1Short titleThis declaration may be cited as the Fisheries (Saucer Scallops) Amendment Declaration 2021.2CommencementThis declaration commences on 1 September 2021 immediately after the commencement of the Fisheries Legislation Amendment Regulation 2020, chapter 4, part 2.3Declaration amendedThis declaration amends the Fisheries Declaration 2019.4Insertion of new ch 2, pt 12, divs 1 and 1AChapter 2, part 12—insert—Division 1Southern offshore trawl region A and southern offshore trawl region B86Using trawl nets in southern offshore trawl region A or southern offshore trawl region B(1)A person must not use a trawl net in the southern offshore trawl region A or the southern offshore trawl region B in a regulated period.(2)However, subsection (1) does not apply to—

(a)a person using a trawl net in waters south of the eastern tip of Point Cartwright; or

(b)a person using an otter trawl net under a T5 licence.

(3)For subsection (1), the regulated period is from 8a.m. to 6p.m.Division 1ASouthern inshore trawl region86APossessing or using trawl nets in southern inshore trawl region(1)A person must not possess or use a trawl net in the southern inshore trawl region in a regulated period.(2)However, subsection (1) does not apply to a person possessing or using an otter trawl net under a T6, T7 or T8 licence.(3)For subsection (1), each of the following is a regulated period—

(a)from midday on 20 September to midday on 1 November;

(b)from midday on 23 December to midday on 3 January.
