												<txt break.before="1">the battery in the smoke alarm is replaced; and</txt>

											<no>(b)</no>
											<block>
												<txt break.before="1">after the battery is replaced, the smoke alarm operates when tested in the way required under subsection (3).</txt>
											</block>
										</li>

								</block>
							</subclause>
							<subclause id="sec.5-frag-sec.104RAA-ssec.3" guid="_7cbdb7b3-ffda-49cc-807c-ae97b9a9bcc3" affected.by.uncommenced="0" provision.type="other">
								<no>(3)</no>

									<txt break.before="1">A smoke alarm installed in a domestic dwelling must be tested as follows—</txt>

										<li id="sec.5-frag-sec.104RAA-ssec.3-para1.a" guid="_604b6cd2-6e95-40ca-b4a5-8da81385d804" provision.type="other">
											<no>(a)</no>
											<block>
												<txt break.before="1">for an alarm that can be tested by pressing a button or other device to indicate whether the alarm is capable of detecting smoke—by pressing the button or other device;</txt>
											</block>
										</li>
										<li id="sec.5-frag-sec.104RAA-ssec.3-para1.b" guid="_f52343d3-6208-4b3f-8850-ef933490be62" provision.type="other">
											<no>(b)</no>
											<block>
												<txt break.before="1">otherwise—</txt>

												<txt break.before="1">the building work to which the application relates is a substantial renovation; and</txt>

											<no>(c)</no>
											<block>
												<txt break.before="1">a final inspection certificate or certificate of classification is issued for the building work.</txt>
											</block>
										</li>

								</block>
							</subclause>
							<subclause id="sec.7-frag-sec.104RBA-ssec.2" guid="_c1358222-ae7a-480e-950f-bb0f34b3adde" affected.by.uncommenced="0" provision.type="other">
								<no>(2)</no>

									<txt break.before="1">This section also applies to a domestic dwelling if, after 31 December 2021—</txt>

											<no>(b)</no>
											<block>
												<txt break.before="1">a new tenancy for the dwelling starts or an existing tenancy for the dwelling is renewed.</txt>

							</subclause>

								<no>(3)</no>

									<txt break.before="1">The owner of a domestic dwelling must install smoke alarms in the dwelling in compliance with this section.</txt>

											<txt break.before="1">Maximum penalty—5 penalty units.</txt>
										</block>

								<no>(4)</no>

									<txt break.before="1">A smoke alarm must be installed in each place in the domestic dwelling required by a regulation.</txt>
								</block>
							</subclause>

								<no>(5)</no>
								<block>
									<txt break.before="1">Each smoke alarm must—</txt>

											<no>(a)</no>
											<block>
												<txt break.before="1">be powered in a way prescribed by regulation; and</txt>
											</block>
										</li>
										<li id="sec.7-frag-sec.104RBA-ssec.5-para1.b" guid="_79df1e3d-3549-454c-8866-2f2438cbc084" provision.type="other">
											<no>(b)</no>
											<block>
												<txt break.before="1">comply with other requirements prescribed by regulation; and</txt>
											</block>
										</li>
										<li id="sec.7-frag-sec.104RBA-ssec.5-para1.c" guid="_3bddadbf-a859-49ef-9ad2-3af60bf744ea" provision.type="other">
											<no>(c)</no>
											<block>
												<txt break.before="1">have been manufactured less than 10 years before the smoke alarm is installed; and</txt>
											</block>
										</li>
