check="valid">schedule&#160;2</intref> defines particular words used in this regulation.</txt></block></clause><clause id="sec.4" guid="_969bbb25-0988-45c8-81be-25342d8048f0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_37337c3c-5f6e-4bb0-a52b-e0cc7c95a263">Prescribed subordinate legislation—<legref guid="_7542597c-5247-4ca8-96c4-ccab01da821b">Prescribed certificates for disclosure statement for sale of lot—<legref target.doc.id="act-1974-076" target.version.series="4d0b56d0-a89e-498b-b9ce-e650a4f6c4b1" check="valid" jurisd="QLD" type="act">Act</legref>, <legref refid="sec.99" target.doc.id="act-1974-076" target.version.series="4d0b56d0-a89e-498b-b9ce-e650a4f6c4b1" target.guid="_b45b3736-a063-48a4-8f4e-4d36ea90a4ca" check="valid" jurisd="QLD" type="act">s&#160;99</legref></heading><subclause id="sec.5-ssec.1" guid="_3738f0e1-1ba9-4e8c-a425-6934d6e38130" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <legref refid="sec.99" type="act">section&#160;99</legref><legref refid="sec.99-ssec.1" target.doc.id="act-1974-076" target.version.series="4d0b56d0-a89e-498b-b9ce-e650a4f6c4b1" target.guid="_7c5b6d34-ac66-42cf-a658-00f28e82d280" check="valid" jurisd="QLD" type="act">(1)</legref><legref refid="sec.99-ssec.1-para1.b" target.doc.id="act-1974-076" target.version.series="" check="invalid" jurisd="QLD" type="act">(b)</legref> of the <legref target.doc.id="act-1974-076" target.version.series="4d0b56d0-a89e-498b-b9ce-e650a4f6c4b1" check="valid" jurisd="QLD" type="act">Act</legref>, the following documents are prescribed for the sale of a lot—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_ff243351-d4a8-43ed-987f-cb65b64d9b0a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a title search for the lot showing interests registered under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref> for the lot;</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_e56efe64-8695-4995-9b7d-a5bcc710181e" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a copy of the plan of survey registered under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref> for the lot;</txt></block></li><li id="sec.5-ssec.1-para1.c" guid="_cedc47c3-3e4c-420f-b6b8-bb2aaec4f35b" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">if the seller is required to give the buyer a notice under the <legref target.doc.id="act-1991-098" target.version.series="b20a6ba1-d45a-4cf3-a1e3-8370a2766a12" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Queensland Building and Construction Commission Act 1991</name></legref>, <legref refid="sec.47" target.doc.id="act-1991-098" target.version.series="b20a6ba1-d45a-4cf3-a1e3-8370a2766a12" target.guid="_608cb1b6-b1e4-49c5-b838-f053926a597c" check="valid" jurisd="QLD" type="act">section&#160;47</legref> before the buyer signs the contract for the sale of the lot—a copy of the notice;</txt></block></li><li id="sec.5-ssec.1-para1.d" guid="_7b18e653-29a4-4e57-ab71-8b9a48b53501" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">if the seller has been given a notice mentioned in the <legref target.doc.id="act-1975-011" target.version.series="d9daab5f-059e-488d-ba00-96f36d4a1fe5" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Act 1975</name></legref>, <legref refid="sec.246AG" target.doc.id="act-1975-011" target.version.series="d9daab5f-059e-488d-ba00-96f36d4a1fe5" target.guid="_2033d560-0f75-4df3-b40c-f1271f555867" check="valid" jurisd="QLD" type="act">section&#160;246AG</legref>, <legref refid="sec.247" target.doc.id="act-1975-011" target.version.series="d9daab5f-059e-488d-ba00-96f36d4a1fe5" target.guid="_a55870a3-e80b-4bdb-96fe-0d372d9eb7e9" check="valid" jurisd="QLD" type="act">247</legref> or <legref refid="sec.248" target.doc.id="act-1975-011" target.version.series="d9daab5f-059e-488d-ba00-96f36d4a1fe5" target.guid="_156fce9d-85f4-4e00-8e0a-b4b072c772b5" check="valid" jurisd="QLD" type="act">248</legref> or the <legref target.doc.id="act-2016-025" target.version.series="d4a7e9d3-f73d-48a3-9459-9be0b66a1c15" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Planning Act 2016</name></legref>, <legref refid="sec.167" target.doc.id="act-2016-025" target.version.series="d4a7e9d3-f73d-48a3-9459-9be0b66a1c15" target.guid="_3df81a17-3f76-4aa9-b757-9825df0c548f" check="valid" jurisd="QLD" type="act">section&#160;167</legref> or <legref refid="sec.168" target.doc.id="act-2016-025" target.version.series="d4a7e9d3-f73d-48a3-9459-9be0b66a1c15" target.guid="_e840e0eb-20d7-4232-9e5c-bae8b5f9e0e4" check="valid" jurisd="QLD" type="act">168</legref> and the notice remains in effect immediately before the buyer signs the contract for the sale of the lot—a copy of the notice;</txt></block></li><li id="sec.5-ssec.1-para1.e" guid="_382396d9-3444-4098-ac18-c91035abe4f7" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">if the seller has been given a notice or order by a competent authority requiring work to be done or money to be spent in relation to the lot and the notice or order remains in effect immediately before the buyer signs the contract for the sale of the lot—a copy of the notice or order;</txt></block></li><li id="sec.5-ssec.1-para1.f" guid="_2ac5ea06-22e9-491e-997f-c6c9100586f6" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">if the seller is required to give the buyer a notice under the <legref target.doc.id="act-1994-062" target.version.series="e86d14b2-a55d-4639-9649-bd989eb91261" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Environmental Protection Act 1994</name></legref>, <legref refid="sec.347" target.doc.id="act-1994-062" target.version.series="e86d14b2-a55d-4639-9649-bd989eb91261" target.guid="_c2178182-1489-4fa1-acb1-ab8503df19be" check="valid" jurisd="QLD" type="act">section&#160;347</legref><legref refid="sec.347-ssec.2" target.doc.id="act-1994-062" target.version.series="e86d14b2-a55d-4639-9649-bd989eb91261" target.guid="_4543042c-3ee3-42ac-9c73-10eaed473a86" check="valid" jurisd="QLD" type="act">(2)</legref>, <legref refid="sec.369C" target.doc.id="act-1994-062" target.version.series="e86d14b2-a55d-4639-9649-bd989eb91261" target.guid="_266c09e2-e902-4937-b75d-941f8cb93185" check="valid" jurisd="QLD" type="act">369C</legref><legref refid="sec.369C-ssec.2" target.doc.id="act-1994-062" target.version.series="e86d14b2-a55d-4639-9649-bd989eb91261" target.guid="_541140ff-0266-4f9c-99d7-9b59de38f56c" check="valid" jurisd="QLD" type="act">(2)</legref> or <legref refid="sec.408" target.doc.id="act-1994-062" target.version.series="e86d14b2-a55d-4639-9649-bd989eb91261" target.guid="_81005619-6453-46a6-9d37-4a5681661cbb" check="valid" jurisd="QLD" type="act">408</legref><legref refid="sec.408-ssec.2" target.doc.id="act-1994-062" target.version.series="e86d14b2-a55d-4639-9649-bd989eb91261" target.guid="_c3f25dfe-3c5b-4f49-a023-8dcff560aeed" check="valid" jurisd="QLD" type="act">(2)</legref> in relation to the sale of the lot—a copy of the notice;</txt></block></li><li id="sec.5-ssec.1-para1.g" guid="_7818719b-21b9-4c10-9c53-790e24aad702" provision.type="other" affected.by.uncommenced="0"><no>(g)</no><block><txt break.before="0">a copy of any document given to the seller in relation to information mentioned in <intref refid="sec.8" target.guid="_d410c7f1-052a-424f-a41d-b8408e96786b" check="valid">section&#160;8</intref><intref refid="sec.8-ssec.1" target.guid="_d2bbb472-b882-427d-948a-0277e386f44f" check="valid">(1)</intref><intref refid="sec.8-ssec.1-para1.h" target.guid="_e3425b05-edea-44fd-b6dd-2a62503727e2" check="valid">(h)</intref>, <intref refid="sec.8-ssec.1-para1.i" target.guid="_06f7903f-61f0-4978-bb2e-3ad9d7ace4fd" check="valid">(i)</intref> or <intref refid="sec.8-ssec.1-para1.k" target.guid="_1d4c46fa-1d34-470a-aa7c-c9e9dae3a8c3" check="valid">(k)</intref>;</txt></block></li><li id="sec.5-ssec.1-para1.h" guid="_a5d4b326-414a-44e1-afda-876611be66d3" provision.type="other" affected.by.uncommenced="0"><no>(h)</no><block><txt break.before="0">if there is a relevant pool for the lot—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.h-para2.i" guid="_86f5ad25-d975-40ce-a4ca-eb3831efdb1d" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a pool compliance certificate for the pool; or</txt></block></li><li id="sec.5-ssec.1-para1.h-para2.ii" guid="_e826e2ff-fcd4-4694-a859-fa618abc7e5a" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a notice under the <legref target.doc.id="act-1975-011" target.version.series="d9daab5f-059e-488d-ba00-96f36d4a1fe5" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Act 1975</name></legref>, <legref refid="sec.246ATM" target.doc.id="act-1975-011" target.version.series="d9daab5f-059e-488d-ba00-96f36d4a1fe5" target.guid="_6f9352e5-fa94-4ca5-9a40-7f4e43e41239" check="valid" jurisd="QLD" type="act">section&#160;246ATM</legref> that there is no pool safety certificate in effect for the pool;</txt></block></li></list></block></li><li id="sec.5-ssec.1-para1.i" guid="_7c3b78bb-4512-428b-a703-4abd69305f8f" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if the lot is included in a community titles scheme—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.i-para2.i" guid="_7d5c5639-bf64-475f-854c-0b267ded0f54" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a copy of the most recent community management statement for the scheme as recorded under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref>, <legref refid="sec.115L" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" target.guid="_7f43426b-3573-479e-8103-0787c5672315" check="valid" jurisd="QLD" type="act">section&#160;115L</legref> or another Act; and</txt></block></li><li id="sec.5-ssec.1-para1.i-para2.ii" guid="_b8529195-be10-439f-88cf-bdf6668562bb" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.i-para2.ii-para3.A" guid="_09a9e182-3262-481c-8e25-85b773fd6296" provision.type="other" affected.by.uncommenced="0"><no>(A)</no><block><txt break.before="0">a copy of a body corporate certificate for the lot; or</txt></block></li><li id="sec.5-ssec.1-para1.i-para2.ii-para3.B" guid="_1bb4b406-260a-4f03-ac09-aae0d03ffba0" provision.type="other" affected.by.uncommenced="0"><no>(B)</no><block><txt break.before="0">if <intref refid="sec.6" target.guid="_cef7d9bd-fa36-46be-be9a-26dec4388262" check="valid">section&#160;6</intref> applies—an explanatory statement for the lot;</txt></block></li></list></block></li></list></block></li><li id="sec.5-ssec.1-para1.j" guid="_6fe432ab-e304-470e-987c-b9353a3ccb39" provision.type="other" affected.by.uncommenced="0"><no>(j)</no><block><txt break.before="0">if the lot is included in a BUGTA scheme, either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.j-para2.i" guid="_cf4ed77e-b18b-47b5-a407-73967f55e45f" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a copy of a body corporate certificate for the lot; or</txt></block></li><li id="sec.5-ssec.1-para1.j-para2.ii" guid="_0741b388-389e-4ab7-9b2f-6df8cb00a2d1" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if <intref refid="sec.7" target.guid="_66742f9c-6d14-4136-a0dc-f6e5a18f5e8e" check="valid">section&#160;7</intref> applies—an explanatory statement for the lot.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_4225b1f2-a2cb-4c9c-9e1d-d42dd07e5f9b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-ssec.2-def.bodycorporatecertificate_" guid="_cba9d1f3-63d3-43a1-acaf-caea68df54cb" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.2-def.bodycorporatecertificate" guid="_366e9189-1f29-4edc-ae14-62335a86bcc7" type="definition">body corporate certificate</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-def.bodycorporatecertificate-para1.a" guid="_693f811c-457d-44c4-905d-990edd71aa25" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for a lot included in a community titles scheme—a body corporate certificate under the <legref target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Body Corporate and Community Management Act 1997</name></legref>, <legref refid="sec.205" target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" target.guid="_e8260fa1-f392-4edd-a88e-fb3348e2da16" check="valid" jurisd="QLD" type="act">section&#160;205</legref><legref refid="sec.205-ssec.4" target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" target.guid="_0c6c639f-8bce-43f1-894b-7312f3e52273" check="valid" jurisd="QLD" type="act">(4)</legref>; or</txt></block></li><li id="sec.5-ssec.2-def.bodycorporatecertificate-para1.b" guid="_5caa347d-3c54-4fc1-b0cb-9cf3825095d0" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for a lot included in a BUGTA scheme—a body 	corporate certificate under the <legref target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Units and Group Titles Act 1980</name></legref>, <legref refid="sec.40AA" target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="invalid" jurisd="QLD" type="act">section&#160;40AA</legref><legref refid="sec.40AA-ssec.1" target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="invalid" jurisd="QLD" type="act">(1)</legref>.</txt></block></li></list></definition><definition id="sec.5-ssec.2-def.communitymanagementstatement_" guid="_318655fb-f335-4e9c-bd97-a1ded6ef03dc" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.2-def.communitymanagementstatement" guid="_0665d80e-e4aa-4687-956f-5dd89e4539fe" type="definition">community management statement</defterm> means a community management statement under the <legref target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Body Corporate and Community Management Act 1997</name></legref>, <legref refid="sec.12" target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" target.guid="_1f843af0-7994-4add-aa4f-527555193e4c" check="valid" jurisd="QLD" type="act">section&#160;12</legref>.</txt></definition><definition id="sec.5-ssec.2-def.competentauthority_" guid="_eb4f4823-4ba1-4120-af30-a8f763781296" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.2-def.competentauthority" guid="_4e6c1024-007d-434a-af77-f56a44cd68ff" type="definition">competent authority</defterm> includes the Commonwealth, a State, a local government, and a court or tribunal.</txt></definition><definition id="sec.5-ssec.2-def.poolcompliancecertificate_" guid="_d4499cbe-f63d-4c5f-a57f-21840b378173" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.2-def.poolcompliancecertificate" guid="_81f50167-95cc-40aa-86bb-6157417b064f" type="definition">pool compliance certificate</defterm>, for a pool, means any of the following relating to the pool—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-def.poolcompliancecertificate-para1.a" guid="_4263d4e6-6688-482c-a9f5-25d4a336aa4d" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a pool
