break.before="1">The purpose of financial assistance under the scheme is to help owners of eligible homes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.2-para1.a" guid="_496e13a4-a065-4b5b-8028-801cfec25b53" provision.type="other"><no>(a)</no><block><txt break.before="0">to repair or retrofit an eligible home to incorporate flood resilient design and materials to make the home more resilient to damage caused by flooding; or</txt></block></li><li id="sec.5-sec.2-para1.b" guid="_d9dfb917-1886-49ea-8c33-9356c4e03739" provision.type="other"><no>(b)</no><block><txt break.before="0">to raise an eligible home to make the home more resilient to flooding.</txt></block></li></list></block></clause><clause affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.eligiblehome" guid="_00d9ca0d-c679-49d0-a376-59914a98eb9d" type="definition">eligible home</defterm> see section id="sec.5-sec.3-def.eligibleworks-para1.a-note-para2.1" guid="_b469e644-6c33-4666-8347-25b927338699" provision.type="other"><no>1</no><block><txt break.before="0">replacing cavity walls with non-cavity walls</txt></block></li><li id="sec.5-sec.3-def.eligibleworks-para1.a-note-para2.2" guid="_86acd003-5fe9-448a-b644-e3aef796ccd4" provision.type="other"><no>2</no><block><txt break.before="0">raising general power outlets, switchboards, air conditioning units and hot water systems above recognised flood levels</txt></block></li></list></block></note></block></li><li id="sec.5-sec.3-def.eligibleworks-para1.b" guid="_6b3012c9-d01b-4bcd-9723-4b1ef06ad3ae" provision.type="other"><no>(b)</no><block><txt break.before="0">raise all or part of an eligible home so that the habitable floor level of the home is at or above the flood hazard level that applies to the home.</txt></block></li></list></definition><definition id="sec.5-sec.3-def.floodhazardlevel_" guid="_a84a08d6-3c87-4e01-aaa4-a3b00de20a16" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.floodhazardlevel" guid="_e7c62ed9-da25-464c-b209-9baf7ca6717a" type="definition">flood hazard level</defterm>, that applies to a home, means the minimum habitable floor level of residential buildings as determined by the local government for the local government area in which the home is located.</txt></definition><definition id="sec.5-sec.3-def.grannyflat_" guid="_eda2e8db-a8ab-4974-b7f1-73d9245c87bb" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.grannyflat" guid="_1d281737-2b56-467c-b922-cd5127652a27" type="definition">granny flat</defterm>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.grannyflat-para1.a" guid="_24c919bc-e241-4710-9350-5cf7d7bde3e2" provision.type="other"><no>(a)</no><block><txt break.before="0">means a small building that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.grannyflat-para1.a-para2.i" guid="_dcc25b99-1361-41ab-bb25-91156e016f1f" provision.type="other"><no>(i)</no><block><txt break.before="0">is capable of providing self-contained accommodation; and</txt></block></li><li id="sec.5-sec.3-def.grannyflat-para1.a-para2.ii" guid="_3fc4e323-48cc-4984-bf62-10e0056cb4f8" provision.type="other"><no>(ii)</no><block><txt break.before="0">is attached to land; and</txt></block></li><li id="sec.5-sec.3-def.grannyflat-para1.a-para2.iii" guid="_c3c69995-b105-4910-ab24-5a856d3590dc" provision.type="other"><no>(iii)</no><block><txt break.before="0">is detached from the main building on the land used for residential purposes; and</txt></block></li></list></block></li><li id="sec.5-sec.3-def.grannyflat-para1.b" guid="_d1257dca-3f77-4c2f-9798-3ec33965bc83" provision.type="other"><no>(b)</no><block><txt break.before="0">does not include a house, townhouse, unit or manufactured home.</txt></block></li></list></definition><definition id="sec.5-sec.3-def.habitablefloorlevel_" guid="_76b01059-ed07-47d6-ac5e-431a59a5d99d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.habitablefloorlevel" guid="_bbf6a4b7-61e0-4540-b9cd-8e15b5ce419c" type="definition">habitable floor level</defterm>, of a home or residential building, means the level of the floors of the habitable rooms of the home or building.</txt></definition><definition id="sec.5-sec.3-def.habitableroom_" guid="_1f0110cc-9415-44db-83df-afeb5b473235" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.habitableroom" guid="_88a385ce-815d-44e1-8766-5b8285b4e43b" type="definition">habitable room</defterm> means a habitable room within the meaning of the National Construction Code.</txt></definition><definition id="sec.5-sec.3-def.hardshipcertificate_" guid="_bf041d48-1d95-48b0-becd-23aee1795758" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.hardshipcertificate" guid="_60894885-6f0d-465a-a653-464a882af4ce" type="definition">hardship certificate</defterm> means a certificate issued by the department of energy and public works stating that the chief executive of that department is satisfied that, due to exceptional circumstances, a stated person is unable to contribute to the cost of carrying out eligible works to the person’s home.</txt></definition><definition id="sec.5-sec.3-def.house_" guid="_433b77c7-1451-4350-b817-a6773c188b74" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.house" guid="_4947013b-dce1-4b0e-95e8-3b3422525e36" type="definition">house</defterm> means a single detached dwelling on a lot within the meaning of the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref>.</txt></definition><definition id="sec.5-sec.3-def.licensedcontractor_" guid="_2b67010c-e662-4b49-b673-428175f31463" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.licensedcontractor" guid="_e73100f0-795a-4428-a78a-c71d63a6c5ba" type="definition">licensed contractor</defterm>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.licensedcontractor-para1.a" guid="_eb865775-d830-4fd8-8774-7a839ef888c0" provision.type="other"><no>(a)</no><block><txt break.before="0">means a person who holds—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.licensedcontractor-para1.a-para2.i" guid="_363ebc6e-4364-4294-a3fb-d14273561016" provision.type="other"><no>(i)</no><block><txt break.before="0">an electrical licence under the <legref target.doc.id="act-2002-042" target.version.series="9d2ec9d5-3b10-46e1-9683-4924f95ec319" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Electrical Safety Act 2002</name></legref>; or</txt></block></li><li id="sec.5-sec.3-def.licensedcontractor-para1.a-para2.ii" guid="_ab7bdb3d-16d6-408a-8bc0-a992af763ad3" provision.type="other"><no>(ii)</no><block><txt break.before="0">a licence under the <legref target.doc.id="act-2018-017" target.version.series="cee7b881-5660-41fb-8db7-3e79959b802a" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Plumbing and Drainage Act 2018</name></legref>; or</txt></block></li><li id="sec.5-sec.3-def.licensedcontractor-para1.a-para2.iii" guid="_0676d25a-df5c-477f-8db8-3d17385e9043" provision.type="other"><no>(iii)</no><block><txt break.before="0">a licence under the <legref target.doc.id="act-1991-098" target.version.series="b20a6ba1-d45a-4cf3-a1e3-8370a2766a12" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Queensland Building and Construction Commission Act 1991</name></legref>; target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Manufactured Homes (Residential Parks) Act 2003</name></legref>, section 10; or</txt></block></li><li id="sec.5-sec.3-def.manufacturedhome-para1.b" guid="_a0e08ccd-c450-4b4d-8b6c-a729c964ba7a" provision.type="other"><no>(b)</no><block><txt break.before="0">a caravan that has been modified so that it may not be moved from its position using the means ordinarily used to transport the caravan.</txt></block></li></list></definition><definition id="sec.5-sec.3-def.NationalConstructionCode_" guid="_3ed1b65e-0fc5-435a-9fe7-c2858c9966a4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.NationalConstructionCode" guid="_8cf96f67-00e6-42b4-82c4-b8520248fd08" type="definition">National Construction Code</defterm> means the document called ‘National Construction Code’ published by the Australian Building Codes Board.</txt></definition><definition id="sec.5-sec.3-def.owner_" guid="_a34a297c-0cc6-4399-a7bf-7938991dab54" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.owner" guid="_ddc08fc3-4663-4513-823c-b85d25299034" type="definition">owner</defterm>, of a home, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.owner-para1.a" guid="_877e1751-beef-4c91-b666-3044541aa21f" provision.type="other"><no>(a)</no><block><txt break.before="0">for a house—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.owner-para1.a-para2.i" guid="_4d1a98ab-179d-4791-b3cf-321022439a54" provision.type="other"><no>(i)</no><block><txt break.before="0">the registered owner, of the lot on which the house is located, under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref>; or</txt></block></li><li id="sec.5-sec.3-def.owner-para1.a-para2.ii" guid="_71cac601-36e0-42e9-b09e-b08262ed6d4f" provision.type="other"><no>(ii)</no><block><txt break.before="0">the lessee, for the land on which the house is located, under the <legref target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Act 1994</name></legref> if the lease allows for the residential occupation of a home on the land; or</txt></block></li><li id="sec.5-sec.3-def.owner-para1.a-para2.iii" guid="_fe389ee9-6f85-4544-a285-3a38ab086942" provision.type="other"><no>(iii)</no><block><txt break.before="0">the lessee, for a home ownership lease over the land on which the house is located, under the <legref target.doc.id="act-1991-032" target.version.series="9408f57c-9b40-4ed4-817e-ee06cee2b54e" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Aboriginal Land Act 1991</name></legref> or the <legref target.doc.id="act-1991-033" target.version.series="dbdd7c1d-f4f4-4804-a544-27228a06ed09" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Torres Strait Islander Land Act 1991</name></legref>; or</txt></block></li></list></block></li><li id="sec.5-sec.3-def.owner-para1.b" guid="_c19e23f8-cd08-4ea8-8c56-f701b10e5502" provision.type="other"><no>(b)</no><block><txt break.before="0">for a townhouse or unit—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.owner-para1.b-para2.i" guid="_b171de09-bd95-4f3b-ab23-981f4af43bc2" provision.type="other"><no>(i)</no><block><txt break.before="0">the registered owner of the lot, that is the townhouse or unit, under the <legref target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Body Corporate and Community Management Act 1997</name></legref>; or</txt></block></li><li id="sec.5-sec.3-def.owner-para1.b-para2.ii" guid="_c80db385-c486-4ee7-a3f1-72484c1a2d8a" provision.type="other"><no>(ii)</no><block><txt break.before="0">the proprietor of the lot, that is the townhouse or unit, under the <legref target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="valid" jurisd="QLD" type="act"><name provision.type="other"><no>(c)</no><block><txt break.before="0">for a granny flat—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.owner-para1.c-para2.i" guid="_4c126657-8c96-4d90-a90e-c852a88ab037" provision.type="other"><no>(i)</no><block><txt break.before="0">the registered owner, of the lot on which the flat is located, under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref>; or</txt></block></li><li id="sec.5-sec.3-def.owner-para1.c-para2.ii" guid="_252e3ffb-19c1-4057-9592-af6d764436a9" provision.type="other"><no>(ii)</no><block><txt break.before="0">the person who, under any arrangement, resides at the flat and has responsibility for making significant repairs or modifications to the flat; or</txt></block></li></list></block></li><li id="sec.5-sec.3-def.owner-para1.d" guid="_b9b40331-ec7c-4cc1-89c7-a1a881ef766f" provision.type="other"><no>(d)</no><block><txt break.before="0">for a manufactured home—the home owner for the manufactured home under the <legref target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Manufactured Homes (Residential Parks) Act 2003</name></legref>, section 10; or</txt></block></li><li id="sec.5-sec.3-def.owner-para1.e" guid="_2e85cce7-ad0c-416b-a16b-15eb818f3d8f" provision.type="other"><no>(e)</no><block><txt break.before="0">for another home—the person the authority is satisfied owns the home on the basis of an arrangement or document evidencing that the person is the owner or is treated as the owner by the entity that owns the land on which the home is located.</txt></block></li></list></definition><definition id="sec.5-sec.3-def.scheme_" guid="_c9f98b42-8a6f-4867-a09b-0f73ff838f47" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.scheme" guid="_bc3015ce-97da-46a9-83b5-8facf1ac00d9" type="definition">scheme</defterm> means the scheme set out in this schedule.</txt></definition><definition id="sec.5-sec.3-def.townhouse_" guid="_93fc2981-9f8d-4449-bda9-363a796e1a40" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.townhouse" guid="_817ff520-cb71-4243-9574-d34a43e81fa1" type="definition">townhouse</defterm> means 1 or more attached dwellings that are separated by a common wall.</txt></definition><definition id="sec.5-sec.3-def.unit_" guid="_be2f97ca-d4d2-4763-ba6e-33803ef0432f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.unit" guid="_3960c118-0493-4434-9160-03bdabf67f8e" type="definition">unit</defterm> means a dwelling that is a lot under—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.unit-para1.a" guid="_006e62c0-93f7-4c1e-a3d6-89a66b59f83b" provision.type="other"><no>(a)</no><block><txt break.before="0">the <legref target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Body Corporate and Community Management Act 1997</name></legref>; or</txt></block></li><li id="sec.5-sec.3-def.unit-para1.b" guid="_518750f3-9831-476e-bc56-9db6b4a682d2" provision.type="other"><no>(b)</no><block><txt break.before="0">the <legref target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Units and Group Titles Act 1980</name></legref>.</txt></block></li></list></definition><definition id="sec.5-sec.3-def.valueformoneycertificate_" guid="_cbb660ac-592c-4a11-9fbf-b123a0761ca1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.valueformoneycertificate" guid="_3dbeba50-2b16-46a9-a3a4-798b08a2aff8" type="definition">value for money certificate</defterm> means a certificate issued by the department of energy and public works stating that the eligible works carried out, or to be carried out, to a particular eligible home represent value for money.</txt></definition></deflist></block></clause><clause id="sec.5-sec.4" guid="_9a3010b6-6831-43ad-8a7e-991936d759c0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.5-sec.4-he" guid="_881c6881-e77d-4586-b04e-cfa740dfddb3">What is an <i>eligible home</i></heading><subclause id="sec.5-sec.4-ssec.1" guid="_00f8626e-17b6-4830-a7a3-24168b4284fa" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A home is an <defterm id="sec.5-sec.4-def.eligiblehome" guid="_012f38a9-3c3b-42e0-b128-b2e26be532a6" type="definition">eligible home</defterm> if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.4-ssec.1-para1.a" guid="_eb56607e-8f08-4833-80a4-0b9310f358ef" provision.type="other"><no>(a)</no><block><txt break.before="0">the home is a house, townhouse, unit, granny flat or manufactured home; and</txt></block></li><li id="sec.5-sec.4-ssec.1-para1.b" guid="_9df3f86f-c850-441a-a8a3-e226e9f05e18" provision.type="other"><no>(b)</no><block><txt break.before="0">the home is used primarily as a residence; and</txt></block></li><li id="sec.5-sec.4-ssec.1-para1.c" guid="_c526a480-51ac-4ea4-b665-0c4874399c36" provision.type="other"><no>(c)</no><block><txt break.before="0">the home is located in a local government area identified as a DRFA activated area in any of the following documents published by the Queensland Reconstruction Authority on it’s website—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.4-ssec.1-para1.c-para2.i" guid="_52ca76b8-b657-49ec-9185-b6cb8e1c3cc4" provision.type="other"><no>(i)</no><block><txt break.before="0">‘Disaster Recovery Funding Arrangements event Central, Southern and Western Queensland Rainfall and Flooding, 10 November–3 December 2021’;</txt></block></li><li id="sec.5-sec.4-ssec.1-para1.c-para2.ii" guid="_44983afd-439f-484e-9359-b896c84a5055" provision.type="other"><no>(ii)</no><block><txt break.before="0">‘Disaster Recovery Funding Arrangements event Ex-Tropical Cyclone Seth, 29 December 2021–10 January 2022’;</txt></block></li><li id="sec.5-sec.4-ssec.1-para1.c-para2.iii" guid="_bff9bc17-65a6-4460-b554-baa71780dc33" provision.type="other"><no>(iii)</no><block><txt break.before="0">‘Disaster Recovery Funding Arrangements event South East Queensland Rainfall and Flooding, 22 February 2022–5 April 2022’;</txt></block></li><li id="sec.5-sec.4-ssec.1-para1.c-para2.iv" guid="_7b1e45e7-ec2d-4683-939e-48e756cc714c" provision.type="other"><no>(iv)</no><block><txt break.before="0">‘Disaster Recovery Funding Arrangements event Southern Queensland Flooding, 06–20 May 2022’; and</txt></block></li></list></block></li><li id="sec.5-sec.4-ssec.1-para1.d" guid="_f4ee9f0f-e55a-4c96-ab0b-ccbcb1082a48" provision.type="other"><no>(d)</no><block><txt break.before="0">parts of the home within the building envelope for the home were inundated by floodwaters during a disaster event mentioned in paragraph (c).</txt></block></li></list></block></subclause><subclause id="sec.5-sec.4-ssec.2" guid="_b2817698-fae4-42cb-954f-2b0e89a681ef" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-sec.4-ssec.2-def.buildingenvelope_" guid="_1eb99bf5-ff98-4e39-b917-09a36103d38a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.4-ssec.2-def.buildingenvelope" guid="_7f541788-d7ba-4d0b-b785-44d8dbff5278" type="definition">building envelope</defterm>, for a home, means the outermost sides of the aggregation of the components of the home that have the primary function of separating the internal part of the home from the external environment.</txt></definition></deflist></block></subclause></clause></part><part id="sec.5-frag-sch.44-pt.2" guid="_03d66a95-6e2e-4ae0-9efd-46f5b847d349" affected.by.uncommenced="0"><no>Part 2</no><heading id="sec.5-frag-sch.44-pt.2-he" guid="_dd6c92d7-2732-4c25-9b06-9d3bc0270275">General provisions for scheme</heading><clause id="sec.5-sec.5" guid="_7f864601-12b1-4ed3-94f3-816bf7164975" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-sec.5-he" guid="_af20fdb5-0cca-4288-af04-0352af903ecd">Nature and amount of assistance</heading><subclause id="sec.5-sec.5-ssec.1" guid="_0d302dd4-b589-4a32-9997-fff1a0d14294" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The nature of the assistance available under the scheme is a grant of financial assistance to carry out eligible works to an eligible home.</txt></block></subclause><subclause id="sec.5-sec.5-ssec.2" guid="_935bf5ab-ac18-4e05-8ca0-d286af3060e6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, financial assistance may be granted under the scheme only for 1 of the following types of eligible works for the eligible home—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.5-ssec.2-para1.a" guid="_841bac1a-45d7-4d73-b80e-8f6db2ce3f03" provision.type="other"><no>(a)</no><block><txt break.before="0">repair or retrofit works;</txt></block></li><li id="sec.5-sec.5-ssec.2-para1.b" guid="_9950e4c6-0c4b-44f0-9ecd-723185b1c933" provision.type="other"><no>(b)</no><block><txt break.before="0">home raising works.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.5-ssec.3" guid="_da9b717b-dbe6-49b0-9f7a-04e939633b8b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The amount of financial assistance available under the scheme is the total of the amounts equivalent to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.5-ssec.3-para1.a" guid="_0cd76bef-35b7-409f-becd-146f24f2b1c0" provision.type="other"><no>(a)</no><block><txt break.before="0">100% of the cost of carrying out the eligible works, up to the contribution threshold; and</txt></block></li><li id="sec.5-sec.5-ssec.3-para1.b" guid="_0500266f-c539-4724-b8d9-9491048519be" provision.type="other"><no>(b)</no><block><txt break.before="0">50% of the cost of carrying out the eligible works, to the extent the cost is more than the contribution threshold.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.5-ssec.4" guid="_25fc0a75-3706-41a9-b516-773bdbf0b210" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, if the applicant is the stated person for a hardship certificate, the amount of financial assistance available under the scheme is 100% of the cost of carrying out the eligible works.</txt></block></subclause><subclause id="sec.5-sec.5-ssec.5" guid="_b00db946-1970-4c8b-a70b-b37131bef110" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The <defterm id="sec.5-sec.5-def.contributionthreshold" guid="_2677020f-b1d1-4f89-8f6d-d5488d80cf27" type="definition">contribution threshold</defterm> is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.5-ssec.5-para1.a" guid="_155250e7-295b-446a-9e56-0d0eabe3fe13" provision.type="other"><no>(a)</no><block><txt break.before="0">for repair or retrofit works—$50,000; or</txt></block></li><li id="sec.5-sec.5-ssec.5-para1.b" guid="_abffe38b-589e-4cdd-b11e-346d848dd247" provision.type="other"><no>(b)</no><block><txt break.before="0">for home raising works—$100,000.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.5-ssec.6" guid="_0177d2c9-cde4-44c1-8a93-f826aeb68898" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">However, if there are 2 or more eligible homes on the same property, the contribution threshold—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.5-ssec.6-para1.a" guid="_4f6cf7ae-7f41-4906-bf9e-a83c9f8964fd" provision.type="other"><no>(a)</no><block><txt break.before="0">applies for the cost of carrying out eligible works to all of the eligible homes on the property; and</txt></block></li><li id="sec.5-sec.5-ssec.6-para1.b" guid="_4eb40bfc-5a9e-466d-ad9e-1b0fa9d74a62" provision.type="other"><no>(b)</no><block><txt break.before="0">is to be divided between the grants of financial assistance relating to the homes in the following way—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.5-ssec.6-para1.b-para2.i" guid="_fbf6e84c-8c45-49ce-8c79-7f717a750827" provision.type="other"><no>(i)</no><block><txt break.before="0">if the owners of all of the eligible homes apply for a grant of financial assistance at the same time and have agreed how the contribution threshold is to be divided—the agreed way;</txt></block></li><li id="sec.5-sec.5-ssec.6-para1.b-para2.ii" guid="_6a85c64d-01fe-4587-a8e9-a84cfb05a91f" provision.type="other"><no>(ii)</no><block><txt break.before="0">otherwise—the way decided by the authority.</txt></block></li></list></block></li></list><note id="sec.5-sec.5-ssec.6-note" guid="_12abfd2b-8fa2-44a8-bf34-3e596d09e5cd" type="example"><heading id="sec.5-sec.5-ssec.6-note-he" guid="_61458979-03f6-4feb-81a9-f7a6630fc5bc">Example—</heading><block><txt break.before="1">Houses 1 and 2 are eligible homes on the same property. The cost of repair or retrofit works to each house is $100,000. The total of the contribution threshold for all repair or retrofit works to both houses is $50,000.</txt></block></note></block></subclause><subclause id="sec.5-sec.5-ssec.7" guid="_993b1b1d-d583-471d-926d-ac4e6a8dfbd2" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">Subsection (6)— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.5-ssec.7-para1.a" guid="_4e893efb-e3f9-484c-ad20-7a8a1f09e095" provision.type="other"><no>(a)</no><block><txt break.before="0">applies regardless of whether the eligible homes have different owners; and</txt></block></li><li id="sec.5-sec.5-ssec.7-para1.b" guid="_6a1e11c5-049d-4745-b5a7-e8c50485da32" provision.type="other"><no>(b)</no><block><txt break.before="0">does not apply to an eligible home that is a manufactured home located in a residential park under a site agreement.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.5-ssec.8" guid="_65ae8554-e2df-41fa-aa3a-e89eee8976f6" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">To remove any doubt, it is declared that if subsection (6) applies, the contribution threshold for the owner of 1 or more of the eligible homes may be zero.</txt><note id="sec.5-sec.5-ssec.8-note" guid="_92ec7d1c-6368-4600-8573-dee349f9e668" type="example"><heading id="sec.5-sec.5-ssec.8-note-he" guid="_22acf365-8597-4375-b989-27fc516533f1">Example—</heading><block><txt break.before="1">Houses 1 and 2 are eligible homes on the same property. The cost of repair or retrofit works to each house is $100,000. The owner of house 1 has been granted financial assistance of $75,000 (the full contribution threshold of $50,000 plus 50% of the cost of the repair or retrofit works that is more the contribution threshold).</txt><txt break.before="1">After the assistance has been granted for house 1, the owner of house 2 applies for a grant of financial assistance. The contribution threshold for the owner of house 2 would be zero and the amount of financial assistance for house 2 would be $50,000 (or $100,000 if the owner had a hardship certificate).</txt></block></note></block></subclause><subclause id="sec.5-sec.5-ssec.9" guid="_1aa24baa-89e3-4e57-a372-8a86d4be274e" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">For subsection (3), the cost of carrying out eligible works is exclusive of GST.</txt></block></subclause><subclause id="sec.5-sec.5-ssec.10" guid="_cbb06b6b-1f8c-41a2-b774-6bee35fd432f" affected.by.uncommenced="0" provision.type="other"><no>(10)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-sec.5-ssec.10-def.homeraisingworks_" guid="_88cd5ec3-9d88-4f74-b61b-1131c3c37b26" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.5-ssec.10-def.homeraisingworks" guid="_b94d41e0-b8b9-4185-a278-14f65680745c" type="definition">home raising works</defterm> means works to raise all or part of an eligible home so that the habitable floor level of the home is at or above the flood hazard level that applies to the home.</txt></definition><definition id="sec.5-sec.5-ssec.10-def.property_" guid="_ba7f7c10-46b7-4570-8ad6-985036737c42" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.5-ssec.10-def.property" guid="_0694ad4a-046c-494d-b822-c7728125c9a6" type="definition">property</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.5-ssec.10-def.property-para1.a" guid="_8c59d3aa-6bb7-4154-a2ce-cbae8358a50d" provision.type="other"><no>(a)</no><block><txt break.before="0">a lot within the meaning of the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref> but does not include a lot under the <legref target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Units and Group Titles Act 1980</name></legref>; or</txt></block></li><li id="sec.5-sec.5-ssec.10-def.property-para1.b" guid="_8c4d24d6-6eec-4a86-984b-83606f9191dd" provision.type="other"><no>(b)</no><block><txt break.before="0">land subject to a lease held under the <legref target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Act 1994</name></legref>.</txt></block></li></list></definition><definition id="sec.5-sec.5-ssec.10-def.repairorretrofitworks_" guid="_c9561465-f4ee-4f20-8be3-df1cc10ab945" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.5-ssec.10-def.repairorretrofitworks" guid="_50cd3a06-6492-4361-b19d-6dfdd1025108" type="definition">repair or retrofit works</defterm> means works to repair or retrofit an eligible home to incorporate flood resilient design and materials in the home.</txt></definition><definition id="sec.5-sec.5-ssec.10-def.residentialpark_" guid="_ac9a256a-f044-4e00-97c1-316d634ba003" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.5-ssec.10-def.residentialpark" guid="_6715b759-30d7-4269-a0c0-3760176fe060" type="definition">residential park</defterm> see the <legref target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Manufactured Homes (Residential Parks) Act 2003</name></legref>, section 12.</txt></definition><definition id="sec.5-sec.5-ssec.10-def.siteagreement_" guid="_9267e35c-6a5f-4500-bef2-3550ec137388" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.5-ssec.10-def.siteagreement" guid="_0f51a0eb-6e04-4545-a34e-997e3ad5976b" type="definition">site agreement</defterm> see the <legref target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Manufactured Homes (Residential Parks) Act 2003</name></legref>, section 14.</txt></definition></deflist></block></subclause></clause><clause id="sec.5-sec.6" guid="_293081df-f1c6-490e-91a8-4b441fc41980" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.5-sec.6-he" guid="_d7e3b457-1da4-493c-b3bd-822d353ece76">Eligibility for assistance</heading><subclause id="sec.5-sec.6-ssec.1" guid="_4fbd15c6-5bf4-4d79-8c17-f0fbb306b5f8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An applicant is eligible to receive a grant of financial assistance under the scheme for carrying out works to a home if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.6-ssec.1-para1.a" guid="_9b903988-78b3-4154-a51e-8385492a7210" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant is the owner of the home; and</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.b" guid="_c684b5d3-5fed-4844-847a-5b586cf5bb27" provision.type="other"><no>(b)</no><block><txt break.before="0">the works are eligible works; and</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.c" guid="_ec15917a-803d-4c87-a715-e6353bcb2a42" provision.type="other"><no>(c)</no><block><txt break.before="0">the home is an eligible home; and</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.d" guid="_16efeaa8-3f2f-4acd-83ec-5186d22bef7e" provision.type="other"><no>(d)</no><block><txt break.before="0">an eligible home assessment has been completed for the home and—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.6-ssec.1-para1.d-para2.i" guid="_3d322977-3702-47b3-b3b8-f9f6493f6003" provision.type="other"><no>(i)</no><block><txt break.before="0">for works that have not been started—the report for the assessment identifies the works as eligible works suitable to be carried out to the home; or</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.d-para2.ii" guid="_b5ddd136-00c1-4b82-b631-2575f7e82740" provision.type="other"><no>(ii)</no><block><txt break.before="0">for works that have been started or are completed—the report for the assessment confirms that the works—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.6-ssec.1-para1.d-para2.ii-para3.A" guid="_afaeb990-032e-4f28-91c1-f1c66032c582" provision.type="other"><no>(A)</no><block><txt provision.type="other"><no>(B)</no><block><txt break.before="0">are being, or were, carried out by a licensed contractor; and</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.d-para2.ii-para3.C" guid="_4de80d0e-abbd-4b8c-9290-5d1cc5fd2084" provision.type="other"><no>(C)</no><block><txt break.before="0">are being, or were, carried out because of inundation by floodwaters during a disaster event mentioned in section 4(1)(c); and</txt></block></li></list></block></li></list></block></li><li id="sec.5-sec.6-ssec.1-para1.e" guid="_1bb4bd7b-8987-4eac-826e-2484b66bb8d3" provision.type="other"><no>(e)</no><block><txt break.before="0">the applicant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.6-ssec.1-para1.e-para2.i" guid="_2e11f3d8-affa-407a-8534-bcc82771d0d8" provision.type="other"><no>(i)</no><block><txt break.before="0">has obtained a quote from a licensed contractor to carry out the works; or</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.e-para2.ii" guid="_b71d6702-9f14-4ecd-8252-f2748300507e" provision.type="other"><no>(ii)</no><block><txt break.before="0">has been given an invoice for carrying out the works from the licensed contractor who carried out the works; or</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.e-para2.iii" guid="_b344e510-8e19-4e20-9bcc-8f8113164cb9" provision.type="other"><no>(iii)</no><block><txt break.before="0">has a receipt for payment to a licensed contractor who carried out the works; or</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.e-para2.iv" guid="_913d9a0a-e128-405e-883d-0bb4aef49248" provision.type="other"><no>(iv)</no><block><txt break.before="0">has entered into a contract with a licensed contractor for the carrying out of the works; and</txt></block></li></list></block></li><li id="sec.5-sec.6-ssec.1-para1.f" guid="_4bdecfe2-55d2-4bbb-88b1-ffd1927e77af" provision.type="other"><no>(f)</no><block><txt break.before="0">the department of energy and public works has issued a value for money certificate for the eligible works; and</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.g" guid="_3daec4aa-d687-47c5-b096-a6aded361a36" provision.type="other"><no>(g)</no><block><txt break.before="0">for an amount of financial assistance that is more than the contribution threshold—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.6-ssec.1-para1.g-para2.i" guid="_a05a7247-0062-4c6d-8ad5-29a7849fa2bc" provision.type="other"><no>(i)</no><block><txt break.before="0">the applicant is able to contribute 50% of the cost of carrying out the works, to the extent the cost is more than the contribution threshold; or</txt></block></li><li id="sec.5-sec.6-ssec.1-para1.g-para2.ii" guid="_15ed4fb4-1270-48e1-93ef-fc0289a7bc31" provision.type="other"><no>(ii)</no><block><txt break.before="0">the applicant is the stated person for a hardship certificate.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-sec.6-ssec.2" guid="_b3ac983b-8aa6-42b7-b318-79700670fb47" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, the applicant is only eligible for conditional approval of a grant of financial assistance under the scheme if the applicant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.6-ssec.2-para1.a" guid="_71460f09-ee43-45ed-91c0-fe59f7604977" provision.type="other"><no>(a)</no><block><txt break.before="0">does not have a receipt for payment to the licensed contractor who carried out the works; or</txt></block></li><li id="sec.5-sec.6-ssec.2-para1.b" guid="_3c434bbc-4f23-47c8-8c62-ca4925d20446" provision.type="other"><no>(b)</no><block><txt break.before="0">has not entered into a contract with a licensed contractor for the carrying out of the works.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.6-ssec.3" guid="_a852b8d9-9c7e-489d-b292-9ca02b4f0ac9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Despite subsection (1), an applicant is not eligible to receive financial assistance under the scheme for carrying out eligible works to a home if the applicant has received—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.6-ssec.3-para1.a" guid="_2e109334-f70e-435c-bbf1-ffea6c001bce" provision.type="other"><no>(a)</no><block><txt break.before="0">a grant of financial assistance under the scheme for the home; or</txt></block></li><li id="sec.5-sec.6-ssec.3-para1.b" guid="_724e37ef-fe21-4c68-ab74-265f7590d5c8" provision.type="other"><no>(b)</no><block><txt break.before="0">funding for the eligible works under another government scheme.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.6-ssec.4" guid="_93b6b36b-7942-4f67-baf5-1cb22987c66e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">This section applies subject to section 7.</txt></block></subclause><subclause id="sec.5-sec.6-ssec.5" guid="_05701818-c75a-4bf6-88d6-d46adbf77682" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-sec.6-ssec.5-def.eligiblehomeassessment_" guid="_c90ce67c-3a05-4b09-b9c6-e2d474af740e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.6-ssec.5-def.eligiblehomeassessment" guid="_0b0f2ff1-14b7-4c7f-a5ee-b25f9a45534e" type="definition">eligible home assessment</defterm> means an assessment of a home, undertaken by or for the department of energy and public works, to identify the eligible works that may be suitable to be carried out to the home or to identify if works done to the home are eligible works.</txt></definition><definition id="sec.5-sec.6-ssec.5-def.governmentscheme_" guid="_a7d1cca3-0b99-4722-bb1a-088d66cfdcbd" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.6-ssec.5-def.governmentscheme" guid="_d59b6b24-9a59-4e69-94d4-72f2980280c6" type="definition">government scheme</defterm> means a scheme for providing financial assistance that is administered or funded by a local government, the State or the Commonwealth.</txt></definition></deflist></block></subclause></clause><clause id="sec.5-sec.7" guid="_29c61ecf-a13a-401f-a653-e52d56a89d56" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.5-sec.7-he" guid="_98fd0a54-e8f2-49b3-beb3-5e7fc8c04141">Effect of insurance</heading><subclause id="sec.5-sec.7-ssec.1" guid="_20f9dba9-cd4f-4ca9-9464-c9ab6f6ddbe0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.1-para1.a" guid="_39516b46-3a6c-471d-a45f-d1d9dba42f18" provision.type="other"><no>(a)</no><block><txt break.before="0">an applicant applies for a grant of financial assistance under the scheme for carrying out eligible works to an eligible home; and</txt></block></li><li id="sec.5-sec.7-ssec.1-para1.b" guid="_89c55166-5f0a-4b16-9436-371e6d8e3f67" provision.type="other"><no>(b)</no><block><txt break.before="0">damage (<defterm id="sec.5-sec.7-ssec.1-def.flooddamage" guid="_518aa857-2208-4470-a62d-51ad541f6d67" type="definition">flood damage</defterm>) to the eligible home was caused by inundation by floodwaters during a disaster event mentioned in section 4(1)(c); and</txt></block></li><li id="sec.5-sec.7-ssec.1-para1.c" guid="_a43daf8a-9217-4da2-abc5-0c4084c40e5c" provision.type="other"><no>(c)</no><block><txt break.before="0">a policy of insurance over the eligible home may cover all or some of the flood damage (the <defterm id="sec.5-sec.7-ssec.1-def.insurance" guid="_ad63dc4f-9df1-4bbf-b3bc-4c1e8ed91cc8" type="definition">insurance</defterm>).</txt></block></li></list></block></subclause><subclause id="sec.5-sec.7-ssec.2" guid="_ef28b605-cb79-420b-b489-e180bcaf6083" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The applicant is not eligible to receive financial assistance under the scheme until—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.2-para1.a" guid="_6fb13904-db83-4ebf-a8a8-130ffcc136f4" provision.type="other"><no>(a)</no><block><txt break.before="0">a claim is made under the policy of insurance for the flood damage; and</txt></block></li><li id="sec.5-sec.7-ssec.2-para1.b" guid="_dd6a1282-1cb5-41de-a49e-10c30d01f896" provision.type="other"><no>(b)</no><block><txt break.before="0">the insurer either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.2-para1.b-para2.i" guid="_e89c67e9-b7e7-4833-97f1-0f325cfe03a2" provision.type="other"><no>(i)</no><block><txt break.before="0">accepts liability to pay an amount for the flood damage or to pay for repairing the flood damage; or</txt></block></li><li id="sec.5-sec.7-ssec.2-para1.b-para2.ii" guid="_3cbcdb4c-4136-4ac2-823e-f9d83d1d849c" provision.type="other"><no>(ii)</no><block><txt break.before="0">rejects the claim.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-sec.7-ssec.3" guid="_6ebe1c48-5c0a-4fd5-87c9-45d179bad898" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the insurance covers the full cost of the eligible works, the applicant is not eligible to receive financial assistance under the scheme.</txt></block></subclause><subclause id="sec.5-sec.7-ssec.4" guid="_fab737a6-c807-40d4-b1a5-10f2096ddd6c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the insurance covers part of the cost of the eligible works, the financial assistance the applicant may receive under the scheme is limited to the extent to which the insurance does not cover the cost of the eligible works.</txt><note id="sec.5-sec.7-ssec.4-note" guid="_d7a0dd02-531a-402f-b5b8-37549128ecf8" type="example"><heading id="sec.5-sec.7-ssec.4-note-he" guid="_45cae468-7a08-4537-9b67-58734536dbb0">Example—</heading><block><txt break.before="1">If the cost of the eligible works is $40,000 and the insurer is to pay $8,000 in relation to the eligible works, the amount of financial assistance the applicant may receive under the scheme for the eligible works is limited to $32,000.</txt></block></note></block></subclause><subclause id="sec.5-sec.7-ssec.5" guid="_a2f9343b-d22e-4555-a179-71b3bf4b0680" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">For subsections (3) and (4), the extent to which the insurance covers the cost of eligible works is the extent to which—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.5-para1.a" guid="_b04a5c37-4926-47a8-b035-c4440ce1bbef" provision.type="other"><no>(a)</no><block><txt break.before="0">the insurer accepts liability to pay for the eligible works; or</txt></block></li><li id="sec.5-sec.7-ssec.5-para1.b" guid="_13e23bf6-2324-4e2a-b2f6-218d79a6662d" provision.type="other"><no>(b)</no><block><txt break.before="0">under the policy of insurance, the insurer pays the policy holder an amount for the flood damage.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.7-ssec.6" guid="_54587261-9f24-4690-ba36-b431b5b07f37" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">For subsection (5)(b), if the insurer gave the policy holder an itemised breakdown of what the payment relates to, the amount of the payment does not include that part of the payment that is for something other than the eligible works.</txt><note id="sec.5-sec.7-ssec.6-note" guid="_00bc5a67-747d-4b36-88cc-709a756be0a3" type="example"><heading id="sec.5-sec.7-ssec.6-note-he" guid="_f07e9f13-2756-4872-9d79-56eeea137983">Example—</heading><block><txt break.before="1">If the insurer pays the policy holder an amount of $15,000 for the flood damage and, under the itemised breakdown of the payment, $5,000 of the payment is for replacement of a damaged rain water tank and fence, the amount of the payment for subsection (5)(b) is $10,000.</txt></block></note></block></subclause><subclause id="sec.5-sec.7-ssec.7" guid="_d71ccc91-1818-4b46-9103-76276fd9ad23" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">Subsections (4) to (6) do not apply to a grant of financial assistance under the scheme that is for home raising works.</txt></block></subclause><subclause id="sec.5-sec.7-ssec.8" guid="_d293290f-4017-446c-be0a-bd0ef3f6eaf5" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-sec.7-ssec.8-def.homeraisingworks_" guid="_5ff002d4-b618-4479-a051-f213f3fe8dea" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.7-ssec.8-def.homeraisingworks" guid="_8ebc37cf-2fc2-4683-88b1-9a7a82146632" type="definition">home raising works</defterm> means works to raise all or part of an eligible home so that the habitable floor level of the home is at or above the flood hazard level that applies to the home.</txt></definition><definition id="sec.5-sec.7-ssec.8-def.insurer_" guid="_92cf4bfe-b100-46e4-b87f-dcc19988eb61" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.7-ssec.8-def.insurer" guid="_2d0c54c7-5972-43cd-b251-5fcb8209c796" type="definition">insurer</defterm> means the insurer under the policy of insurance mentioned in subsection (1)(c).</txt></definition></deflist></block></subclause></clause><clause id="sec.5-sec.8" guid="_c19fa17b-caf7-4ff0-8701-a919ad50cdf2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.5-sec.8-he" guid="_f00e2abe-5c54-450d-9863-65adbb6201e3">Requirement for applications</heading><subclause id="sec.5-sec.8-ssec.1" guid="_e152bbe3-e961-4da8-996b-84aacc22565b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An application for a grant of financial assistance under the scheme must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.8-ssec.1-para1.a" guid="_5c3c7747-5ed9-45c4-9df1-ce8e3ea2acd5" provision.type="other"><no>(a)</no><block><txt break.before="0">be made in the approved form; and</txt></block></li><li id="sec.5-sec.8-ssec.1-para1.b" guid="_20654221-dd6a-4aca-9c9b-6e4ec44b585b" provision.type="other"><no>(b)</no><block><txt break.before="0">be accompanied by the documents stated in the approved form; and</txt></block></li><li id="sec.5-sec.8-ssec.1-para1.c" guid="_b543f927-5949-4724-bf80-186906006259" provision.type="other"><no>(c)</no><block><txt break.before="0">be given to the authority no later than 31 March 2024.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.8-ssec.2" guid="_ff00433f-d4cc-4f9a-8761-a0bdf6b0b4d5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the authority asks the applicant to provide further information to decide the application, the applicant must provide the information to the authority.</txt></block></subclause><subclause id="sec.5-sec.8-ssec.3" guid="_eff764b5-3c98-40d2-aa56-f8ab9e2f78aa" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-sec.8-ssec.3-def.approvedform_" guid="_60dab88e-b5c7-45c1-be45-085f39c0aa20" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.8-ssec.3-def.approvedform" guid="_af676362-2ca8-4b73-8290-aa32900a43dc" type="definition">approved form</defterm> means a form approved by the authority.</txt></definition></deflist></block></subclause></clause><clause id="sec.5-sec.9" guid="_fdbe8f92-6f0b-4155-a6de-a7e42dd1ae0c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.5-sec.9-he" guid="_9e8f4e64-a24f-4dd6-8f4d-8c5db5fb97c0">Deciding applications</heading><subclause id="sec.5-sec.9-ssec.1" guid="_7a708995-cdf4-45b0-b6ea-d6c14c825f0d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to each application for a grant of financial assistance under the scheme that complies with section 8.</txt></block></subclause><subclause id="sec.5-sec.9-ssec.2" guid="_9fd463b2-71fe-42f5-bedd-0ea3c2b9df04" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The authority must consider, and decide to approve or refuse to approve, the application.</txt></block></subclause><subclause id="sec.5-sec.9-ssec.3" guid="_f512e9e6-686a-449c-8739-182500219f9b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The authority may, with the agreement of the applicant, approve an amount of financial assistance that is less than the amount sought in the application.</txt></block></subclause><subclause id="sec.5-sec.9-ssec.4" guid="_3c68f9e9-fe90-4e3d-bfce-00ff4132d57d" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The authority must refuse to approve the application if the authority’s assistance funds for the scheme are not enough to pay for the amount of financial assistance applied for in the application.</txt></block></subclause><subclause id="sec.5-sec.9-ssec.5" guid="_d69c85ca-3a90-44d2-a86f-f01db9edcb92" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the authority refuses to approve the application, the authority must give the applicant written notice of the decision.</txt></block></subclause></clause><clause id="sec.5-sec.10" guid="_f0776baa-86f7-465b-bd46-ed7261be795e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.5-sec.10-he" guid="_1d5b8c3c-8a83-463f-bbea-2851e95d2ef9">Priority of consideration for applications</heading><block><txt break.before="0">The authority must consider applications in the order they are received by the authority.</txt></block></clause><clause id="sec.5-sec.11" guid="_35858a08-bc2f-4bf1-a77f-86535f978bfc" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.5-sec.11-he" guid="_ca7cb0b4-239c-44fc-a076-8d11744a7943">Conditional approval</heading><subclause id="sec.5-sec.11-ssec.1" guid="_9b6a3f77-9fa4-4756-bb56-605f38ce71de" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.11-ssec.1-para1.a" guid="_5685b1e6-2b5c-4b89-8630-baab99593c51" provision.type="other"><no>(a)</no><block><txt break.before="0">the authority approves an application for a grant of financial assistance for carrying out eligible works to an eligible home; and</txt></block></li><li id="sec.5-sec.11-ssec.1-para1.b" guid="_14f0ce6d-6dc9-4963-a5f8-b7bd70813b90" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant is only eligible for conditional approval of the grant under section 6(2).</txt></block></li></list></block></subclause><subclause id="sec.5-sec.11-ssec.2" guid="_fa3b9f11-d95b-49e7-8a0a-fd113f21a18a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The approval is subject to a condition requiring the applicant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.11-ssec.2-para1.a" guid="_bcfa6837-6978-4e3c-937b-57793cb753bb" provision.type="other"><no>(a)</no><block><txt break.before="0">to give the authority a copy of a receipt for payment to the licensed contractor who carried out the eligible works; or</txt></block></li><li id="sec.5-sec.11-ssec.2-para1.b" guid="_0f1706b0-44d3-41a4-8d6a-49cb04544b07" provision.type="other"><no>(b)</no><block><txt break.before="0">to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.11-ssec.2-para1.b-para2.i" guid="_6f4000b8-9d4a-40dc-a45f-8965a95d27c3" provision.type="other"><no>(i)</no><block><txt break.before="0">enter into a contract with a licensed contractor for the carrying out of the eligible works; and</txt></block></li><li id="sec.5-sec.11-ssec.2-para1.b-para2.ii" guid="_9e543699-9291-45dd-a4e9-67eb936349d7" provision.type="other"><no>(ii)</no><block><txt break.before="0">give the authority a copy of the contract.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-sec.11-ssec.3" guid="_43c55f6b-8d9d-4e1d-9329-d4121cfd57ff" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The condition mentioned in subsection (2)(b) is satisfied only if the authority is satisfied the contract is consistent with the quote or invoice the applicant gave the authority as part of the application.</txt></block></subclause></clause><clause id="sec.5-sec.12" guid="_bdcb2497-74c8-40a8-a2e6-f9395fb2aa20" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.5-sec.12-he" guid="_d3119cb3-8fb1-4be1-b26d-42371e3a9c76">Payment of financial assistance</heading><subclause id="sec.5-sec.12-ssec.1" guid="_dee75fdb-d6fa-4bbd-8f58-e5ddc9f2ac4e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the authority approves an application for a grant of financial assistance for carrying out eligible works to an eligible home.</txt></block></subclause><subclause id="sec.5-sec.12-ssec.2" guid="_e661f6d7-a9d6-4be8-a996-00555f1537ca" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, if the applicant is only eligible for a conditional approval under section 6(2), this section does not apply unless the condition mentioned in section 11(2) has been satisfied.</txt></block></subclause><subclause id="sec.5-sec.12-ssec.3" guid="_7438f78e-892e-42f7-8c64-33e880a75e08" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The authority must pay the financial assistance directly to the following person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.12-ssec.3-para1.a" guid="_7be089dc-c831-47f3-8071-541caca3b512" provision.type="other"><no>(a)</no><block><txt break.before="0">to the extent the applicant has paid for the eligible works—the applicant;</txt></block></li><li id="sec.5-sec.12-ssec.3-para1.b" guid="_d71e849c-7cf2-4bdd-a413-f565dc9a214a" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—the licensed contractor who carried out the eligible works or is contracted to carry out the eligible works.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.12-ssec.4" guid="_4c510486-3cb2-4ae0-b57a-05304d53945e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The authority may pay the financial assistance in a single payment or in instalments, at intervals decided by the authority.</txt><note id="sec.5-sec.12-ssec.4-note" guid="_281a6973-1107-46f7-9a11-56785196c498" type="example"><heading id="sec.5-sec.12-ssec.4-note-he" guid="_6ed1582e-fa5a-4c23-b1e9-1dcbd20345b7">Example—</heading><block><txt break.before="1">The authority may pay the financial assistance in instalments consistent with the milestone payments under a contract for carrying out the eligible works.</txt></block></note></block></subclause><subclause id="sec.5-sec.12-ssec.5" guid="_1239518e-7d20-478d-b3ef-ac18223c6141" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">For the purpose of a contract for carrying out the eligible works, a payment made under subsection (3)(b) is made on behalf of the entity that is liable to pay for the works under the contract.</txt></block></subclause><subclause id="sec.5-sec.12-ssec.6" guid="_bbc9fddf-8f18-4f1b-84ff-d1ec299130ac" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">This section applies subject to sections 7 and 13.</txt></block></subclause></clause><clause id="sec.5-sec.13" guid="_fae3a2d6-15bd-43ae-8ab6-12d89ad7f9ad" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.5-sec.13-he" guid="_4300b886-a6c4-441e-ba0a-5120c06ee11e">Conditions of financial assistance</heading><subclause id="sec.5-sec.13-ssec.1" guid="_0d5932ba-1c57-42e4-9a80-ac1ab0b960f9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the authority approves an application for a grant of financial assistance under the scheme for carrying out eligible works to an eligible home.</txt></block></subclause><subclause id="sec.5-sec.13-ssec.2" guid="_2b4488dc-f2ad-4630-99d0-9b7c9ef793cd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The payment of financial assistance is subject to the following conditions— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.13-ssec.2-para1.a" guid="_81b8bf4f-2121-4866-ae55-2ef45c476717" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant must enter into a written agreement with the authority setting out the terms on which the financial assistance is provided (the <defterm id="sec.5-sec.13-ssec.2-def.paymentagreement" guid="_07f6c89e-8360-47db-81ed-0658cfcc9cdb" type="definition">payment agreement</defterm>);</txt></block></li><li id="sec.5-sec.13-ssec.2-para1.b" guid="_770c79f7-b2f9-4c8e-a772-310ec1c67360" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant must comply with the terms of the payment agreement.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.13-ssec.3" guid="_3902171e-b9a1-4882-a108-7877e54bc625" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The applicant must repay all or part of the financial assistance if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.13-ssec.3-para1.a" guid="_df765353-9f18-40de-965d-ced21359a32c" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant is unable to secure access to particular land for the purpose of carrying out the eligible works; or</txt></block></li><li id="sec.5-sec.13-ssec.3-para1.b" guid="_e4cd34d0-2dce-4158-b70a-6205f8cd1b68" provision.type="other"><no>(b)</no><block><txt break.before="0">the eligible works can not be carried out to the home for any reason; or</txt></block></li><li id="sec.5-sec.13-ssec.3-para1.c" guid="_79feaf7c-9c38-42b5-b416-cc37abe45e4c" provision.type="other"><no>(c)</no><block><txt break.before="0">the cost of carrying out the eligible works is, on completion of the works, less than the amount of the financial assistance; or</txt></block></li><li id="sec.5-sec.13-ssec.3-para1.d" guid="_68cf362e-776f-4655-95df-62f8df67f2a5" provision.type="other"><no>(d)</no><block><txt break.before="0">the authority is satisfied the application, or a document accompanying the application, includes information that is false or misleading in a material particular.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.13-ssec.4" guid="_23c17cae-8310-4853-a00b-aa0fb2ab7381" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The authority may decide the amount to be repaid under subsection (3).</txt></block></subclause><subclause id="sec.5-sec.13-ssec.5" guid="_4c43815d-9d91-4c20-a20d-2b83fe006f45" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The authority may withhold payment of all or part of the financial assistance if satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.13-ssec.5-para1.a" guid="_e83f8b6e-3dbd-4011-b735-17a877cee605" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant has not complied with the terms of the payment agreement; or</txt></block></li><li id="sec.5-sec.13-ssec.5-para1.b" guid="_000df4ba-f5e8-4806-bc88-a87756c42a0a" provision.type="other"><no>(b)</no><block><txt break.before="0">the application, or a document accompanying the application, includes information that is false or misleading in a material particular.</txt></block></li></list></block></subclause></clause><clause id="sec.5-sec.14" guid="_14c5c28c-5256-4aad-b9eb-3827ee1bab89" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.5-sec.14-he" guid="_baa52d34-992b-4c06-a180-60a1f81b6111">Changes affecting eligible works</heading><subclause id="sec.5-sec.14-ssec.1" guid="_a9fbd9ca-536a-4cc7-93a2-9d7491c100f4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the authority made a grant of financial assistance under the scheme for carrying out eligible works to an eligible home and any of the following changes happen—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.14-ssec.1-para1.a" guid="_bed69c34-30a7-4553-b454-672a7e471e05" provision.type="other"><no>(a)</no><block><txt break.before="0">there is a change to the licensed contractor who is to carry out the eligible works;</txt></block></li><li id="sec.5-sec.14-ssec.1-para1.b" guid="_2dc10453-6a06-4366-af0d-714a69f65c58" provision.type="other"><no>(b)</no><block><txt break.before="0">there is a change in the scope of the eligible works under the approved contract;</txt></block></li><li id="sec.5-sec.14-ssec.1-para1.c" guid="_aa69660d-37b7-4d9d-940b-073e2b73051b" provision.type="other"><no>(c)</no><block><txt break.before="0">there is a change in the costs of carrying out the eligible works under the approved contract.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.14-ssec.2" guid="_6a815aa5-f448-406d-86a1-411653b90ce8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The applicant must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.14-ssec.2-para1.a" guid="_2036413a-ea55-407d-809d-1244ac1fdcd5" provision.type="other"><no>(a)</no><block><txt break.before="0">give the authority and the department of energy and public works written notice of the change; and</txt></block></li><li id="sec.5-sec.14-ssec.2-para1.b" guid="_cf6d09a6-39b0-4ec7-b022-dc5177d5408d" provision.type="other"><no>(b)</no><block><txt break.before="0">request the department of energy and public works issue a new value for money certificate for the eligible works.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.14-ssec.3" guid="_a60b3393-fbe2-4a3a-a506-783b211f925d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the authority or department of energy and public works asks the applicant to provide further information about the change, the applicant must provide the information to the authority or department.</txt></block></subclause><subclause id="sec.5-sec.14-ssec.4" guid="_aa27e278-c685-483d-8385-ffd95247f5ed" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The authority may increase the amount of financial assistance paid under section 12 if the authority is satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.14-ssec.4-para1.a" guid="_ea707e40-5ec6-4099-82c5-309268ef2334" provision.type="other"><no>(a)</no><block><txt break.before="0">the change has caused an increase in the cost of carrying out the eligible works; and</txt></block></li><li id="sec.5-sec.14-ssec.4-para1.b" guid="_ba3c7379-c22b-45ef-87d7-eff763ecec37" provision.type="other"><no>(b)</no><block><txt break.before="0">the department of energy and public works has issued a new value for money certificate for the eligible works.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.14-ssec.5" guid="_35ea3ae4-8c32-44df-b8f9-ec25cde9fc3a" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The authority may withhold any outstanding payment of financial assistance if satisfied the applicant has not complied with subsection (2) or (3).</txt></block></subclause><subclause id="sec.5-sec.14-ssec.6" guid="_a6029092-1d6d-4ec1-99cf-df374b897988" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-sec.14-ssec.6-def.approvedcontract_" guid="_234b4960-c4e1-44a8-8a81-425a953ee469" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.14-ssec.6-def.approvedcontract" guid="_d4b2973a-b5cc-45be-aecd-89dee1af1125" type="definition">approved contract</defterm>, in relation to eligible works and a grant of financial assistance under the scheme, means the contract to carry out the eligible works that formed the basis of the applicant’s eligibility for the assistance.</txt></definition></deflist></block></subclause></clause></part></schedule></fragment></block></clause></body></wrapper></subordleg>
