provide in respect of an exchange of land on which is the trades and labour hall in the city of Ipswich for other lands in that city and for related purposes</txt></block></longtitle><preamble id="frnt-preamble" guid="_e25533d9-a3ae-4dcb-b517-9f0d7021b98a"><heading id="frnt-preamble-he" guid="_17d3686c-28b9-47e4-976f-ce39c513bc93">Preamble</heading><block align="justify"><list number.type="manual" unnumbered.indent="0"><li id="frnt-preamble-para1.1" guid="_03c4d4a9-76d3-4fff-810e-c12590cec9b1" provision.type="other"><no>1</no><block><txt break.before="0">Pursuant to the<legref jurisd="QLD" type="act" check="invalid"><name emphasis="yes"> Ipswich Trades and Labour Hall Land Perpetual Lease Act 1925</name></legref>, the Governor in Council was empowered to grant perpetual leases to the trustees of the Ipswich and West Moreton Labour Day Celebration Committee over certain land in Nicholas Street Ipswich, which land was, by that Act, required to be held by the trustees for the purposes of a trades and labour hall and for no other purpose.</txt></block></li><li id="frnt-preamble-para1.2" guid="_74712fcd-8dfd-4b84-955a-2fff1b349fdc" provision.type="other"><no>2</no><block><txt break.before="0">Those leases were granted and a trades and labour hall has been erected on the land aforesaid and the land has at all times been held for the purposes of that hall and for no other purpose.</txt></block></li><li id="frnt-preamble-para1.3" guid="_011bb38b-ad6e-4db8-a9a6-31259c12e3a6" provision.type="other"><no>3</no><block><txt break.before="0">The name and style of the trustees aforesaid is now the trustees of the Ipswich Trades Hall and Labour Day Committee.</txt></block></li><li id="frnt-preamble-para1.4" guid="_7db4093a-df9a-4bbc-b6e1-0a9ad673079d" provision.type="other"><no>4</no><block><txt break.before="0">The trustees aforesaid desire to exchange the land aforesaid and all improvements thereon freed and discharged from all trusts affecting the same for certain parcels of land in Bell Street Ipswich, of which parcels Kern Corporation Ltd is the owner and for improvements to be constructed on those parcels.</txt></block></li><li id="frnt-preamble-para1.5" guid="_2ea8d423-128c-4d80-b7c4-9643db28a1eb" provision.type="other"><no>5</no><block><txt break.before="0">In consideration of the exchange aforesaid Kern Corporation Ltd is prepared to enter into an agreement that, amongst other things, Kern Corporation Ltd will cause to be designed and constructed on the parcels of land aforesaid in Bell Street Ipswich premises suitable for use in part as the Ipswich Trades Hall.</txt></block></li><li id="frnt-preamble-para1.6" guid="_f502b216-5721-4665-9214-4235462264d8" provision.type="other"><no>6</no><block><txt break.before="0">It is desirable to facilitate the objectives of the trustees and Kern Corporation Ltd in respect of the lands and improvements aforesaid.</txt></block></li></list></block></preamble></front><body numbering.style="manual"><clause id="sec.1" guid="_8d4ecda9-8a3f-4868-9861-b536ce857d91" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>1</no><heading id="sec.1-he" guid="_1e6b020e-5b34-4cfc-b993-3c4b191ed3b2">Short title</heading><block><txt break.before="1">This Act may be cited as the<legref jurisd="QLD" type="act" target.doc.id="act-1986-itha" target.version.series="7fcfa939-8ed5-44a1-95cc-bcb8bb6add4c" check="valid"><name emphasis="yes"> Ipswich Trades Hall Act 1986</name></legref>.</txt></block></clause><clause id="sec.2" guid="_4d011aee-e7c9-41ec-9462-f014cf287b5d" status="repealed" affected.by.uncommenced="0" spent.amends="0" provision.type="other" toc="no"><no>2</no><repealed><repealedtxt/></repealed><historynote><txt break.before="1"><b>s&#160;2</b> om 18 March 1996 RA s&#160;37</txt></historynote></clause><clause id="sec.4" guid="_229ff2ce-95b8-4160-aeb4-cb802ec54618" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_e30ea959-5970-40ef-ae98-445eeb9555fb">Interpretation</heading><block><txt break.before="1">In this Act—</txt><deflist><definition id="sec.4-def.BellStreetlands_" guid="_eab08243-7ed2-40be-a085-14f96fa4103c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.BellStreetlands" guid="_01f4115f-0f38-410e-95ed-0d8b373c4efe" type="definition">Bell Street lands</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.BellStreetlands-para1.a" guid="_bb63880d-c2a2-4ba3-9397-e2b1bea8472e" provision.type="other"><no>(a)</no><block><txt break.before="0">all that piece of land situate in the county of Stanley parish of Ipswich containing 212m<sup>2</sup> being lot 1 on registered plan number 132466 and being the whole of the land contained in certificate of title volume 5369 folio 104; and</txt></block></li><li id="sec.4-def.BellStreetlands-para1.b" guid="_e928f663-8ec4-4b2b-af55-e7652959d65d" provision.type="other"><no>(b)</no><block><txt break.before="0">all that piece of land situate in the county of Stanley parish of Ipswich containing 324m<sup>2</sup> being lot 2 on registered plan number 132466 and being the whole of the land contained in certificate of title volume 6491 folio 109; and</txt></block></li><li id="sec.4-def.BellStreetlands-para1.c" guid="_aee4c9bf-a29f-40bd-8d5e-df2e7ad18d9a" provision.type="other"><no>(c)</no><block><txt break.before="0">all that piece of land situate in the county of Stanley parish of Ipswich City of Ipswich commencing from the north-east corner of lot 2 on registered plan number 132466 bearing 4&#186;47'l0" for a distance of 13.242m along the western alignment of Bell Street and thence bearing 274&#186;48'20" for a distance of 24.804m, and thence bearing 184&#186;47'10" for a distance of 13.242m, and thence bearing 94&#186;48'20" for a distance of 24.804m, along the northern alignment of lots l and 2 on registered plan number 132466 back to the point of commencement and containing an area of 328m<sup>2</sup> more or less being part of allotment 14 of <intref refid="sec.3" check="invalid">section&#160;3</intref> and being part of the land contained in certificate of title volume 5003 folio 18.</txt></block></li></list></definition><definition id="sec.4-def.NicholasStreetlands_" guid="_3429a8cc-a481-4895-ab49-648f772df767" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.NicholasStreetlands" guid="_79ec541b-47e9-481c-8ab9-bcd5974a73f2" type="definition">Nicholas Street lands</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.NicholasStreetlands-para1.a" guid="_09f3b970-ac27-496d-8095-49314c5222aa" provision.type="other"><no>(a)</no><block><txt break.before="0">all that piece of land situate in the county of Stanley parish of Ipswich containing 19.84p being <intref refid="sec.4-def.NicholasStreetlands-para1.a-sdiv.2" check="invalid">subdivision&#160;2</intref> of allotment 13 of <intref refid="sec.4" target.guid="_229ff2ce-95b8-4160-aeb4-cb802ec54618" check="valid">section&#160;4</intref> and being the whole of the land contained in perpetual lease number 662;</txt></block></li><li id="sec.4-def.NicholasStreetlands-para1.b" guid="_357cfc58-12a3-46e3-bbbb-0222dcb604a6" provision.type="other"><no>(b)</no><block><txt break.before="0">all that piece of land situate in the county of Stanley parish of Ipswich containing 14.46p being <intref refid="sec.4-def.NicholasStreetlands-para1.b-sdiv.1" check="invalid">subdivision&#160;1</intref> of allotment 12 of <intref refid="sec.4" target.guid="_229ff2ce-95b8-4160-aeb4-cb802ec54618" check="valid">section&#160;4</intref> and being the whole of the land contained in perpetual lease number 1566.</txt></block></li></list></definition><definition id="sec.4-def.registrarofdealings_" guid="_62d0bdbe-51cb-4b1f-a3a8-bc4c78cfe9bd" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.registrarofdealings" guid="_5c73c551-2443-497e-9df1-f21f6df7b234" type="definition">registrar of dealings</defterm> means the registrar of dealings within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-1962-042" target.version.series="a534eabd-1836-4220-9334-2bd2d3d647be" check="valid"><name emphasis="yes">Land Act 1962</name></legref>.</txt></definition><definition id="sec.4-def.registraroftitles_" guid="_6218d084-bb9c-4672-a61f-3a8ea40fa64c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.registraroftitles" guid="_fa497fa9-5538-4711-9a29-594d596ba78f" type="definition">registrar of titles</defterm> means the registrar of titles appointed for the purposes of the <legref jurisd="QLD" type="act" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid"><name emphasis="yes">Land Title Act 1994</name></legref>.</txt></definition></deflist></block></clause><clause id="sec.5" guid="_518367b7-0afe-4d52-bcc6-d04a56591e91" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_8039d6d4-ad8f-4685-8f0b-6c8cf9bba3fb">Notification of surrender of Bell Street lands</heading><subclause id="sec.5-ssec" guid="_e6422d6b-3c81-4c71-838c-80a8dc798b74" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="1">Upon—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec-para1.a" guid="_18961afb-4fa7-451c-a317-4f91ddabf1ef" provision.type="other"><no>(a)</no><block><txt break.before="0">registration in the office of the registrar of titles of a plan of survey amalgamating the lands referred to in the definition <defterm guid="_b1cc4d0a-8650-4e23-9b66-4e0aea961510" type="mention">Bell Street lands</defterm>, <intref refid="sec.5-ssec-para1.a" target.guid="_18961afb-4fa7-451c-a317-4f91ddabf1ef" check="valid">paragraphs&#160;(a)</intref> to <intref refid="sec.5-ssec-para1.c" check="invalid">(c)</intref>; and</txt></block></li><li id="sec.5-ssec-para1.b" guid="_2037abee-9523-4ae3-aceb-773e4bb70b2b" provision.type="other"><no>(b)</no><block><txt break.before="0">registration, in accordance with <intref refid="sec.5-ssec.2" target.guid="_e29b4df8-0f2e-4f10-9e64-76e002e02e68" check="valid">subsection&#160;(2)</intref>, in the office of the registrar of titles of an instrument of transfer and surrender to Her Majesty of the Bell Street lands, the registrar of titles shall forthwith notify the registrar of dealings in writing of that transfer and surrender.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_e29b4df8-0f2e-4f10-9e64-76e002e02e68" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An instrument of transfer and surrender to Her Majesty of the Bell Street lands shall not be registered in the office of the registrar of titles unless there is lodged in that office with the instrument of transfer and surrender the written consent to the registration thereof of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_f303b56d-4d49-43bd-95f2-975a148d99a9" provision.type="other"><no>(a)</no><block><txt break.before="0">every mortgagee under a mortgage encumbrance registered or noted on an instrument of title to the Bell Street lands or any part thereof and to which those lands or that part are subject immediately before such registration; and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_94a7f8fb-0635-4389-976e-5be60046057f" provision.type="other"><no>(b)</no><block><txt break.before="0">every person whose caveat is registered or noted on an instrument of title to the Bell Street lands or any part thereof, being a caveat lawfully lodged with the registrar and that remains in force.</txt></block></li></list></block></subclause></clause><clause id="sec.6" guid="_3ea065f4-e7e4-4abe-9b52-a4fa31702fa0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_d729bca7-2b6e-41fb-bf48-005459bf26d1">Proclamation of designated day</heading><block><txt break.before="1">Upon receipt by the registrar of dealings of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-para1.a" guid="_0c666e57-ea76-456a-a2be-da434cc91ca4" provision.type="other"><no>(a)</no><block><txt break.before="0">the notification referred to in <intref refid="sec.5" target.guid="_518367b7-0afe-4d52-bcc6-d04a56591e91" check="valid">section&#160;5</intref>; and</txt></block></li><li id="sec.6-para1.b" guid="_a157b113-36ea-4fa3-bb74-4376efb1a4a6" provision.type="other"><no>(b)</no><block><txt break.before="0">a document purporting to be a copy of an agreement (duly stamped under the <legref jurisd="QLD" type="act" target.doc.id="act-1894-008" target.version.series="5f48416c-ed00-4196-a94c-e4fdfe414db1" check="valid"><name emphasis="yes">Stamp Act 1894</name></legref>) entered into by Kern Corporation Ltd and the trustees (at the time of the agreement’s execution) of the Ipswich Trades Hall and Labour Day Committee and certified on behalf of both parties to the agreement to be a true copy of the agreement, being an agreement for the design and construction on the Bell Street lands of premises suitable for use in part as the Ipswich Trades Hall; and</txt></block></li><li id="sec.6-para1.c" guid="_f3dddf44-3d07-4d17-b4a5-fcec866a259c" provision.type="other"><no>(c)</no><block><txt break.before="0">a certificate of classification as prescribed by the <legref jurisd="QLD" type="act" check="invalid"><name emphasis="no">Standard Building Law</name></legref>, <legref jurisd="QLD" type="act" refid="sec.6.3" check="invalid">section&#160;6.3</legref> under the <legref jurisd="QLD" type="act" target.doc.id="act-1975-011" target.version.series="d9daab5f-059e-488d-ba00-96f36d4a1fe5" check="valid"><name emphasis="yes">Building Act 1975</name></legref> from the Council of the City of Ipswich in respect of the building work carried out by Kern Corporation Ltd on the Bell Street lands; and</txt></block></li><li id="sec.6-para1.d" guid="_0151976e-0bfb-416f-a584-dc5ffca38906" provision.type="other"><no>(d)</no><block><txt break.before="0">a certificate from the Council of the City of Ipswich confirming that all rates, charges and fire levies payable to that council in respect of the Bell Street lands and the Nicholas Street lands, up to and including the date of execution of that certificate, have been paid; and</txt></block></li><li id="sec.6-para1.e" guid="_20453970-fc57-4785-a05c-1180a0fdf442" provision.type="other"><no>(e)</no><block><txt break.before="0">a certificate of an architect acceptable to both parties to the agreement referred to in <intref refid="sec.6-para1.b" target.guid="_a157b113-36ea-4fa3-bb74-4376efb1a4a6" check="valid">paragraph&#160;(b)</intref> that the building work carried out by Kern Corporation Ltd under that agreement has been executed to practical completion; and</txt></block></li><li id="sec.6-para1.f" guid="_499191a6-7f1e-490a-a165-c8927bc6017b" provision.type="other"><no>(f)</no><block><txt break.before="0">the written consent of every mortgagee under a mortgage encumbrance registered or noted on an instrument of lease of the Nicholas Street lands immediately before the day on which the proclamation referred to in this section is made, being a consent to the termination pursuant to <intref refid="sec.7" target.guid="_d9296810-77fb-4ad2-9503-c4a24ae5fcc2" check="valid">section&#160;7</intref> of the perpetual leases over the Nicholas Street lands;</txt></block></li></list></block><block><txt break.before="1">the Governor may by proclamation appoint a day for the purposes of this Act, which day is in this Act referred to as the <defterm id="def.designatedday" guid="_c5627422-5cc9-4714-9da2-ef3844d77b9b" type="definition">designated day</defterm>.</txt><note id="sec.6-note" guid="_4ced095c-5679-43c3-8a2c-51bd255a1793" type="editorial"><heading id="sec.6-note-he" guid="_c41a1bcf-f258-4640-83de-b7241e117716">Editor’s note—</heading><block><txt break.before="1">The designated day is 1 September 1988 (proc pubd gaz 3 September 1988 p 12).</txt></block></note></block></clause><clause id="sec.7" guid="_d9296810-77fb-4ad2-9503-c4a24ae5fcc2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_17b303a6-5cfc-4ccf-8f63-ca8dc9c36b17">Consequences upon proclamation of designated day</heading><subclause id="sec.7-ssec.1" guid="_2d29ec01-a941-4044-aa97-942742ddeaab" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Upon the designated day—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_d77ac9cb-1ada-4c6f-bf8f-6505330e8c38" provision.type="other"><no>(a)</no><block><txt break.before="0">the perpetual leases over the Nicholas Street lands shall terminate and those lands shall, subject to this Act, revert to being Crown land freed and discharged from all trusts and encumbrance easements that immediately before the designated day affected those lands; and</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_f576316d-e654-4a5c-b059-88db57b051dd" provision.type="other"><no>(b)</no><block><txt break.before="0">the Nicholas Street lands shall cease to have the benefit they had immediately before the designated day under any benefit easement; and</txt></block></li><li id="sec.7-ssec.1-para1.c" guid="_b8a5dc45-162b-496d-864e-6e8941c5f6a0" provision.type="other"><no>(c)</no><block><txt break.before="0">Kern Corporation Ltd shall be entitled to a grant by the Governor in Council of an estate in fee simple pursuant to the <legref jurisd="QLD" type="act" target.doc.id="act-1962-042" target.version.series="a534eabd-1836-4220-9334-2bd2d3d647be" check="valid"><name emphasis="yes">Land Act 1962</name></legref> in the Nicholas Street lands in priority to all other persons and the registrar of dealings is hereby authorised, for that purpose, to amalgamate the lands referred to in the definition <defterm guid="_da4adef8-8e21-4dc4-83d1-790ebdbabd16" type="mention">Nicholas Street lands</defterm>, <intref refid="sec.7-ssec.1-para1.a" target.guid="_d77ac9cb-1ada-4c6f-bf8f-6505330e8c38" check="valid">paragraphs&#160;(a)</intref> and <intref refid="sec.7-ssec.1-para1.b" target.guid="_f576316d-e654-4a5c-b059-88db57b051dd" check="valid">(b)</intref>; and</txt></block></li><li id="sec.7-ssec.1-para1.d" guid="_346ead04-6768-4bca-8094-0e2fee5d5b62" provision.type="other"><no>(d)</no><block><txt break.before="0">the trustees for the time being of the Ipswich Trades Hall and Labour Day Committee shall be entitled to a grant by the Governor in Council in trust of the Bell Street lands and the improvements thereon pursuant to the <legref jurisd="QLD" type="act" check="invalid"><name emphasis="yes">Land Act 1962-1986</name></legref> under the official name of ‘The Trustees of the Ipswich Trades Hall and Labour Day Committee’ upon the trusts and with the powers specified in <intref refid="sch.2" target.guid="_ad6230be-a90a-4708-94bc-16470bfba5ef" check="valid">schedule&#160;2</intref>; and</txt></block></li><li id="sec.7-ssec.1-para1.e" guid="_57cdec59-34f5-4046-b710-6b011375296c" provision.type="other"><no>(e)</no><block><txt break.before="0">the powers specified in <intref refid="sch.2" target.guid="_ad6230be-a90a-4708-94bc-16470bfba5ef" check="valid">schedule&#160;2</intref> shall be deemed to form part of the purposes of the Ipswich Trades Hall; and</txt></block></li><li id="sec.7-ssec.1-para1.f" guid="_e08241a5-60e2-4804-a17a-a899fc087f07" provision.type="other"><no>(f)</no><block><txt break.before="0">the purposes of the Ipswich Trades Hall shall be deemed to be public purposes within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref>.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_d19f3ca0-19a5-443e-bfb4-581deb616ba9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The specification in <intref refid="sch.2" target.guid="_ad6230be-a90a-4708-94bc-16470bfba5ef" check="valid">schedule&#160;2</intref> of a power of the trustees shall not be taken to limit the powers of the trustees pursuant to the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref> but in the event of any inconsistency between a power so specified and a provision of that Act <intref refid="sch.2" target.guid="_ad6230be-a90a-4708-94bc-16470bfba5ef" check="valid">schedule&#160;2</intref> shall prevail and the provision of that Act shall, to the extent of the inconsistency, be of no force or effect.</txt></block></subclause></clause><clause id="sec.8" guid="_222cb39f-b55f-4c5a-9055-282917646b97" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_feb3d511-be56-47c2-a812-8571f67b04b2">Effect on mortgages of attaining purposes of Act</heading><subclause id="sec.8-ssec.1" guid="_3b180f27-17bc-4d52-a95b-627f6d6aa265" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Upon the registration of the transfer and surrender to Her Majesty of the Bell Street lands, being the registration referred to in <intref refid="sec.5" target.guid="_518367b7-0afe-4d52-bcc6-d04a56591e91" check="valid">section&#160;5</intref>, those lands shall be thereby freed and discharged from—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_1a704485-5526-4c4e-aca7-853c1cf560ff" provision.type="other"><no>(a)</no><block><txt break.before="0">any charge created by a mortgage encumbrance that affected those lands; and</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_26066d08-a802-4060-9601-55bd965738f4" provision.type="other"><no>(b)</no><block><txt break.before="0">any equitable charge claimed to affect those lands;</txt></block></li></list></block><block><txt break.before="1">immediately before the registration.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_2b07bf80-4a59-4217-a09b-b3c2ac94ba44" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Upon the termination of the perpetual leases over the Nicholas Street lands, being the termination referred to in <intref refid="sec.7" target.guid="_d9296810-77fb-4ad2-9503-c4a24ae5fcc2" check="valid">section&#160;7</intref>, those lands shall be thereby freed and discharged from—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.2-para1.a" guid="_7af93b6a-5080-4606-9198-dc04e8186950" provision.type="other"><no>(a)</no><block><txt break.before="0">any charge created by a mortgage encumbrance that affected those lands; and</txt></block></li><li id="sec.8-ssec.2-para1.b" guid="_1e22e615-a797-4425-b920-6d54764a81a5" provision.type="other"><no>(b)</no><block><txt break.before="0">any equitable charge claimed to affect those lands;</txt></block></li></list></block><block><txt break.before="1">immediately before the termination.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_046c1591-2fa6-4ffb-ab7c-db5bb0a04829" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The provisions of <intref refid="sec.8-ssec.1" target.guid="_3b180f27-17bc-4d52-a95b-627f6d6aa265" check="valid">subsection&#160;(1)</intref> or <intref refid="sec.8-ssec.2" target.guid="_2b07bf80-4a59-4217-a09b-b3c2ac94ba44" check="valid">(2)</intref> shall not affect the continued operation of personal covenants or undertakings entered into by the registered proprietor or lessee of the lands therein referred to before the registration or, as the case may be, the termination therein referred to.</txt></block></subclause></clause><clause id="sec.9" guid="_70c4afe9-9845-4a82-9c47-232dbf22d4a6" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_1f4ad589-4487-41fa-9105-b7a9ed990317">Registrars to give effect to this Act</heading><subclause id="sec.9-ssec.1" guid="_1811d1de-b6f1-4872-9273-0b9f4975561c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The registrar of dealings is authorised and required to make (without further or other authority than this subsection) in the registers kept by the registrar such entries and endorsements as are necessary or desirable to give effect to the provisions of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_7c6173de-9792-40d8-863f-11dc0564988e" provision.type="other"><no>(a)</no><block><txt break.before="0"><intref refid="sec.7" target.guid="_d9296810-77fb-4ad2-9503-c4a24ae5fcc2" check="valid">section&#160;7</intref><intref refid="sec.7-ssec.1" target.guid="_2d29ec01-a941-4044-aa97-942742ddeaab" check="valid">(1)</intref><intref refid="sec.7-ssec.1-para1.a" target.guid="_d77ac9cb-1ada-4c6f-bf8f-6505330e8c38" check="valid">(a)</intref> and <intref refid="sec.7-ssec.1-para1.b" target.guid="_f576316d-e654-4a5c-b059-88db57b051dd" check="valid">(b)</intref>; and</txt></block></li><li id="sec.9-ssec.1-para1.b" guid="_075762a3-a16c-4a1f-a296-83a186fec9d0" provision.type="other"><no>(b)</no><block><txt break.before="0"><intref refid="sec.8" target.guid="_222cb39f-b55f-4c5a-9055-282917646b97" check="valid">section&#160;8</intref><intref refid="sec.8-ssec.2" target.guid="_2b07bf80-4a59-4217-a09b-b3c2ac94ba44" check="valid">(2)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_471bddbd-d28e-4ce1-ae70-623357a4917c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The registrar of titles is authorised and required to make (without further or other authority than this subsection) in the register kept by the registrar such entries and endorsements as are necessary or desirable to give effect to the provisions of <intref refid="sec.8" target.guid="_222cb39f-b55f-4c5a-9055-282917646b97" check="valid">section&#160;8</intref><intref refid="sec.8-ssec.1" target.guid="_3b180f27-17bc-4d52-a95b-627f6d6aa265" check="valid">(1)</intref>, notwithstanding any caveat that applies in respect of any of the lands in question.</txt></block></subclause><subclause id="sec.9-ssec.3" guid="_5d39f822-6789-477f-8dfa-586255b755d3" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Entries and endorsements to be made under <intref refid="sec.9-ssec.1" target.guid="_1811d1de-b6f1-4872-9273-0b9f4975561c" check="valid">subsection&#160;(1)</intref> or <intref refid="sec.9-ssec.2" target.guid="_471bddbd-d28e-4ce1-ae70-623357a4917c" check="valid">(2)</intref> shall be made without payment of any fees.</txt></block></subclause></clause><clause id="sec.10" guid="_4d0f1048-b422-45ab-b9cb-98d1875c0c5f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_1e27522f-4ebd-440b-9659-03ae52a3df31">Further provision by order in council</heading><subclause id="sec.10-ssec.1" guid="_6bcc006f-8d85-4d10-83d8-70f2ceab4e57" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Governor in Council may, from time to time, by order in council prescribe with respect to all matters that in the Governor in Council’s opinion are necessary or desirable for effectually achieving the objects and purposes of this Act.</txt></block></subclause><subclause id="sec.10-ssec.2" guid="_c7886976-fc7a-40f1-bef9-29ec5b4d03d8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The <legref jurisd="QLD" type="act" target.doc.id="act-1954-003" target.version.series="3cfb010e-ce09-4afd-baf6-bd10d22741a7" check="valid"><name emphasis="yes">Acts Interpretation Act 1954</name></legref>, <legref jurisd="QLD" type="act" refid="sec.28A" target.doc.id="act-1954-003" target.version.series="3cfb010e-ce09-4afd-baf6-bd10d22741a7" target.guid="_7d12728c-0f2b-4c0e-965d-e31980da064f" check="valid">section&#160;28A</legref> shall apply in respect of every order in council made under <intref refid="sec.10-ssec.1" target.guid="_6bcc006f-8d85-4d10-83d8-70f2ceab4e57" check="valid">subsection&#160;(1)</intref> as if the order were a regulation.</txt></block></subclause></clause><clause id="sec.11" guid="_1d688b4f-5868-4b59-b822-c742b118b35f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Governor in Council may by order in council, at the request of the Ipswich Trades Hall and Labour Day Committee, amend the trusts specified in the schedule of trusts contained in <intref refid="sch.2" target.guid="_ad6230be-a90a-4708-94bc-16470bfba5ef" check="valid">schedule&#160;2</intref> and thereupon the trusts as amended shall be deemed to be the trusts contained in <intref refid="sch.2" target.guid="_ad6230be-a90a-4708-94bc-16470bfba5ef" check="valid">schedule&#160;2</intref> for the time being.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_a58b6c05-4a11-4edd-8350-7883a8d3d7e4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The <legref jurisd="QLD" type="act" target.doc.id="act-1954-003" target.version.series="3cfb010e-ce09-4afd-baf6-bd10d22741a7" any other person shall incur any liability on account of anything done bona fide and without negligence for the purposes of this Act for loss or damage alleged to have arisen by reason Bell Street lands and powers of trustees</heading><sourceref id="sch.2-ref" guid="_c0bb92ff-259a-4e99-84af-b367eff964a6" affected.by.uncommenced="0"><intref refid="sec.7" target.guid="_d9296810-77fb-4ad2-9503-c4a24ae5fcc2" check="valid">section&#160;7</intref></sourceref><block><txt break.before="1">To hold the Bell Street lands and the improvements for the time being thereon upon trust for the purposes of the Ipswich Trades Hall with power to the trustees, free of any restriction prescribed by the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.2-para1.a" guid="_81de285b-371d-49cb-98f3-e181cbcb3370" provision.type="other"><no>(a)</no><block><txt break.before="0">to mortgage the whole or part of the lands and the improvements thereon to secure repayment of any advance or advances made in respect of those improvements and for the purpose of effecting further improvements on the lands or of maintaining the improvements on the lands and to secure payment of interest on such advance or advances;</txt></block></li><li id="sch.2-para1.b" guid="_73cba235-a939-4c93-a943-546b838f8afa" provision.type="other"><no>(b)</no><block><txt break.before="0">to let or lease, with the consent of the mortgagee (if any), the whole or part of the lands and the improvements thereon that is surplus to the requirements of the Ipswich Trades
