1Short titleThis regulation may be cited as the Drugs Misuse (Fees for Commercial Production of Industrial Cannabis) Amendment Regulation 2022.2Regulation amendedThis regulation amends the Drugs Misuse Regulation 1987.3Replacement of s 28 (Licence fees—Act, ss 54 and 65)Section 28—omit, insert—28FeesThe fees payable under the Act are stated in section 28A and schedule 8E.28AMonitoring fees—Act, s 110G(1)For section 110G(1) of the Act, the monitoring fee for the monitoring of activities performed under a relevant authority is stated in schedule 8E, item 8.(2)The fee stated in schedule 8E, item 8 may consist of, or include, an amount for part of an hour that is the equivalent of the relevant proportion of the hourly rate, stated in the schedule, worked out using 15-minute periods (wholly or partly completed).(3)Subsection (4) applies if in the course of monitoring an activity performed under a relevant authority—

(a)an inspector takes a sample of cannabis under section 101(b) of the Act; and

(b)the sample is analysed to determine the THC concentration of the sample.
