id="sec.5-ssec.1" guid="_9a7874ba-f38f-4974-8a92-198678ef7bd5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Solicitor-General shall be appointed, from time to time, by Letters Patent issued by or on behalf of Her Majesty, on recommendation of the Executive Council.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_e086960a-b257-48e7-98bc-debd1e62cf30" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Solicitor-General—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_d72c02c9-7dc7-4102-8d02-92038bb3aa1a" provision.type="other"><no>(a)</no><block><txt break.before="0">shall be appointed for a term not exceeding 5 years determined by the Governor in Council and specified in the instrument of his or her appointment; and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_c8856e3f-feee-4659-b8ad-13b88dfec1cc" provision.type="other"><no>(b)</no><block><txt break.before="0">shall, subject to this Act, be eligible for reappointment upon the expiration of his or her term of appointment; and</txt></block></li><li id="sec.5-ssec.2-para1.c" guid="_4aecf12a-7cdd-40eb-81d8-8100664158d5" provision.type="other"><no>(c)</no><block><txt break.before="0">shall be appointed and hold office on the conditions prescribed and otherwise as the Governor in Council determines.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.3" guid="_cbc44347-e5bc-415e-8ff7-00880beb0040" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person shall be eligible for appointment to the office of Solicitor-General if the person is a barrister entitled to practise in the Supreme Court of not less than 10 years standing.</txt></block></subclause><subclause id="sec.5-ssec.4" guid="_0d33256f-40a3-473a-a679-869d7eb251d0" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Notification of the appointment of a person to the office of Solicitor-General shall be published in the Gazette.</txt></block></subclause><subclause id="sec.5-ssec.5" guid="_eb34a42c-0cbc-402c-809e-2315b1b1853d" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The solicitor-general is to be appointed under this Act, and not under the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public Service Act 2008</name></legref>.</txt></block></subclause><historynote><txt emphasis="yes">Constitution Act 1967</name></legref> does not apply in respect of the appointment to the office of Solicitor-General.</txt></block></clause><clause id="sec.7" guid="_c7cc221f-521c-4f7e-aba9-53d52d8415d8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_1632a05a-66f0-4af1-9b76-343fa00703a0">Acting Solicitor-General</heading><subclause id="sec.7-ssec.1" guid="_83f407c8-0879-41d0-b5b5-45e496b1d33f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">In the event of a vacancy in the office of Solicitor-General or of the illness or absence of the person holding that office the Governor in Council may, upon the recommendation of the Minister, by notification published in the Gazette, appoint a person eligible for appointment to that office to act as Solicitor-General and may at any time revoke that appointment.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_654950f9-37bc-4d57-a7f2-d3d885c5dcab" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person appointed under <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">subsection&#160;(1)</intref> shall be entitled to act as Solicitor-General until—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-para1.a" guid="_ee04c0b8-a866-4181-8e51-a90f6659448f" provision.type="other"><no>(a)</no><block><txt break.before="0">the appointment is revoked; or</txt></block></li><li id="sec.7-ssec.2-para1.b" guid="_bb06a503-92c7-415a-b62a-e560578c10a3" provision.type="other"><no>(b)</no><block><txt break.before="0">a person is appointed Solicitor-General under <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">section&#160;5</intref>; or</txt></block></li><li id="sec.7-ssec.2-para1.c" guid="_fc0815a3-d0c8-47a5-a827-788f05c5601e" provision.type="other"><no>(c)</no><block><txt break.before="0">the person holding the office of Solicitor-General returns to the duties of that office;</txt></block></li></list></block><block><txt break.before="1">whichever event first occurs.</txt></block></subclause><subclause id="sec.7-ssec.3" guid="_19e5f163-bc2c-492e-af4c-3689032d35fe" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person appointed to act in the office of Solicitor-General shall hold the appointment on conditions determined by the Governor in Council and specified in the instrument of appointment.</txt></block></subclause><subclause id="sec.7-ssec.4" guid="_ff15762f-08e0-4709-9aba-39cefaf285fd" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">While a person continues to be entitled to act in the office of Solicitor-General the person shall discharge the functions and may exercise the authorities conferred on the Solicitor-General by this Act.</txt></block></subclause><subclause id="sec.7-ssec.5" guid="_2922e2be-5a92-4e7c-893c-fa554fb99fb1" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A person appointed to act in the office of Solicitor-General shall not be subject to the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public Service Act 2008</name></legref> while the person acts in that office unless immediately before the appointment the person was subject to that Act, in which case, while the person acts in that office, the person shall continue to be subject to that Act and shall be an officer of the public service.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;7</b> amd <legref jurisd="QLD" guid="_86e1b2d0-6a4e-415d-96af-b3b673cbb08e">Functions of Solicitor-General</heading><block><txt break.before="1">The functions of the Solicitor-General are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-para1.a" guid="_d527156b-88fb-49d7-bed8-e5b07176016a" provision.type="other"><no>(a)</no><block><txt break.before="0">to act, upon the request of the Attorney-General, as counsel for—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-para1.a-para2.i" guid="_f0eeeff3-576e-456b-9111-eb2e8d653f82" provision.type="other"><no>(i)</no><block><txt break.before="0">the Crown in right of the State;</txt></block></li><li id="sec.8-para1.a-para2.ii" guid="_5993b28f-b7ae-4670-b3ff-17c349a28997" provision.type="other"><no>(ii)</no><block><txt break.before="0">the State;</txt></block></li><li id="sec.8-para1.a-para2.iii" guid="_aaa77442-446c-4c94-82ae-863d1fb4c293" provision.type="other"><no>(iii)</no><block><txt break.before="0">a person suing or being sued on behalf of the State;</txt></block></li><li id="sec.8-para1.a-para2.iv" guid="_682041ad-b6ef-4682-ae17-7d71f9bca337" provision.type="other"><no>(iv)</no><block><txt break.before="0">a body established by or under an Act;</txt></block></li><li id="sec.8-para1.a-para2.v" guid="_b32a6e82-81d8-4af5-8c1c-8ea4039b4576" provision.type="other"><no>(v)</no><block><txt break.before="0">any other person or body where it is to the benefit of the State that the Solicitor-General should so act; and</txt></block></li></list></block></li><li id="sec.8-para1.b" guid="_4c3c9669-a20a-4c7a-bd9f-6e6e07ac3ab6" provision.type="other"><no>(b)</no><block><txt break.before="0">to carry out for the benefit of the Government of the State such other functions ordinarily performed by counsel as the Attorney-General requests.</txt></block></li></list></block></clause><clause id="sec.9" guid="_c343373c-2cc4-4119-8636-25dad22d06e9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_f164b03d-cc16-4e7b-8477-3c7cd8571448">Authority to delegate</heading><subclause id="sec.9-ssec.1" guid="_fc792639-b2c8-4559-990f-0e1f80284517" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Solicitor-General may, from time to time by signed instrument of delegation delegate to any person or to the holder from time to time of a specified office (without naming a particular person) any of the Solicitor-General’s functions under this Act or of the duties to be discharged in connection with those functions.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_4a9b97f0-bbf4-4599-bf97-8615acb1c3ed" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A delegation may be made subject to such terms, conditions and limitations as the Solicitor-General thinks fit, including a requirement that the delegate report to the Solicitor-General upon the discharge of the delegated function or duty, and may be given in relation to a particular matter or a class of matter.</txt></block></subclause><subclause id="sec.9-ssec.3" guid="_4e8d7746-e92c-46b2-bd1a-145ebacfdda1" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Solicitor-General may give such and as many delegations of the same function or duty and to such number of persons or holders of office as the Solicitor-General thinks fit.</txt></block></subclause><subclause id="sec.9-ssec.4" guid="_63c9d8ad-8ede-4680-b2a5-3fb779744242" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Where a function or duty has been delegated—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.4-para1.a" guid="_85560ee4-2427-4b70-8e22-b9e3dff34991" provision.type="other"><no>(a)</no><block><txt break.before="0">its discharge shall be in accordance with the instrument of delegation; and</txt></block></li><li id="sec.9-ssec.4-para1.b" guid="_e2512106-ed82-4b64-8d55-b5f4ae9a7d33" provision.type="other"><no>(b)</no><block><txt break.before="0">any act or thing done or suffered by the delegate in discharge of the function or duty has the same force and effect as if the act or thing had been done or suffered by the Solicitor-General; and</txt></block></li><li id="sec.9-ssec.4-para1.c" guid="_c922d3b0-a9d2-462a-bd9b-de117effbf47" provision.type="other"><no>(c)</no><block><txt break.before="0">the delegation does not prejudice the discharge of the function or duty by the Solicitor-General.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.5" guid="_a7b53513-c0fc-47ff-a5e4-3065a2acf306" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A delegation is revocable at the will of the Solicitor-General and shall be revoked if the Minister so directs.</txt></block></subclause></clause><clause id="sec.10" guid="_a1af92b6-e5a8-42eb-b6f7-2c1dee7afdaf" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_324b142f-aac4-420a-b902-5b68381032d0">Staff</heading><subclause id="sec.10-ssec.1" guid="_1c7121ef-2ca1-4357-b30f-0ec080bd2b2e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">There may be employed or assigned to assist the Solicitor-General in the discharge of the Solicitor-General’s functions such number of persons as is necessary for the purpose.</txt></block></subclause><subclause id="sec.10-ssec.2" guid="_3410e4b3-ee52-4c3c-9449-3c8fb6563733" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The staff of the solicitor-general are to be employed under the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public Service Act 2008</name></legref>.</txt></block></subclause><subclause id="sec.10-ssec.3" guid="_2607ffa4-4eab-4ea6-a601-be5d1f9e80ac" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">An officer of the public service may be assigned for a limited and specified period to perform duties for the purpose referred to in <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">subsection&#160;(1)</intref> and shall continue to be subject to the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public aggregate rate per annum of salary and allowance payable from time to time to a Puisne Judge of the Supreme Court.</txt></block></clause><clause id="sec.12" guid="_5605fda0-a6ec-4757-800c-18b96468134b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_ab27b3b6-e634-4a35-88d8-3a27d1e5c89d">Leave entitlements</heading><subclause id="sec.12-ssec.1" guid="_4d697c3f-db98-43f9-bac9-ebde2eedac7c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Solicitor-General shall have the same recreation leave and sick leave entitlements as an officer of the public service.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_fbef9c58-e71b-4b3e-af6d-d27815af3635" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The <legref jurisd="QLD" type="act" target.doc.id="act-1957-038" target.version.series="af869782-32f0-4b36-9dbe-e258d8648e9c" check="valid"><name emphasis="yes">Judges (Pensions and Long Leave) Act 1957</name></legref>, <legref jurisd="QLD" type="act" refid="sec.15" target.doc.id="act-1957-038" target.version.series="af869782-32f0-4b36-9dbe-e258d8648e9c" check="invalid">section&#160;15</legref>, applies to the Solicitor-General as if a reference to a judge included a reference to the Solicitor-General.</txt></block></subclause><subclause id="sec.12-ssec.3" guid="_56493fcc-2e4b-4215-bc2c-8069e6306443" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, for the purpose of applying <legref target.doc.id="act-1957-038" refid="sec.4_-oc.3" jurisd="QLD" type="act" check="invalid">section&#160;15</legref> of that Act for leave of absence of the Solicitor-General, the prescribed authority is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.3-para1.a" guid="_d1458a57-168a-4545-a23a-d1673eb001d1" provision.type="other"><no>(a)</no><block><txt break.before="0">the Governor in Council, if the leave of absence is more than 1 month; or</txt></block></li><li id="sec.12-ssec.3-para1.b" guid="_452d7ad6-0eca-4263-b6e6-d829b0bc6272" provision.type="other"><no>(b)</no><block><txt break.before="0">the Minister, if the leave of absence is 1 month or less.</txt></block></li></list></block></subclause><historynote><txt break.before="1"><b>s&#160;12</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2008-059" office of Solicitor-General is appointed a Judge of the Supreme Court or a Judge of District Courts, then for the purposes of the <legref jurisd="QLD" type="act" target.doc.id="act-1957-038" target.version.series="af869782-32f0-4b36-9dbe-e258d8648e9c" check="valid"><name emphasis="yes">Judges (Pensions and Long Leave) Act 1957</name></legref> in its application to the person any period of service had by the person as Solicitor-General shall be added to and be deemed to be part of the period of service as a Judge except that where the person has been paid a lump sum under <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">section&#160;14</intref> any such period of service before the person was paid that sum shall be disregarded.</txt></block></clause><clause id="sec.14" guid="_2ea0ce39-8509-4ead-b7d4-a904c4f36cfb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_cfae7b68-0b49-4279-a081-e82286df97b3">Severance entitlement</heading><block><txt break.before="1">If the appointment of a person as Solicitor-General is terminated—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-para1.a" guid="_34dc2855-6aab-443a-b5a0-44d2b39c3193" provision.type="other"><no>(a)</no><block><txt break.before="0">otherwise than in the circumstances referred to in <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">section&#160;13</intref>; and</txt></block></li><li id="sec.14-para1.b" guid="_950fd7c7-61f1-49d5-8252-f14adb952a8c" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise than by death or removal from office by the Governor in Council on the ground of misbehaviour;</txt></block></li></list></block><block><txt break.before="1">the person is entitled to be paid a lump sum accrued at a rate of 6% per annum of the remuneration payable to the Solicitor-General from time to time throughout the period or periods of his or her service as Solicitor-General.</txt></block></clause><clause id="sec.15" guid="_89fdbed5-1bc3-4993-84c2-ab55f8ee8edc" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_c4f5d66a-252f-4d3b-83db-b0d77ef72ba3">Dependants’ pension entitlements</heading><block><txt break.before="1">Where the Solicitor-General has died in office leaving a spouse or children, the spouse or each child shall be entitled to pension benefits in accordance with the <legref jurisd="QLD" type="act" target.doc.id="act-1957-038" target.version.series="af869782-32f0-4b36-9dbe-e258d8648e9c" check="valid"><name emphasis="yes">Judges (Pensions and Long Leave) Act 1957</name></legref> as if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-para1.a" guid="_f6937e6d-7b25-4b29-b754-51e4e590da71" provision.type="other"><no>(a)</no><block><txt break.before="0">the Solicitor-General had been a Judge and the Solicitor-General’s service as Solicitor-General had been service as a Judge; and</txt></block></li><li id="sec.15-para1.b" guid="_6be07b9b-8dd2-450f-b98a-e301ab675b07" provision.type="other"><no>(b)</no><block><txt break.before="0">in respect of the spouse’s entitlement—the maximum pension entitlement that, as a Judge, the Solicitor-General might have had under that Act would have been had upon attaining the age of 65 years.</txt></block></li></list></block></clause><clause id="sec.16" guid="_7c795da4-a83e-4cc8-8bc9-14260958840a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_edf8143f-e500-4ab9-9136-20f055e79911">Other employment curtailed</heading><subclause id="sec.16-ssec.1" guid="_aa792f98-6447-40e4-86da-e2d4f7011eb2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">With the approval of the Governor in Council first had and obtained the Solicitor-General may engage in the practice of his or her profession as a barrister otherwise than in discharge of the Solicitor-General’s functions.</txt></block></subclause><subclause id="sec.16-ssec.1A" guid="_c5dac8ea-bc96-4215-8529-c12cfa0f98d6" affected.by.uncommenced="0" provision.type="other"><no>(1A)</no><block><txt break.before="0">However, if the Solicitor-General does so—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.1A-para1.a" guid="_4e8d22a2-7ec8-4a38-8547-9d4d1bc5e9d6" provision.type="other"><no>(a)</no><block><txt break.before="0">the Solicitor-General shall at all times give priority to the discharge of his or her functions as Solicitor-General;</txt></block></li><li id="sec.16-ssec.1A-para1.b" guid="_faed8b14-965d-4b2b-858b-dd68ee998cdb" provision.type="other"><no>(b)</no><block><txt break.before="0">the Solicitor-General shall not at any time—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.1A-para1.b-para2.i" guid="_a2264152-a49f-4baf-81c4-555b6bb62868" provision.type="other"><no>(i)</no><block><txt break.before="0">appear for the defence upon a charge brought by the Crown; or</txt></block></li><li id="sec.16-ssec.1A-para1.b-para2.ii" guid="_04b7fb3b-f88c-4024-9037-999ad522797b" provision.type="other"><no>(ii)</no><block><txt break.before="0">act in any case to which the Crown is a party for any party other than the Crown; or</txt></block></li><li id="sec.16-ssec.1A-para1.b-para2.iii" guid="_831348fe-f6c7-4d88-a56b-05527605720d" provision.type="other"><no>(iii)</no><block><txt break.before="0">permit or suffer a conflict of interests to exist between the practice of his or her profession and the proper discharge of his or her functions as Solicitor-General.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.16-ssec.2" guid="_a47bfcdd-e637-4087-898c-05c644bbb112" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Except as provided by <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">subsection&#160;(1)</intref>, the Solicitor-General shall not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.a" guid="_3edcfbf6-75ae-4590-8c05-85d20e852fbe" provision.type="other"><no>(a)</no><block><txt break.before="0">engage in the practice of his or her profession as a barrister except in the discharge of his or her functions; or</txt></block></li><li id="sec.16-ssec.2-para1.b" guid="_b1178fa3-6e3a-4416-ae7f-a89adf71480b" provision.type="other"><no>(b)</no><block><txt break.before="0">engage in paid employment outside the duties of his or her office.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.3" guid="_dfbcb8e9-b048-4510-bd71-5c442ebab3f9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">An approval under <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">subsection&#160;(1)</intref> may be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.3-para1.a" guid="_63ce0d93-32de-4ea7-9959-1d338fae38a8" provision.type="other"><no>(a)</no><block><txt break.before="0">for the whole of the time that the Solicitor-General in question serves in the office of Solicitor-General; or</txt></block></li><li id="sec.16-ssec.3-para1.b" guid="_99968a00-18a6-4e48-98e7-aeddb645fbca" provision.type="other"><no>(b)</no><block><txt break.before="0">for the whole or any part of the term of an appointment of the Solicitor-General in question;</txt></block></li></list></block><block><txt break.before="1">as expressed in the approval.</txt></block></subclause></clause><clause id="sec.17" guid="_2014291d-5e25-40ba-8ed5-46100292ac17" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>17</no><heading id="sec.17-he" guid="_fcb1aac2-f2be-4591-91d2-92bb08fa43de">Termination of Solicitor-General’s appointment</heading><subclause id="sec.17-ssec.2" guid="_6b9c2132-1105-4bb3-bdbe-384f05a889e4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Solicitor-General may resign office by signed writing delivered to the Minister.</txt></block></subclause><subclause id="sec.17-ssec.3" guid="_c506e541-0ec2-49cf-9a93-1587a0e2a840" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Governor in Council may terminate the appointment of the Solicitor-General, by removing the Solicitor-General from office, for misbehaviour or physical or mental incapacity.</txt></block></subclause><subclause id="sec.17-ssec.4" guid="_6ca54068-1371-4994-9595-a0ce74503855" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Governor in Council shall terminate the appointment of the Solicitor-General for any of the following misbehaviour—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.4-para1.a" guid="_34f810bd-e999-4ff8-8eb3-59df9f46b80b" provision.type="other"><no>(a)</no><block><txt break.before="0">if the Solicitor-General becomes bankrupt or takes advantage of the law in force relating to bankruptcy;</txt></block></li><li id="sec.17-ssec.4-para1.b" guid="_5a426ac3-3e15-4943-8999-42b3135fe18a" provision.type="other"><no>(b)</no><block><txt break.before="0">if the Solicitor-General is absent from duty, except on leave of absence to which the Solicitor-General is entitled under conditions of his or her appointment or granted by the Minister, for 14 consecutive working days, or for 28 working days in any period of 12 months;</txt></block></li><li id="sec.17-ssec.4-para1.c" guid="_4e5537de-d30b-4c6e-b722-ee7226d97b38" provision.type="other"><no>(c)</no><block><txt break.before="0">if the Solicitor-General contravenes <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">section&#160;16</intref>.</txt></block></li></list></block></subclause><subclause id="sec.17-ssec.5" guid="_64fb79fa-599e-447a-9a9d-3f1c14b728ad" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Termination of the appointment of Solicitor-General shall be by way of notification in writing signed by the guid="_b04fe12f-ccbf-42c6-bdca-26de240710ad">Suspension of Judges’ pension</heading><block><txt break.before="1">If a person in receipt of a pension under the <legref jurisd="QLD" type="act" target.doc.id="act-1957-038" target.version.series="af869782-32f0-4b36-9dbe-e258d8648e9c" check="valid"><name emphasis="yes">Judges (Pensions and Long Leave) Act 1957</name></legref> is appointed to the office of Solicitor-General that pension ceases to be payable while the person serves in that office.</txt></block></clause><clause id="sec.19" guid="_118493ad-f1a4-472c-ad65-efbf5fd82f99" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sec.19-he" guid="_0f3f5d52-7d81-4b0b-b1cc-711e865ee182">Rights of public servant appointed as Solicitor-General</heading><block><txt break.before="1">Where the Solicitor-General was, immediately before appointment to that office, an officer of the public service—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-para1.a" guid="_ec2cf332-2f13-412e-ba0b-8c2146d4a752" provision.type="other"><no>(a)</no><block><txt break.before="0">the Solicitor-General retains his or her existing and accruing rights; and</txt></block></li><li id="sec.19-para1.b" guid="_bdc60835-8770-43c1-95a6-e995aaa3fa3e" provision.type="other"><no>(b)</no><block><txt break.before="0">for the purpose of determining those rights, service as Solicitor-General shall be taken into account as if it were service in the public service; and</txt></block></li><li id="sec.19-para1.c" guid="_e747c90a-d761-472e-ba79-0deba5e03329" provision.type="other"><no>(c)</no><block><txt break.before="0"><intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">sections&#160;12</intref>, <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">13</intref>, <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">14</intref> and <intref refid="sec.4_-oc.3" check="valid" target.guid="_e505cc83-0c21-49c4-836d-982da483fdaa">15</intref> do not apply to the Solicitor-General, or the Solicitor-General’s spouse or children;</txt></block></li></list></block><block><txt break.before="1">unless the Solicitor-General has duly resigned his or her appointment as an officer of the public service and has renounced the rights referred to in <intref refid="sec.19-para1.a" check="valid" target.guid="_ec2cf332-2f13-412e-ba0b-8c2146d4a752">paragraph&#160;(a)</intref>.</txt></block></clause><clause id="sec.20" guid="_a16a80ea-49a1-487f-b9ff-b49c13518b83" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.20-he" guid="_aeacb2a8-4230-4818-852e-e463c43dcf31">Administrative and financial control</heading><subclause id="sec.20-ssec.1" guid="_b206cc7f-848d-4456-9f6c-9e4689ab0d1b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive shall be the chief executive within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public Service Act 2008</name></legref> in respect of matters of an administrative nature associated with the discharge of the Solicitor-General’s functions and in respect of staff assisting the Solicitor-General.</txt></block></subclause><subclause id="sec.20-ssec.2" guid="_d1f5edc2-bbf7-47b5-8a37-b2e47fdd9c63" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For the purposes of the <legref jurisd="QLD" type="act" target.doc.id="act-2009-009" target.version.series="3bbc6476-dce9-45a6-a821-229426b13686" check="valid"><name emphasis="yes">Financial Accountability Act 2009</name></legref> the chief executive shall be the accountable officer in respect of the discharge of the Solicitor-General’s functions other than in respect of the acts and conduct of the Solicitor-General himself or herself.</txt></block></subclause><subclause id="sec.20-ssec.3" guid="_1d467d5e-165e-4206-b696-3e20ef6343f5" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Solicitor-General shall do all such things as the chief executive in proper performance of the chief executive’s duties as such accountable officer, may require for the purposes of that Act.</txt></block></subclause><historynote><txt
