provision.type="transitional" affected.by.uncommenced="0" spent.amends="0"><no>408</no><heading id="sec.5-frag-div.20-sec.408-he" guid="_379fbdab-1975-4000-882c-db681fb6335a">Ending proceedings and punishment </heading><subclause id="sec.5-frag-div.20-sec.408-ssec.1" guid="_e7510a04-c0de-4c59-a0d0-2cff0a4f80c0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A police officer may not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.408-ssec.1-para1.a" guid="_c9148110-49c3-4549-829e-59da852786cf" provision.type="other"><no>(a)</no><block><txt break.before="0">take any alternative action against the person for the offence; or</txt></block></li><li id="sec.5-frag-div.20-sec.408-ssec.1-para1.b" guid="_ffd916e0-f6a8-4eb1-b713-a37a486c460c" provision.type="other"><no>(b)</no><block><txt break.before="0">start a proceeding against the person for the offence.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.408-ssec.2" guid="_c84e4239-3f3d-4c0f-9371-550f73eaa3e5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">On the commencement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.a" guid="_28c2d58a-6884-4fcc-a2bc-e699701ceffb" provision.type="other"><no>(a)</no><block><txt break.before="0">any alternative action taken by a police officer against the person for the offence, that is still in effect, ends; and</txt></block></li><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.b" guid="_dbd3a758-2dd9-49b9-9af5-f2c2fbc09741" provision.type="other"><no>(b)</no><block><txt break.before="0">if the person is under arrest by a police officer for the offence, the arrest ends; and</txt></block></li><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.c" guid="_0e8e3712-af26-4b0e-b047-bcf9b8033b87" provision.type="other"><no>(c)</no><block><txt break.before="0">a notice to appear or a summons for the offence ceases to have effect; and</txt></block></li><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.d" guid="_adc09cf2-6b6c-4e75-a1e1-19cdb8bed61f" provision.type="other"><no>(d)</no><block><txt break.before="0">a warrant for the arrest of the person on a charge for the offence ceases to have effect; and</txt></block></li><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.e" guid="_8cd5f40f-7053-4b7f-bf87-668f2a6e771e" provision.type="other"><no>(e)</no><block><txt break.before="0">if the person is on bail for the offence, the bail ends; and</txt></block></li><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.f" guid="_717a0576-e59a-4d2e-afb4-6a8934afb273" provision.type="other"><no>(f)</no><block><txt break.before="0">a proceeding before a court in which the person is charged with the offence ends; and</txt></block></li><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.g" guid="_8b9fa492-7e15-4ce5-8cf3-b78650ebfc03" provision.type="other"><no>(g)</no><block><txt break.before="0">all consequences for the offence under this Act cease to be enforceable against the person or any other person, including, for example—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.g-para2.i" guid="_30e6c1da-0b78-4778-b232-0c24e6cdde47" provision.type="other"><no>(i)</no><block><txt break.before="0">a sentence order; and</txt></block></li><li id="sec.5-frag-div.20-sec.408-ssec.2-para1.g-para2.ii" guid="_488a7967-d3d1-4156-addb-c1c7479749a2" provision.type="other"><no>(ii)</no><block><txt break.before="0">a community based order.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.408-ssec.3" guid="_61026c5d-8d5d-492f-b494-d8ad7013044f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-frag-div.20-sec.408-ssec.3-def.alternativeaction_" guid="_728ef434-477c-4e0c-aae6-adcf32b03a80" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-div.20-sec.408-ssec.3-def.alternativeaction" guid="_071914bc-696c-44d8-977b-28016c3d5924" type="definition">alternative action</defterm> means action mentioned in section 11(1)(b) to (e).</txt></definition></deflist></block></subclause></clause><clause id="sec.5-frag-div.20-sec.409" guid="_cf961225-2713-4401-a02e-63f895b0d5f1" provision.type="transitional" affected.by.uncommenced="0" spent.amends="0"><no>409</no><heading id="sec.5-frag-div.20-sec.409-he" guid="_cf66fa5a-7ac0-4476-b827-9c26909d1c16">Release from watch-house</heading><subclause id="sec.5-frag-div.20-sec.409-ssec.1" guid="_814abe08-9929-452f-8a20-68068243df41" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, on the commencement, the person is being held in custody in a watch-house in relation to the offence.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.409-ssec.2" guid="_6c98790a-a6f9-463f-a232-04819db76c08" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The watch-house manager must arrange for the person to be released from custody as soon as reasonably practicable to do so but no later than the sooner of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.409-ssec.2-para1.a" guid="_0086ba33-bbd3-48d3-8806-1ffe7d05f108" provision.type="other"><no>(a)</no><block><txt break.before="0">the time the person would have been released from custody if this section had not commenced;</txt></block></li><li id="sec.5-frag-div.20-sec.409-ssec.2-para1.b" guid="_51b57702-8295-4ae1-b9ab-e2259da38173" provision.type="other"><no>(b)</no><block><txt break.before="0">3 days after the commencement.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.409-ssec.3" guid="_bae24f8f-c1d9-4f16-b428-888533bb6ce8" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In deciding when it is reasonably practicable to release the person from custody, the watch-house manager must have regard to the welfare of the person, including whether the person will have access to the following things from the day the person is released—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.409-ssec.3-para1.a" guid="_a6098325-29a7-4ea4-9082-7fcb35a07a9e" provision.type="other"><no>(a)</no><block><txt break.before="0">appropriate accommodation;</txt></block></li><li id="sec.5-frag-div.20-sec.409-ssec.3-para1.b" guid="_8fc33dd0-03b1-4685-9833-8d43b0acfe01" provision.type="other"><no>(b)</no><block><txt break.before="0">support from a consistent parent or guardian;</txt></block></li><li id="sec.5-frag-div.20-sec.409-ssec.3-para1.c" guid="_a0b68c30-627b-44b1-b6c7-83f7295f7cad" provision.type="other"><no>(c)</no><block><txt break.before="0">any health or other services the person required while in custody.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.409-ssec.4" guid="_7cba2693-6436-428f-a5ea-c82923b3c05c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Subsection (3) does not prevent the watch-house manager releasing the person from custody merely because the person will not have access to a thing mentioned in that subsection.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.409-ssec.5" guid="_b9b44d05-8e17-406a-a4d3-0960524e37b3" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In making arrangements for the release of the person from custody, the watch-house manager—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.409-ssec.5-para1.a" guid="_8d1fa65d-f4bf-49e5-b4b4-8e643eac25d1" provision.type="other"><no>(a)</no><block><txt break.before="0">may consult with the chief executive or the chief executive (child safety); and</txt></block></li><li id="sec.5-frag-div.20-sec.409-ssec.5-para1.b" guid="_be50bfe4-3fb6-466d-97f7-6d985072873f" provision.type="other"><no>(b)</no><block><txt break.before="0">must, in consultation with the chief executive and the chief executive (child safety), make all reasonable efforts to ensure the person has access to the things mentioned in subsection (3)(a) to (c); and</txt></block></li><li id="sec.5-frag-div.20-sec.409-ssec.5-para1.c" guid="_5e406d8a-79f3-4e34-95b1-57c97beaf8f9" provision.type="other"><no>(c)</no><block><txt break.before="0">may, for the consultation mentioned in paragraph (a) or (b), share any confidential information about the person with the chief executive or the chief executive (child safety).</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.409-ssec.6" guid="_c4947768-4eee-49df-8a81-b5c69d45f569" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">While the person is waiting to be released from a watch-house, the person continues to be subject to the rules governing the watch-house.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.409-ssec.7" guid="_07112b16-3a36-4317-9632-09fe8cf8e95d" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">This section does not apply if, on the commencement, the person is also being held in custody in a watch-house in relation to an offence committed when the person was 14 years or older.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.409-ssec.8" guid="_a899af97-890a-4285-b790-27303398b9fd" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-frag-div.20-sec.409-ssec.8-def.confidentialinformation_" guid="_773526c9-39bb-4c62-a893-d6d759fb66e2" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-div.20-sec.409-ssec.8-def.confidentialinformation" guid="_2673ad63-4558-43dd-9942-beac805b4480" type="definition">confidential information</defterm> means confidential information to which part 9 applies.</txt></definition><definition id="sec.5-frag-div.20-sec.409-ssec.8-def.watchhousemanager_" guid="_a4cba245-2ad4-46fd-a522-1a2c3f079625" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-div.20-sec.409-ssec.8-def.watchhousemanager" guid="_5d16364c-17db-4980-8f36-f477d5e268e5" type="definition">watch-house manager</defterm> see the <legref target.doc.id="act-2000-005" id="sec.5-frag-div.20-sec.410-ssec.1" guid="_335936f3-d70e-4b53-99a9-6fefae8ec18f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, on the commencement, the person is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.410-ssec.1-para1.a" guid="_ecff8297-4478-418f-b6b1-567df28961c2" provision.type="other"><no>(a)</no><block><txt break.before="0">serving a period of detention in a detention centre in relation to the offence; or</txt></block></li><li id="sec.5-frag-div.20-sec.410-ssec.1-para1.b" guid="_e9464ab6-20eb-45fa-a45c-5723b5133e58" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise being held in custody in a detention centre in relation to the offence.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.410-ssec.2" guid="_0f9d4f20-f0ed-4b9d-a4b3-65a067c3e249" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive must arrange for the person to be released from detention or custody as soon as reasonably practicable to do so but no later than the sooner of the following days—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.410-ssec.2-para1.a" guid="_83d7ff45-60cc-41f8-a874-4081880d2c9a" provision.type="other"><no>(a)</no><block><txt break.before="0">the day the person would have been released from detention or custody if this section had not commenced;</txt></block></li><li id="sec.5-frag-div.20-sec.410-ssec.2-para1.b" guid="_12994b40-04f7-4ed1-b1ca-77202a2b8710" provision.type="other"><no>(b)</no><block><txt break.before="0">the day that is 1 month after the commencement.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.410-ssec.3" guid="_ef918670-b9ac-46e9-a2dd-3359511802eb" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In deciding when it is reasonably practicable to release the person from detention or custody, the chief executive must have regard to the welfare of the person, including whether the person will have access to the following things from the day the person is released—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.410-ssec.3-para1.a" guid="_a8fbc534-5496-4572-84ea-f1169a89909b" provision.type="other"><no>(a)</no><block><txt break.before="0">appropriate accommodation;</txt></block></li><li id="sec.5-frag-div.20-sec.410-ssec.3-para1.b" guid="_b920d22a-f958-41e6-95af-18dd9ae461d3" provision.type="other"><no>(b)</no><block><txt break.before="0">support from a consistent parent or guardian;</txt></block></li><li id="sec.5-frag-div.20-sec.410-ssec.3-para1.c" guid="_074f57a9-4d42-4356-bf76-f0d9c1e4948e" provision.type="other"><no>(c)</no><block><txt break.before="0">any health or other services the person required while in detention or custody.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.410-ssec.4" guid="_349bec70-5849-40b5-a441-fc9fab51ae7e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Subsection (3) does not prevent the chief executive releasing the person from detention or custody merely because the person will not have access to a thing mentioned in that subsection.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.410-ssec.5" guid="_b6529c41-fa1d-4389-97e4-93dbb8769c20" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In making arrangements for the release of the person from detention or custody, the chief executive—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.410-ssec.5-para1.a" guid="_50255a0d-e8e6-49ab-94df-ec4e1a758092" provision.type="other"><no>(a)</no><block><txt break.before="0">may consult with the chief executive (child safety); and</txt></block></li><li id="sec.5-frag-div.20-sec.410-ssec.5-para1.b" guid="_91566d93-b256-4951-b4c3-6bfbd4f93bed" provision.type="other"><no>(b)</no><block><txt break.before="0">must, in consultation with the chief executive (child safety), make all reasonable efforts to ensure the person has access to the things mentioned in subsection (3)(a) to (c); and</txt></block></li><li id="sec.5-frag-div.20-sec.410-ssec.5-para1.c" guid="_048b5000-56f8-4ee3-a2fb-0e25597fb80d" provision.type="other"><no>(c)</no><block><txt break.before="0">may, for the consultation mentioned in paragraph (a) or (b), share any confidential information about the person with the chief executive (child safety).</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.410-ssec.6" guid="_344c46db-4cdc-42d4-8470-c31eb54c8550" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">While the person is waiting to be released from a detention centre, the person continues to be subject to the rules governing the detention centre.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.410-ssec.7" guid="_f497cb46-dd40-4004-b522-d53e20d044c0" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">This section does not apply if, on the commencement, the person is also serving a period of detention in a detention centre, or otherwise being held in custody in a detention centre, in relation to an offence committed when the person was 14 years or older.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.410-ssec.8" guid="_ba94aff3-ac6e-42bd-81c1-44efa0bdf505" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-frag-div.20-sec.410-ssec.8-def.confidentialinformation_" guid="_957d61ae-3797-4f93-a375-46d4fcc54925" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-div.20-sec.410-ssec.8-def.confidentialinformation" guid="_ed01eb5b-585f-49f9-939b-fce172e2aa63" type="definition">confidential information</defterm> means confidential information to which part 9 applies.</txt></definition></deflist></block></subclause></clause><clause id="sec.5-frag-div.20-sec.411" guid="_d33d8c2d-12e5-463b-9741-ece11951a4da" provision.type="transitional" affected.by.uncommenced="0" spent.amends="0"><no>411</no><heading id="sec.5-frag-div.20-sec.411-he" guid="_053d4904-ca95-4b0c-90d2-06cddee3f469">Destruction of things collected by forensic procedures</heading><subclause id="sec.5-frag-div.20-sec.411-ssec.1" guid="_cc9a639f-ce75-4503-9cb6-878cc2990eee" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, before the commencement, any of the following things happened in relation to the offence—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.411-ssec.1-para1.a" guid="_79c3e84c-8fbc-45b1-9a6a-9041f19d3cc4" provision.type="other"><no>(a)</no><block><txt break.before="0">identifying particulars of the person were taken or photographed under the <legref target.doc.id="act-2000-005" target.version.series="13728c9a-0e6c-41c2-8090-97af5880885b" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Police Powers and Responsibilities Act 2000</name></legref>, chapter 17, part 4;</txt></block></li><li id="sec.5-frag-div.20-sec.411-ssec.1-para1.b" guid="_95e5d5b4-0fed-4e1b-8072-f5d3b3536110" provision.type="other"><no>(b)</no><block><txt break.before="0">a DNA sample was taken from the person under the <legref target.doc.id="act-2000-005" target.version.series="13728c9a-0e6c-41c2-8090-97af5880885b" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Police Powers and Responsibilities Act 2000</name></legref>, chapter 17, part 5;</txt></block></li><li id="sec.5-frag-div.20-sec.411-ssec.1-para1.c" guid="_73b51735-4295-43d2-9071-724ce65b04d4" provision.type="other"><no>(c)</no><block><txt break.before="0">another forensic procedure was performed on the person under the <legref target.doc.id="act-2000-005" target.version.series="13728c9a-0e6c-41c2-8090-97af5880885b" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Police Powers and Responsibilities Act 2000</name></legref>, chapter 17.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.411-ssec.2" guid="_f5d49611-aba2-4cc9-8e61-404b34bca913" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The commissioner of the police service must, within a reasonable time after the commencement, ensure that each of the following things is destroyed in the presence of a justice—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.411-ssec.2-para1.a" guid="_5de8e999-09e3-4934-b853-1eac5f22ef17" provision.type="other"><no>(a)</no><block><txt break.before="0">the identifying particulars;</txt></block></li><li id="sec.5-frag-div.20-sec.411-ssec.2-para1.b" guid="_b53e8fa6-85d7-4b85-95b1-cd114c5f69f2" provision.type="other"><no>(b)</no><block><txt break.before="0">the DNA sample;</txt></block></li><li id="sec.5-frag-div.20-sec.411-ssec.2-para1.c" guid="_633d2eb3-a41c-4097-a108-be2d5689a55c" provision.type="other"><no>(c)</no><block><txt break.before="0">the results of any DNA analysis of the DNA sample;</txt></block></li><li id="sec.5-frag-div.20-sec.411-ssec.2-para1.d" guid="_458219e8-db63-4a82-af79-e5f31d064e89" provision.type="other"><no>(d)</no><block><txt break.before="0">the results of any analysis of the forensic procedure;</txt></block></li><li id="sec.5-frag-div.20-sec.411-ssec.2-para1.e" guid="_6afd7445-9737-40e0-8c17-8ecc4ab60f67" provision.type="other"><no>(e)</no><block><txt break.before="0">the record of any information collected from the forensic procedure.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-div.20-sec.411-ssec.3" guid="_f89fb271-f771-4162-8f67-96cab3909cc8" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Also, subsection (4) applies if a police officer caused any information collected from the identifying particulars, DNA sample or forensic procedure to be entered into a database or record.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.411-ssec.4" guid="_4f2bf532-03d6-41e4-b756-6bbc6ad17579" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The commissioner of the police service must, within a reasonable time after the commencement, ensure the information is removed from the guid="_d8e1ee21-2419-425b-a9c7-d75d6283fd2d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">On the commencement, the conviction is expunged.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.412-ssec.3" guid="_204e292b-b28b-4662-9691-58c90cb7b9a2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The person need not, and any other person must not, disclose that the person was convicted of the offence.</txt></block></subclause><subclause id="sec.5-frag-div.20-sec.412-ssec.4" guid="_6942cb94-e55c-4b5c-aad8-7e7be4367891" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A record of any of the following matters must not be disclosed in any court proceeding to which the person is subject—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-div.20-sec.412-ssec.4-para1.a" guid="_5f903f69-46da-4792-a89b-7064b7fd79e7" provision.type="other"><no>(a)</no><block><txt break.before="0">action taken by a police officer against the person for the offence, including, for example, administering a caution or arresting the person;</txt></block></li><li id="sec.5-frag-div.20-sec.412-ssec.4-para1.b" guid="_bf6a33c5-5624-47a8-b707-a6a3d8f251f2" provision.type="other"><no>(b)</no><block><txt break.before="0">a failure of the person to comply with a direction made, in relation to the offence, by a police officer or other person under this Act or another Act;</txt></block></li><li id="sec.5-frag-div.20-sec.412-ssec.4-para1.c" guid="_75fbdfd8-4aa2-4660-8f03-cc770959b105" provision.type="other"><no>(c)</no><block><txt break.before="0">action taken by a court against the person for the offence, including, for example, granting bail or convicting the person;</txt></block></li><li id="sec.5-frag-div.20-sec.412-ssec.4-para1.d" guid="_7154c90a-4767-4616-b0f5-2a9750fdae41" provision.type="other"><no>(d)</no><block><txt break.before="0">a failure of the person to comply with an order made by a court in relation to the offence.</txt></block></li></list></block></subclause><subclause
