provision.type="other"><no>(2)</no><block><txt break.before="0">Expired section 84(5) continues to apply in relation to the private certifier until the exempted licence expires.</txt><note id="sec.6-frag-div.4-sec.104-ssec.2-note" guid="_7cea27af-68a7-4d95-b905-42e734ca9b88" type="example"><heading id="sec.6-frag-div.4-sec.104-ssec.2-note-he" guid="_5c5ced4a-7fc5-4bb9-b1b9-ad1cfdab6b8a">Example—</heading><block><txt break.before="1">If the private certifier holds an exempted licence that expires on 12 September 2023, section 84(1) does not apply to the certifier until 13 September 2023 to the extent the certifier performs private certifying functions mentioned in expired section 84(5).</txt></block></note></block></subclause><subclause id="sec.6-frag-div.4-sec.104-ssec.3" guid="_097cd10f-08d8-4a1a-b21a-d016293d1839" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For subsection (2), the reference in expired section 84(5) to the exemption period is taken to be a reference to the period starting on 1 July 2023 and ending when the exempted licence expires.</txt></block></subclause><subclause id="sec.6-frag-div.4-sec.104-ssec.4" guid="_e80fb6bf-6bf7-478f-95da-f3a35da6ebec" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">This section does not limit section 84(1).</txt></block></subclause><subclause id="sec.6-frag-div.4-sec.104-ssec.5" id="sec.6-frag-div.4-sec.104-ssec.5-def.exemptedlicence_" guid="_3a18fee9-0d4f-4ec4-a265-9d8091a5749f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-div.4-sec.104-ssec.5-def.exemptedlicence" guid="_c31b95cd-358d-4465-85b3-ed776b33cd2f" type="definition">exempted licence</defterm> means a private certifier’s licence—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-div.4-sec.104-ssec.5-def.exemptedlicence-para1.a" guid="_18a3d99c-2d70-4de7-bdb0-0a96a636a99a" provision.type="other"><no>(a)</no><block><txt break.before="0">with a private certification endorsement made during the extended exemption period in reliance on section 84(5) as in force during that period; and</txt></block></li><li id="sec.6-frag-div.4-sec.104-ssec.5-def.exemptedlicence-para1.b" guid="_d7f1f7d5-6c15-44a2-a6cb-6e7a5a5b7c94" provision.type="other"><no>(b)</no><block><txt break.before="0">that is in force at the end of the extended exemption period.</txt></block></li></list></definition><definition id="sec.6-frag-div.4-sec.104-ssec.5-def.expiredsection845_" guid="_f16bac0e-de63-405d-a210-b36b9954a223" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-div.4-sec.104-ssec.5-def.expiredsection845" guid="_fa93d0c2-1844-4f01-90c1-3894b7159f93" type="definition">expired section 84(5)</defterm> means section 84(5) as in force immediately before its expiry on 1 July 2023.</txt></definition><definition id="sec.6-frag-div.4-sec.104-ssec.5-def.extendedexemptionperiod_" guid="_cabe9968-1db9-4c81-be73-8fe0604f7a94" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-div.4-sec.104-ssec.5-def.extendedexemptionperiod" guid="_fc2f3b1e-6ffa-4008-aeb2-ef87a38156d4" type="definition">extended exemption period</defterm> means the provision.type="other"><no>(a)</no><block><txt break.before="0">starting on the commencement; and</txt></block></li><li id="sec.6-frag-div.4-sec.104-ssec.5-def.extendedexemptionperiod-para1.b" guid="_2e4528b3-52ca-4976-9faf-1324351bf370" provision.type="other"><no>(b)</no><block><txt break.before="0">ending on 30 June
