vegetation if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.20A-para1.a" guid="_9df15bdb-f991-48fb-940f-cd33863f18d2" provision.type="other"><no>(a)</no><block><txt break.before="0">the clearing is necessary for—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.20A-para1.a-para2.i" guid="_e9d8a26a-2114-4982-a589-f1b56dac2d1f" provision.type="other"><no>(i)</no><block><txt break.before="0">establishing or maintaining a necessary firebreak to protect infrastructure, other than a fence, road or vehicular track, and the maximum width of the firebreak is equal to 1.5 times the height of the tallest vegetation next to the infrastructure, or 20m, whichever is the wider; or</txt></block></li><li id="sec.4-frag-sec.20A-para1.a-para2.ii" guid="_525c22a0-65bf-4e65-afb4-caf984920127" provision.type="other"><no>(ii)</no><block><txt break.before="0">establishing a necessary fire management line, and the maximum width of the clearing for the fire management line is 10m; and</txt></block></li></list></block></li><li id="sec.4-frag-sec.20A-para1.b" guid="_13f82c38-961d-4a01-9c6f-b9afe51d4ae1" provision.type="other"><no>(b)</no><block><txt break.before="0">the clearing—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.20A-para1.b-para2.i" guid="_fcb9de7a-c7ac-4b89-b528-7954ed7b3693" provision.type="other"><no>(i)</no><block><txt break.before="0">is on freehold land; or</txt></block></li><li id="sec.4-frag-sec.20A-para1.b-para2.ii" guid="_61309257-0f17-4aad-a542-26ec8514613d" provision.type="other"><no>(ii)</no><block><txt break.before="0">is on indigenous land; or</txt></block></li><li id="sec.4-frag-sec.20A-para1.b-para2.iii" guid="_0a637c2d-a55c-4428-a5b3-c1df2ffe9bbf" provision.type="other"><no>(iii)</no><block><txt break.before="0">is on land leased under the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f"><name emphasis="yes">Land Act 1994</name></legref> for agriculture or grazing purposes; or</txt></block></li><li id="sec.4-frag-sec.20A-para1.b-para2.iv" guid="_44e23bb3-af13-42c2-a5e4-53de0647482e" provision.type="other"><no>(iv)</no><block><txt break.before="0">is on land leased under the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f"><name emphasis="yes">Land Act 1994</name></legref>, other than for agriculture or grazing purposes, and is consistent with the purpose of the lease; or</txt></block></li><li id="sec.4-frag-sec.20A-para1.b-para2.v" guid="_714a6d2c-b597-4ec2-9b67-47882e954157" provision.type="other"><no>(v)</no><block><txt break.before="0">is on trust land under the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f"><name emphasis="yes">Land Act 1994</name></legref>, other than indigenous land, is carried out, or allowed to be carried out, by the trustee and is consistent with achieving the purpose of the trust; or</txt></block></li><li id="sec.4-frag-sec.20A-para1.b-para2.vi" guid="_a45b01b0-21ad-4bde-b990-97c2a5777037" provision.type="other"><no>(vi)</no><block><txt break.before="0">is on unallocated State land and is carried out, or allowed to be carried out, by the chief executive of the department in which the provision.type="other"><no>(1)</no><block><txt break.before="0">Development in the Spit building height control area is prohibited development to the extent the development results in a building or structure that has a building height of more than 3 storeys or 15m.</txt></block></subclause><subclause id="sec.6-frag-pt.16A-div.1-sec.27H-ssec.2" guid="_f23964b2-ea91-406b-8920-cf10dfdf97e5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, subsection (1) does not apply to development for an outdoor theme park ride at Sea World.</txt></block></subclause><subclause id="sec.6-frag-pt.16A-div.1-sec.27H-ssec.3" guid="_4b1e6231-fa51-4ca5-9886-225702b0a0b3" affected.by.uncommenced="0" provision.type="other"><no>(b)</no><block><txt break.before="0">the vertical distance, measured in metres, between the ground level of the building or structure and the highest point of the building or structure, other than a point that is part of an aerial, chimney, flagpole or load-bearing antenna.</txt></block></li></list></definition><definition
