to be transported to a circuit breaker site</txt></block></li><li id="sec.13-frag-sec.52AB-ssec.3-para1.e-note-para2-oc.2" guid="_c27d28c0-a911-44b6-9003-2a98c864fd7d" provision.type="other" guid="_3935fb58-bd93-480a-9485-e26d8e1b0f65" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A circuit breaker order made for a child must require—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-frag-div.9A-sec.206D-ssec.1-para1.a" guid="_3bc008ac-2c2d-4ec3-b160-4d67972528df" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">that the child report in person to the chief executive within 1 business day after the order is made, or any longer period that is specified in the order, unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-frag-div.9A-sec.206D-ssec.1-para1.a-para2.i" guid="_50918d07-6a93-46eb-8a0a-02cf5d73cbd8" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the child is at a circuit breaker site because the court previously has imposed on the child a circuit breaker condition; or</txt></block></li><li id="sec.20-frag-div.9A-sec.206D-ssec.1-para1.a-para2.ii" guid="_90e20ccb-8977-4560-97de-1d3326f00881" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the child is subject to a detention order; and</txt></block></li></list></block></li><li participate as directed by the chief executive in a circuit breaker program for the period of at least 3 months but not more than 6 months as stated in the order (the <defterm id="sec.20-frag-div.9A-sec.206D-ssec.1-para1.c" guid="_598192ca-a13c-4441-b2d3-0c3b0ed80a2f" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">that, during the program period for the order—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-frag-div.9A-sec.206D-ssec.1-para1.c-para2.i" guid="_c6a5e1c9-f893-4ec8-907b-78609b85d2a9" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the child abstain from violation of the law; and</txt></block></li><li id="sec.20-frag-div.9A-sec.206D-ssec.1-para1.c-para2.ii" guid="_167deb06-d22d-4af9-8263-ee8da9094792" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the child satisfactorily participate in activities as directed by the chief executive; and</txt></block></li><li id="sec.20-frag-div.9A-sec.206D-ssec.1-para1.c-para2.iii" guid="_f423ffe9-4ab9-4860-a7b5-01fd72f5c1b3" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the child comply with every reasonable direction of the chief a part of the period of the order, with conditions the court considers necessary or desirable, including any condition the court considers necessary to facilitate the participation of the child in the break.before="0">facilitate access to education appropriate to the child’s age and development; and</txt></block></li><li id="sec.25-frag-pt.8B-div.3-sec.282S-ssec.3-para1.b" guid="_fb6d2cae-4696-4fe0-b7a2-5548f04ba8c7" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">appropriately support the child’s engagement in the education.</txt></block></li></list></block></subclause><subclause id="sec.25-frag-pt.8B-div.3-sec.282S-ssec.4" guid="_e8ad1890-98c5-42c2-a104-8200df2e0abe" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Without limiting any other provision of this division, a regulation may prescribe other responsibilities of a circuit breaker provider in relation to the implementation of the provider’s circuit breaker program.</txt></block></subclause></clause><clause id="sec.25-frag-pt.8B-div.3-sec.282T" guid="_d828b563-d683-4440-a613-53d1705cac11" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>282T </no><heading id="sec.25-frag-pt.8B-div.3-sec.282T-he" guid="_f6894589-062e-480c-8ba5-20cab75e637f">Recordings in circuit breaker sites</heading><subclause id="sec.25-frag-pt.8B-div.3-sec.282T-ssec.1" guid="_fe848efe-f8a1-4803-bf71-4e4d84f43325" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A circuit breaker provider may, for carrying out the provider’s responsibilities under section&#160;282S(1), record images or sounds at the provider’s circuit breaker site.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.3-sec.282T-ssec.2" guid="_9db0b348-42f0-497f-a656-d3e06ab80778" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, the circuit breaker provider must not record a communication between a child participating in the provider’s circuit breaker program and any of the following persons—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.3-sec.282T-ssec.2-para1.a" guid="_942ed1ed-2538-45b8-9e07-5e3934c4e5db" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the child’s lawyer; </txt></block></li><li id="sec.25-frag-pt.8B-div.3-sec.282T-ssec.2-para1.b" guid="_d52af96d-dd2e-488c-8722-ea08f2c210a8" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">an officer of a law enforcement agency;</txt></block></li><li id="sec.25-frag-pt.8B-div.3-sec.282T-ssec.2-para1.c" guid="_ff63ce27-eb94-43e5-a32d-76977801062c" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the ombudsman;</txt></block></li><li id="sec.25-frag-pt.8B-div.3-sec.282T-ssec.2-para1.d" provision.type="other"><no>(3)</no><block><txt break.before="0">Also, the circuit breaker provider must not record a telephone conversation between a child participating in the provider’s circuit breaker program and someone else unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.3-sec.282T-ssec.3-para1.a" guid="_73310fe3-4e02-4e28-9974-316c65875d11" provision.type="other" affected.by.uncommenced="0"><no>(a) </no><block><txt break.before="0">the recording of the conversation is made for a purpose, and in accordance with the requirements, break.before="0">The chief executive must make guidelines about the recording of images or sounds at circuit breaker sites under section&#160;282T. </txt></block></subclause><subclause provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">an employee or a contractor of the circuit breaker provider at the circuit breaker site; guid="_f955b9ff-7c06-4d87-a029-ad162b64c80e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive must decide the circuit breaker site at which a child subject to a circuit breaker condition imposed on a grant of bail to the child, or subject to a circuit breaker order, is to participate in a circuit breaker program.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282V-ssec.2" guid="_c0a2f4fb-acdf-4702-a0be-825ee91987a8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may direct that a child participating in a circuit breaker program at a circuit breaker site be transferred to another circuit breaker site.</txt></block></subclause></clause><clause id="sec.25-frag-pt.8B-div.4-sec.282W" guid="_b053f88e-78f1-4718-98af-ee6df64edf73" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>282W </no><heading id="sec.25-frag-pt.8B-div.4-sec.282W-he" guid="_b4abda21-25c2-4e86-94a4-865f34ae61f9">Child must be given information on entry to circuit breaker site</heading><subclause id="sec.25-frag-pt.8B-div.4-sec.282W-ssec.1" guid="_4df6fba8-cd29-4380-a4e9-966a80d1ab11" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A circuit breaker provider must ensure that, as soon as practicable after a child who is participating in the provider’s circuit breaker program first attends the provider’s circuit breaker site, the child is given a document containing the following information—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.4-sec.282W-ssec.1-para1.a" guid="_31cac425-0469-409e-88ca-686b91585231" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the rules governing the circuit breaker site;</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282W-ssec.1-para1.b" guid="_53fd7bd9-45ef-4a29-9824-9636d7ffa25d" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the child’s rights and responsibilities under the youth justice principles;</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282W-ssec.1-para1.c" guid="_f23ce92e-7704-4bbf-87a3-ae1e03489fd8" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">how, and to whom, the child may make a complaint about a matter relating to the circuit breaker program;</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282W-ssec.1-para1.d" guid="_f6e351e9-c017-47b0-9134-204d833f1901" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">how the child can access legal services during the circuit breaker program;</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282W-ssec.1-para1.e" guid="_69a21b0c-248b-498d-bac9-f4163a5f5e31" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">the obligation on an employee or contractor of a circuit breaker provider under section&#160;282X to report any harm the child suffers during the circuit breaker program;</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282W-ssec.1-para1.f" guid="_726ba9a1-5bb7-4757-b8ab-914c52457934" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">any other information the circuit breaker provider considers appropriate.</txt></block></li></list></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282W-ssec.2" guid="_8194146a-9052-474e-8b23-80720855276c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The circuit breaker provider must also ensure the information in the document is orally explained to the child in a way, and to an extent, that is reasonable, having regard to the child’s age and ability to understand.</txt></block></subclause></clause><clause id="sec.25-frag-pt.8B-div.4-sec.282X" guid="_6acd577c-5154-4070-8040-63f36e9cb5da" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>282X </no><heading id="sec.25-frag-pt.8B-div.4-sec.282X-he" guid="_a007ebce-3a74-49cd-b607-e72adf95279e">Obligation to report harm to children participating in circuit breaker programs</heading><subclause id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.1" guid="_4e3adcba-9ca8-4e06-8a8d-5d4251609e81" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If a circuit breaker provider, or an employee or contractor of a circuit breaker provider, (each a <defterm id="sec.25-frag-pt.8B-div.4-sec.282X-def.reportingentity" guid="_30076683-7035-4823-8973-74bda24fbaa0" type="definition">reporting entity</defterm>) becomes aware, or reasonably suspects, that a child has suffered harm while participating in the provider’s circuit breaker program, the reporting entity must, unless the reporting entity has a reasonable excuse, report the harm or suspected harm to the chief executive—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.1-para1.a" guid="_46c5319b-3b31-4b6c-a92e-abb585334bd1" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">immediately; and</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.1-para1.b" guid="_878ac031-7ea7-45a7-9669-e56d00cd43a1" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if a regulation is in force under subsection (3)—in compliance with the regulation.</txt></block></li></list><penalty id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.1-pen" guid="_68ac16cc-5c21-4301-8d86-bb47449c84ef"><block><txt break.before="1">Maximum penalty—20 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.2" guid="_b049ce48-e710-4dc8-975d-a94ec4a473b7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">It is immaterial how the harm was caused.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.3" guid="_bee1571c-4b22-4065-9e70-c03ba56e6d14" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A regulation may prescribe the way the report must be given or the particulars that the report must include.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.4" guid="_87bd2893-280e-49e3-86ac-3b0f990dbd4f" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">It is a reasonable excuse for the reporting entity not to report a matter that reporting the matter might tend to incriminate the reporting entity.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.5" guid="_ee93237e-b45d-4929-9413-85dc9c0d31ac" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Subsection (1) does not apply if the reporting entity knows or reasonably considers that the chief executive is aware of the harm or suspected harm.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.6" guid="_89121b80-cc0e-460e-9d58-500b0138b210" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.6-def.harm_" guid="_e841da6b-eace-4043-8aad-b0a93960e4e5" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.25-frag-pt.8B-div.4-sec.282X-ssec.6-def.harm" guid="_0d46a9bd-ea5a-46bf-9f9f-caf0419b8f34" type="definition">harm</defterm>, to a child, is any detrimental effect of a significant nature in the child’s physical, psychological or emotional wellbeing.</txt></definition></deflist></block></subclause></clause><clause id="sec.25-frag-pt.8B-div.4-sec.282Y" guid="_4dbfbfe6-fa0a-4d80-a7e4-13647764f649" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>282Y </no><heading id="sec.25-frag-pt.8B-div.4-sec.282Y-he" guid="_38db7da4-388b-4704-bb67-6d49bbad8b36">Chief executive may authorise medical treatment</heading><block><txt break.before="1">Despite any other Act or law, the chief executive is authorised to give consent to any medical treatment of a child participating in a circuit breaker program if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.4-sec.282Y-para1.a" guid="_dcafff13-6e53-494a-b007-c1261d45a208" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the medical treatment requires the consent of a guardian of the child; and</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282Y-para1.b" guid="_70068606-0e59-4f18-8f1a-f00780dd34c1" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the chief executive is unable to ascertain the whereabouts of a guardian of the child despite reasonable inquiries; and</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282Y-para1.c" guid="_74e758b7-4a40-4287-8c32-aa0f9f9df18e" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">it would be detrimental to the child’s health to delay the medical treatment until the guardian’s consent can be obtained.</txt></block></li></list></block></clause><clause id="sec.25-frag-pt.8B-div.4-sec.282Z" guid="_520dc5c5-6e20-4382-9cd7-ae29baed320d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>282Z </no><heading id="sec.25-frag-pt.8B-div.4-sec.282Z-he" guid="_23d8ae3c-d69a-4bf7-91bd-ff953d6a123b">Ordinary visitor</heading><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.1" guid="_780e6353-36d7-41ba-94f3-55bbef6b4e7d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section does not apply to any of the following persons—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.1-para1.a" guid="_0a51af50-a743-4dcd-bb0b-e070a1d594c9" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a community visitor (child);</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.1-para1.b" guid="_fdf27e1b-8e46-42f6-b098-1d4ddfa1f0da" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a child advocacy officer;</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.1-para1.c" guid="_a2643ebb-3c27-434d-ae71-62b10fa1b8b7" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the chief executive.</txt></block></li></list></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.2" guid="_386e5a5a-91db-4254-be18-8bc13535a32a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A circuit breaker provider may approve the entry of visitors to the provider’s circuit breaker site either generally or in a particular case.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.3" guid="_8106bc5e-fa7f-4736-a704-2fef30bcbf0c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The circuit breaker provider may refuse entry to the provider’s circuit breaker site to a person if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.3-para1.a" guid="_606f2178-49c3-463e-84a1-3d642195c23b" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">in the circuit breaker provider’s opinion, the person’s presence at the circuit breaker site would prejudice the security or good order of the circuit breaker site; or</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.3-para1.b" guid="_0b4ddbda-7103-4dba-87d7-3507091fe8e2" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the person does not, on request, give the person’s name, address or proof of identity; or</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.3-para1.c" guid="_44f695a3-5192-4ce0-85a1-4e342dbfabeb" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the person refuses to comply with a request made under subsection&#160;(5).</txt></block></li></list></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.4" guid="_8aa8ae82-b983-4a51-a89d-724fb40760bf" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Subject to section&#160;282ZC, the circuit breaker provider may require a visit to the circuit breaker site to take place in the presence, or under the supervision, of an employee or contractor of the circuit breaker provider.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.5" guid="_ab0343fb-8c86-411a-96c6-cee6d45b3283" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The circuit breaker provider may, on reasonable grounds, ask a visitor to the circuit breaker site to submit anything in the visitor’s possession to a search by an employee or contractor of the circuit breaker provider.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.6" guid="_db7b39c2-5630-45fa-aa7e-40d109b04e9a" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The circuit breaker provider may give a visitor who has entered the circuit breaker site a direction the provider considers necessary for the security or good order of the site.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.7" guid="_67b3998c-e5cd-471a-8dba-8ecdcb36fada" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">If a visitor refuses to submit to a search requested under subsection&#160;(5) or fails to comply with a direction under subsection&#160;(6), the circuit breaker provider may ask the visitor to leave the circuit breaker site immediately.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.8" guid="_e413048c-d832-44d5-b37c-a1b52ec0660f" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">A police officer or an employee or contractor of the circuit breaker provider may, using force that is reasonable and necessary, remove from the circuit breaker site a visitor who refuses to leave the site immediately when requested to leave.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.9" guid="_aba5bcdc-5e18-4935-b57e-ede37fd257e5" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">However, the employee or contractor may use force that is reasonable and necessary to remove the visitor under subsection (8) only if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.9-para1.a" guid="_31230263-f240-47d3-89c9-14cea16a26a5" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the employee or contractor has successfully completed targeted physical intervention training; and</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282Z-ssec.9-para1.b" guid="_3416a940-6a34-4afe-813b-172217e378bc" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the employee or contractor reasonably believes the visitor will not leave the circuit breaker site unless the employee or contractor uses force as mentioned in subsection (8).</txt></block></li></list></block></subclause></clause><clause id="sec.25-frag-pt.8B-div.4-sec.282ZA" guid="_ab763422-3f7b-456b-a8d9-f112e746410b" affected.by.uncommenced="0" spent.amends="0" entry</heading><subclause id="sec.25-frag-pt.8B-div.4-sec.282ZA-ssec.1" guid="_d34e3096-6f51-4728-96a2-862707222d1f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person refused entry to a circuit breaker site may make a complaint to the chief executive about the refusal.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282ZA-ssec.2" guid="_433986a2-8957-4430-8422-d5a123c814b3" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may direct the circuit breaker provider who operates a circuit breaker site to permit entry of a person to the site.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282ZA-ssec.3" guid="_8b497516-7b02-4398-8f5f-c9664e1f6f63" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The circuit breaker provider must comply with a direction under subsection (2).</txt></block></subclause></clause><clause id="sec.25-frag-pt.8B-div.4-sec.282ZB" guid="_b13664e5-cd34-4cca-8d36-a660e981a9a2" access to lawyer</heading><block><txt break.before="1">A circuit breaker provider must ensure that, if a child participating in a circuit breaker provider’s circuit breaker program asks the provider or an employee or contractor of the provider for help in gaining access to a lawyer, the child is given the help that is reasonable in the circumstances.</txt></block></clause><clause id="sec.25-frag-pt.8B-div.4-sec.282ZC" guid="_6b59f5d8-44af-4392-ab33-b1bf0713832d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>282ZC </no><heading id="sec.25-frag-pt.8B-div.4-sec.282ZC-he" guid="_d5c525f9-a7ea-4b40-aa1d-6c5e51ade2a1">Protection of lawyer representing child</heading><subclause id="sec.25-frag-pt.8B-div.4-sec.282ZC-ssec.1" guid="_01776d3d-eed9-4b54-a464-6e83a8c50e07" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A lawyer representing a child participating in a circuit breaker provider’s circuit breaker program is entitled to access to the child at all reasonable times.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282ZC-ssec.2" guid="_3bbf10f9-da0d-4ca0-9668-cc24ae06821b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The circuit breaker provider or an employee or a contractor of a circuit breaker provider (each a <defterm id="sec.25-frag-pt.8B-div.4-sec.282ZC-def.relevantentity" guid="_b69f6496-72ca-4b71-9ad3-b979234b2801" type="definition">relevant entity</defterm>)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.4-sec.282ZC-ssec.2-para1.a" guid="_f51ff639-507c-413d-b8a4-68f3a95e464f" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">must allow the lawyer to conduct an interview with the child out of the hearing of any other person; and</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282ZC-ssec.2-para1.b" guid="_6a89a14c-eaac-4cbe-aae9-eda2d31a2d07" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">must not open, copy, remove or read any correspondence—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-frag-pt.8B-div.4-sec.282ZC-ssec.2-para1.b-para2.i" guid="_b0ef201f-89ac-4a67-a43e-5c2444c4baa1" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">from the child to the lawyer; or</txt></block></li><li id="sec.25-frag-pt.8B-div.4-sec.282ZC-ssec.2-para1.b-para2.ii" guid="_1fdd4237-3ae1-41a2-b30c-1300a7d6f837" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">from the lawyer to the child.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282ZC-ssec.3" guid="_5df1ffa4-5c3f-483d-bede-f0fb40863064" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Subsection&#160;(2)(b) does not prevent the relevant entity from handling the correspondence to the extent necessary to give the child access to the correspondence or, at the child’s request, to store the correspondence in a secure place.</txt></block></subclause></clause><clause id="sec.25-frag-pt.8B-div.4-sec.282ZD" guid="_eb45d015-a8c7-48f7-8929-63fb500529f9" affected.by.uncommenced="0" spent.amends="0" id="sec.25-frag-pt.8B-div.4-sec.282ZD-ssec.1" guid="_a2781770-77a3-4636-9f40-21e813d77220" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A child or parent of a child participating in a circuit breaker program may make a complaint about a matter that affects the child.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282ZD-ssec.2" guid="_4412426f-d8f6-4f5b-8c44-c9ae493132a7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive must issue written instructions on how a complaint may be made and dealt with, which may include the direction of the complaint to the chief executive or other appropriate authority.</txt></block></subclause><subclause id="sec.25-frag-pt.8B-div.4-sec.282ZD-ssec.3" guid="_31714f37-a3e9-40d5-974c-f217945a5b51" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive need not deal with a complaint that the chief executive reasonably believes to be trivial or made only to cause annoyance.</txt></block></subclause><subclause
