provision.type="other"><no>(a)</no><block><txt break.before="0">provide for the giving of appropriate directions in relation to expert evidence; and</txt></block></li><li id="sec.3-frag-pt.5-div.1-sec.423-para1.b" guid="_09bcb3bc-c7a5-4e60-8d85-45904f3955c5" provision.type="other"><no>(b)</no><block><txt break.before="0">declare the duty of an expert in relation to the provision.type="other"><no>(d)</no><block><txt break.before="0">provide for the appointment of experts jointly by the parties to a proceeding and by the apply in relation to a witness giving evidence, whether orally or in writing, in a proceeding who is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.5-div.1-sec.424-ssec.1-para1.a" guid="_da409527-3c54-4b04-86a4-b97cbd7df13a" provision.type="other"><no>(a)</no><block><txt break.before="0">a party to the proceeding; or</txt></block></li><li id="sec.3-frag-pt.5-div.1-sec.424-ssec.1-para1.b" guid="_6ce2e4be-d7a0-42a3-a701-826780d88689" provision.type="other"><no>(b)</no><block><txt break.before="0">a person whose 2</no><heading id="sec.3-frag-pt.5-div.2-he" guid="_268acf8b-ae6b-4d7f-833a-cc6e99200878">Directions</heading><clause id="sec.3-frag-pt.5-div.2-sec.426" guid="_9bd9e34f-6ab0-4448-bbb8-88a1254d9214" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>426 </no><heading id="sec.3-frag-pt.5-div.2-sec.426-he" guid="_d4a797e3-9f14-4f0f-966c-23c37e9f56b5">Application for directions</heading><subclause id="sec.3-frag-pt.5-div.2-sec.426-ssec.1" guid="_1643df9f-fb5e-40d0-a727-f417ba533607" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt id="sec.3-frag-pt.5-div.2-sec.427-ssec.1" guid="_c3bfdb9c-4ed8-43cf-a74a-257b7377b1c2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The court may, at any time, give the directions it considers appropriate about the use of expert evidence in a proceeding.</txt></block></subclause><subclause id="sec.3-frag-pt.5-div.2-sec.427-ssec.2" guid="_0d49c89d-b141-4220-b262-a36662b1d389" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting subrule (1), 1 or more of the following directions may be given under this rule—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.5-div.2-sec.427-ssec.2-para1.a" guid="_5b21a93a-3ed6-4d6c-a984-ae38c029a9b5" provision.type="other"><no>(a)</no><block><txt break.before="0">a direction that reports be served within a particular period;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.427-ssec.2-para1.b" guid="_a0594e16-5870-4cc4-ad5a-7aa68abdd215" provision.type="other"><no>(b)</no><block><txt break.before="0">a direction that expert evidence on a particular issue may not be adduced, or may be provision.type="other"><no>(c)</no><block><txt break.before="0">a direction that expert evidence may be adduced on particular issues only;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.427-ssec.2-para1.d" guid="_f28f54dc-c6b8-43d0-a42d-ed63c5918c12" provision.type="other"><no>(d)</no><block><txt break.before="0">a direction limiting the number of experts who may be called to give evidence on a particular issue or for a particular area of expertise;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.427-ssec.2-para1.e" guid="_75c6c50b-f8d3-469d-8808-e42c9a45f25f" provision.type="other"><no>(e)</no><block><txt break.before="0">a direction providing for the appointment and instruction of an expert under division 5, subdivision 1 or 2 in relation to a particular issue;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.427-ssec.2-para1.f" guid="_d3b8647a-139e-4c6c-89fd-13612c612b88" provision.type="other"><no>(f)</no><block><txt break.before="0">a direction requiring experts in relation to the same issue to confer before preparing their reports in relation to the issue;</txt><note id="sec.3-frag-pt.5-div.2-sec.427-ssec.2-para1.f-note" guid="_f3670deb-ae0d-49c0-ac46-01004d84a892" type="example"><heading id="sec.3-frag-pt.5-div.2-sec.427-ssec.2-para1.f-note-he" guid="_ae3290cc-0f30-429e-be66-8d7b16746d63" provision.type="other"><no>(g)</no><block><txt break.before="0">a direction requiring an expert who has prepared more than 1 report for a proceeding to prepare a single report that reflects the expert’s evidence-in-chief in the proceeding;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.427-ssec.2-para1.h" reports</heading><subclause id="sec.3-frag-pt.5-div.2-sec.428-ssec.1" guid="_92608c17-ff45-4b6a-9a05-2bd4c994bcbf" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The court may, at any time, direct that 2 or more experts who are to give evidence in a proceeding—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.1-para1.a" guid="_e03b5a83-65a7-4cbd-8169-962686c7386f" provision.type="other"><no>(a)</no><block><txt break.before="0">hold a conference in which they identify, and attempt to resolve, any disagreement between them; and</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.1-para1.b" guid="_3a0f3ec1-62cc-4e0a-b03d-ce561c2cba00" provision.type="other"><no>(b)</no><block><txt break.before="0">jointly prepare a report about the conference (a <defterm id="sec.3-frag-pt.5-div.2-sec.428-ssec.1-def.jointreport" guid="_2f5e2fcc-c301-4035-8498-15326d22f3da" type="definition">joint report</defterm>) that states—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.1-para1.b-para2.i" guid="_d1f7ea55-a3a4-422d-8749-91710a91bf76" provision.type="other"><no>(i)</no><block><txt break.before="0">the matters, if any, on which the experts agree; and</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.1-para1.b-para2.ii" guid="_34824b4a-2ab8-44c2-ae66-7c94501bac69" provision.type="other"><no>(ii)</no><block><txt break.before="0">the matters, if any, on which the experts disagree and the reasons for any disagreement.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.3-frag-pt.5-div.2-sec.428-ssec.2" guid="_2d4f4577-3665-43f6-a531-35f10435f56c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The court may, for the conference, do 1 or more of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.2-para1.a" guid="_a4840a19-734d-4381-a2e3-3a94a4841565" provision.type="other"><no>(a)</no><block><txt break.before="0">set the date and time at which, or the period within which, the conference is to be held;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.2-para1.b" guid="_332e25fc-b123-46e2-ab53-dcf0972032a2" provision.type="other"><no>(b)</no><block><txt break.before="0">set the agenda for the conference;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.2-para1.c" guid="_9ec901a5-4571-45a3-80c8-bf38bc3cd0ae" provision.type="other"><no>(c)</no><block><txt break.before="0">direct the matters the experts are to discuss at the conference;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.2-para1.d" guid="_cbf12baa-56ad-412a-ae23-fbd3e1a618d2" provision.type="other"><no>(d)</no><block><txt break.before="0">direct that the conference be held with the assistance of a facilitator;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.2-para1.e" guid="_43a3e64b-abf7-4538-ad38-5fa75eecdebb" provision.type="other"><no>(e)</no><block><txt break.before="0">give directions about the form in which, and the period within which, the joint report is to be prepared by the experts;</txt></block></li><li id="sec.3-frag-pt.5-div.2-sec.428-ssec.2-para1.f" guid="_d2e1ebdf-ad17-4ceb-bb4b-103d2ee3a492" mentioned in subrule (1) must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.5-div.3-sec.429B-ssec.2-para1.a" guid="_3a6eed20-f83b-4b45-a028-f4af8e5ab626" provision.type="other"><no>(ii)</no><block><txt break.before="0">if all of the experts do not agree on the terms of the communication—the matters on which the experts material relied on by the expert to prepare the report;</txt></block></li><li id="sec.3-frag-pt.5-div.4-sec.429H-ssec.2-para1.e" guid="_61bba976-2ee6-465f-9ea8-dada0fc87906" provision.type="other"><no>(e)</no><block><txt break.before="0">for any inspection, examination or experiment conducted, initiated, or relied on by the expert to prepare the report—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.5-div.4-sec.429H-ssec.2-para1.e-para2.i" guid="_adcd509f-716e-472e-9757-c75ab7a7ee2b" provision.type="other"><no>(i)</no><block><txt guid="_1d5393c9-ecab-4789-898a-979ce72333d2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The expert—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-sec.7-ssec.2-para1.a" guid="_4205889e-42bd-4ca2-bc6e-3507e18ae337" provision.type="other"><no>(a)</no><block><txt break.before="0">is not an advocate for a party to the proceeding; and</txt></block></li><li id="sec.4-sec.7-ssec.2-para1.b" guid="_9ab4741a-6e79-4313-b41e-061971d99ed9" provision.type="other"><no>(b)</no><block><txt break.before="0">must not accept instructions from any person to adopt or reject a particular opinion.</txt></block></li></list></block></subclause><subclause id="sec.4-sec.7-ssec.3" guid="_6d819077-e391-463d-b0ec-b3e405caf944" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The expert’s duties under this rule override any obligation the expert may have to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-sec.7-ssec.3-para1.a" guid="_e7a046de-49cb-43e4-aafd-39e24a29e082" provision.type="other"><no>(a)</no><block><txt break.before="0">any party to the proceeding; or</txt></block></li><li id="sec.4-sec.7-ssec.3-para1.b" guid="_b3966d66-48a0-451c-be90-0c89f4528478" provision.type="other"><no>(b)</no><block><txt break.before="0">any person who is liable for the expert’s fees or expenses.</txt></block></li></list></block></subclause></clause><clause id="sec.4-sec.8" guid="_8d815025-ddb4-48ad-91e4-6c73713c11f1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.4-sec.8-he" guid="_a4281ec5-990e-433b-a899-6a54c2025dda">Requirements for report [r 429H&#93;</heading><subclause id="sec.4-sec.8-ssec.1" guid="_b0cb51da-302f-4188-b23c-a7a705b5ef94" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A report prepared by the expert must be addressed to the court and signed by the expert.</txt></block></subclause><subclause id="sec.4-sec.8-ssec.2" guid="_f0623df7-1d99-44ed-a4fd-9df7a931b2de" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The report must include the following information—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-sec.8-ssec.2-para1.a" guid="_dac1e79e-13ad-4a7b-85a6-b694b0767f7b" provision.type="other"><no>(a)</no><block><txt break.before="0">the expert’s qualifications;</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.b" guid="_852090e2-e31e-402f-a415-b4cbc8490d72" provision.type="other"><no>(b)</no><block><txt break.before="0">all material facts, whether written or oral, on which the report is based;</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.c" guid="_12c14624-ac1d-4553-b758-cca26bedeed4" provision.type="other"><no>(c)</no><block><txt break.before="0">the expert’s reasons for each opinion expressed in the report;</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.d" guid="_92a209b5-0cea-41c8-9fbc-2cb78d1344f9" provision.type="other"><no>(d)</no><block><txt break.before="0">references to any literature or other material relied on by the expert to prepare the report;</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.e" guid="_6577002e-e9a9-426e-a3b8-85e32be30a23" provision.type="other"><no>(e)</no><block><txt break.before="0">for any inspection, examination or experiment conducted, initiated, or relied on by the expert to prepare the report—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-sec.8-ssec.2-para1.e-para2.i" guid="_da3b0aa3-fc90-4335-8d50-4e157c5db6ca" provision.type="other"><no>(i)</no><block><txt break.before="0">a description of what was done; and</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.e-para2.ii" guid="_c9e5f4f7-e43d-480b-a985-4927036e1b48" provision.type="other"><no>(ii)</no><block><txt break.before="0">whether the inspection, examination or experiment was done by the expert or under the expert’s supervision; and</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.e-para2.iii" guid="_799250a9-fb9c-4495-a7b3-c0b31f459167" provision.type="other"><no>(iii)</no><block><txt break.before="0">the name and qualifications of any other person involved; and</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.e-para2.iv" guid="_9972f691-7348-4058-b3d4-4fd6060b0b75" provision.type="other"><no>(iv)</no><block><txt break.before="0">the result;</txt></block></li></list></block></li><li id="sec.4-sec.8-ssec.2-para1.f" guid="_0007e891-149f-4879-bcc5-5c0f97e976c2" provision.type="other"><no>(f)</no><block><txt break.before="0">if there is a range of opinion on matters dealt with in the report—a summary of the range of opinion, and the reasons why the expert adopted a particular opinion;</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.g" guid="_ed9798f0-8888-415c-9a03-9b91821eee14" provision.type="other"><no>(g)</no><block><txt break.before="0">if the expert believes the report may be incomplete or inaccurate without a qualification—the qualification;</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.h" guid="_f5e76cf9-78f0-47d2-9569-15ae84032dbf" provision.type="other"><no>(h)</no><block><txt break.before="0">a summary of the conclusions reached by the expert;</txt></block></li><li id="sec.4-sec.8-ssec.2-para1.i" guid="_2f6c3acf-7e5e-42e4-90b8-61b4ce1a8f0b" provision.type="other"><no>(i)</no><block><txt break.before="0">a statement about whether access to any readily ascertainable additional facts would assist the expert in reaching a more reliable conclusion.</txt></block></li></list></block></subclause><subclause id="sec.4-sec.8-ssec.3" guid="_5f39965d-c33a-4cff-9eef-db9054d1dda7" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the expert believes an opinion expressed in the report is not a concluded opinion, the report must state, where the opinion is expressed, the reason for the expert’s belief.</txt><note id="sec.4-sec.8-ssec.3-note" guid="_329f729a-d549-4e8f-a7e5-0f69b2c14bdd" type="example"><heading id="sec.4-sec.8-ssec.3-note-he" guid="_b8346306-35a3-4f27-97a0-fc2c4c15d226">Examples of reasons why an expert may believe an opinion is not a concluded opinion—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.4-sec.8-ssec.3-note-para1" guid="_e7b9611c-dc22-4efd-bdd2-491d8e921aa4" provision.type="other"><no>•</no><block><txt break.before="0">insufficient research</txt></block></li><li id="sec.4-sec.8-ssec.3-note-para1-oc.2" guid="_6b853047-fd51-44b6-afcb-528fdc3f2993" provision.type="other"><no>•</no><block><txt break.before="0">insufficient data</txt></block></li></list></block></note></block></subclause><subclause id="sec.4-sec.8-ssec.4" guid="_b050e59b-0a40-4edd-b1fb-0de680e03266" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The expert must confirm in the report that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-sec.8-ssec.4-para1.a" guid="_7fa73751-05d2-4089-8374-85a9bb046739" provision.type="other"><no>(a)</no><block><txt break.before="0">the expert has read, and agrees to be bound by, the code of conduct; and</txt></block></li><li id="sec.4-sec.8-ssec.4-para1.b" guid="_9b9c2e7c-ec45-4e9f-94e4-9cb598516ddf" provision.type="other"><no>(b)</no><block><txt break.before="0">the factual matters stated in the report are, as far as the expert knows, true; and</txt></block></li><li id="sec.4-sec.8-ssec.4-para1.c" guid="_98ab1fc6-9433-4acd-a852-ffd1ed3af2dc" provision.type="other"><no>(c)</no><block><txt break.before="0">the expert has made all inquiries considered appropriate; and</txt></block></li><li id="sec.4-sec.8-ssec.4-para1.d" guid="_c4df90fd-b3a9-4b86-973a-5f0ddcfddc9f" provision.type="other"><no>(d)</no><block><txt break.before="0">the opinions stated in the report are genuinely held by the expert; and</txt></block></li><li id="sec.4-sec.8-ssec.4-para1.e" guid="_9eb489a2-0537-472f-ae72-a4837202f653" provision.type="other"><no>(e)</no><block><txt break.before="0">the report contains reference to all matters the expert considers significant; and</txt></block></li><li id="sec.4-sec.8-ssec.4-para1.f" guid="_e1b78ae8-0c11-4878-b08c-d8236687f0f0" provision.type="other"><no>(f)</no><block><txt break.before="0">the expert understands the expert’s duty to the court and has complied with the duty.</txt></block></li></list></block></subclause></clause><clause id="sec.4-sec.9"
