guid="_b157e34d-73fc-4324-acdd-500d96fe2ba2" provision.type="other"><no>(a)</no><block><txt break.before="0">a building certifier–level 1; or</txt></block></li><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.buildingindustryprofessional-para1.1-para2.b" guid="_22dafb07-a202-46aa-a819-0511d2af3c88" provision.type="other"><no>(b)</no><block><txt break.before="0">a person who holds a licence of 1 or more of the following classes under the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1991-098" target.version.series="b20a6ba1-d45a-4cf3-a1e3-8370a2766a12"><name emphasis="no">QBCC Act</name></legref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.buildingindustryprofessional-para1.1-para2.b-para3.i" guid="_0322d7db-e6c8-4964-bcdc-fe3c807b196d" provision.type="other"><no>(i)</no><block><txt target.doc.id="act-2002-053" target.version.series="aebc5051-2682-4436-a969-7386f598f9e8"><name emphasis="yes">Architects Act 2002</name></legref>; or</txt></block></li><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.buildingindustryprofessional-para1.1-para2.d" guid="_69cf4581-3786-4479-b96e-2cc1fe74b5ef" provision.type="other"><no>(d)</no><block><txt break.before="0">a practising professional engineer under the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-2002-054" target.version.series="b7cf8aa4-8814-465b-ac45-cfbd6a158a10"><name emphasis="yes">Professional Engineers Act 2002</name></legref> registered in 1 or more of the following areas of engineering—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.buildingindustryprofessional-para1.1-para2.d-para3.i" guid="_2645e282-e20d-4249-851b-3673c463e54b" provision.type="other"><no>(i)</no><block><txt break.before="0">civil engineering;</txt></block></li><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.buildingindustryprofessional-para1.1-para2.d-para3.ii" guid="_e6b09114-da91-45b6-b346-0812217851a4" less than 2,000m<sup>2</sup>, a <defterm guid="_8ff1412a-76b0-4c1f-87e5-12f0565ae404" type="mention">building industry professional</defterm> includes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.buildingindustryprofessional-para1.2-para2.a" guid="_55969fa1-8376-419d-8b26-da67a596d571" provision.type="other"><no>(a)</no><block><txt break.before="0">a building certifier–level 2; and</txt></block></li><li person who holds a licence of 1 or more of the following classes under the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1991-098" target.version.series="b20a6ba1-d45a-4cf3-a1e3-8370a2766a12"><name emphasis="no">QBCC Act</name></legref>—</txt><list number.type="manual" unnumbered.indent="0"><li break.before="1"><defterm id="sec.5-frag-pt.4A-div.1-sec.16O-def.combustiblecladding" guid="_d1e2cb5d-a05c-4815-ab27-268ee4bd06b8" type="definition">combustible cladding</defterm> means cladding that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.combustiblecladding-para1.a" guid="_41cef38f-c2c2-4a06-89b0-096e6c893be6" provision.type="other"><no>(a)</no><block><txt break.before="0">is made of a material of a kind that is not mentioned in the BCA, clause C1.9(e)(i), (ii), (iii), (iv) or (v); or</txt></block></li><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.combustiblecladding-para1.b" guid="_4c66480f-35a8-4475-a272-27f20424b72f" provision.type="other"><no>(b)</no><block><txt break.before="0">is deemed to be combustible under AS 1530.1—1994 (Methods for fire tests on building materials, components and structures, Part 1: Combustibility test for materials), section 3.4(a), (b) or (c).</txt></block></li></list></definition><definition id="sec.5-frag-pt.4A-div.1-sec.16O-def.combustiblecladdingchecklistpart1_" guid="_7135420a-5750-437d-b559-f826a46d153c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-pt.4A-div.1-sec.16O-def.combustiblecladdingchecklistpart3" guid="_d91113ac-d53e-4f94-840b-4a71f81a901e" type="definition">combustible cladding checklist (part 3)</defterm> means the checklist of that name on the online system.</txt></definition><definition id="sec.5-frag-pt.4A-div.1-sec.16O-def.completed_" guid="_f8d8391f-30e9-43c2-9dbe-2a8481e65aee" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-pt.4A-div.1-sec.16O-def.completed" guid="_2dbe1db9-564b-4938-8244-c5fe8cdbeeef" type="definition">completed</defterm>, for a checklist, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.completed-para1.a" guid="_6e098511-7d69-4b20-b233-84829fe044ab" provision.type="other"><no>(a)</no><block><txt break.before="0">the checklist is filled out on the online system by the owner; and</txt></block></li><li id="sec.5-frag-pt.4A-div.1-sec.16O-def.completed-para1.b" guid="_979b3e42-736f-42c0-9b11-b2225c0bb92e" provision.type="other"><no>(b)</no><block><txt break.before="0">the filled-out checklist is—</txt><list number.type="manual" unnumbered.indent="0"><li section 16Q for the owner’s private building.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-pt.4A-div.2-sdiv.2-sec.16S-ssec.2" guid="_bc297e2c-ce05-4235-95b0-683c1a7490d1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, this subdivision does not apply to an owner in relation to a private building if, before the provision.type="other"><no>(c)</no><block><txt break.before="0">a QBCC investigator—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-pt.4A-div.2-sdiv.3-sec.16V-para1.c-para2.i" guid="_9238ef0a-ca60-42ae-b1b5-2e2925e4fbd8" provision.type="other"><no>(i)</no><block><txt break.before="0">reasonably suspects the completed combustible cladding checklist (part 2) for an owner’s private building is false or misleading in a material particular; and</txt></block></li><li id="sec.5-frag-pt.4A-div.2-sdiv.3-sec.16V-para1.c-para2.ii" guid="_23c05d45-a6b3-4f2e-8dc4-ed80df550018" provision.type="other"><no>(ii)</no><block><txt break.before="0">gives the owner notice of the cladding is assessed to be combustible cladding—include an assessment of the combustibility of the insulation or sarking located behind the indicator panel—also securely attached to a wall, or the internal side of a door, that is adjacent to the panel.</txt></block></li></list></block></subclause><subclause
