and</txt></block></li><li id="sec.4-frag-para1.a-para2.ii" guid="_2e9f905a-094a-438d-9948-e707b414137c" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">hospitals; and</txt></block></li><li id="sec.4-frag-para1.a-para2.iii" guid="_a89fef69-ac75-4522-9d01-1db01a17fc7e" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">transport and telecommunication networks; and</txt></block></li><li id="sec.4-frag-para1.a-para2.iv" guid="_8ee1efcc-6d5f-4c66-96e4-5b6ef5a01efc" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">utility installations; and</txt></block></li></list></block></li><li id="sec.4-frag-para1.b" guid="_0d7db221-8715-4863-b432-83f41586264b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">residential uses, if all of the dwellings for the residential use, other than caretaker’s accommodation, are— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-para1.b-para2.i" guid="_3624c94b-04be-4668-ba20-e50f6d15881e" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">an affordable housing component; and</txt></block></li><li id="sec.4-frag-para1.b-para2.ii" guid="_e30220b6-4516-49c8-b596-af39565a181f" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">either on land—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-para1.b-para2.ii-para3.A" guid="_9c38b208-6535-45f7-b5c3-1dc0c0d56444" provision.type="other" affected.by.uncommenced="0"><no>(A)</no><block><txt break.before="0">associated with a community activity comprised of a community care centre, a place of worship or a residential care facility; or</txt></block></li><li id="sec.6-frag-sec.7D-ssec.1-para1.a-para2.ii" guid="_6fb71d11-d9a6-4542-934c-b5357625e4df" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a zone, other than a zone stated in schedule 2, that is of a substantially similar type to a zone stated in subparagraph (i); and</txt></block></li></list></block></li><li id="sec.6-frag-sec.7D-ssec.1-para1.b" guid="_279674b7-7a24-4199-8f3f-6612fa58750c" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the material change of use involves an existing dwelling, including, for example, a presbytery or caretaker’s accommodation, on the premises; and</txt></block></li><li id="sec.6-frag-sec.7D-ssec.1-para1.c" guid="_ac69964d-e42c-4df4-ac98-08af8fc6d454" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the material change of use—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-sec.7D-ssec.1-para1.c-para2.i" guid="_a6daafad-4e5c-4fbc-a474-21616d752e44" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">does not involve the carrying out of building work; or</txt></block></li><li id="sec.6-frag-sec.7D-ssec.1-para1.c-para2.ii" guid="_1c42de10-d47b-4f0a-a7ca-50a53539c127" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">involves the carrying out of minor building work only; and</txt></block></li></list></block></li><li id="sec.6-frag-sec.7D-ssec.1-para1.d" guid="_232f3b72-4584-4ecd-b1ed-7882811d1ab7" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-sec.7D-ssec.1-para1.d-para2.i" guid="_ddecc0f6-384e-46eb-ac3b-453f5cc87a8a" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">none of the following overlays apply to the premises—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-sec.7D-ssec.1-para1.d-para2.i-para3.A" guid="_a9066007-0270-4c08-8e52-e8b0e5092c48" provision.type="other" affected.by.uncommenced="0"><no>(A)</no><block><txt break.before="0">an overlay about bush fire hazards, coastal hazards, flood hazards or landslide hazards;</txt></block></li><li id="sec.6-frag-sec.7D-ssec.1-para1.d-para2.i-para3.B" guid="_3cea7e56-4ce9-482c-9b14-eba0553ba502" provision.type="other" affected.by.uncommenced="0"><no>(B)</no><block><txt break.before="0">an overlay about safety hazards arising from historic mining activities, including, for example, mining subsidence and mining contamination;</txt></block></li><li id="sec.6-frag-sec.7D-ssec.1-para1.d-para2.i-para3.C" guid="_268c4a4a-c719-409b-b931-2197037bcac0" provision.type="other" affected.by.uncommenced="0"><no>(C)</no><block><txt break.before="0">an overlay about development of a local heritage place; or</txt></block></li></list></block></li><li id="sec.6-frag-sec.7D-ssec.1-para1.d-para2.ii" guid="_f97bc6df-18cc-44b8-b906-709aec074faf" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">an overlay mentioned in subparagraph (i) applies to the premises and the application of the overlay does not result in the material change of use being categorised as assessable development.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.6-frag-sec.7D-ssec.2" guid="_aba0d335-ac81-4c8b-84df-b736334cb2c9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section a reference to an overlay is a reference to the overlay as identified in the local categorising instrument and relevant to assessment of the material change of use. </txt></block></subclause></clause></fragment></block></clause></body></wrapper></subordleg>
