortgage have been started in, or are before, a court—that court; or</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_076486b1-5f49-4358-a054-6eaca42a3929" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—the court whose monetary jurisdiction is not exceeded by the amount payable under the mortgage when the proceeding concerned is started in the court.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_d4c586c9-18cb-466f-b33e-8eb1bccbee15" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6-ssec.2-def.court_" guid="_949c7799-be40-4cd5-998b-da9f09d0b503" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-ssec.2-def.court" guid="_06b91ac6-6024-4d29-93ae-2a9cc1087883" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_3e9e044a-b12c-4db5-862c-2dfdb5881fc0">Mortgagee must give default notice</heading><subclause id="sec.7-ssec.1" guid="_e85b9531-02af-4dd9-86e2-061d7ffe7bb6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a mortgagee has a right under a mortgage over farm equipment to take possession of, or sell, the equipment.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_8b2887ce-f1dd-480c-9f29-0a39c408abac" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The mortgagee must not exercise, or purport to exercise, the right unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-para1.a" guid="_2b82e23b-9c81-408b-a793-111f9d4dfe53" provision.type="other"><no>(a)</no><block><txt break.before="0">the mortgagor has defaulted; and</txt></block></li><li id="sec.7-ssec.2-para1.b" guid="_5cbf4dff-e8ba-4863-bacb-2e0a0c84ae32" provision.type="other"><no>(b)</no><block><txt break.before="0">the mortgagee has given the mortgagor, and guarantor (if any), written notice (a <defterm id="sec.7-ssec.2-def.defaultnotice" guid="_f72e808a-13bc-4256-94dd-e7ea829c9da7" type="definition">default notice</defterm>) under this part for the default; and</txt></block></li><li id="sec.7-ssec.2-para1.c" guid="_173de98a-c744-4f4e-a665-3930b1217faa" provision.type="other"><no>(c)</no><block><txt break.before="0">the default has not been remedied by the due day stated in the default notice.</txt></block></li></list></block><penalty id="sec.7-ssec.2-pen" guid="_21573643-b73b-429b-b7c8-ad333055a311"><block><txt break.before="1">Maximum penalty—500 penalty guid="_7f5ad58f-5baf-42b4-88ed-4e716c255fad" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Unless the mortgagee reasonably believes the default is incapable of being remedied, the default notice must state—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_2064fed0-9c28-4379-a315-da1ae2eb16e4" provision.type="other"><no>(a)</no><block><txt break.before="0">how the mortgagor has defaulted; and</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_51015e27-943b-4c23-957c-177d4e6c876e" provision.type="other"><no>(b)</no><block><txt break.before="0">what the mortgagor must do to remedy the default, including, for example, any amount that must be paid to the mortgagee; and</txt></block></li><li id="sec.8-ssec.1-para1.c" guid="_f197f9d2-e279-4118-868e-ef44204d41ea" provision.type="other"><no>(c)</no><block><txt break.before="0">that the mortgagee intends to take possession of, or sell, the equipment on or after a stated day (the <defterm id="sec.8-ssec.1-def.dueday" guid="_f1b8afcc-6e18-4fc3-bee4-47becd8826cc" type="definition">due day</defterm>) unless the default is remedied; and</txt></block></li><li id="sec.8-ssec.1-para1.d" guid="_d6cb6708-a88b-46fe-9d3d-23c93986edad" provision.type="other"><no>(d)</no><block><txt break.before="0">that, if the mortgagor makes another default of the same type before the due day that is not remedied by the due day, the mortgagee may take possession of, or sell, the equipment without giving another default notice under this part; and</txt></block></li><li id="sec.8-ssec.1-para1.e" guid="_cac2159e-2a0d-42be-b715-a50796c62aae" provision.type="other"><no>(e)</no><block><txt break.before="0">anything else prescribed under a regulation.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_ea0d89c8-ab76-4464-883d-db36d858bd4d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the mortgagee reasonably believes the default is incapable of being remedied, the default notice must state—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.2-para1.a" guid="_866f639d-744c-46f7-a030-82fe5b0c93f3" provision.type="other"><no>(a)</no><block><txt break.before="0">how the mortgagor has defaulted; and</txt></block></li><li id="sec.8-ssec.2-para1.b" guid="_ad2b259d-e2c1-4e8d-8c6e-59fc2bb3dfcc" provision.type="other"><no>(b)</no><block><txt break.before="0">that the mortgagee believes the default is incapable of being remedied; and</txt></block></li><li id="sec.8-ssec.2-para1.c" guid="_f4fae6b5-55ea-4b45-8865-054faa1691b0" provision.type="other"><no>(c)</no><block><txt break.before="0">that the mortgagee intends to take possession of, or sell, the equipment on or after a stated day (the <defterm id="sec.8-ssec.2-def.dueday" guid="_47fcb42c-be55-4dac-9464-cae05ca46f1a" type="definition">due day</defterm>); and</txt></block></li><li id="sec.8-ssec.2-para1.d" guid="_42b00ffd-4240-49f5-a455-c5f561dd1ba9" provision.type="other"><no>(d)</no><block><txt break.before="0">anything else prescribed under a regulation.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.3" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_ffb681ba-6c44-4c6f-9d76-0387d2728929" provision.type="other"><no>(a)</no><block><txt break.before="0">a mortgagor defaults under a mortgage; and</txt></block></li><li id="sec.9-ssec.1-para1.b" guid="_d3f01611-c342-4ab1-b452-8d7e0376cf00" provision.type="other"><no>(b)</no><block><txt break.before="0">the mortgagee gives the mortgagor, and guarantor (if any), a default notice under this part for the default; and</txt></block></li><li id="sec.9-ssec.1-para1.c" guid="_cd5268c8-5d79-4340-9f6e-faca3bd0a3a1" provision.type="other"><no>(c)</no><block><txt break.before="0">the mortgagor makes a further default of the same type before the due day stated in the default notice for the first default; and</txt></block></li><li id="sec.9-ssec.1-para1.d" guid="_21f4b604-509e-4296-b6d2-ade2e3d3683f" provision.type="other"><no>(d)</no><block><txt break.before="0">the further default is not remedied by the due day stated in the default notice for the first default.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_f1d2eece-ca02-4b7c-acdf-4db52c6a030e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.7" target.guid="_06b91ac6-6024-4d29-93ae-2a9cc1087883" check="valid">Section&#160;7</intref> does not apply to the mortgagee in exercising, or purporting to exercise, a right under the mortgage for the further default.</txt></block></subclause></clause><clause id="sec.10" guid="_0d1dc5f2-cc8b-42f2-aff0-9347ac191236" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_eed1d732-3daf-4e23-99cb-1975437f0615">Exception to <intref refid="sec.7" target.guid="_06b91ac6-6024-4d29-93ae-2a9cc1087883" check="valid">s&#160;7</intref>—taking possession to protect equipment</heading><block><txt break.before="1"><intref refid="sec.7" target.guid="_06b91ac6-6024-4d29-93ae-2a9cc1087883" check="valid">Section&#160;7</intref> does not apply to a mortgagee in exercising, or purporting to exercise, a right under a mortgage to take possession of farm equipment if the mortgagee reasonably believes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a" guid="_da9a207d-8b78-495e-a354-d7d43f161717" provision.type="other"><no>(a)</no><block><txt break.before="0">the mortgagor has removed or disposed of the equipment, or intends to remove or dispose of the equipment, in contravention of the mortgage; or</txt></block></li><li id="sec.10-para1.b" guid="_b3880834-c6e0-4c10-abd3-ffc737247927" provision.type="other"><no>(b)</no><block><txt break.before="0">it is necessary to take possession urgently to protect the equipment.</txt></block></li></list></block></clause><clause id="sec.11" guid="_b5e07731-16b3-419e-8518-2f0f8bb0421f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_b7fb568c-c91b-4230-a3aa-05fbdce3107d">Other exceptions to <intref refid="sec.7" target.guid="_06b91ac6-6024-4d29-93ae-2a9cc1087883" check="valid">s&#160;7</intref></heading><block><txt break.before="1"><intref refid="sec.7" target.guid="_06b91ac6-6024-4d29-93ae-2a9cc1087883" check="valid">Section&#160;7</intref> does not apply to a mortgagee in exercising, or purporting to exercise, a right under a mortgage if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-para1.a" guid="_ea00e10b-9d3d-473f-a590-a0a746ae5113" provision.type="other"><no>(a)</no><block><txt break.before="0">the mortgagee reasonably believes it was induced by fraud by the mortgagor to enter into the mortgage; or</txt></block></li><li id="sec.11-para1.b" guid="_70d5c367-b236-4244-ab4d-137b923f7324" order</heading><subclause id="sec.13-ssec.1" guid="_582452ed-b09e-40a6-a1da-78347cd0bd28" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.a" guid="_7b45578c-9b23-42ef-9ac4-525d8461b924" provision.type="other"><no>(a)</no><block><txt break.before="0">for a mortgage over farm equipment—the mortgagee has given the mortgagor a default notice under <intref refid="pt.2" target.guid="_20c08788-32d6-4fcf-b9fa-cfac95bf7f4f" check="valid">part&#160;2</intref>; or</txt></block></li><li id="sec.13-ssec.1-para1.b" guid="_09bcf548-d0bb-41d3-970d-392d62b2fae5" provision.type="other"><no>(b)</no><block><txt break.before="0">for a mortgage over equipment (whether or not it is farm equipment)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.b-para2.i" guid="_253adc7e-c444-4f17-b83f-810f3bd1e196" provision.type="other"><no>(i)</no><block><txt break.before="0">the mortgagee has exercised, or purported to exercise, a right under the mortgage to take possession of the equipment; or</txt></block></li><li id="sec.13-ssec.1-para1.b-para2.ii" guid="_46882bd2-1b52-41b7-a74b-4e32ef885bf7" provision.type="other"><no>(ii)</no><block><txt break.before="0">the mortgagor has defaulted under the mortgage; or</txt></block></li><li id="sec.13-ssec.1-para1.b-para2.iii" guid="_8844baeb-76c9-4708-87db-7892743e0ab0" provision.type="other"><no>(iii)</no><block><txt break.before="0">for another reason, the mortgagor believes the mortgagee may exercise, or purport to exercise, a right under the mortgage to take possession of, or sell, the equipment.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.13-ssec.2" guid="_c7a3934f-e9e1-49c4-a3b1-b2ea1509c520" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The mortgagor may apply to the court for a relieving order if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.a" guid="_2186ceca-c689-4192-bf7a-47524e9e45d6" provision.type="other"><no>(a)</no><block><txt break.before="0">the mortgagee has not taken possession of, or sold, the equipment or, if the mortgagee has taken possession of the equipment, has not parted with possession of the equipment; and</txt></block></li><li id="sec.13-ssec.2-para1.b" guid="_9c2c1ab4-7b2b-4347-8f43-7613d400776d" provision.type="other"><no>(b)</no><block><txt break.before="0">the mortgagor is a farmer who is using, or intending to use, the equipment to carry out the farmer’s farming business, or would be using, or intending to use, the equipment to carry out the farmer’s farming business if the mortgagee had not taken possession of the equipment.</txt></block></li></list></block></subclause></clause><clause id="sec.14" guid="_3e66a65d-f0d1-4c32-8d0c-5abb1672898b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_bedc5430-2dcd-4642-8098-ab8f8620d431">Notice of application</heading><subclause id="sec.14-ssec.1" guid="_72922414-9b2c-403b-bb3e-efdb9c6c1fa9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the mortgagor applies for a relieving order, the mortgagor must immediately give a copy of the application (a <defterm id="sec.14-def.noticeofapplication" guid="_09374444-f0ea-4d0a-adff-8b23a8c2534a" type="definition">notice of application</defterm>) to the mortgagee.</txt></block></subclause><subclause id="sec.14-ssec.2" guid="_65968f8a-e19b-401f-b164-f93a135a3dfa" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt id="sec.15-he" guid="_84e980f4-721e-4ce0-b7f9-40fa61074916">Effect of serving notice of application</heading><subclause id="sec.15-ssec.1" guid="_b52204f4-d9ce-4e20-8ed8-732931a1617b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the mortgagor gives a notice of application to the mortgagee, the mortgagee must not, until the court orders otherwise or the application is withdrawn or dismissed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.1-para1.a" guid="_6c588341-a49a-45bc-b002-ce6fdc322282" provision.type="other"><no>(a)</no><block><txt break.before="0">sell the equipment; or</txt></block></li><li id="sec.15-ssec.1-para1.b" guid="_6adb122d-bfe8-47ec-b559-bbf376d36413" provision.type="other"><no>(b)</no><block><txt break.before="0">if the mortgagee does not have possession of the equipment—take possession of the equipment; or</txt></block></li><li id="sec.15-ssec.1-para1.c" guid="_48f3c373-0294-4285-9b54-7da54eafd3de" provision.type="other"><no>(c)</no><block><txt break.before="0">if the mortgagee has possession of the equipment—part with its possession (other than to return it to the mortgagor).</txt></block></li></list></block><penalty id="sec.15-ssec.1-pen" guid="_87d2b4df-dd7f-460c-af5f-846d11627c74"><block><txt provision.type="other"><no>(2)</no><block><txt break.before="0">To remove any doubt, it is declared that if the mortgagee has possession of the equipment when given a notice of application, the mortgagee is not required by <intref refid="sec.15-ssec.1" target.guid="_b52204f4-d9ce-4e20-8ed8-732931a1617b" check="valid">subsection&#160;(1)</intref><intref refid="sec.15-ssec.1-para1.c" target.guid="_48f3c373-0294-4285-9b54-7da54eafd3de" check="valid">(c)</intref> to return the equipment.</txt></block></subclause></clause><clause id="sec.16" guid="_83e6a65e-1a64-40d4-9011-e270901cd6fe" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_369a29f8-64d9-4a97-aac4-44a3e40cc738">Court may make relieving order</heading><subclause id="sec.16-ssec.1" guid="_cd9755c9-6763-453a-866f-0f474c4e9624" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The court must decide the application by dismissing it or by making a relieving order.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_d6fc2604-b1b7-40b7-b5c3-f43282a10e48" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In deciding the application, the court must consider—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.a" guid="_95d69ab4-d7ca-41e4-a967-6a527af93ef6" provision.type="other"><no>(a)</no><block><txt break.before="0">whether the mortgagor has a reasonable prospect of being able to remedy the stated default within 1&#160;year after the notice day; and</txt></block></li><li id="sec.16-ssec.2-para1.b" guid="_e36fb265-ca23-414d-863a-348b0fedf8fe" provision.type="other"><no>(b)</no><block><txt break.before="0">how necessary the equipment is to the mortgagor in carrying out the farming business; and</txt></block></li><li id="sec.16-ssec.2-para1.c" guid="_1236167c-e4d9-4f92-b4ab-fab980408020" provision.type="other"><no>(c)</no><block><txt break.before="0">whether the mortgagor has removed, damaged or disposed of the equipment, or intends to remove, damage or dispose of the equipment, in contravention of the mortgage; and</txt></block></li><li id="sec.16-ssec.2-para1.d" guid="_5f0bbc1f-b3ba-457d-b7b2-1e277ced6f17" provision.type="other"><no>(d)</no><block><txt break.before="0">anything else the court considers relevant to making a just decision.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.3" guid="_817270cf-13da-4c10-8b6e-4b4a2cfba11e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A <defterm id="sec.16-def.relievingorder" guid="_e8ed62ff-b15b-40b9-9df9-5d7023047cab" type="definition">relieving order</defterm> is an order that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.3-para1.a" guid="_06256e12-0dc6-40ea-83bd-750de6e643ca" provision.type="other"><no>(a)</no><block><txt break.before="0">if the mortgagee has possession of the equipment—the mortgagee must return it to the mortgagor; and</txt></block></li><li id="sec.16-ssec.3-para1.b" guid="_4447066b-1480-488b-9956-5ea0fc8b9857" provision.type="other"><no>(b)</no><block><txt break.before="0">the mortgagee must not take possession of, or sell, the equipment for a stated period ending not later than 1 year after the notice day.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.4" guid="_f2ce5b60-e7a4-4627-a741-a5293c5ebf12" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The court may make a relieving order on terms it considers appropriate, including, for example, that the mortgagor pay any enforcement expenses incurred by the mortgagee.</txt></block></subclause><subclause id="sec.16-ssec.5" guid="_e40bbd3a-21a0-4e5b-864e-531ac1cd2374" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.16-ssec.5-def.noticeday_" guid="_de287188-db6b-46fe-b9ef-9cddd0e94a1d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.16-ssec.5-def.noticeday" guid="_b64aef00-0b6a-4953-81bc-a20323270ba3" type="definition">notice day</defterm> means the day the mortgagee is given the notice of application or, if the court orders that the mortgagor is not required to give the notice, the day the court makes that order.</txt></definition><definition id="sec.16-ssec.5-def.stateddefault_" guid="_ca2ba01f-3d76-43e5-86c0-ac11a428359e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.16-ssec.5-def.stateddefault" guid="_277d98b6-686b-4908-ba7e-8c0b13a1bce5" type="definition">stated default</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.5-def.stateddefault-para1.a" guid="_eace3754-461f-49d6-bc94-2d1808ea0a75" provision.type="other"><no>(a)</no><block><txt break.before="0">if the mortgagee has given the mortgagor a default notice under <intref refid="pt.2" target.guid="_20c08788-32d6-4fcf-b9fa-cfac95bf7f4f" check="valid">part&#160;2</intref>—the default stated in the notice; or</txt></block></li><li id="sec.16-ssec.5-def.stateddefault-para1.b" guid="_02c7c9bb-ca8b-477c-8c90-5350cb7fe32b" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—the default that is claimed by either party to have been made by the type="definition">hire-purchase agreement</defterm> is an agreement entered into after the commencement of this section, under which—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17B-ssec.1-para1.a" guid="_c4e2a47c-054c-4c2f-a3fd-8461083e9337" provision.type="other"><no>(a)</no><block><txt break.before="0">farm equipment is let or hired to a farmer and the farmer has an option to purchase the farm equipment; or</txt></block></li><li id="sec.17B-ssec.1-para1.b" guid="_d11a213d-1a83-44c0-aaf6-943aae1a86be" provision.type="other"><no>(b)</no><block><txt break.before="0">a farmer agrees to purchase farm equipment by instalments, whether the instalments are described as rent, hire or something provision.type="other"><no>(2)</no><block><txt break.before="0">Two or more agreements, which individually are not hire-purchase agreements, are also a <defterm id="sec.17B-def.hirepurchaseagreement-oc.3" guid="_a63ca2b1-255a-4fa1-a2ce-e85370f16960" type="definition">hire-purchase agreement</defterm>, from the time the last agreement is entered into, if under provision.type="other"><no>(b)</no><block><txt break.before="0">the farmer may purchase the farm equipment or the property in the farm equipment may pass to the
