guid="_a3645398-93d8-4edc-a84c-53bd61f627e3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13B</no><heading id="sec.3-frag-pt.2A-div.2-sec.13B-he" guid="_226a367a-1bc1-4c77-90f6-f688bc337e54">Chief executive may ask for consent to obtain criminal history</heading><subclause id="sec.3-frag-pt.2A-div.2-sec.13B-ssec.1" guid="_9a8706d4-821e-4ff6-8b31-c1cf8ea66017" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the chief executive proposes to employ a person as a staff member, the chief executive may ask the person for written consent for the chief executive to obtain the person’s criminal history.</txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13B-ssec.2" guid="_3df8b59f-7162-45d8-9db2-de0451c96670" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subsection (1) applies even if the person is employed as a staff member when the chief executive proposes to employ the person.</txt></block></subclause></clause><clause id="sec.3-frag-pt.2A-div.2-sec.13C" guid="_8c884825-15d5-4349-a767-3fa0b029ac4f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13C</no><heading id="sec.3-frag-pt.2A-div.2-sec.13C-he" guid="_894c65c9-58b2-4914-8d3a-6cabeb15deb0">Refusing consent</heading><subclause id="sec.3-frag-pt.2A-div.2-sec.13C-ssec.1" guid="_69c8a55c-409d-4015-b19e-d9d1c0b0ae1b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the person does not consent, or withdraws the person’s consent, to the chief executive obtaining the person’s criminal history.</txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13C-ssec.2" guid="_103e0a8f-5d13-4cf0-9866-2bc31312fc77" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the person is not employed as a staff member, the chief executive may decide not to consider the person for employment as a staff member.</txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13C-ssec.3" guid="_26099ca0-c4b0-46b1-a667-9a64c0068ef3" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the person is a staff member, the person’s employing member or, if the person is a ministerial staff member, the Premier, may prevent the person from performing any further relevant duties. </txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13C-ssec.4" guid="_d34ab55d-bc2b-45b4-ba01-fd0304bf6b9e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For subsection (3), duties are <defterm id="sec.3-frag-pt.2A-div.2-sec.13C-def.relevantduties" guid="_006d2e31-95e8-493e-b1b2-ff1247852538" type="definition">relevant duties</defterm> if, because of the nature of the duties, the employing member or Premier considers it may be necessary to have regard to the criminal history of a person who is or will be performing the duties.</txt></block></subclause></clause><clause id="sec.3-frag-pt.2A-div.2-sec.13D" guid="_479e2540-da64-4eae-b5c5-ca3db8c35b91" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13D</no><heading id="sec.3-frag-pt.2A-div.2-sec.13D-he" guid="_b97cb003-0443-4d97-912f-ef801a182f7b">Obtaining criminal history with consent</heading><subclause id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.1" guid="_27d9429e-ff51-419d-89ac-3a9531569dea" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the person gives the chief executive written consent to the chief executive obtaining the person’s criminal history.</txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.2" guid="_7bf08023-4349-4706-bc3e-9b25e3497abe" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may ask the police commissioner for— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.2-para1.a" guid="_4b87d0de-86a6-4e0b-a726-1514b0d35e42" provision.type="other"><no>(a)</no><block><txt break.before="0">a written report about the person’s criminal history; and</txt></block></li><li id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.2-para1.b" guid="_daaeff10-4cb9-483f-bb85-6f2225d580c1" provision.type="other"><no>(b)</no><block><txt break.before="0">a brief description of the circumstances of a conviction mentioned in the criminal history.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.3" guid="_dda1a1ec-12dd-4a92-aeda-78aa12001843" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The request may include the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.3-para1.a" guid="_3f8a50ac-cf5b-4bf9-87ee-4f77e8bce30e" provision.type="other"><no>(a)</no><block><txt break.before="0">the person’s name and any other name the chief executive believes the person may use or may have used; </txt></block></li><li id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.3-para1.b" guid="_a384a163-dd80-4915-ad10-b0daec61d5ec" provision.type="other"><no>(b)</no><block><txt break.before="0">the person’s date and place of birth, gender and address. </txt></block></li></list></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.4" guid="_2b552b79-6796-4dd7-8a6e-7216ae839509" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The police commissioner must comply with the request.</txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13D-ssec.5" guid="_f37acf32-eaaf-437d-8cae-36612a88127b" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">However, the duty to comply applies only to information in the police commissioner’s possession or to which the police commissioner has access.</txt></block></subclause></clause><clause id="sec.3-frag-pt.2A-div.2-sec.13E" guid="_b8d7fae2-f6d5-4e5a-abb0-3febf626eba6" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13E</no><heading id="sec.3-frag-pt.2A-div.2-sec.13E-he" guid="_8133b8d9-699d-4b54-b2ff-b4e6fd7e0ad0">Criminal history no longer required to be obtained</heading><subclause id="sec.3-frag-pt.2A-div.2-sec.13E-ssec.1" guid="_2ea20f23-e692-457f-9939-68a5a38eee69" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.2A-div.2-sec.13E-ssec.1-para1.a" guid="_dc87124d-a91c-496e-b371-f0fdcef5fed7" provision.type="other"><no>(a)</no><block><txt break.before="0">the chief executive has, under section 13D, asked the police commissioner to give the chief executive a written report about a person’s criminal history; and</txt></block></li><li id="sec.3-frag-pt.2A-div.2-sec.13E-ssec.1-para1.b" guid="_f1078ecf-87e3-4a4d-89e8-4ff14a465f9c" provision.type="other"><no>(b)</no><block><txt break.before="0">the chief executive decides the criminal history is no longer required.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13E-ssec.2" guid="_81959adb-8ed6-4352-b1c0-bd06250df246" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive must, by written notice, tell the police commissioner that the requested report is no longer required.</txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.2-sec.13E-ssec.3" guid="_d5273d28-690b-4959-8d3e-535def627fbb" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the police commissioner is notified as mentioned in subsection (2) before the police commissioner has given the requested report to the chief executive, the police commissioner must not give it to the chief executive. </txt></block></subclause></clause></division><division id="sec.3-frag-pt.2A-div.3" guid="_7232c25b-1342-4ad5-bbd9-b9bbffde9af5" affected.by.uncommenced="0"><no>Division 3</no><heading id="sec.3-frag-pt.2A-div.3-he" guid="_b998a960-77c2-4de7-b927-8e614a31875c">Use of criminal histories and related matters</heading><clause id="sec.3-frag-pt.2A-div.3-sec.13F" guid="_23a099c7-2fcc-49bf-bad5-e2d8cbfea4bf" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13F</no><heading id="sec.3-frag-pt.2A-div.3-sec.13F-he" guid="_7306c063-48e5-4f12-8fc6-99ae5e4661b2">Assessment of suitability</heading><block><txt break.before="1">If the chief executive obtains a person’s criminal history under this part, the chief executive must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.2A-div.3-sec.13F-para1.a" guid="_79e5df3b-e679-4bee-bd47-c63d6a920bf5" provision.type="other"><no>(a)</no><block><txt break.before="0">give a copy of the criminal history to— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.2A-div.3-sec.13F-para1.a-para2.i" guid="_219a8bf6-57cf-4d18-8df6-9e6d4fe17d6b" provision.type="other"><no>(i)</no><block><txt break.before="0">if the person is proposed to be employed as a ministerial staff member—the Premier; or</txt></block></li><li id="sec.3-frag-pt.2A-div.3-sec.13F-para1.a-para2.ii" guid="_37b21659-8b14-48a4-a149-45c4d8a98ad7" provision.type="other"><no>(ii)</no><block><txt break.before="0">otherwise—the person’s proposed employing member; and</txt></block></li></list></block></li><li id="sec.3-frag-pt.2A-div.3-sec.13F-para1.b" guid="_8869130c-f6f4-4be4-8758-26b66fba1926" provision.type="other"><no>(b)</no><block><txt break.before="0">consider the criminal history, in consultation with the member to whom a copy of the criminal history is given, in making an assessment about the person’s suitability for employment as a staff member.</txt></block></li></list></block></clause><clause id="sec.3-frag-pt.2A-div.3-sec.13G" guid="_cca2cb9b-14f8-4367-a477-2923255c9c15" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13G</no><heading id="sec.3-frag-pt.2A-div.3-sec.13G-he" guid="_497db732-abeb-4303-a75f-7d5f1f65aa19">Destruction of reports and notices</heading><subclause id="sec.3-frag-pt.2A-div.3-sec.13G-ssec.1" guid="_97e8cf6c-1b3b-4714-922c-55e63bddb326" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.2A-div.3-sec.13G-ssec.1-para1.a" guid="_9b10f093-a14b-492c-9c80-dba1f183504b" provision.type="other"><no>(a)</no><block><txt break.before="0">a criminal history report about a person is no longer required to be kept for the purpose for which it was requested under this part; or</txt></block></li><li id="sec.3-frag-pt.2A-div.3-sec.13G-ssec.1-para1.b" guid="_10701470-57f1-4778-8f20-31b364604fde" provision.type="other"><no>(b)</no><block><txt break.before="0">a notice given to the chief executive under section 13I is no longer required to be kept for assessing a person’s suitability to perform relevant duties within the meaning of section 13C.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-pt.2A-div.3-sec.13G-ssec.2" guid="_f174f958-f4b0-4b42-8326-90477d3ddead" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive must destroy the report, the notice and any other document containing information contained in the report or notice.</txt></block></subclause></clause><clause id="sec.3-frag-pt.2A-div.3-sec.13H" guid="_373477be-d511-4d49-bd53-ad0e728d2138" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13H</no><heading id="sec.3-frag-pt.2A-div.3-sec.13H-he" guid="_1b818db4-a980-47be-a8e3-ef62bf04f3fa">Police commissioner must not use information given under this part</heading><subclause id="sec.3-frag-pt.2A-div.3-sec.13H-ssec.1" guid="_34a105ee-9924-4cd5-8bdb-bb98406f70a1" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Information given to the police commissioner by the chief executive under section 13D(3) must not be accessed, disclosed or used for any purpose, other than a purpose under this part or any other purpose relevant to law enforcement.</txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.3-sec.13H-ssec.2" guid="_ac6c650f-6300-45c3-88fd-233d3e9df6a0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, subsection (1) does not apply to information obtained by the police commissioner before the chief executive gave the information under section 13D(3).</txt></block></subclause></clause></division><division id="sec.3-frag-pt.2A-div.4" guid="_69105796-4a88-49f2-aee9-7ee3c457ea5c" affected.by.uncommenced="0"><no>Division 4</no><heading id="sec.3-frag-pt.2A-div.4-he" guid="_4acc9d33-0bd1-4663-af48-3d7a0afe32ad">Other matters</heading><clause id="sec.3-frag-pt.2A-div.4-sec.13I" guid="_85ff981c-8e24-493e-bfb1-a36fcca4c5b3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13I</no><heading id="sec.3-frag-pt.2A-div.4-sec.13I-he" guid="_905421b3-04b7-49f4-b64b-9bbb7837ca5e">Prosecuting authority to notify chief executive about committal, conviction etc.</heading><subclause id="sec.3-frag-pt.2A-div.4-sec.13I-ssec.1" guid="_77ab4930-b00d-4f86-85d0-e621f0ca7f8d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the police commissioner or the director of public prosecutions (each a <defterm id="sec.3-frag-pt.2A-div.4-sec.13I-def.prosecutingauthority" guid="_b613d1da-e6ef-4030-bab6-2480c2de3942" type="definition">prosecuting authority</defterm>) is aware that a person is employed as a staff member and, after the commencement of this section, the person is charged with an indictable offence. </txt></block></subclause><subclause id="sec.3-frag-pt.2A-div.4-sec.13I-ssec.2" guid="_9fa2c6b6-b6de-4bf6-9958-73b3ef212aef" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the person is committed by a court for trial for the indictable offence, the prosecuting authority must, within 7 days after the committal, give notice to the chief executive of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.2A-div.4-sec.13I-ssec.2-para1.a" guid="_5a82a63c-2ef9-47c3-933b-150cb66d18a8" provision.type="other"><no>(a)</no><block><txt not an officer or employee of the parliamentary service, the Clerk may decide not to consider the person for appointment or engagement as an officer or employee to perform the relevant provision.type="other"><no>(3)</no><block><txt break.before="0">If the person is an officer or employee of the parliamentary service who is performing relevant duties, the Clerk may prevent the person break.before="0">This section applies if the person gives the Clerk written consent to the Clerk obtaining the person’s criminal history.</txt></block></subclause><subclause id="sec.10-frag-pt.5A-div.2-sec.47B-ssec.2" guid="_072afd58-25cd-4ccb-9ac5-052bf2e023ec" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Clerk may ask circumstances of a conviction mentioned in the criminal history.</txt></block></li></list></block></subclause><subclause id="sec.10-frag-pt.5A-div.2-sec.47B-ssec.3" guid="_6d9cb8d9-ef07-4aa1-a3eb-ab930a1c0a69" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The request may include the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.5A-div.2-sec.47B-ssec.3-para1.a" guid="_044a42b0-b580-4bf0-bd1a-268ddb64e9bc" provision.type="other"><no>(a)</no><block><txt break.before="0">the person’s name and any other name the Clerk believes the person may use or may have used; </txt></block></li><li id="sec.10-frag-pt.5A-div.2-sec.47B-ssec.3-para1.b" guid="_62060be7-dff0-4e5b-888d-769f9dbea0bd" provision.type="other"><no>(b)</no><block><txt break.before="0">the person’s date and place of birth, gender and address. </txt></block></li></list></block></subclause><subclause id="sec.10-frag-pt.5A-div.2-sec.47B-ssec.4" guid="_72211796-eb1a-4f2f-8b1f-b6ee4fb58e84" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The police commissioner must comply with a request made to the police commissioner under this section.</txt></block></subclause><subclause id="sec.10-frag-pt.5A-div.2-sec.47B-ssec.5" guid="_19e13296-3562-4aae-a475-b26dff54f886" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">However, the duty to comply under subsection (4) applies only to information in the police commissioner’s possession or to which the applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.5A-div.2-sec.47C-ssec.1-para1.a" guid="_f8b2c0d5-2772-4646-9e54-359bf12ac29b" provision.type="other"><no>(a)</no><block><txt break.before="0">the Clerk has, under section 47B, asked the police commissioner to give the Clerk a written report about a person’s criminal history; and</txt></block></li><li id="sec.10-frag-pt.5A-div.2-sec.47C-ssec.1-para1.b" guid="_d6cc0f29-9cb8-455f-9c2c-884e44bf5dcb" provision.type="other"><no>(b)</no><block><txt break.before="0">the Clerk decides the criminal history is no longer required.</txt></block></li></list></block></subclause><subclause id="sec.10-frag-pt.5A-div.2-sec.47C-ssec.2" guid="_e11c4596-0137-4c69-bdf2-0ed5aa3d05b7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Clerk must, by written notice, tell the police commissioner that the requested report is no longer required.</txt></block></subclause><subclause id="sec.10-frag-pt.5A-div.2-sec.47C-ssec.3" guid="_26a133e0-53a6-4dae-88e7-89b362a54cf7" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the police commissioner is notified as mentioned in subsection (2) before the police commissioner has given the requested report to the Clerk, the police commissioner must not give it to the Clerk. </txt></block></subclause></clause><clause id="sec.10-frag-pt.5A-div.2-sec.47D" guid="_e9acad49-53a9-4219-b942-2b33ea061546" provision.type="other"><no>(1)</no><block><txt break.before="0">Information given to the police commissioner by the Clerk under section 47B(3) must not be accessed, disclosed or used for any purposes, other than a purpose under this part or any other purpose relevant to law enforcement.</txt></block></subclause><subclause id="sec.10-frag-pt.5A-div.2-sec.47D-ssec.2" provision.type="other"><no>(a)</no><block><txt break.before="0">a criminal history report about a person is no longer required to be kept for the purpose for which it was requested under this part; or</txt></block></li><li id="sec.10-frag-pt.5A-div.3-sec.47F-ssec.1-para1.b" guid="_f6c88f8f-a55a-401f-af0a-c333848a41fd" provision.type="other"><no>(b)</no><block><txt break.before="0">a notice given to the Clerk under section 47G is no longer required to be kept for deciding whether a person is suitable to perform relevant duties.</txt></block></li></list></block></subclause><subclause type="definition">prosecuting authority</defterm>) is aware that a person is an officer or employee of the parliamentary service and, after the commencement of this section, the person is charged with </txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.3-para1.d" guid="_1ea6f235-f5bf-4398-bb66-6ca73cfc5e0d" provision.type="other"><no>(d)</no><block><txt break.before="0">the date of the conviction;</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.3-para1.e" guid="_65415cec-d544-4ce2-9725-23dccb51450e" provision.type="other"><no>(e)</no><block><txt break.before="0">the sentence imposed by the court.</txt></block></li></list></block></subclause><subclause id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.4" guid="_29a1fd01-01bb-4e67-b6cb-feda7b8a6ef6" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the person has appealed against the conviction mentioned in subsection (3) and the appeal is finally decided or has otherwise ended, the prosecuting authority must, within 7 days after the decision or the day the appeal otherwise ends, give notice to the Clerk of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.4-para1.a" guid="_5d7383ee-cab0-4720-81fb-0c516b1aa763" provision.type="other"><no>(a)</no><block><txt break.before="0">the person’s name;</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.4-para1.b" guid="_16e6be92-4902-4397-a64d-ef8bf672d7c7" provision.type="other"><no>(b)</no><block><txt break.before="0">particulars of the offence; </txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.4-para1.c" guid="_87a85d20-e082-4aef-9611-a787b18bda2c" provision.type="other"><no>(c)</no><block><txt break.before="0">the date of the decision or other ending of the appeal;</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.4-para1.d" guid="_dff927ab-e607-4e6f-8cd3-b040c8e451d6" provision.type="other"><no>(d)</no><block><txt break.before="0">if the appeal was decided—</txt><list break.before="0">the court in which it was decided; and</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.4-para1.d-para2.ii" guid="_cd41e35c-d99f-4496-81f6-3c6c022e87c7" provision.type="other"><no>(ii)</no><block><txt break.before="0">particulars of the decision.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.5" guid="_0b05287f-a720-4f6a-8903-b2067a87b944" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the prosecution for the indictable offence ends without the person being convicted of the offence, the prosecuting authority must, within 7 days after the prosecution process ends, give notice to the Clerk of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.5-para1.a" guid="_ccb02ab1-8116-4e72-a5c7-1dc1bc5a46e3" provision.type="other"><no>(a)</no><block><txt break.before="0">the person’s name;</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.5-para1.b" guid="_66bef811-8963-408a-a302-209b2fbb3240" provision.type="other"><no>(b)</no><block><txt break.before="0">the court;</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.5-para1.c" guid="_54d3bda5-b93d-4631-a4e4-f351d7666fe7" provision.type="other"><no>(c)</no><block><txt break.before="0">particulars of the offence; </txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.5-para1.d" guid="_6426df0e-89ee-4cd2-8370-534a1529d7fe" provision.type="other"><no>(d)</no><block><txt break.before="0">the date of the committal;</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.5-para1.e" guid="_eb992713-e6b5-4201-9773-a2f5787683b2" provision.type="other"><no>(e)</no><block><txt break.before="0">the court to which the person was committed.</txt></block></li></list></block></subclause><subclause id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.6" guid="_1ae121fd-2537-4334-9983-87086f86578b" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">For subsection (5), the prosecution process ends if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.6-para1.a" guid="_973417ab-9c2d-43d6-8dec-01c13d5f29e6" provision.type="other"><no>(a)</no><block><txt break.before="0">an indictment was presented against the person but a nolle prosequi is entered on the indictment or the person is acquitted; or</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47G-ssec.6-para1.b" guid="_1f31b133-4f7c-4865-abe3-9bff1464a58f" provision.type="other"><no>(b)</no><block><txt break.before="0">the prosecution process otherwise ends. provision.type="other"><no>47H</no><heading id="sec.10-frag-pt.5A-div.4-sec.47H-he" guid="_2ad52d3f-0196-4907-b0be-28250ef1b981">False or misleading statements in consent</heading><block><txt break.before="1">A person must not give the Clerk a consent mentioned in section 47, or another document for this part, that the person knows contains information that is false or misleading in a material particular. </txt><penalty id="sec.10-frag-pt.5A-div.4-sec.47H-pen" guid="_ea5b0fe2-fa94-46fc-ac22-c6f7f6a2a9a3"><block><txt break.before="1">Maximum penalty—100 penalty units.</txt></block></penalty></block></clause><clause id="sec.10-frag-pt.5A-div.4-sec.47I" guid="_607ca4f3-98c7-4c05-b06a-48fbb2f411f1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>47I</no><heading id="sec.10-frag-pt.5A-div.4-sec.47I-he" guid="_6944a239-be70-4d92-8797-5620eea054a0">Confidentiality</heading><subclause id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.1" guid="_9ea5de89-549e-4e5f-bb5a-0a6d914f78fe" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If a person obtains criminal history information in carrying out functions or performing duties as the Speaker, the Clerk, a member of the Legislative Assembly or an officer or employee of the parliamentary service, the person must not disclose the criminal history information to any other person unless the disclosure is permitted under subsection (2). </txt><penalty id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.1-pen" guid="_93a58256-604b-479b-8904-cafb975edc2c"><block><txt break.before="1">Maximum penalty—100 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.2" guid="_e6975403-7ef2-46ae-98f3-e24905ed2add" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The person is permitted to disclose criminal history information about an individual—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.2-para1.a" guid="_939368e4-fa8a-4a78-922e-17f7d7ef14fe" provision.type="other"><no>(a)</no><block><txt break.before="0">to the Speaker, the Clerk, or an officer or employee of the parliamentary service, for the purpose of assessing the individual’s suitability to perform relevant duties; or</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.2-para1.b" guid="_dff06a27-9eaa-4c6f-aaf8-37bfc17eca42" provision.type="other"><no>(b)</no><block><txt break.before="0">to a member of the Legislative Assembly for the purpose of assessing the individual’s suitability—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.2-para1.b-para2.i" guid="_aba07e95-070b-4163-855d-843eddabed21" provision.type="other"><no>(i)</no><block><txt break.before="0">to perform relevant duties in the member’s electorate office under section 26AA; or</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.2-para1.b-para2.ii" guid="_4e3921c9-c7da-4f17-b752-7a21dc815f16" provision.type="other"><no>(ii)</no><block><txt break.before="0">for otherwise providing administrative and support services to the member; or</txt></block></li></list></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.2-para1.c" guid="_2335374f-5217-4b15-8591-f19062532f13" provision.type="other"><no>(c)</no><block><txt break.before="0">with the person’s consent; or</txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.2-para1.d" guid="_c8a197f7-4079-4d12-bfc6-8109d567945d" provision.type="other"><no>(d)</no><block><txt break.before="0">if the disclosure is otherwise required or permitted under an Act.</txt></block></li></list></block></subclause><subclause id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.3" guid="_73943335-ba5a-4b45-b97f-5de5a2b97887" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.3-def.criminalhistoryinformation_" guid="_8dade83f-db09-49d6-a6b6-a6557fb8bbf5" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.3-def.criminalhistoryinformation" guid="_8eb1f63c-2402-4359-9748-b9f13f15e5ac" type="definition">criminal history information</defterm> means information contained in the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.3-def.criminalhistoryinformation-para1.a" guid="_b60d4551-cf53-468f-b763-bad9803a3531" provision.type="other"><no>(a)</no><block><txt break.before="0">a criminal history report; </txt></block></li><li id="sec.10-frag-pt.5A-div.4-sec.47I-ssec.3-def.criminalhistoryinformation-para1.b" guid="_ea58a597-0a0b-4f2b-b2ca-162f9386a5a2" provision.type="other"><no>(b)</no><block><txt break.before="0">a notice given to the Clerk under section
