and</txt></block></li><li id="sec.3-ssec.1-frag-para1.aa-para2.ii" guid="_4cdb6cce-5caa-4e4c-9ff6-a4f75052101a" provision.type="other"><no>(ii)</no><block><txt break.before="0">gives the owner notice of the suspicion; or</txt></block></li></list></block></li></list></fragment></block></subclause><subclause id="sec.3-ssec.2" guid="_07e343b8-efc8-4848-9dc7-00e7411b57f6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><legref refid="sec.16S" check="invalid" jurisd="QLD" type="act">Section&#160;16S</legref><legref refid="sec.16S-ssec.1" check="invalid" jurisd="QLD" type="act">(1)</legref><legref refid="sec.16S-ssec.1-para1.aa" check="invalid" jurisd="QLD" type="act">(aa)</legref> and <legref refid="sec.16S-ssec.1-para1.b" check="invalid" jurisd="QLD" type="act">(b)</legref>—</txt><txt break.before="1"><i>renumber</i> as <legref refid="sec.16S" check="invalid" jurisd="QLD" type="act">section&#160;16S</legref><legref refid="sec.16S-ssec.1" check="invalid" jurisd="QLD" type="act">(1)</legref><legref refid="sec.16S-ssec.1-para1.b" check="invalid" jurisd="QLD" type="act">(b)</legref> and <legref refid="sec.16S-ssec.1-para1.c" check="invalid" jurisd="QLD" type="act">(c)</legref>.</txt></block></subclause></clause><clause id="sec.4" guid="_99f573fc-aeeb-4b72-9ddc-4cad266755b7" affected.by.uncommenced="0" spent.amends="0" provision.type="amend"><no>4</no><heading id="sec.4-he" guid="_2612d7a4-5dc5-45de-b1e2-18a7922be3d2">Replacement of <legref refid="sec.16ZN" check="invalid" jurisd="QLD" type="act">s&#160;16ZN</legref> (Proof of agency)</heading><block><txt break.before="1"><legref refid="sec.16ZN" check="invalid" jurisd="QLD" type="act">Section&#160;16ZN</legref>—</txt><txt break.before="1"><i>omit, insert—</i></txt><fragment format="fromcontext" auto.number.type="manual" style="indent"><clause id="sec.4-frag-sec.16ZN" guid="_72616a7b-a9f7-49d8-89fa-0f0b899bf5d3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16ZN </no><heading id="sec.4-frag-sec.16ZN-he" guid="_b7110b6b-af88-496e-9621-1192d373c71c">Proof of agency</heading><subclause id="sec.4-frag-sec.16ZN-ssec.1" guid="_ac4d6bff-4041-4beb-b651-89e3cdfa13c5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a person (an <defterm id="sec.4-frag-sec.16ZN-def.agent" guid="_70abddc6-f4e2-4768-93e4-9e1483fdb8ca" type="definition">agent</defterm>) does an act for an owner to comply with this part.</txt></block></subclause><subclause id="sec.4-frag-sec.16ZN-ssec.2" guid="_416ae5e0-663c-4deb-9440-4dcef226a26c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Before the agent does the act, the agent must give to the QBCC, by using the online system, a copy of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.16ZN-ssec.2-para1.a" guid="_3dd504be-1bab-4021-bdba-b5dbd12e4100" provision.type="other"><no>(a)</no><block><txt break.before="0">if the owner’s private building comprises 2 or more lots and the agent is the owner’s body corporate manager—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.16ZN-ssec.2-para1.a-para2.i" guid="_bdc1cec0-151f-4a5d-a561-b9b86d1e08ac" provision.type="other"><no>(i)</no><block><txt break.before="0">a document evidencing the body corporate manager’s authority to act for the owner; and</txt></block></li><li id="sec.4-frag-sec.16ZN-ssec.2-para1.a-para2.ii" guid="_69f6b28b-2294-468c-b3d5-fdf8b71d2abc" provision.type="other"><no>(ii)</no><block><txt break.before="0">another document, in the approved form, about the document mentioned in subparagraph (i); or</txt></block></li></list></block></li><li id="sec.4-frag-sec.16ZN-ssec.2-para1.b" guid="_9cfa217b-4fa6-480c-b51d-3c9329067e2f" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—a document, in the approved form, evidencing the agent’s authority to act for the owner.</txt></block></li></list><penalty id="sec.4-frag-sec.16ZN-ssec.2-pen" guid="_064f7ca9-84b3-4d45-8dc5-d8e27e5e4d27"><block><txt break.before="1">Maximum penalty—20 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.4-frag-sec.16ZN-ssec.3" guid="_376f27b0-f14f-40eb-87b9-9703173c530e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.4-frag-sec.16ZN-ssec.3-def.bodycorporatemanager_" guid="_d96a19ca-c7bd-4824-b9f9-15c253b564a6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-frag-sec.16ZN-ssec.3-def.bodycorporatemanager" guid="_d6d75822-7951-4d3d-a576-63ecd73b5576" type="definition">body corporate manager</defterm>, for an owner of a private building comprising 2 or more lots, see—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.16ZN-ssec.3-def.bodycorporatemanager-para1.a" guid="_faa5198b-1325-4ed8-95d7-7aa9ee51af4f" provision.type="other"><no>(a)</no><block><txt break.before="0">if the building is subject to the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515"><name emphasis="yes">Body Corporate and Community Management Act 1997</name></legref>—section 14 of that Act; or</txt></block></li><li id="sec.4-frag-sec.16ZN-ssec.3-def.bodycorporatemanager-para1.b" guid="_5898bdbe-ab98-418b-8af9-e8f096e6b52b" provision.type="other"><no>(b)</no><block><txt break.before="0">if the building is subject to the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3"><name emphasis="yes">Building Units and Group Titles Act 1980</name></legref>—section 7 of that Act; or</txt></block></li><li id="sec.4-frag-sec.16ZN-ssec.3-def.bodycorporatemanager-para1.c" guid="_1b7ea9ed-4078-4f5d-b3de-63963f1a7b36" provision.type="other"><no>(c)</no><block><txt break.before="0">if the building is subject to the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1987-023" target.version.series="2a40e9d2-f366-4aa8-8ca0-2c8761bccaa1"><name emphasis="yes">Integrated Resort Development Act 1987</name></legref>—schedule 7 of that Act; or</txt></block></li><li id="sec.4-frag-sec.16ZN-ssec.3-def.bodycorporatemanager-para1.d" guid="_6595796e-279c-48b3-895c-043129fdb042" provision.type="other"><no>(d)</no><block><txt break.before="0">if the building is subject to the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1993-021" target.version.series="a1980134-4305-4e29-8d0b-f8ea1b42de22"><name emphasis="yes">Mixed Use Development Act 1993</name></legref>—schedule 5 of that Act; or</txt></block></li><li id="sec.4-frag-sec.16ZN-ssec.3-def.bodycorporatemanager-para1.e" guid="_245e14d1-3290-41a6-b877-1bc7672bfc76" provision.type="other"><no>(e)</no><block><txt break.before="0">if the building is subject to the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1985-079" target.version.series="ea0bc530-b369-4273-a723-35a9b5f30fba"><name emphasis="yes">Sanctuary Cove Resort Act 1985</name></legref>—schedule 9 of that Act; or</txt></block></li><li id="sec.4-frag-sec.16ZN-ssec.3-def.bodycorporatemanager-para1.f" guid="_c63c4eaf-2a69-4126-8460-6cd3379e25b3" provision.type="other"><no>(f)</no><block><txt break.before="0">if the building is subject to the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1989-037" target.version.series="ed5b9d32-54b5-46f1-a027-ce415156ab04"><name emphasis="yes">South Bank Corporation Act 1989</name></legref>—schedule 4, section 7 of that Act.</txt></block></li></list></definition></deflist></block></subclause></clause></fragment></block></clause><clause id="sec.5" guid="_82561a3f-fadd-4a85-b75d-9b80fe280c22" affected.by.uncommenced="0" spent.amends="0" provision.type="amend"><no>5</no><heading id="sec.5-he" guid="_a87a9599-ef04-4cc7-8435-c2ed7c0938ad">Insertion of new <legref refid="sec.16ZP" check="invalid" jurisd="QLD" type="act">s&#160;16ZP</legref></heading><block><txt break.before="1">After <legref refid="sec.16ZO" check="invalid" jurisd="QLD" type="act">section&#160;16ZO</legref>—</txt><txt break.before="1"><i>insert—</i></txt><fragment format="fromcontext" auto.number.type="manual" style="indent"><clause id="sec.5-frag-sec.16ZP" guid="_e44f51fe-886f-4499-8e53-fe8af08f0dc6" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16ZP </no><heading id="sec.5-frag-sec.16ZP-he" guid="_feef4089-6180-470e-9ba7-f7f76755c4ea">When owner not required to comply with part</heading><block><txt break.before="1">An owner is not required to comply with a provision of this part in relation to the owner’s private building if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-sec.16ZP-para1.a" guid="_617f1858-7b9e-476d-8b64-081e7a04ddd5" provision.type="other"><no>(a)</no><block><txt break.before="0">the building is owned by the owner and at least 1 other owner (<defterm id="sec.5-frag-sec.16ZP-def.anotherowner" guid="_1f10549b-159e-4638-b38f-d848f30de371" type="definition">another owner</defterm>); and</txt></block></li><li id="sec.5-frag-sec.16ZP-para1.b" guid="_14a159c1-a6f0-4975-a0b1-c19f04803d8d" provision.type="other"><no>(b)</no><block><txt break.before="0">another owner has complied with the provision in relation to the building.</txt></block></li></list></block></clause></fragment></block></clause></body></wrapper></subordleg>
