guid="_c35f9226-0935-4340-bb8b-3ab39d9f5a63" provision.type="other"><no>(b)</no><block><txt break.before="0">the matters, if any, on which the experts disagree and the reasons for any provision.type="other"><no>(2)</no><block><txt break.before="0">In holding the meeting of experts, and preparing the joint report, the experts—</txt><list number.type="manual" provision.type="other"><no>(c)</no><block><txt break.before="0">must not act on any instruction or request to withhold or avoid reaching an agreement.</txt></block></li></list></block></subclause><subclause id="sec.9-frag-sec.28-ssec.3" guid="_2451d992-2f3c-41f7-9610-adc0b7189005" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Unless the P&#38;E Court orders or directs otherwise, the experts must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-frag-sec.28-ssec.3-para1.a" guid="_ebdc09d6-0d5c-4629-b85c-1ae483d0fe0e" provision.type="other"><no>(a)</no><block><txt break.before="0">hold the meeting of experts in the absence of the active parties to the P&#38;E Court proceeding; and</txt></block></li><li id="sec.9-frag-sec.28-ssec.3-para1.b" guid="_e23a3df8-cee0-4bee-bc26-7a5fdafafb67" provision.type="other"><no>(b)</no><block><txt break.before="0">prepare the joint report without reference to, or instructions from, the active parties to the P&#38;E Court proceeding.</txt></block></li></list></block></subclause><subclause id="sec.9-frag-sec.28-ssec.4" guid="_ac820910-51ae-49a4-a67d-dfb533f0eb2f" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The joint report must confirm that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-frag-sec.28-ssec.4-para1.a" guid="_6695dc5a-f38a-4cef-b4c7-795c1077f3e2" provision.type="other"><no>(a)</no><block><txt break.before="0">each of the experts has read, and agrees to be bound by, the code of conduct; and</txt></block></li><li id="sec.9-frag-sec.28-ssec.4-para1.b" guid="_382b87a7-f0ef-45f8-be4b-f4c752bd4321" provision.type="other"><no>(b)</no><block><txt break.before="0">the factual matters stated in the report are, as far as each of the experts knows, true; and</txt></block></li><li id="sec.9-frag-sec.28-ssec.4-para1.c" guid="_5e6dde31-44ec-449c-bee7-61a0648cc446" provision.type="other"><no>(c)</no><block><txt break.before="0">each of the experts has made all inquiries considered appropriate; and</txt></block></li><li id="sec.9-frag-sec.28-ssec.4-para1.d" guid="_071956dc-78c3-4803-9cae-13a1a2aff20f" provision.type="other"><no>(d)</no><block><txt break.before="0">the opinions stated in the report are genuinely held by each of the experts; and</txt></block></li><li id="sec.9-frag-sec.28-ssec.4-para1.e" guid="_12524656-7c33-4e8d-a4dc-b5fe6a93ca7e" provision.type="other"><no>(e)</no><block><txt break.before="0">the report contains reference to all matters each of the experts considers significant; and</txt></block></li><li id="sec.9-frag-sec.28-ssec.4-para1.f" guid="_51ed658f-b7da-49cc-981e-d6c7bfcce868" provision.type="other"><no>(f)</no><block><txt break.before="0">each of the experts understands the expert’s duty to the P&#38;E Court and has complied with the duty.</txt></block></li></list></block></subclause><subclause id="sec.9-frag-sec.28-ssec.5" guid="_a3cbfc15-438a-4b47-a7bd-7fa2a9684a37" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The experts must give the joint report to the active parties to the P&#38;E Court proceeding as soon as practicable after the meeting of experts has concluded and, in any case, as ordered or directed by the P&#38;E Court.</txt></block></subclause><subclause id="sec.9-frag-sec.28-ssec.6" guid="_59781127-188d-4a88-9f1b-5c68024b9ed8" experts, or preparation of the joint report, if a copy of the request is given to all the other active parties at the same time the request is made.</txt><note id="sec.9-frag-sec.28A-ssec.5-note" material facts, whether written or oral, on which the report is based;</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.c" guid="_ce185b96-a94d-4ae4-8a99-330b121d90f6" provision.type="other"><no>(c)</no><block><txt break.before="0">the expert’s reasons for each opinion expressed in the report;</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.d" guid="_8fa353e4-06e4-40e5-849a-e4af0bbc7b73" provision.type="other"><no>(d)</no><block><txt break.before="0">references to any literature or other material relied on by the expert to prepare the report;</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.e" guid="_f91b893c-7a71-408f-8d11-1139286d44ed" provision.type="other"><no>(e)</no><block><txt break.before="0">for any inspection, examination or experiment conducted, initiated, or relied on by the expert to prepare the report—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.e-para2.i" guid="_e9526240-c699-4752-ba54-ab4c9b867738" provision.type="other"><no>(i)</no><block><txt break.before="0">a description of what was done; and</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.e-para2.ii" guid="_2aaed68b-ab9e-43ed-9c44-cef25cdfa51c" provision.type="other"><no>(ii)</no><block><txt break.before="0">whether the inspection, examination or experiment was done by the expert or under the expert’s supervision; and</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.e-para2.iii" guid="_ecbe6ed1-f49e-4ae2-bf3d-16f77179eb97" provision.type="other"><no>(iii)</no><block><txt break.before="0">the name and qualifications of any other person involved; and</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.e-para2.iv" guid="_672ad37d-54ee-4f7d-abe9-b5e8f019e55f" provision.type="other"><no>(iv)</no><block><txt break.before="0">the result;</txt></block></li></list></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.f" guid="_7082c8c7-86eb-4f4c-a900-49f727e6063d" provision.type="other"><no>(f)</no><block><txt break.before="0">if there is a range of opinion on matters dealt with in the report—a summary of the range of opinion, and the reasons why the expert adopted a particular opinion;</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.g" guid="_f40d443c-fd2d-4cfd-828f-09d5a68f30d7" provision.type="other"><no>(g)</no><block><txt break.before="0">if the expert believes the report may be incomplete or inaccurate without a qualification—the qualification;</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.h" guid="_8a5381db-a45f-475c-b9f6-6d7ef7a9b5e0" provision.type="other"><no>(h)</no><block><txt break.before="0">a summary of the conclusions reached by the expert;</txt></block></li><li id="sec.10-frag-div.4-sec.35-ssec.2-para1.i" guid="_dd87ec34-22db-4d04-80c4-1d50ceae9a41" provision.type="other"><no>(i)</no><block><txt break.before="0">a statement about whether access to any readily ascertainable additional facts would assist the expert in reaching a more reliable conclusion.</txt></block></li></list></block></subclause><subclause id="sec.10-frag-div.4-sec.35-ssec.3" guid="_f4ec3830-b409-40b5-97d8-48c5bdbd71fa" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, subrule (2) does not apply to the extent the information is already included in a joint report prepared for the P&#38;E Court proceeding.</txt></block></subclause><subclause id="sec.10-frag-div.4-sec.35-ssec.4" appropriate; and</txt></block></li><li id="sec.13-sec.6-ssec.4-para1.d" guid="_85d1de5d-35dc-4fc3-9b88-c7876cf07de4" provision.type="other"><no>(d)</no><block><txt break.before="0">the opinions stated in the report are genuinely held by each of the experts; and</txt></block></li><li id="sec.13-sec.6-ssec.4-para1.e" guid="_9d5c09ff-828d-4966-b2b9-ad1e04c5f1e7" provision.type="other"><no>(e)</no><block><txt break.before="0">the report contains reference to all matters each of the experts considers significant; and</txt></block></li><li id="sec.13-sec.6-ssec.4-para1.f" guid="_f5fa7350-304b-4e90-9e73-82bb4a351ceb" provision.type="other"><no>(f)</no><block><txt break.before="0">each of the experts understands the expert’s duty to the P&#38;E Court and has complied with the duty.</txt></block></li></list></block></subclause><subclause id="sec.13-sec.6-ssec.5" guid="_e0815f27-628e-4dbf-9ce3-ed5cc930384f" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The experts must give the joint report to the active parties to the P&#38;E Court proceeding as soon as practicable after the meeting of provision.type="other"><no>(b)</no><block><txt break.before="0">informing the recipient of any matter affecting the proper and timely conduct or conclusion of the meeting of experts or preparation of the joint report.</txt><note id="sec.13-sec.7-ssec.2-para1.b-note" guid="_2be457f6-11a9-4e51-96de-361b4bdf3ace" type="example"><heading id="sec.13-sec.7-ssec.2-para1.b-note-he" guid="_785a3fc9-5731-471c-8f9d-2f9c18af3d08">Example for paragraph (b)—</heading><block><txt break.before="1">informing the active parties of a delay in gathering data for use in the joint report</txt></block></note></block></li></list></block></subclause><subclause id="sec.13-sec.7-ssec.3" guid="_203067f8-bd7d-4fb0-94c1-edb8adcf1289" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, a notice under subrule (2) may be given to an active party to the P&#38;E Court proceeding only if—</txt><list provision.type="other"><no>(2)</no><block><txt break.before="0">If the expert has taken part in a meeting of experts for the P&#38;E Court proceeding—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-sec.9-ssec.2-para1.a" guid="_4f6ab005-654a-415d-b797-f6fb9e59d740" provision.type="other"><no>(a)</no><block><txt break.before="0">a joint report prepared in relation to the meeting is taken to be the expert’s report for the hearing of the proceeding; but</txt></block></li><li id="sec.13-sec.9-ssec.2-para1.b" guid="_7b6c31b3-9cd8-4551-a8cb-607e66a57a6f" provision.type="other"><no>(b)</no><block><txt break.before="0">the expert may prepare a separate report in relation to any issue of disagreement recorded in the joint report is based;</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.c" guid="_dd4e585b-429f-45c0-a206-63d4bb394d04" provision.type="other"><no>(c)</no><block><txt break.before="0">the expert’s reasons for each opinion expressed in the report;</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.d" guid="_9ad405f4-d36e-4417-ace3-5857d0139a5c" provision.type="other"><no>(d)</no><block><txt break.before="0">references to any literature or other material relied on by the expert to prepare the report;</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.e" guid="_7b44cf31-1f6c-49b8-afd0-c52981a85aba" provision.type="other"><no>(e)</no><block><txt break.before="0">for any inspection, examination or experiment conducted, initiated, or relied on by the expert to prepare the report—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-sec.10-ssec.2-para1.e-para2.i" guid="_9b0d1565-f212-4b5c-b3f3-c2793e0a1a89" provision.type="other"><no>(i)</no><block><txt break.before="0">a description of what was done; and</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.e-para2.ii" guid="_eebfdb71-de12-4cae-a785-c838075c754a" provision.type="other"><no>(ii)</no><block><txt break.before="0">whether the inspection, examination or experiment was done by the expert or under the expert’s supervision; and</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.e-para2.iii" guid="_d8278d9b-5913-4014-9703-7e8314c88c04" provision.type="other"><no>(iii)</no><block><txt break.before="0">the name and qualifications of any other person involved; and</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.e-para2.iv" guid="_a028938b-141d-4105-95a8-a72a8fa7b572" provision.type="other"><no>(iv)</no><block><txt break.before="0">the result;</txt></block></li></list></block></li><li id="sec.13-sec.10-ssec.2-para1.f" guid="_c4c5aa05-88f5-49d5-9d26-c7bfd0f9e488" provision.type="other"><no>(f)</no><block><txt break.before="0">if there is a range of opinion on matters dealt with in the report—a summary of the range of opinion, and the reasons why the expert adopted a particular opinion;</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.g" guid="_45881791-8760-4379-9bcf-3b323e844578" provision.type="other"><no>(g)</no><block><txt break.before="0">if the expert believes the report may be incomplete or inaccurate without a qualification—the qualification;</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.h" guid="_dc946b4d-fdbe-4dd0-9a1a-93953664616f" provision.type="other"><no>(h)</no><block><txt break.before="0">a summary of the conclusions reached by the expert;</txt></block></li><li id="sec.13-sec.10-ssec.2-para1.i" guid="_3aaca86e-dcda-4086-88af-d44e8069b055" provision.type="other"><no>(i)</no><block><txt break.before="0">a statement about whether access to any readily ascertainable additional facts would assist the expert in reaching a more reliable conclusion.</txt></block></li></list></block></subclause><subclause id="sec.13-sec.10-ssec.3" guid="_d5ede3ec-6222-4c9e-a62f-25e973bd4213" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, subrule (2) does not apply to the extent the information is already included in a joint report prepared for the P&#38;E Court proceeding.</txt></block></subclause><subclause id="sec.13-sec.10-ssec.4" guid="_48e4fa7b-06db-4181-ae9b-2a0895d3cb57" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the expert believes an opinion expressed in the separate report is not a concluded opinion, the report must state, where the opinion is expressed, the reason for the expert’s belief.</txt><note id="sec.13-sec.10-ssec.4-note" guid="_f4747439-0fc0-405f-b73c-a95f233bcdf2" type="example"><heading id="sec.13-sec.10-ssec.4-note-he" guid="_90959f2a-a39d-4948-9014-684c2c85cb24">Examples of reasons why an expert may believe an opinion is not a concluded opinion—</heading><block><list break.before="0">insufficient research</txt></block></li><li id="sec.13-sec.10-ssec.4-note-para1-oc.2" guid="_c13d4117-f41f-4620-b388-87ccea0c0f3f" provision.type="other"><no>•</no><block><txt break.before="0">insufficient data</txt></block></li></list></block></note></block></subclause><subclause id="sec.13-sec.10-ssec.5" guid="_73ddcce1-bbcb-45cf-911a-c95b40e7dc09" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The expert must confirm in the separate report that—</txt><list number.type="manual"
