P&#38;E Court proceeding and the rules applying in the District Court would provide for the matter in relation to a proceeding in the District Court, the rules applying in the District Court apply for provision.type="other"><no>5</no><heading id="sec.5-he" guid="_5077696a-3146-4d96-afbe-6c1c2423c248">Compliance with rules and orders of the P&#38;E Court</heading><block><txt break.before="1">The P&#38;E Court may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.a" guid="_293381d1-0412-469c-a80c-07c66eb29cf9" provision.type="other"><no>(a)</no><block><txt break.before="0">waive compliance with a provision of these rules if the court considers compliance would be likely to cause injustice, unreasonable expense or inconvenience or otherwise considers waiving compliance appropriate; or</txt></block></li><li id="sec.5-para1.b" guid="_9130af94-db73-45d8-958d-091e822ec42b" provision.type="other"><no>(b)</no><block><txt break.before="0">excuse noncompliance with a provision of these rules; or</txt></block></li><li id="sec.5-para1.c" guid="_e1c3a8d2-5e46-40a2-8fcc-21ca5ffd6d1a" provision.type="other"><no>(c)</no><block><txt break.before="0">impose appropriate sanctions if a party to a P&#38;E Court proceeding does not comply with these rules or an order of the court.</txt><note id="sec.5-para1.c-note" relief sought in the proceeding; and</txt></block></li><li id="sec.9-para1.b" guid="_a0b574c7-50c2-4bd0-875e-a46c2f199cd4" provision.type="other"><no>(b)</no><block><txt break.before="0">the grounds provision.type="other"><no>10</no><heading id="sec.10-he" guid="_f533f9c5-0b94-41bd-bd03-ba460962d67f">Originating process—contact details and address for service of applicant or appellant</heading><subclause id="sec.10-ssec.1" guid="_da55dc98-1139-4fe7-a9cb-b59bcc5ca592" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An applicant or appellant intending to act personally must ensure all of the following details are stated on the originating process before it is filed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_25a82974-1fd0-416b-9e5a-f7a3deb99e80" provision.type="other"><no>(a)</no><block><txt break.before="0">the residential or business address of the applicant or appellant;</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_6cd0098f-5812-4721-8fb0-0ff9fd2a1046" provision.type="other"><no>(b)</no><block><txt break.before="0">if the address stated under paragraph (a) is not in Queensland—an address in Queensland where documents may be served on the applicant or appellant;</txt></block></li><li id="sec.10-ssec.1-para1.c" guid="_6eef43cd-7678-4843-b322-29fcae8d1c0d" provision.type="other"><no>(c)</no><block><txt break.before="0">the telephone number, if any, of the applicant or appellant;</txt></block></li><li id="sec.10-ssec.1-para1.d" guid="_ee4f35e5-0de8-46e2-9c44-f41082fea160" provision.type="other"><no>(d)</no><block><txt break.before="0">if the applicant or appellant does not have a telephone number—a break.before="0">the email address, if any, of the applicant or appellant;</txt></block></li><li id="sec.10-ssec.1-para1.f" guid="_2c4d703e-a9cb-471b-98a2-9a9129fcbaf1" provision.type="other"><no>(f)</no><block><txt break.before="0">the fax number, if any, of the applicant or appellant.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.2" guid="_fd1a7b0d-be4b-4702-999b-875ce6ad39a1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A lawyer or agent acting for an applicant or appellant must ensure all of the following details are stated on the originating process before it is filed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.a" guid="_136a7013-790f-4ed9-8a83-f6eb78458f7a" provision.type="other"><no>(a)</no><block><txt break.before="0">the residential or business address of the applicant or appellant;</txt></block></li><li id="sec.10-ssec.2-para1.b" guid="_589a37f5-9ce5-4ba4-beae-e92d387549a2" provision.type="other"><no>(b)</no><block><txt break.before="0">the name of the lawyer or agent and, if the lawyer or agent practises in a firm, the name of the firm;</txt></block></li><li id="sec.10-ssec.2-para1.c" guid="_2bd43e63-55d3-49cb-b09f-861c69c97688" provision.type="other"><no>(c)</no><block><txt break.before="0">the address of the place of business of the lawyer or agent;</txt></block></li><li id="sec.10-ssec.2-para1.d" guid="_24c87dc1-aefc-4ec5-93b1-43c9264303ab" provision.type="other"><no>(d)</no><block><txt break.before="0">if the address stated under paragraph (c) is not the applicant’s or appellant’s address for service or is not an address in Queensland—an address for service in Queensland including, for example, an address approved by the P&#38;E Court as the address for service;</txt></block></li><li id="sec.10-ssec.2-para1.e" guid="_839ea417-d74b-4642-a9ab-11210b3330ca" provision.type="other"><no>(e)</no><block><txt break.before="0">the telephone number of the lawyer or agent;</txt></block></li><li id="sec.10-ssec.2-para1.f" guid="_3bb28d5f-a0e8-4260-a273-b7f88948a030" provision.type="other"><no>(f)</no><block><txt break.before="0">the email address of the lawyer or agent;</txt></block></li><li id="sec.10-ssec.2-para1.g" guid="_ca6a3b2b-7d3f-426d-805f-80d434ec19d2" provision.type="other"><no>(g)</no><block><txt break.before="0">the fax number, if any, of the lawyer or agent.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.3" guid="_91350bda-0250-406a-8fd5-7a59a5ba0e51" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the lawyer or agent, or the lawyer’s or agent’s firm, is a member of an approved document exchange, the lawyer or agent may include the document exchange address with the details required under subrule (2).</txt></block></subclause><subclause id="sec.10-ssec.4" guid="_e3e34682-6f50-45fc-bd05-24c18afc2010" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Notice of any change in an applicant’s or appellant’s address for service must be filed and served on each other party to the P&#38;E Court proceeding.</txt></block></subclause><subclause id="sec.10-ssec.5" guid="_1290db14-2da3-48dd-bb2e-3bfdf596f62d" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The <defterm id="sec.10-def.addressforservice" guid="_ded07c5a-afae-4a94-8f90-d233b0f67041" type="definition">address for service</defterm> of an applicant or appellant is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.5-para1.a" guid="_fc608508-4421-481f-b019-276bcf54ed6f" provision.type="other"><no>(a)</no><block><txt break.before="0">for an applicant or appellant acting personally—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.5-para1.a-para2.i" guid="_57581e3e-f6e2-4661-b185-47fb15130783" provision.type="other"><no>(i)</no><block><txt break.before="0">if the applicant or appellant is required to state an address under subrule (1)(b)—that address; or</txt></block></li><li id="sec.10-ssec.5-para1.a-para2.ii" guid="_0d7bbb7c-cbfb-43ff-877a-86869037d523" provision.type="other"><no>(ii)</no><block><txt type="definition">approved document exchange</defterm> means a document exchange approved under the <legref jurisd="QLD" type="subordleg" check="valid" target.doc.id="sl-1999-0111" target.version.series="a4c6031c-5851-4957-a8e9-46b6b54892a3"><name emphasis="yes">Uniform Civil Procedure Rules 1999</name></legref>, rule 102.</txt></definition></deflist></block></subclause></clause><clause id="sec.11" guid="_5fd27dc3-717e-4d2f-9b7e-2b42f20e972e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_983dec92-8149-4d58-a9b1-550c7c0f914a">Originating process must be signed</heading><block><txt break.before="1">The applicant or appellant, or the applicant’s or appellant’s lawyer or agent, must sign the originating process.</txt></block></clause><clause id="sec.12" guid="_cd15cec5-c620-4230-8648-bc3de4b342d6" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_94d9b3a6-20fb-479d-9abd-a3df937cf6d4">Originating application must be served on other parties</heading><block><txt break.before="1">Unless the P&#38;E Court otherwise orders under rule 19, an applicant must, within 10 business days after filing the originating application, serve a copy provision.type="other"><no>(1)</no><block><txt break.before="0">A P&#38;E Court proceeding must be heard in the P&#38;E Court sitting at the place where the originating process for the proceeding is filed (the <defterm id="sec.18-def.firstplace" guid="_4591a6fe-e2ad-456c-9700-22da2d182449" type="definition">first place</defterm>).</txt></block></subclause><subclause id="sec.18-ssec.2" guid="_09d904d1-75d1-48e6-a7a8-f3fca9bc326e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, the P&#38;E Court proceeding, or part of it, may be id="sec.20-ssec.1-para1.a" guid="_3d405a44-a6d8-4134-8468-d6a2f5ca2cde" provision.type="other"><no>(a)</no><block><txt break.before="0">at any time; or</txt></block></li><li id="sec.20-ssec.1-para1.b" guid="_246fbb80-5cbb-49e9-938a-ca25370ffb7b" provision.type="other"><no>(b)</no><block><txt break.before="0">on application by an active party to the proceeding.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.2" guid="_941e5755-fdd5-4134-9038-c8d370c0c173" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An active party to a P&#38;E Court proceeding may, at any time, apply to the P&#38;E Court for an order or directions about the proceeding.</txt></block></subclause><subclause id="sec.20-ssec.3" guid="_68624a9c-b8ca-4886-9128-c8575a700c7b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, the active party to a P&#38;E Court proceeding with the onus in the proceeding must, as soon as practicable, but within 3 months after the applicant or appellant files the originating process for the proceeding, apply to the P&#38;E Court for an order or directions about the proceeding.</txt></block></subclause><subclause id="sec.20-ssec.4" proceeding at a preliminary stage of the proceeding;</txt></block></li><li id="sec.20-ssec.5-para1.c" guid="_ee9ff4d5-2b49-44c5-9f47-0938ae46d842" provision.type="other"><no>(c)</no><block><txt break.before="0">an order about the conduct of the proceeding or directions about a procedural matter, including an order or directions about 1 or more of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.5-para1.c-para2.i" guid="_a31ccf18-fc5c-4a57-ad1a-1a052df23dbd" provision.type="other"><no>(i)</no><block><txt break.before="0">identifying matters as an issue in dispute in the proceeding;</txt></block></li><li id="sec.20-ssec.5-para1.c-para2.ii" guid="_e4798870-7efa-4a6f-9399-0622bf042183" provision.type="other"><no>(ii)</no><block><txt break.before="0">the content and performance of a dispute resolution plan for the proceeding;</txt></block></li><li id="sec.20-ssec.5-para1.c-para2.iii" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_15821c51-fbe2-42bb-ac43-690c3796f93e">Copy of draft order or directions must be served</heading><subclause id="sec.21-ssec.1" guid="_1245acf0-319f-4af3-8552-fe222d09cb37" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If an active party to a P&#38;E Court proceeding (the <defterm id="sec.21-def.relevantparty" guid="_17a67f8c-742e-4517-9614-de732ae31f8b" type="definition">relevant party</defterm>) applies, under rule 20, for an order or directions about the proceeding, the relevant party must give the other active parties to the application a copy of a draft of the order or directions the relevant party is seeking (the <defterm id="sec.21-def.draftorder" guid="_a01e2f1c-457e-4a9d-bcb4-c03e21e10eb0" type="definition">draft order</defterm>) not later than 2 days before the day the application is to be
