								<txt break.before="1">The Chief Judge is responsible for the administration of the P&#38;E Court and for ensuring the orderly and expeditious exercise of the jurisdiction and powers of the P&#38;E Court.</txt>

								<txt break.before="1">Subject to any Act, the Chief Judge has power to do all things necessary or convenient to perform the functions mentioned in subsection (1).</txt>

								<txt break.before="1">Unless the Supreme Court decides a P&#38;E Court decision or other matter under a relevant enabling Act is affected by jurisdictional error, the decision or matter is non-appealable, other than—</txt>

							<txt break.before="1">A P&#38;E Court judge retains all of the judge’s jurisdiction as a District Court judge.</txt>
						</block>

											<txt break.before="1">the court is satisfied the matter should be dealt with by the tribunal;</txt>

								<txt break.before="1">In conducting P&#38;E Court proceedings and applying the rules, the P&#38;E Court must—</txt>

											<txt break.before="1">avoid undue delay, expense and technicality.</txt>

								<txt break.before="1">The parties to a P&#38;E Court proceeding impliedly undertake to the court and each other to proceed in an expeditious way.</txt>

								<txt break.before="1">Any person may start a P&#38;E Court proceeding seeking a declaration (a <defterm id="sec-oc.11-def.declaratoryproceeding" guid="_8b9e8129-9da4-46e2-b746-592306f73f0a" type="definition">declaratory proceeding</defterm>) about—</txt>

											<txt break.before="1">a matter done, to be done or that should have been done for this Act or the Planning Act; or</txt>

											<txt break.before="1">the interpretation of this Act or the Planning Act; or</txt>

											<txt break.before="1">the lawfulness of land use or development under the Planning Act; or</txt>

											<txt break.before="1">the construction of a land use plan under the <legref jurisd="QLD" type="act" check="unknown">
													<name emphasis="yes">Airport Assets (Restructuring and Disposal) Act 2008</name>
												</legref> and the interpretation of chapter 3, part 1 of that Act; or</txt>
										</block>
									</li>
									<li id="sec-oc.11-ssec-para1-oc.5" guid="_e01b4573-3e02-4f7c-b49b-2d12d45914d1" provision.type="other">
										<no/>
										<block>
											<txt break.before="1">the construction of the Brisbane port LUP under the <legref jurisd="QLD" type="act" check="unknown">
													<name emphasis="yes">Transport Infrastructure Act 1994</name>
												</legref>.</txt>

															<name emphasis="yes">Acts Interpretation Act 1954</name>
														</legref>, section 7, a reference to an Act in this list of subject matter about which a declaration may be sought includes a reference to the statutory instruments made under the Act.</txt>
