(a)damaged or lost as a result of a person, other than the holder, committing an indictable offence that is a crime or misdemeanour; or

(b)stolen.

Part 3Amendment of Transport Operations (Passenger Transport) Regulation 20185Regulation amendedThis part amends the Transport Operations (Passenger Transport) Regulation 2018.6Amendment of s 81 (Taxi driver must not refuse booked hire service or taxi service in particular circumstances)(1)Section 81—insert—(1A)Without limiting subsection (1), a driver refuses to provide a booked hire service to a prescribed person if the driver accepts a booking to provide the service to the person but does not provide the service to the person.(1B)Subsection (4) applies if a driver accepts a booking to provide a booked hire service to a prescribed person but does not provide the service to the person.(1C)For subsection (1)(b), it is not a reasonable excuse that, after the driver accepted the booking, another booking for a booked hire service, or an opportunity to provide a taxi service, became available to the driver.(2)Section 81(1A) to (2)—renumber as section 81(2) to (5).Part 4Amendment of Transport Operations (Road Use Management—Accreditation and Other Provisions) Regulation 20157Regulation amendedThis part amends the Transport Operations (Road Use Management—Accreditation and Other Provisions) Regulation 2015.8Amendment of s 60 (Application by accredited person for replacement accreditation document)(1)Section 60(6)—omit, insert—(6)The chief executive may waive payment of the fee mentioned in subsection (3) if—

(a)the application is for the replacement of an accreditation document; and

(b)the chief executive is satisfied the accreditation document was lost or damaged because of a natural disaster.

(6A)Also, the chief executive may waive payment of the fee mentioned in subsection (3) if the application is for the replacement of a smartcard accreditation document that was—

(a)damaged or lost as a result of a person, other than the accredited person, committing an indictable offence that is a crime or misdemeanour; or

(b)stolen.

(2)Section 60(7), definition exempt application, from ‘if’ to ‘document’—omit, insert—that(3)Section 60(6A) and (7)—renumber as section 60(7) and (8).Part 5Amendment of Transport Operations (Road Use Management—Driver Licensing) Regulation 20219Regulation amendedThis part amends the Transport Operations (Road Use Management—Driver Licensing) Regulation 2021.10Amendment of s 367 (Replacement Queensland driver licences if licences damaged, lost or stolen)Section 367(3)—omit, insert—(3)The chief executive must issue a driver licence receipt to the holder unless the chief executive suspects the original licence was not damaged, lost or stolen.11Amendment of s 367A (Replacement Queensland driver licences if data breach)(1)Section 367A, heading, ‘data breach’—omit, insert—unauthorised access or disclosure of confidential information(2)Section 367A(1), from ‘is at risk’—omit, insert—believes that confidential information on the Queensland driver licence has been accessed by, or disclosed to, a person not authorised to have the information.(3)Section 367A(5)—omit, insert—(5)In this section—confidential information—

(a)means—

(i)the personal information of a person; or

(ii)the number of a Queensland driver licence; or

(iii)the card number stated on a smartcard driver licence; and

(b)includes a digital photo of a person and a digitised signature of a person.

12Insertion of new s 398 After section 397—insert—398Waiving payment of fees for replacement Queensland driver licence in particular circumstances(1)The chief executive may waive the payment of the fee mentioned in schedule 7, item 11 for the issue of a replacement Queensland driver licence under section 367(3) if the application is for the replacement of a licence that was—

(a)damaged or lost as a result of a person, other than the person required to pay the fee, committing an indictable offence that is a crime or misdemeanour; or

(b)stolen.

(2)The chief executive may waive the payment of the fee mentioned in schedule 7, item 11 for the issue of a replacement Queensland driver licence under section 367A(3).Part 6Amendment of Transport Operations (Road Use Management—Vehicle Registration) Regulation 202113Regulation amendedThis part amends the Transport Operations (Road Use Management—Vehicle Registration) Regulation 2021.14Insertion of new s 123AAfter section 123—insert—123A Waiving fee for particular number plates damaged, destroyed, lost or stolen in particular circumstances(1)This section applies to an application under section 123 for the replacement of a number plate for a vehicle.(2)The chief executive may waive the application fee mentioned in section 123(3)(a)(i) if the application is for the replacement of a number plate that was—

(a)damaged, destroyed or lost as a result of a person, other than the registered operator of the vehicle, committing an indictable offence that is a crime or misdemeanour; or

(b)stolen.

(3)However, if the application is for the replacement of a special plate for a vehicle, subsection (2) applies only if the application is for another number plate that is not a special plate.
