the Act, the park owner must, within 28 days after the day the interim plan is prepared for the residential park, give a notice that complies with subsection (2) to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-frag-div.2-sec.29-ssec.1-para1.a" guid="_d3fa3084-4177-4693-bd75-6a0f93c0a9c2" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">each home owner; and</txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.1-para1.b" guid="_52d394b6-65f8-4785-9268-a551d41d0279" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">any home owners committee established for the park. </txt></block></li></list></block></subclause><subclause id="sec.11-frag-div.2-sec.29-ssec.2" guid="_045ea2f1-4951-4fcb-bacf-7a1be713115c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The notice must state the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.a" guid="_d76df206-3cab-4668-9dc4-5a7e50ddbe28" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">that under section 86B of the Act, the park owner must ensure a maintenance and capital replacement plan is prepared and kept for the residential park;</txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.b" guid="_e6d375c3-63b1-44cc-af7d-592d760fe160" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">that the maintenance and capital replacement plan for the residential park includes information about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.b-para2.i" guid="_73270f78-5acf-4e02-9730-25c480e962b0" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the park owner’s long-term priorities for maintaining the common areas and communal facilities; and</txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.b-para2.ii" guid="_60042ad7-be68-4dc4-8944-f273141fbd16" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the park owner’s proposed schedule for keeping the common areas and communal facilities in a reasonable state of cleanliness and repair; </txt></block></li></list></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.c" guid="_c474b4e6-d5da-4b2c-9dd7-baa5d222f8e9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">that the maintenance and capital replacement plan prepared for the residential park is an interim plan that includes information about capital items relating to the period ending on 31 December 2027;</txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.d" guid="_0ce7a904-5557-47b0-a00d-90aaa61ec6fe" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">that the park owner must, not later than 1 January 2028, revise the maintenance and capital replacement plan for the residential park to include information about capital items relating to a period of 10 years;</txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.e" guid="_444c4339-f44f-420c-945e-423eadc38873" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">that the park owner must consult home owners, and any home owners committee established for the residential park, to seek submissions about the matters mentioned in section 16(2)(a)(i) to (iv); </txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.f" guid="_e267ef0d-6942-49dd-be81-24c61c1d28c6" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">that each home owner, and any home owners committee established for the residential park, may make a submission to the park owner in writing about the matters mentioned in section 16(2)(a)(i) to (iv);</txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.g" guid="_83a5da11-f330-47ac-984e-f9d93921d25a" provision.type="other" affected.by.uncommenced="0"><no>(g)</no><block><txt break.before="0">that, at least 90 days before the maintenance and capital replacement plan for the residential park is first revised under section 86B(2)(c) of the Act, a notice under section 16 will be given to each home owner, and any home owners committee established for the park, stating the day by which any further submissions must be made;</txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.h" guid="_e24e325b-7daa-429b-8b57-679d9068aa2f" provision.type="other" affected.by.uncommenced="0"><no>(h)</no><block><txt break.before="0">the location within the residential park where a hard copy of the maintenance and capital replacement plan is kept for home owners to view free of charge; </txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.i" guid="_2c2fc5ae-04bd-4eee-91a5-185bd37625dd" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">that a home owner may ask the park owner, in writing, for a copy of the maintenance and capital replacement plan;</txt></block></li><li id="sec.11-frag-div.2-sec.29-ssec.2-para1.j" guid="_a1a060cc-e149-4940-a35c-d0b07ba894a2" provision.type="other" affected.by.uncommenced="0"><no>(j)</no><block><txt break.before="0">details of any fee the park owner may charge for giving the home owner a copy of the maintenance and capital replacement plan.</txt><note id="sec.11-frag-div.2-sec.29-ssec.2-para1.j-note" guid="_c064c3c9-6e5d-4355-9319-f3e5e464f164" type="example"><heading id="sec.11-frag-div.2-sec.29-ssec.2-para1.j-note-he" 7 for revision of interim plan</heading><subclause id="sec.11-frag-div.2-sec.30-ssec.1" guid="_b54095f9-8b14-4848-aa28-3c3a399c3fc3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Part 7 applies in relation to the revision of the interim plan for the residential park with the modifications provided under this
