id="sec.3-frag-pt.1A-sec.2A-he" guid="_f673713a-4176-4266-8a40-642d8baacc3b">Definitions for part</heading><block><txt break.before="1">In this part—</txt><deflist><definition id="sec.3-frag-pt.1A-sec.2A-def.affordablepurchaseprice_" guid="_3bbf3ab2-9318-4612-823e-8f78c3cf8e30" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.affordablepurchaseprice" guid="_19acc508-e1d9-4aa1-9c55-6828cc2e9f71" type="definition">affordable purchase price</defterm>, for a household, means a price that enables the cost of servicing a mortgage for 90% of the purchase price to be not more than 30% of the gross income of the household.</txt></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.affordablerent_" guid="_8f6692c7-66ba-43cf-9783-dc6dc7469815" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.affordablerent" guid="_932cdf08-de99-4e21-abb9-ab4020b01369" type="definition">affordable rent</defterm>, for a household, means a rent of not more than 30% of the gross income of the household.</txt></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.firsthomebuyerhousehold_" guid="_249974c9-29c6-4098-a2f4-067a245798e4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.firsthomebuyerhousehold" guid="_1225a34c-c7ce-479e-b6db-9f4cd4636822" type="definition">first home buyer household</defterm> means a household that has a gross household income within the range nominated in a housing needs analysis for identifying a first home buyer household for the priority development area in which the household is situated.</txt></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.housingneedsanalysis_" guid="_9b37c035-c295-4ff2-ab5a-483dbf687afc" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.housingneedsanalysis" guid="_18731f2a-23f8-4e3a-a7b2-6592671dbe2a" type="definition">housing needs analysis</defterm> means a document called ‘Housing needs analysis’ that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.1A-sec.2A-def.housingneedsanalysis-para1.a" guid="_2f748b04-65c1-4037-be3c-410ab9d9d1ce" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">analyses the need for particular types of housing for particular types of households in a particular priority development area; and</txt></block></li><li id="sec.3-frag-pt.1A-sec.2A-def.housingneedsanalysis-para1.b" guid="_6f28e956-2920-4b71-9eca-95a0659c1aa4" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">nominates a range of gross household income within which a household may be identified as a first home buyer household or a key worker household for a particular priority development area; and</txt></block></li><li id="sec.3-frag-pt.1A-sec.2A-def.housingneedsanalysis-para1.c" guid="_854fe28d-65e3-49bb-b4b5-8e5ec542290d" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">is published on MEDQ’s website.</txt></block></li></list></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.keyworkerhousehold_" guid="_9d469bbc-937e-43d9-a0af-fbb3b91fcc60" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.keyworkerhousehold" guid="_ea882e41-53d0-45d1-94f9-e95774b468d0" type="definition">key worker household</defterm> means a household that has a gross household income within the range nominated in a housing needs analysis for identifying a key worker household for the priority development area in which the household is situated.</txt></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.lowtomoderateincomehousehold_" guid="_fce01429-8b89-43b3-b409-080c6ed2a2c4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.lowtomoderateincomehousehold" guid="_aa9266dd-bbb3-4dda-9ab1-db6833944077" type="definition">low to moderate income household</defterm> means a household that has a gross household income of more than 50% and less than 120% of the median household income for the local government area in which the household is situated.</txt></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.marketrent_" guid="_e1ed28bf-8114-40b6-a3a7-3089297f7737" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.marketrent" guid="_4b274208-14c1-40ff-a466-dd8cc39216d2" type="definition">market rent</defterm>, of housing, means the estimated amount for which an interest in the housing should be leased on the open market between a willing lessor and willing lessee on appropriate terms in an arm’s length transaction, after proper marketing and if the parties had each acted knowledgeably, prudently and without compulsion.</txt></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.marketvalue_" guid="_4d3291e1-4d42-47f2-bf1c-cdbd4a0ee2d4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.marketvalue" guid="_e550cd61-464a-471d-82ce-0628d8097598" type="definition">market value</defterm>, of housing, means the estimated amount for which the housing should exchange on the open market between a willing buyer and a willing seller in an arm’s length transaction, after proper marketing and if the parties had each acted knowledgeably, prudently and without compulsion.</txt></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.medianhouseholdincome_" guid="_ebd03fcb-0557-41e3-9fc6-e9aa018a0b93" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.medianhouseholdincome" guid="_6c7da76a-34c9-41a6-87ff-849a75bf891a" type="definition">median household income</defterm>, for a local government area, means the median household income for the area published by the Australian Bureau of Statistics and indexed by the Queensland wage price index published by the Australian Bureau of Statistics.</txt></definition><definition id="sec.3-frag-pt.1A-sec.2A-def.verylowincomehousehold_" guid="_b368837e-5be6-4f2e-a721-836ee8e762b6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.1A-sec.2A-def.verylowincomehousehold" guid="_bacde178-0480-4491-bba5-7916c470e0d3" type="definition">very low income household</defterm> means a household that has a gross household income of 50% or less than the median household income for the local government area in which the household is situated.</txt></definition></deflist></block></clause><clause id="sec.3-frag-pt.1A-sec.2B" guid="_c3b9baac-6f5d-4b4a-bb14-e5d30cb8aceb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2B</no><heading id="sec.3-frag-pt.1A-sec.2B-he" guid="_5fe1ca6a-68c1-40b7-a271-f221fddd0c2f">Affordable housing—Act, s 7B</heading><subclause id="sec.3-frag-pt.1A-sec.2B-ssec.1" guid="_83542dd5-8627-4f2f-a5cb-fabd98177da3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section prescribes, for section 7B of the Act, housing that is affordable to the following types of households—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.1A-sec.2B-ssec.1-para1.a" guid="_29d08b13-0e34-4e1e-8fd7-5c06c04e0d22" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">very low income households;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.1-para1.b" guid="_74a7e4f8-e162-4628-b96a-8ca53bb749ac" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">low to moderate income households;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.1-para1.c" guid="_68419917-9dcd-4104-8751-204db58188f2" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">key worker households;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.1-para1.d" guid="_e56b077b-1652-4bac-8b19-f91c65cd8b3d" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">first home buyer households.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-pt.1A-sec.2B-ssec.2" guid="_620a01e2-b68e-4da5-aef1-f23e0999c6c9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Housing is affordable to very low income households if the housing satisfies either or both of the following criteria—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.1A-sec.2B-ssec.2-para1.a" guid="_e70f8a0b-de98-43e6-baf6-bfb98b320233" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the housing is provided for rental by a registered provider under the <legref target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Housing Act 2003</name></legref>, schedule 4 at an affordable rent for very low income households;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.2-para1.b" guid="_f8296240-998c-492c-a4fc-4c2557ac04c7" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the housing is provided as part of a program, funded by any of the following entities, to support the provision of housing that is affordable to very low income households—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.1A-sec.2B-ssec.2-para1.b-para2.i" guid="_51b9c4e1-cd4e-441b-8683-8c436b4e8a04" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a public sector entity under the <legref target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Sector Act 2022</name></legref>, section 8;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.2-para1.b-para2.ii" guid="_ed79dd51-9b37-48d4-ba77-0fb539a1aa03" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a local government;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.2-para1.b-para2.iii" guid="_86858dd8-50e3-45b1-b60d-eda0376077a7" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the State;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.2-para1.b-para2.iv" guid="_123cba1a-550b-4c91-be79-b90c9613ccd8" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">the Commonwealth.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.3-frag-pt.1A-sec.2B-ssec.3" guid="_d1a6123e-44e9-4120-a45b-5e0490fff1e9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Housing is affordable to low to moderate income households if the housing satisfies 1 or more of the following criteria—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.a" guid="_5d716709-b96e-4cdc-9c43-2d1fbaf83992" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the housing is provided for rental by a registered provider under the <legref target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Housing Act 2003</name></legref>, schedule 4 at an affordable rent for low to moderate income households;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.b" guid="_f15a5b7d-e578-483b-ba5e-dc1e63f96f90" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the housing is provided for rental at a rent of not more than 74.9% of the market rent of the housing;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.c" guid="_894fc1cf-b6dd-4bc6-bf8f-3fad9d57d590" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the housing is provided as part of a program, funded by any of the following entities, to support the provision of housing that is affordable to low to moderate income households—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.c-para2.i" guid="_5a128991-2bd0-43c5-b572-3ac599f92978" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a public sector entity under the <legref target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Sector Act 2022</name></legref>, section 8;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.c-para2.ii" guid="_9a228a19-85b0-49d7-b26d-b1d49c05758e" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a local government;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.c-para2.iii" guid="_e776d048-4c28-42a1-9cb6-46d8dd0f9c81" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the State;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.c-para2.iv" guid="_bc4598d0-b178-446f-b50f-7c7fc633a769" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">the affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the housing has a market value that is not more than the affordable purchase price for low to moderate income households in the local government area in which the housing is located;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.e" guid="_ace45096-e686-40c1-9dfb-a7c575cc83e7" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">the housing has a market value that is not more than 20 times the affordable rent, calculated on a yearly basis, for low to moderate income households in the local government area in which the housing is located;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.3-para1.f" guid="_321ddeb2-eba6-41b2-abc8-32f09e3685f8" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">the housing has a market rent that is not more than the affordable rent for low to moderate income households in the local government area in which the housing is located.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-pt.1A-sec.2B-ssec.4" guid="_d617fbdc-a824-4607-a77c-c39bf7f50d14" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Housing is affordable to key worker households if the housing satisfies 1 or more of the following criteria—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.1A-sec.2B-ssec.4-para1.a" guid="_f379e099-919d-41c0-bcbe-9ac5fbe5770a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the housing has a market value that is not more than the affordable purchase price for key worker households in the priority development area in which the housing is located;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.4-para1.b" guid="_d0070d9f-d231-41cc-abf3-1d19eaf2b1e5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the housing has a market value that is not more than 20 times the affordable rent, calculated on a yearly basis, for key worker households in the priority development area in which the housing is located;</txt></block></li><li id="sec.3-frag-pt.1A-sec.2B-ssec.4-para1.c" guid="_f5d2588c-cebf-4b70-9772-5a2385787d95" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the housing has a market rent that is not more than the affordable rent for key worker households in the priority development area in which the housing is located.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-pt.1A-sec.2B-ssec.5" guid="_0512a916-2cb6-47f2-80c3-ddd043a54f43" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Housing is affordable to first home buyer households if the housing has a market value that is not more than the affordable purchase price for first home buyer households in the priority development area in which the housing is located.</txt></block></subclause></clause></part></fragment></block></clause></body></wrapper></subordleg>
