guid="_b61f1728-0761-4187-b0c9-7ace96bd4f4d">Serious harm element of cause of action for defamation</heading><subclause id="sec.6-frag-sec.10A-ssec.1" guid="_552c6496-ce84-45ab-90cc-90f11b03e3a3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">	It is an element (the <defterm id="sec.6-frag-sec.10A-def.seriousharmelement" guid="_22734651-be6e-4425-8ac3-84f48412442f" type="definition">serious harm element</defterm>) of a cause of action for defamation that the publication of defamatory matter about a person has caused, or is likely to cause, serious harm to the reputation of the person.</txt></block></subclause><subclause id="sec.6-frag-sec.10A-ssec.2" guid="_b92f8d71-0404-49b3-aa8a-50aaac6a4dc6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For the purposes of subsection (1), harm to the reputation of an excluded corporation is not serious harm unless it has caused, or is likely to cause, the corporation serious financial loss.</txt></block></subclause><subclause id="sec.6-frag-sec.10A-ssec.3" guid="_3a597842-3ccf-4c68-9e82-65e016072f43" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The judicial officer (and not the jury) in defamation proceedings is to determine whether the serious harm element is established.</txt></block></subclause><subclause id="sec.6-frag-sec.10A-ssec.4" guid="_6526c555-48d7-4b87-9391-aa4a2e9f8cd2" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Without limiting subsection (3), the judicial officer may (whether on the application of a party or on the judicial officer’s own motion)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-sec.10A-ssec.4-para1.a" guid="_fee3eee8-31d1-4c2a-94d5-d7b755bc4820" provision.type="other"><no>(a)</no><block><txt break.before="0">	determine whether the serious harm element is established at any time before the trial for the proceedings commences or during the trial; and</txt></block></li><li id="sec.6-frag-sec.10A-ssec.4-para1.b" guid="_90a66255-abf1-4a07-80d4-cee603ce8442" provision.type="other"><no>(b)</no><block><txt break.before="0">	make any orders the judicial officer considers appropriate concerning the determination of the issue (including dismissing the proceedings if satisfied the element is not established).</txt></block></li></list></block></subclause><subclause id="sec.6-frag-sec.10A-ssec.5" guid="_02ab8925-b8a2-42d5-92b2-630f10d7c138" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If a party applies for the serious harm element to be determined before the trial for the proceedings commences, the judicial officer is to determine the issue as soon as practicable before the trial commences unless satisfied that there are special circumstances justifying the postponement of the determination to a later stage of the proceedings (including during the trial).</txt></block></subclause><subclause id="sec.6-frag-sec.10A-ssec.6" guid="_5109c391-becd-4e44-bb1d-c7be7cd37063" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The matters a judicial officer may take into account in deciding whether there are special circumstances for the purposes of subsection (5) include (but are not limited to) the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-sec.10A-ssec.6-para1.a" guid="_887bcdb6-58d5-4a26-9106-b9f6a223da76" provision.type="other"><no>(a)</no><block><txt break.before="0">the cost implications for the parties;</txt></block></li><li id="sec.6-frag-sec.10A-ssec.6-para1.b" guid="_a44cc5e2-ffe2-4a9f-98ab-6a644f269492" provision.type="other"><no>(b)</no><block><txt break.before="0">the resources available to the court at the time;</txt></block></li><li id="sec.6-frag-sec.10A-ssec.6-para1.c" guid="_a48b0c5e-b978-49da-839f-27b8d58da00a" provision.type="other"><no>(c)</no><block><txt break.before="0">the extent to which establishing the serious harm element is linked to other issues for determination during the trial for the proceedings.</txt></block></li></list></block></subclause><subclause id="sec.6-frag-sec.10A-ssec.7" guid="_2574dde1-fc88-4c4c-9618-ae02a97af286" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">Without limiting subsection (5), the judicial officer may determine the serious harm element is not established on the pleadings without the need for further evidence if satisfied that the pleaded particulars are insufficient to establish the element.</txt></block></subclause><subclause id="sec.6-frag-sec.10A-ssec.8" guid="_2183b9d6-a206-4219-9536-87db6569f314" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">Nothing in this section limits the powers that a judicial officer may have apart from this section to dismiss defamation proceedings (whether before or after the trial commences).</txt></block></subclause></clause></fragment></block></clause><clause provision.type="other"><no>(1)</no><block><txt break.before="0">For the purpose of this Act, a notice is a <defterm id="sec.8-frag-sec.12A-def.concernsnotice" guid="_ecf75203-2744-4866-8060-51f59abcb3ac" type="definition">concerns notice</defterm> if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.12A-ssec.1-para1.a" guid="_27164385-aa59-4078-b295-e3662768d090" provision.type="other"><no>(a)</no><block><txt break.before="0">the notice—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.12A-ssec.1-para1.a-para2.i" guid="_1289a018-0123-4464-bfde-54dbb7befd14" provision.type="other"><no>(i)</no><block><txt break.before="0">	is in writing; and</txt></block></li><li id="sec.8-frag-sec.12A-ssec.1-para1.a-para2.ii" guid="_ca762310-0f5c-4428-9eb7-d0514f6fdd70" provision.type="other"><no>(ii)</no><block><txt break.before="0">	specifies the location where the matter in question can be accessed (for example, a webpage address); and</txt></block></li><li id="sec.8-frag-sec.12A-ssec.1-para1.a-para2.iii" guid="_0eabb107-109c-412e-a23f-e602d4a82dff" provision.type="other"><no>(iii)</no><block><txt break.before="0">	informs the publisher of the defamatory imputations that the aggrieved person considers are or may be carried about the aggrieved person by the matter in question; and</txt></block></li><li id="sec.8-frag-sec.12A-ssec.1-para1.a-para2.iv" guid="_681eec23-fd96-47db-ad66-8e23bfb29490" provision.type="other"><no>(iv)</no><block><txt break.before="0">	informs the publisher of the harm that the person considers to be serious harm to the person’s reputation caused, or likely to be caused, by the publication of the matter in question; and</txt></block></li><li id="sec.8-frag-sec.12A-ssec.1-para1.a-para2.v" guid="_4ae55ba4-108e-41c0-91e3-9168aed95c9c" provision.type="other"><no>(v)</no><block><txt break.before="0">	for an aggrieved person that is an excluded corporation—also informs the publisher of the financial loss that the corporation considers to be serious financial loss caused, or likely to be caused, by the publication of the matter in question; and</txt></block></li></list></block></li><li id="sec.8-frag-sec.12A-ssec.1-para1.b" guid="_4bf7dd4d-ee84-4e20-b601-440c0bff3132" provision.type="other"><no>(b)</no><block><txt break.before="0">a copy of the matter in question is, if practicable, provided to the publisher together with the notice.</txt></block></li></list><note id="sec.8-frag-sec.12A-ssec.1-note" guid="_a35daca3-f6ec-4092-9096-80027601baba" type="example"><heading id="sec.8-frag-sec.12A-ssec.1-note-he" guid="_f87e914a-411a-4e99-b92c-4691ff195ec4">Note—</heading><block><txt break.before="1">Section 12B requires a concerns notice to be given before proceedings for defamation can be provision.type="other"><no>(2)</no><block><txt break.before="0">	For the avoidance of doubt, a document that is required to be filed or lodged to commence defamation proceedings can not be used as a concerns notice.</txt></block></subclause><subclause id="sec.8-frag-sec.12A-ssec.3" guid="_d5fba2ea-6ea8-4eb1-bf34-4d66944d34b7" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a concerns notice fails to particularise adequately any of the information required by subsection (1)(a)(ii), (iii), (iv) or (v), the publisher may give the aggrieved person a written notice (a <defterm id="sec.8-frag-sec.12A-def.furtherparticularsnotice" guid="_e036ca06-69d8-4253-9278-2fcbfe0d4fbb" type="definition">further particulars notice</defterm>) requesting that the aggrieved person provide reasonable further particulars as specified in the further particulars notice about the information concerned.</txt></block></subclause><subclause id="sec.8-frag-sec.12A-ssec.4" guid="_6afe3333-e3f1-4f56-b2da-947c4dc0cc2b" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">An aggrieved person to whom a further particulars notice is given must provide the reasonable further particulars specified in the notice within 14 days (or any further period agreed by the publisher and aggrieved person) after being given the notice.</txt></block></subclause><subclause id="sec.8-frag-sec.12A-ssec.5" guid="_c23f9e5e-e9fa-4620-9df5-cdc71b4fa249" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">An aggrieved person who fails to provide the reasonable further particulars specified in a further particulars notice within the applicable period is taken not to have given the publisher a concerns notice for the purposes of this section.</txt></block></subclause></clause><clause id="sec.8-frag-sec.12B" guid="_ce92e04c-48a9-4604-b7be-40576e181dc7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12B</no><heading id="sec.8-frag-sec.12B-he" guid="_667fd3be-6dfc-4462-be68-b18073fef3b3">Defamation proceedings can not be commenced without concerns notice</heading><subclause id="sec.8-frag-sec.12B-ssec.1" guid="_2e1e2b07-55f5-41fa-8acd-7dfa8db06562" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">	An aggrieved person can not commence defamation proceedings unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.12B-ssec.1-para1.a" guid="_10b17271-4fb6-4302-bd14-2fbf4f674073" provision.type="other"><no>(a)</no><block><txt break.before="0">the person has given the proposed defendant a concerns notice in respect of the matter concerned; and</txt></block></li><li id="sec.8-frag-sec.12B-ssec.1-para1.b" guid="_710bedb8-4f7e-445f-8930-24f9a3635da7" provision.type="other"><no>(b)</no><block><txt break.before="0">the imputations to be relied on by the person in the proposed proceedings were particularised in the concerns notice; and</txt></block></li><li id="sec.8-frag-sec.12B-ssec.1-para1.c" guid="_a1a6bbee-84c6-4b36-be06-8843d905fcb8" provision.type="other"><no>(c)</no><block><txt break.before="0">	the applicable period for an offer to make amends has elapsed.</txt></block></li></list></block></subclause><subclause id="sec.8-frag-sec.12B-ssec.2" guid="_27c2fd37-9638-4e6d-b4d9-2815f8cae113" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subsection (1)(b) does not prevent reliance on—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.12B-ssec.2-para1.a" guid="_c54f4657-1def-416f-a879-0fef50e1a967" provision.type="other"><no>(a)</no><block><txt break.before="0">some, but not all, of the imputations particularised in a concerns notice; or</txt></block></li><li id="sec.8-frag-sec.12B-ssec.2-para1.b" guid="_164a985b-3368-4588-967e-9cb0a7cf4c58" provision.type="other"><no>(b)</no><block><txt break.before="0">	imputations that are substantially the same as those particularised in a concerns notice.</txt></block></li></list></block></subclause><subclause id="sec.8-frag-sec.12B-ssec.3" guid="_d381956e-e888-4762-913f-8eea413bf670" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The court may grant leave for proceedings to be commenced despite non-compliance with subsection (1)(c), but only if the proposed plaintiff satisfies the court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.12B-ssec.3-para1.a" guid="_236299cb-74f5-4a1a-8786-9b8d97c36075" provision.type="other"><no>(a)</no><block><txt break.before="0">the commencement of proceedings after the end of the applicable period for an offer to make amends contravenes the limitation law; or</txt></block></li><li id="sec.8-frag-sec.12B-ssec.3-para1.b" guid="_8e5ff163-5e11-4ef3-95a5-828597c232f6" provision.type="other"><no>(b)</no><block><txt break.before="0">	it is just and reasonable to grant leave.</txt></block></li></list></block></subclause><subclause id="sec.8-frag-sec.12B-ssec.4" guid="_3cc9707f-699f-43b7-859e-d7c1b59fe16b" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The commencement of proceedings contravenes the limitation law for the purposes of subsection (3)(a) if the proceedings could not be commenced after the end of the applicable period for an offer to make amends because the court will have ceased to have power to extend the limitation period.</txt></block></subclause><subclause id="sec.8-frag-sec.12B-ssec.5" guid="_5ea8673e-63b3-4f79-82f8-c969c0652538" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this id="sec.10-ssec.4-frag-ssec.1A-para1.b" guid="_a29cc01b-06c1-4c93-abff-a4d9664c2b38" provision.type="other"><no>(b)</no><block><txt break.before="0">if the matter has been published on a website or any other electronically accessible location—an offer to remove the matter from the website or location; or</txt></block></li><li id="sec.10-ssec.4-frag-ssec.1A-para1.c" guid="_159b34ed-6be3-417e-9c96-7fed91935d86" provision.type="other"><no>(c)</no><block><txt break.before="0">an offer to pay compensation for any economic or non-economic loss of the aggrieved person; which the matter published distinguishes between suspicions, allegations and proven facts;</txt></block></li><li id="sec.16-frag-sec.29A-ssec.3-para1.c" guid="_063995ad-a3c7-4092-bd92-004a34aac17e" provision.type="other"><no>(c)</no><block><txt break.before="0">	the extent to which the matter published relates to the performance of the public functions or activities of the person;</txt></block></li><li id="sec.16-frag-sec.29A-ssec.3-para1.d" guid="_e2b9da8d-69ac-4449-aced-acc9a44c348f" provision.type="other"><no>(d)</no><block><txt break.before="0">whether it was in the public interest in the circumstances for the matter to be published expeditiously;</txt></block></li><li id="sec.16-frag-sec.29A-ssec.3-para1.e" guid="_a5e20c80-3e20-47a7-a343-b2b48dfc8fc6" provision.type="other"><no>(e)</no><block><txt break.before="0">the sources of the information in the matter published, including the integrity of the sources;</txt></block></li><li id="sec.16-frag-sec.29A-ssec.3-para1.f" guid="_dce273a1-6e22-4780-a0ee-e7c8998865bf" provision.type="other"><no>(f)</no><block><txt break.before="0">if a source of the information in the matter published is a person whose identity is being kept confidential, whether there is good reason for the person’s identity to be kept confidential (including, for example, to comply with an applicable professional code or standard);</txt></block></li><li id="sec.16-frag-sec.29A-ssec.3-para1.g" guid="_ce810475-211e-4bf4-9679-fabdc1dd69f3" provision.type="other"><no>(g)</no><block><txt break.before="0">whether the matter published contained the substance of the person’s side of the story and, if not, whether a reasonable attempt was made by the defendant to obtain and publish a response from the person;</txt></block></li><li id="sec.16-frag-sec.29A-ssec.3-para1.h" guid="_dd89a2f7-7253-4bb6-99f4-a8189293ec40" provision.type="other"><no>(h)</no><block><txt break.before="0">any other steps taken to verify the information in the matter published;</txt></block></li><li id="sec.16-frag-sec.29A-ssec.3-para1.i" guid="_5d111df2-f050-4152-af21-22a86ea3cc53" provision.type="other"><no>(i)</no><block><txt break.before="0">the importance of freedom of expression in the discussion of issues of public interest.</txt></block></li></list></block></subclause><subclause id="sec.16-frag-sec.29A-ssec.4" guid="_f798b20f-ab85-4029-b769-bbd5a8941757" affected.by.uncommenced="0" which the matter published distinguishes between suspicions, allegations and proven facts;</txt></block></li><li id="sec.17-ssec.1-frag-ssec.3-para1.c" guid="_b66de7ba-85b3-45e7-bffa-1e5e159631da" provision.type="other"><no>(c)</no><block><txt break.before="0">	the nature of the business environment in which the defendant operates;</txt></block></li><li id="sec.17-ssec.1-frag-ssec.3-para1.d" guid="_b7e8e6eb-c746-45a4-bc79-7bfde4d73181" provision.type="other"><no>(d)</no><block><txt break.before="0">	whether it was appropriate in the circumstances for the matter to be published expeditiously;</txt></block></li><li id="sec.17-ssec.1-frag-ssec.3-para1.e" guid="_1bdda47b-30d2-4178-b565-b13fb10b853a" provision.type="other"><no>(e)</no><block><txt break.before="0">	any other steps taken to verify the information in the matter published. </txt></block></li></list></block></subclause><subclause id="sec.17-ssec.1-frag-ssec.3A" guid="_ba9895e8-7dc2-41fe-a3fa-f8ce72183093" guid="_c85114b2-b6c8-4585-a570-b0cf1fdd95e1" provision.type="other"><no>(b)</no><block><txt break.before="0">the matter relates to a scientific or academic issue; and</txt></block></li><li id="sec.18-frag-sec.30A-ssec.1-para1.c" guid="_c0a58910-3b55-47a5-a80c-70a8edb541d0" provision.type="other"><no>(c)</no><block><txt break.before="0">	an independent review of the matter’s scientific or academic merit was carried out before the matter was published in the journal by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-frag-sec.30A-ssec.1-para1.c-para2.i" guid="_34098ffd-c258-4ebd-af7c-dde9d2c060fd" provision.type="other"><no>(i)</no><block><txt break.before="0">the editor of the journal if the editor has expertise in the scientific or academic issue concerned; or</txt></block></li><li id="sec.18-frag-sec.30A-ssec.1-para1.c-para2.ii" guid="_06fc3779-24b4-4149-9756-2428cf388453" provision.type="other"><no>(ii)</no><block><txt break.before="0">1 or in a scientific or academic journal because of subsection (1), there is also a defence to the publication of any assessment of the matter in the same journal if the defendant proves that—</txt><list assessment was written by 1 or more of the persons who carried out the independent review of the matter; and</txt></block></li><li id="sec.18-frag-sec.30A-ssec.2-para1.b" guid="_c2d4fa1a-fa00-4d1c-8893-9e6660119f33" provision.type="other"><no>(b)</no><block><txt break.before="0">	the assessment was written in the course of that provision.type="other"><no>(3)</no><block><txt break.before="0">It is a defence to the publication of defamatory matter if the defendant proves that the matter was contained in a fair summary of, or general terms in the published matter; or</txt></block></li><li id="sec.19-frag-ssec.5-para1.a-para2.ii" guid="_6337fc4b-9ba9-4412-9718-b3eff2d4b38c" provision.type="other"><no>(ii)</no><block><txt break.before="0">notorious; or</txt></block></li><li id="sec.19-frag-ssec.5-para1.a-para2.iii" guid="_4530d20b-be19-427d-9aa9-3bb938f2a739" provision.type="other"><no>(iii)</no><block><txt break.before="0">	accessible from a reference, link or other access point included in the matter (for example, a hyperlink on a webpage); or</txt></block></li><li id="sec.19-frag-ssec.5-para1.a-para2.iv" guid="_e4a41e29-e2f5-411f-a9a3-09ad20745d82" provision.type="other"><no>(iv)</no><block><txt break.before="0">otherwise apparent from the context in which the
