provision.type="other"><no>(iii)</no><block><txt break.before="0">the place where the arbitration is being conducted;</txt></block></li><li id="sec.3-frag-ch.9A-pt.2-sec.365F-ssec.2-para1.b-para2.iv" guid="_2859a983-6058-4bc7-a187-92ba3f757f46" provision.type="other"><no>(iv)</no><block><txt break.before="0">the nature of the arbitration;</txt></block></li><li id="sec.3-frag-ch.9A-pt.2-sec.365F-ssec.2-para1.b-para2.v" guid="_3b31bcfd-d81a-4a98-b343-767f66cf285c" provision.type="other"><no>(v)</no><block><txt break.before="0">the terms of the permission affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">An amount fixed under subrule (3) may be in addition to any conduct money or witness expenses mentioned in guid="_40f9d344-813a-400e-ae50-98e43582db13" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An application for an order under the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="yes">International Arbitration Act 1974</name> (Cwlth)</legref>, section 23A(3) must be in the approved form.</txt></block></subclause><subclause provision.type="other"><no>(3)</no><block><txt break.before="0">The application must be accompanied by an affidavit showing that, before the end of the appeal period referred to in the <legref jurisd="QLD" type="act" target.doc.id="act-2013-008" target.version.series="3de805c2-6ba8-42e7-be88-90ee9e5434c9" check="valid"><name emphasis="yes">Commercial Arbitration Act 2013</name></legref>, break.before="0">a copy of the award, including the reasons of the arbitral tribunal for the award.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-ch.9A-pt.3-sec.365T-ssec.5" guid="_79785643-24cb-4837-8462-2c3f87fc51f7" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The application must be accompanied by a submission setting out—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-ch.9A-pt.3-sec.365T-ssec.5-para1.a" guid="_7d2234f6-3165-4275-a5bf-2ce864b8058d" provision.type="other"><no>(a)</no><block><txt break.before="0">the name and usual or last known place of business or residence of any person whose interest might be affected by the proposed appeal provision.type="other"><no>(c)</no><block><txt break.before="0">when and how the arbitral tribunal was asked to determine the question of law and where in the award or the reasons, and in what way, provision.type="other"><no>(d)</no><block><txt break.before="0">the relevant facts found by the arbitral tribunal on the basis of which the question of law is to be determined by the court; and</txt></block></li><li id="sec.3-frag-ch.9A-pt.3-sec.365T-ssec.5-para1.e" guid="_00637a6c-2583-47d8-8231-6f0122f5d644" provision.type="other"><no>(e)</no><block><txt break.before="0">the basis on which it is contended that the determination of the question of law will substantially affect the rights of 1 or more parties; and</txt></block></li><li the matter by arbitration, it is just and proper in the circumstances for the court to determine the question; and</txt></block></li><li id="sec.3-frag-ch.9A-pt.3-sec.365T-ssec.5-para1.h" guid="_93cae6cc-1d44-4b6b-a42c-8c1f3652b4b5" provision.type="other"><no>(h)</no><block><txt break.before="0">a succinct statement of the argument in support of the application for leave and the appeal provision.type="other"><no>(6)</no><block><txt break.before="0">The application and the supporting material must be served on any person whose interest might be affected by the proposed
