1Short titleThis notice may be cited as the Nature Conservation (Macropod Harvest Period 2019) Notice 2018.2CommencementThis notice commences on 1 January 2019.3DefinitionsThe dictionary in schedule 3 defines particular words used in this notice.4Harvest period(1)The harvest period for a harvest macropod starts, for each harvest zone and harvest region, on 1 January 2019 and ends at the end of—

(a)if the chief executive has published a notice under subsection (2) for the harvest macropod for the harvest zone or harvest region—the day stated in the notice; or

(b)otherwise—31 December 2019.

(2)The chief executive may publish a notice stating the harvest period for a harvest macropod for a harvest zone or harvest region ends on a stated day, before 31 December 2019, if the chief executive is satisfied—

(a)the relevant maximum amount for the harvest macropod in the harvest zone or harvest region will be taken in 2019 by the stated day; or

(b)it is necessary to end the harvest period for the harvest macropod for the harvest zone or harvest region on the stated day because an event has reduced or is likely to reduce the population size for the macropod in the zone or region.Examples of an event—

•a flood

•a disease outbreak

(3)The notice must—

(a)state—

(i)the matter of which the chief executive is satisfied under subsection (2)(a) or (b); and

(ii)the day the harvest period for the harvest macropod for the harvest zone or harvest region ends; and

(b)be published—

(i)on the department’s website; and

(ii)on or before the day the harvest period ends.

(4)In this section—estimated population size, for a harvest macropod in a harvest zone or harvest region, means the population size estimated by the chief executive in 2018 for the macropod in the zone or region for 2019.relevant maximum amount means—

(a)for an eastern grey kangaroo—

(i)for the central east harvest region—15% of the estimated population size for the kangaroo in the region; or

(ii)for the central north harvest region—7.5% of the estimated population size for the kangaroo in the region; or

(iii)for the central south harvest region—7.5% of the estimated population size for the kangaroo in the region; or

(iv)for the eastern harvest zone—10% of the estimated population size for the kangaroo in the zone; or

(b)for a red kangaroo—

(i)for the central harvest zone—20% of the estimated population size for the kangaroo in the zone; or

(ii)for the eastern harvest zone—10% of the estimated population size for the kangaroo in the zone; or

(iii)for the western harvest zone—10% of the estimated population size for the kangaroo in the zone; or

(c)for a common wallaroo—

(i)for the central harvest zone—15% of the estimated population size for the wallaroo in the zone; or

(ii)for the eastern harvest zone—10% of the estimated population size for the wallaroo in the zone; or

(iii)for the western harvest zone—10% of the estimated population size for the wallaroo in the zone.

5Notice to holders of macropod harvesting licences(1)If the chief executive publishes or intends to publish a notice under section 4(2) for a harvest macropod for a harvest zone or harvest region, the chief executive must also give each holder of a macropod harvesting licence for the macropod a written notice stating—

(a)the chief executive is satisfied of a matter mentioned in section 4(2)(a) or (b) for the macropod for the zone or region; and

(b)the day the harvest period for the macropod for the zone or region ends.

(2)The chief executive must give the notice at least 7 days before the day the harvest period ends.6Conditions on taking harvest macropods(1)This section states, for the Nature Conservation (Macropod) Conservation Plan 2017, section 12(1), conditions on the taking of macropods during the harvest period.(2)The holder of a macropod harvesting licence must not take an eastern grey kangaroo from the western harvest zone.(3)When taking a harvest macropod, the holder of a macropod harvesting licence must comply with the document called ‘National code of practice for the humane shooting of kangaroos and wallabies for commercial purposes’ to the extent the document provides for the way in which the macropod may be taken.7Minimum area of skinFor the Nature Conservation (Macropod) Conservation Plan 2017, section 13, the minimum area of skin of a harvest macropod is 0.41m².8Minimum weights(1)For the Nature Conservation (Macropod) Conservation Plan 2017, section 14—

(a)the minimum whole weight for the carcass of a harvest macropod is 20kg; and

(b)the minimum dressed weight for the carcass of a harvest macropod is—

(i)if the macropod is fully dressed—13kg; or

(ii)otherwise—13kg, plus the extra weight stated in schedule 1, column 2, for each part of the macropod stated in schedule 1, column 1, that has not been removed.

(2)In this section—fully dressed, in relation to a harvest macropod, means a harvest macropod with all of the following parts removed—

(a)the head;

(b)the viscera;

(c)each of the forelimbs, from the elbow joint;

(d)the foot of 1 hind limb, from a point below the tarsal joint;

(e)the hind limb, other than the hind limb mentioned in paragraph (d), from a point on the tibia below midway between the knee and ankle joints;

(f)the tail, not more than 160mm from a point where the underside of the tail joins the body in the external urogenital area.

Schedule 3Dictionarysection 3central east harvest region means the area consisting of each local government area mentioned in schedule 2, part 1, division 1.central harvest zone means the area consisting of each local government area mentioned in schedule 2, part 1.central north harvest region means the area consisting of each local government area mentioned in schedule 2, part 1, division 2.central south harvest region means the area consisting of each local government area mentioned in schedule 2, part 1, division 3.eastern harvest zone means the area consisting of each local government area mentioned in schedule 2, part 2.harvest macropod means—

(a)an eastern grey kangaroo (Macropus giganteus); or

(b)a red kangaroo (Macropus rufus); or

(c)a common wallaroo (Macropus robustus).

harvest region means—

(a)the central east harvest region; or

(b)the central north harvest region; or

(c)the central south harvest region.

harvest zone means—

(a)the central harvest zone; or

(b)the eastern harvest zone; or

(c)the western harvest zone.

viscera means the contents of the abdominal and thoracic cavities.western harvest zone means the area consisting of each local government area mentioned in schedule 2, part 3.
