and</txt></block></li><li id="sec.4-frag-div.3A-sec.68A-ssec.2-para1.b" guid="_77712922-e7f0-48d7-afdf-807abb88e029" provision.type="other"><no>(b)</no><block><txt break.before="0">be given in the time stated in a practice direction.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-div.3A-sec.68A-ssec.3" guid="_d17709d2-a21a-4a23-8264-901a8ae5f757" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The principal registrar must also give written notice of the referral, as stated in subrule (2), to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.3A-sec.68A-ssec.3-para1.a" guid="_113e5463-ce1f-4df4-85cb-2e38b5e87506" provision.type="other"><no>(a)</no><block><txt break.before="0">a person to whom notice of the conciliation is required to be given under an enabling Act; and</txt></block></li><li id="sec.4-frag-div.3A-sec.68A-ssec.3-para1.b" guid="_23d1a502-9fda-444c-bb6d-7b8ab53e9c26" provision.type="other"><no>(b)</no><block><txt break.before="0">the conciliator who is to conduct the conciliation; and</txt></block></li><li id="sec.4-frag-div.3A-sec.68A-ssec.3-para1.c" guid="_460e1a4d-a408-4918-b13d-fd50c89f7541" provision.type="other"><no>(c)</no><block><txt break.before="0">any other person the principal registrar reasonably considers should be given notice of the conciliation.</txt></block></li></list></block></subclause></clause><clause id="sec.4-frag-div.3A-sec.68B" guid="_dce03046-e34b-40f2-a9b7-6a4353e39ceb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>68B</no><heading id="sec.4-frag-div.3A-sec.68B-he" guid="_f40298eb-dbd3-4685-a088-88bb05b4917d">Parties must assist conciliator</heading><block><txt break.before="1">The parties to a proceeding must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.3A-sec.68B-para1.a" guid="_b828d008-4025-44ad-9426-2e6e3deea6e0" provision.type="other"><no>(a)</no><block><txt break.before="0">act reasonably and genuinely in a conciliation; and</txt></block></li><li id="sec.4-frag-div.3A-sec.68B-para1.b" guid="_7bd11153-21c7-45c6-b455-79609e6fb1e4" provision.type="other"><no>(b)</no><block><txt break.before="0">help the conciliator to start and finish the conciliation within the time estimated by the conciliator or stated in the written notice of the referral for conciliation.</txt></block></li></list></block></clause><clause id="sec.4-frag-div.3A-sec.68C" guid="_d3659eda-473a-4902-8fe3-2bce1132003d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>68C</no><heading id="sec.4-frag-div.3A-sec.68C-he" guid="_290aa925-e516-461b-89b6-c6a7bc849ce8">General powers of conciliator</heading><block><txt break.before="1">In conducting a conciliation, the conciliator may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.3A-sec.68C-para1.a" guid="_171ffed8-ec69-43f9-b504-e8008362e2df" provision.type="other"><no>(a)</no><block><txt break.before="0">gather information about the nature and facts of the matter to which the conciliation relates in a way decided by the conciliator; and</txt></block></li><li id="sec.4-frag-div.3A-sec.68C-para1.b" guid="_a8d74f30-64aa-4925-a94c-175ae30cf6b8" provision.type="other"><no>(b)</no><block><txt break.before="0">during the conciliation—see the parties with or without their representatives, together or separately.</txt></block></li></list></block></clause><clause id="sec.4-frag-div.3A-sec.68D" guid="_d0761621-b494-48f1-a020-217db9985db0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>68D</no><heading id="sec.4-frag-div.3A-sec.68D-he" guid="_2f855745-d1e3-43d6-9fe1-109ef4ce4567">Other rules about conduct of conciliation</heading><subclause id="sec.4-frag-div.3A-sec.68D-ssec.1" guid="_ac095bce-ebac-4953-ae3c-20024a374d5a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the parties to a proceeding agree to settle the proceeding, or a part of the proceeding at conciliation, the conciliator must discuss the following with the parties—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.3A-sec.68D-ssec.1-para1.a" guid="_9f936f3c-2002-4814-b6b1-18eb142dbc38" provision.type="other"><no>(a)</no><block><txt break.before="0">the terms of the settlement;</txt></block></li><li id="sec.4-frag-div.3A-sec.68D-ssec.1-para1.b" guid="_e110776a-2645-43f7-88a5-b5a4b0fcc74c" provision.type="other"><no>(b)</no><block><txt break.before="0">if the conciliator is a member, an adjudicator or the principal registrar—whether the terms will be recorded in writing under section 85(2) of the Act and the orders the conciliator is to make to give effect to the settlement under that section;</txt></block></li><li id="sec.4-frag-div.3A-sec.68D-ssec.1-para1.c" guid="_a8415df9-d7e1-47a9-b00a-1fa698cc0591" provision.type="other"><no>(c)</no><block><txt break.before="0">if the conciliator is not a member, an adjudicator or the principal registrar—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.3A-sec.68D-ssec.1-para1.c-para2.i" guid="_9ebbc3c9-5b6f-4776-af24-29bdb2d8d5f8" provision.type="other"><no>(i)</no><block><txt break.before="0">whether the terms will be recorded in writing, signed by the parties and filed under section 85(4) of the Act; and</txt></block></li><li id="sec.4-frag-div.3A-sec.68D-ssec.1-para1.c-para2.ii" guid="_45fc6c55-f026-4d0a-8f35-132051c42d14" provision.type="other"><no>(ii)</no><block><txt break.before="0">whether the parties consider tribunal orders are required to give effect to the settlement and, if so, the orders that the parties consider are required; and</txt></block></li><li id="sec.4-frag-div.3A-sec.68D-ssec.1-para1.c-para2.iii" guid="_ca231186-271f-4408-b436-b13245ed7c1f" provision.type="other"><no>(iii)</no><block><txt break.before="0">the things said or done in the conciliation that the parties agree may be admitted into evidence for the proceeding, including, for example, the tribunal orders that the parties consider are required as mentioned in subparagraph (ii);</txt></block></li></list></block></li><li id="sec.4-frag-div.3A-sec.68D-ssec.1-para1.d" guid="_d70f2e3c-6962-4874-8688-57d5751543e7" provision.type="other"><no>(d)</no><block><txt break.before="0">anything else the conciliator considers may help the parties give effect to the settlement.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-div.3A-sec.68D-ssec.2" guid="_0fff4452-0d98-4928-8c68-aa58317e926b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subrule (3) applies in relation to a proceeding, or a part of a proceeding, for a matter stated in a practice direction for the subrule.</txt></block></subclause><subclause id="sec.4-frag-div.3A-sec.68D-ssec.3" guid="_8999a258-2447-4560-9270-cd44f76e2b1b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a conciliator has attempted unsuccessfully to settle a proceeding or a part of a proceeding by conciliation, the conciliator must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.3A-sec.68D-ssec.3-para1.a" guid="_ef271966-6f84-40bc-9375-f5f860be07b1" provision.type="other"><no>(a)</no><block><txt break.before="0">in the way stated in the practice direction, help the parties to identify—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.3A-sec.68D-ssec.3-para1.a-para2.i" guid="_0b32784a-076d-4068-bce4-e33cb04aca0b" provision.type="other"><no>(i)</no><block><txt break.before="0">the issues that are in dispute in the proceeding or part; and</txt></block></li><li id="sec.4-frag-div.3A-sec.68D-ssec.3-para1.a-para2.ii" guid="_9fbb980a-941b-4804-90b4-e4081b7b554d" provision.type="other"><no>(ii)</no><block><txt break.before="0">the issues that are no longer in dispute in the proceeding or part; and</txt></block></li></list></block></li><li id="sec.4-frag-div.3A-sec.68D-ssec.3-para1.b" guid="_7cfe43ae-ad65-4e08-a8c8-3dbf44a82be6" provision.type="other"><no>(b)</no><block><txt break.before="0">discuss with the parties the things said or done in the conciliation that the parties agree may be admitted into evidence for the proceeding, including, for example, the issues identified under paragraph (a).</txt></block></li></list></block></subclause></clause><clause id="sec.4-frag-div.3A-sec.68E" guid="_e6be38b3-db2b-4bf1-8fd2-80962e014541" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>68E</no><heading id="sec.4-frag-div.3A-sec.68E-he" guid="_95f6e4bd-e4bc-47e8-9dd0-7ad480d90014">Outcome of conciliation</heading><subclause id="sec.4-frag-div.3A-sec.68E-ssec.1" guid="_e9a238b4-d22d-4b85-82d4-4c3ea86b97a8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">As soon as practicable after a conciliation for a proceeding ends, the conciliator must file a certificate in the approved form about the outcome of the conciliation.</txt></block></subclause><subclause id="sec.4-frag-div.3A-sec.68E-ssec.2" guid="_b65b18cd-1c45-4388-9ef1-2d176f062ca7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A certificate filed under subrule (1)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.3A-sec.68E-ssec.2-para1.a" guid="_73080b27-6e03-43ca-82b0-1d299f8e961a" provision.type="other"><no>(a)</no><block><txt break.before="0">must not state anything about the extent to which a party to the proceeding participated or refused to participate in the conciliation; but</txt></block></li><li id="sec.4-frag-div.3A-sec.68E-ssec.2-para1.b" guid="_6960deaa-bd4c-4632-b59d-92722d8c1294" provision.type="other"><no>(b)</no><block><txt break.before="0">may state that a stated party to the proceeding did not attend the conciliation.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-div.3A-sec.68E-ssec.3" guid="_46ebffee-4ca0-4618-973b-95f41a599a1d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A certificate filed under subrule (1) must identify the things said or done in the conciliation that the parties have agreed may be admitted into evidence in the proceeding under section 66J(2)(a) of the Act.</txt></block></subclause><subclause id="sec.4-frag-div.3A-sec.68E-ssec.4" guid="_4853e036-87c2-4236-9093-9eb7450d1402" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the conciliator is not the principal registrar and files a certificate under subrule (1), the conciliator is taken to have notified the principal registrar as required under section 66I of the Act.</txt></block></subclause></clause></division></fragment></block></clause><clause id="sec.5" guid="_90899d61-25ed-4291-8b5f-e0b627e3d5f8" affected.by.uncommenced="0" spent.amends="0" provision.type="amend"><no>5</no><heading id="sec.5-he" guid="_6a183087-864a-4b6f-8ce9-afbc9f94a844">Amendment of schedule (Dictionary)</heading><block><txt break.before="1">Schedule—</txt><txt break.before="1"><i>insert</i>—</txt><fragment format="fromcontext" auto.number.type="manual" style="indent"><deflist><definition id="sec.5-frag-def.conciliation_" guid="_9699e592-3ad5-4551-86de-fdfd3bfa5b0a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-def.conciliation" guid="_5895f17c-d27f-4284-a556-96cb64c557f3" type="definition">conciliation</defterm> means conciliation conducted under chapter 2, part 6, division 1A of the Act.</txt></definition></deflist></fragment></block></clause></body></wrapper></subordleg>
