spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_3352c446-5355-488c-8ad6-ae9df2ca8dd1">School survey data and associated documents</heading><subclause id="sec.5-ssec.1" guid="_d8f24940-2b6d-4356-8582-b1040dc0f702" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A school must keep school survey data for the school, and associated documents—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_f11ec925-1e61-4e85-99cb-10ccfd79e8c5" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for at least 5 years after the day to which the data relates; and</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_5fcd3ce3-55ed-47b5-8cbc-4458ed7e4dfd" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">in a way that ensures the integrity and security of the data and documents.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_e2637720-c0d5-4471-8b0c-7c283126e5bd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For a student mentioned in <intref refid="sec.29" target.guid="_6d324161-59a7-4a56-b2c0-776d884d4a54" check="valid">section&#160;29</intref><intref refid="sec.29-ssec.3" target.guid="_d7c5d54d-e693-4e86-bb95-f1afe3187182" check="valid">(3)</intref> or <intref refid="sec.30" target.guid="_0216ce6f-af26-43be-8795-0c9772fa8ac4" check="valid">30</intref><intref refid="sec.30-ssec.3" target.guid="_275d6dfe-07c9-4826-a4be-9dec2ec58534" check="valid">(3)</intref>, a school must keep a record of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_d2794cac-a4f3-4eb2-9206-0a5c1a8c2e0d" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the reason for the student’s absence from the school; and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_3c70f306-f8d2-43fe-9245-65fa6858d3b5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">why the student’s absence was considered to be for a reason beyond the control of a person mentioned in <intref refid="sec.29" target.guid="_6d324161-59a7-4a56-b2c0-776d884d4a54" check="valid">section&#160;29</intref><intref refid="sec.29-ssec.3" target.guid="_d7c5d54d-e693-4e86-bb95-f1afe3187182" check="valid">(3)</intref><intref refid="sec.29-ssec.3-para1.c" target.guid="_f766ab27-3a2d-4010-98bb-2c0304d675ad" check="valid">(c)</intref><intref refid="sec.29-ssec.3-para1.c-para2.i" target.guid="_e708109a-a494-449b-b868-421c36984001" check="valid">(i)</intref> or <intref refid="sec.29-ssec.3-para1.c-para2.ii" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-ssec.3-def.associateddocument_" guid="_936a604c-4ad3-43f3-90f2-d8f98bde8875" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.3-def.associateddocument" guid="_44d5bf1e-5e4b-4edd-8f5d-bd310ecacfaf" type="definition">associated document</defterm> means a document that records or includes a detail about a student mentioned in <intref refid="sec.27" target.guid="_0589f58b-ea9d-4fa4-b68a-889c61743460" check="valid">section&#160;27</intref>, <intref refid="sec.29" target.guid="_6d324161-59a7-4a56-b2c0-776d884d4a54" check="valid">29</intref> or <intref refid="sec.30" target.guid="_0216ce6f-af26-43be-8795-0c9772fa8ac4" check="valid">30</intref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.6" guid="_0673edc2-b155-45d9-b838-00145b903190" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_51df80f1-6c9d-4233-9649-343fa9e9844f">Governance</heading><subclause id="sec.6-ssec.1" guid="_037bbf02-53ed-4f43-ba84-08f7e7dde46d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A school’s governing body must have a document that outlines the organisational structure for the governance of the school, and includes the following details—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_97d39e25-3590-48be-9d8e-e37a166075dd" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the key functions and responsibilities of any entity that supports the governing body in the governance of the school;</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_40521932-84ca-45fa-bd80-2b712f83a984" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the reporting arrangements—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.b-para2.i" guid="_8627663c-c3c0-4a8b-bb84-9812db1b39dd" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">within the governing body; and</txt></block></li><li id="sec.6-ssec.1-para1.b-para2.ii" guid="_d89f17d2-5247-49e7-9a27-f3d3418ac66d" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">between the governing body and any entity that supports the governing body in the governance of the school.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_1ddc6576-a01f-45bb-86a7-e39256597526" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The organisational structure must be designed to ensure the effective, transparent and accountable governance of the school.</txt></block></subclause><subclause id="sec.6-ssec.3" guid="_1a65c124-11ba-4dd2-a406-25d67d352bba" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The governing body must, if asked by the board, give a copy of the document mentioned in <intref refid="sec.6-ssec.1" target.guid="_037bbf02-53ed-4f43-ba84-08f7e7dde46d" check="valid">subsection&#160;(1)</intref> to the board.</txt></block></subclause></clause><clause id="sec.7" guid="_375523d6-808b-44f0-a4ce-32ee39555eae" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_277a4e34-b8ed-4f48-8f04-43bfad733f32">Complaints procedure</heading><subclause id="sec.7-ssec.1" guid="_76c43af8-a6a7-4324-a943-20e41eeb40be" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A school must have, and implement, written processes about receiving, assessing, investigating and otherwise dealing with complaints made by its staff, students or a student’s parent or guardian.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_a180831f-f3ae-4b01-935f-c5a8907e1451" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The processes must include principles of procedural fairness, including, for example, the right of interested parties to the complaint to be heard.</txt></block></subclause><subclause id="sec.7-ssec.3" guid="_6fa06ada-cadb-40db-be3a-27526337787c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The school’s governing body must ensure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.3-para1.a" guid="_4f3e63ed-29d2-41ad-b330-9e695f4ade76" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">staff, students, parents and guardians are made aware of the processes; and</txt></block></li><li id="sec.7-ssec.3-para1.b" guid="_a9290674-ffac-4bfb-819b-03302cbef806" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the processes are readily accessible by staff, students, parents and guardians.</txt></block></li></list></block></subclause></clause></division><division id="pt.2-div.3" guid="_14ec1784-28e5-4cf4-992e-84c70f91773d" affected.by.uncommenced="0"><no>Division 3</no><heading id="pt.2-div.3-he" guid="_0fa18de4-a2a9-4fed-aa94-4c0716557a56">Financial viability</heading><clause id="sec.8" guid="_8544772f-1c2e-4105-b3cc-b031746fcc30" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_ad39324a-3144-4323-a714-dc4ce9e28ef9">Financial viability</heading><subclause id="sec.8-ssec.1" guid="_6d65d026-bc31-4577-8c02-299b28cd21a5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A school must have access to adequate financial resources for its viable operation.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_bf1a65b9-e442-493e-a916-863ee9d4b7c9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A school must keep records of its financial transactions for at least 5 years after the transactions are entered into.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_c44b1f59-6773-41cb-b161-8328e1aa888a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The school’s governing body must, if asked by the board, give a copy of the records mentioned in <intref refid="sec.8-ssec.2" target.guid="_bf1a65b9-e442-493e-a916-863ee9d4b7c9" check="valid">subsection&#160;(2)</intref> to the board.</txt></block></subclause></clause></division><division id="pt.2-div.4" guid="_2dbc111c-eeda-4dd2-80db-a6c68812db4e" affected.by.uncommenced="0"><no>Division 4</no><heading id="pt.2-div.4-he" guid="_64fe8ebe-5754-4d85-9d10-675aabfc58fb">Educational program</heading><clause id="sec.9" guid="_41be0709-6d89-4bee-a836-8f975774f7bf" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_ea483406-24e0-4fdc-834c-ce6c6359ff3a">Educational program</heading><subclause id="sec.9-ssec.1" guid="_fbdbf0b6-b626-4cd3-b78a-113898f09a7d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A school must have a written educational program that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_f9ea90b2-6940-4eac-af08-44be60ed1347" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">has regard to the ages, abilities, aptitudes and development of the school’s students; and</txt></block></li><li id="sec.9-ssec.1-para1.b" guid="_4ca80594-9042-45e8-92a6-ef2aa719e5d4" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">promotes continuity in the learning experiences of the students; and</txt></block></li><li id="sec.9-ssec.1-para1.c" guid="_91314ad3-6402-41f1-93af-8c6ddbee82b1" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">provides a breadth, depth and balance of learning appropriate to students’ phases of development and across an appropriate range of learning areas; and</txt></block></li><li id="sec.9-ssec.1-para1.d" guid="_8de6b33c-9102-4946-b668-3041e8bfadc9" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">is responsive to the needs of the school’s students; and</txt></block></li><li id="sec.9-ssec.1-para1.e" guid="_ce75f6c7-483f-4946-bc59-3526db662044" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">is consistent with the Alice Springs (Mparntwe) Education Declaration.</txt><note id="sec.9-ssec.1-para1.e-note" guid="_79c2f155-ef1f-49f7-9407-2d21b2d9c186" type="example"><heading id="sec.9-ssec.1-para1.e-note-he" guid="_44b7119b-f0e0-4920-bf10-591f5409c6e8">Note—</heading><block><txt break.before="1">The declaration can be viewed on the COAG Education Council’s website.</txt></block></note></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_75305374-4fc4-4ea7-8b2e-67dc4652be8d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If a school is accredited to provide education to students from preparatory year to year 10 and offers a learning area included in the Australian curriculum, the school must implement 1 or both of the following for the learning area—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_9e386162-7286-44f5-843e-99c229670d4f" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the Australian curriculum;</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_7ffdf7bd-f71d-49c8-92c7-a17fd9ba9457" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a curriculum recognised by ACARA.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_6702d3b4-d86d-4dcb-b8b8-f14767631982" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a school offers a subject in addition to a learning area included in a curriculum mentioned in <intref refid="sec.9-ssec.2" target.guid="_75305374-4fc4-4ea7-8b2e-67dc4652be8d" check="valid">subsection&#160;(2)</intref>, and a syllabus for the subject has been developed, purchased or revised by the Queensland Curriculum Assessment Authority under the <legref jurisd="QLD" type="act" target.doc.id="act-2014-003" target.version.series="77394e5e-c836-49c3-beba-23e067dceeac" check="valid"><name emphasis="yes">Education (Queensland Curriculum and Assessment Authority) Act 2014</name></legref>, <legref jurisd="QLD" type="act" refid="sec.10" target.doc.id="act-2014-003" target.version.series="77394e5e-c836-49c3-beba-23e067dceeac" target.guid="_2170a929-8fd8-431f-a088-acaaea7a0c21" check="valid">section&#160;10</legref>, the school must implement the syllabus for the subject.</txt></block></subclause><subclause id="sec.9-ssec.4" guid="_6e3b1c61-7190-4444-b21f-e23e36593656" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A school accredited to provide senior secondary education must implement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.4-para1.a" guid="_79d78c2f-b55d-40ea-ae73-17e27bca22cd" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the school is offering a subject for which there is a syllabus developed, purchased or revised by the Queensland Curriculum and Assessment Authority under the <legref jurisd="QLD" type="act" target.doc.id="act-2014-003" target.version.series="77394e5e-c836-49c3-beba-23e067dceeac" check="valid"><name emphasis="yes">Education (Queensland Curriculum and Assessment Authority) Act 2014</name></legref>, <legref jurisd="QLD" type="act" refid="sec.9" target.doc.id="act-2014-003" target.version.series="77394e5e-c836-49c3-beba-23e067dceeac" target.guid="_3ce88ceb-4fdc-4d59-b2fc-4b0adce1d815" check="valid">section&#160;9</legref>—the syllabus; or</txt></block></li><li id="sec.9-ssec.4-para1.b" guid="_eb104118-4d9d-4ef5-8865-2b838a9a98b5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a program or syllabus endorsed by the Queensland Curriculum and Assessment Authority as appropriate for senior secondary education; or</txt></block></li><li id="sec.9-ssec.4-para1.c" guid="_51e58425-b8af-453a-8a86-59be5431ff52" service that is appropriate to the school’s distance education students achieving learning standards under the school’s educational program.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_dd6e3a55-8f8b-42b7-8bcd-3329f02b6e65" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The standard of service must deal with the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a" guid="_b3846748-1d91-4ab5-9e70-bf43d5702f76" provision.type="other" break.before="0">the regular tracking and assessment of work submitted by the students to their teachers;</txt></block></li><li id="sec.12-ssec.2-para1.d" guid="_324dfc08-e155-44d6-af9c-ca27d84d1eb8" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the regular engagement between students and teachers;</txt></block></li><li id="sec.12-ssec.2-para1.e" provision.type="other"><no>(3)</no><block><txt break.before="0">The school’s governing body must be able to demonstrate how the school is meeting the standard of service.</txt></block></subclause><subclause id="sec.12-ssec.4" guid="_a2b085dd-2646-4f00-b76a-7b6bc1b85a09" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.12-ssec.4-def.distanceeducationschool_" guid="_5e874d73-5d58-4af1-af4b-4a1eaca3d1b6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.12-ssec.4-def.distanceeducationschool" guid="_46ab695a-bc44-417a-89b3-145a4603976d" type="definition">distance education school</defterm> means a school that uses the distance education mode of delivery of education.</txt></definition></deflist></block></subclause></clause><clause id="sec.13" guid="_56416725-7a34-458f-9896-5606359c2e22" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_13ef2c9b-dd70-48db-a682-a0060fa353ab">Special assistance schools</heading><subclause id="sec.13-ssec.1" guid="_41c8a1bd-1974-4c8b-8ba4-122ee9814ab9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A special assistance school’s educational program must promote continuous engagement by the school’s relevant students in primary education or secondary education.</txt></block></subclause><subclause id="sec.13-ssec.2" guid="_2b8b56ec-ce35-4eb3-826d-f7186305f532" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, the school must have a written standard of service, appropriate to the school’s relevant students achieving learning standards under the educational program.</txt></block></subclause><subclause id="sec.13-ssec.3" guid="_c29f57de-bb9a-481f-b4c5-39b141049ed9" affected.by.uncommenced="0" of work submitted by the relevant students to their teachers;</txt></block></li><li id="sec.13-ssec.3-para1.b" guid="_bad0214d-827c-47a7-bbbd-d7ba8cb2738e" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the regular monitoring of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.3-para1.b-para2.i" guid="_42bbe8db-c67f-460d-99a2-05ae60f6dd1c" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">attendance by the relevant students at an accredited special assistance site for the school; and</txt></block></li><li id="sec.13-ssec.3-para1.b-para2.ii" guid="_ced400f1-3e34-4f38-bced-ae4ca8d0b6fa" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the relevant students’ participation in the educational program; and</txt></block></li><li id="sec.13-ssec.3-para1.b-para2.iii" guid="_3aa2c68f-e0b5-482c-907a-824f8ec2cea8" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the relevant students’ achievement of the learning standards under the educational program;</txt></block></li></list></block></li><li id="sec.13-ssec.3-para1.c" guid="_8b261de2-e47b-4818-b2bf-7a58b37b3558" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">strategies for engaging the relevant students, and keeping the relevant students engaged, in primary education or secondary provision.type="other"><no>(4)</no><block><txt break.before="0">The school’s governing body must be able to demonstrate how the school is meeting the standard of affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.13-ssec.6-def.relevantstudents_" id="sec.14-para1.a" guid="_1e23b3c5-8985-43bd-88e6-3dc1870b2aa9" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">ensure approvals are not given, or purportedly given, under the <legref jurisd="QLD" type="act" target.doc.id="act-2006-039" target.version.series="1e1a0ed5-f492-44f9-ba49-f9194ef5fefb" check="valid"><name emphasis="yes">Education (General Provisions) Act 2006</name></legref>, <legref jurisd="QLD" type="act" refid="sec.182" target.doc.id="act-2006-039" target.version.series="1e1a0ed5-f492-44f9-ba49-f9194ef5fefb" target.guid="_3223467f-4b30-48f4-9aff-687655591ecb" check="valid">section&#160;182</legref>, other than in compliance with that section; and</txt></block></li><li id="sec.14-para1.b" id="sec.15-para1.b" guid="_c11ce7ef-9ec6-4323-8bfc-548e27596f7e" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the <legref jurisd="QLD" type="act" break.before="0">how the school will respond to harm, or allegations of harm, to students under 18 years; and</txt></block></li><li id="sec.16-ssec.1-para1.b" guid="_0e3751d5-b28c-4e18-90a2-6f8db7814d92" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the appropriate conduct of the school’s staff and students.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.2" guid="_43aa668b-f5a7-4c40-9c7e-eec99e567cc3" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting <intref refid="sec.16-ssec.1" target.guid="_c5cb6d45-34a2-42b1-bfa7-978b5409255d" check="valid">subsection&#160;(1)</intref>, the processes must include the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.a" guid="_310948f5-eb95-4e1e-b29e-f227fe1f08df" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a process for the reporting by a student to a stated staff member of conduct of another staff member that the student considers is inappropriate;</txt></block></li><li id="sec.16-ssec.2-para1.b" guid="_b2ebcec6-9010-42e4-b437-572090ae5ec9" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a process for how the information reported to the stated staff member must be dealt with by the stated staff member;</txt></block></li><li id="sec.16-ssec.2-para1.c" guid="_585f3139-3f4b-4fd7-9f63-7e60226e8dd5" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">a target.version.series="1e1a0ed5-f492-44f9-ba49-f9194ef5fefb" target.guid="_7410c9ad-0d39-464e-bde0-611f584a243a" check="valid">section&#160;366A</legref>;</txt></block></li></list></block></li><li id="sec.16-ssec.2-para1.d" guid="_ffdaf45b-397a-4d45-b0ad-2206d3864191" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">a process for reporting a reportable suspicion under the <legref jurisd="QLD" type="act" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" check="valid"><name emphasis="yes">Child Protection Act 1999</name></legref>, <legref jurisd="QLD" type="act" refid="sec.13E" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_9e3c3c52-bb72-4d79-be6a-6106ff844ed1" check="valid">section&#160;13E</legref>.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.3" guid="_0bef4f5a-7e5e-48b5-80a5-aab9ec50182a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For the process mentioned in <intref refid="sec.16-ssec.2" target.guid="_43aa668b-f5a7-4c40-9c7e-eec99e567cc3" check="valid">subsection&#160;(2)</intref><intref refid="sec.16-ssec.2-para1.a" target.guid="_310948f5-eb95-4e1e-b29e-f227fe1f08df" check="valid">(a)</intref>, there must be stated at least 2 staff members to whom a student may report the conduct.</txt></block></subclause><subclause id="sec.16-ssec.4" guid="_d47f4e41-3fd6-491b-a742-cf5638e50750" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The school’s governing body must ensure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.4-para1.a" guid="_3ce21bba-dfc5-41ac-8133-733ab1fc4cbe" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the school’s staff and students, and students’ parents and guardians, are made aware of the processes; and</txt></block></li><li id="sec.16-ssec.4-para1.b" guid="_7d779b10-3916-4b37-9a47-e1fcc2f9fe1d" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the processes are readily accessible by staff, students, parents and guardians; and</txt></block></li><li id="sec.16-ssec.4-para1.c" guid="_f8f640e1-a4bc-4666-a369-2e185b610b4d" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">staff are trained annually in implementing the processes; and</txt></block></li><li id="sec.16-ssec.4-para1.d" guid="_2692e0bf-8f5f-45c8-83c1-0d21bf9fb776" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the school is implementing the processes.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.5" guid="_8630c3e4-4eee-4d68-afb5-ee906fb390ea" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The school must have a written complaints procedure to address allegations of non-compliance with the processes.</txt></block></subclause><subclause id="sec.16-ssec.6" guid="_79f3fba6-be55-4758-97ca-c125c556f3ec" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The complaints procedure may form part of any other written procedure of the school for dealing with complaints.</txt></block></subclause><subclause id="sec.16-ssec.7" guid="_4e0cc784-f0ab-4cc5-8f61-983450f70b7c" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt provision.type="other"><no>(1)</no><block><txt break.before="0">A school must provide a sufficient number, and appropriate types, of staff necessary for the effective delivery of the school’s educational program.</txt></block></subclause><subclause id="sec.17-ssec.2" guid="_85f7c6b4-8874-4a5b-b606-17008c9595af" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting <intref refid="sec.17-ssec.1" target.guid="_90b61a52-3c74-4fec-b68b-e20b8bcaf4f0" check="valid">subsection&#160;(1)</intref>, a school must comply with the <legref guid="_4dcd5652-9112-450f-aecc-e8f02289e271" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A school must, in relation to the school and its buildings, comply with the requirements of any Act or other law relating to land use, building, and workplace health and safety.</txt></block></subclause><subclause id="sec.18-ssec.2" guid="_57aacf67-acf0-4236-a987-f6a5fbb3e8c5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If a school provides boarding facilities, the school must have the necessary accommodation and associated facilities to ensure the health, safety and welfare of students while boarding.</txt></block></subclause></clause><clause id="sec.19" guid="_0c646370-9e8e-4122-80f8-681f03001ba3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sec.19-he" break.before="1">A school must have a demonstrable, systematic approach about improvement processes for the school, dealing with the following—</txt><list number.type="manual" strategies relevant to the processes and setting priorities for achieving the strategies;</txt></block></li><li id="sec.20-para1.b" guid="_1c65236e-09e2-4463-88b3-839e7c816ff3" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">how the strategies are to be achieved;</txt></block></li><li id="sec.20-para1.c" guid="_7109e3a3-9473-438a-8ee5-d5687602db5f" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">regular monitoring of the achievement of the strategies;</txt></block></li><li id="sec.20-para1.d" guid="_b9d899c8-e333-4349-bcdc-ec9ce32745d2" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">annual reporting about the achievement of the strategies to the school’s community, including staff, students, parents and guardians.</txt></block></li></list></block></clause></division></part><part id="pt.3" guid="_9daad3da-6a60-463a-875f-03c1daabb74a" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_0b65b078-7f5b-45e9-9f45-585c176f51f2">Temporary sites</heading><clause id="sec.21" guid="_e6eb9b95-e863-4387-a9fb-2a539f6607d2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_c97d9089-5def-4f41-b83a-164f1192c2c9">Prescribed temporary site criteria—<legref check="valid">(2)</intref> must deal with the regular monitoring of attendance by the school’s students at a temporary site for the school.</txt></block></clause><clause id="sec.23" guid="_55f80724-950a-443d-8085-218366afef38" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>23</no><heading id="sec.23-he" guid="_16b8f714-af6c-4fdb-8900-dd5715b9c193">Application of <intref refid="pt.2" target.guid="_d0697dce-90ab-49e8-bb4e-d28b7e73f1da" check="valid">pt&#160;2</intref>, <intref refid="pt.2-div.6" target.guid="_a49001fb-6ff3-4590-ac6c-5632995e326d" check="valid">div&#160;6</intref></heading><block><txt break.before="1"><intref refid="pt.2" target.guid="_d0697dce-90ab-49e8-bb4e-d28b7e73f1da" relation to each temporary site at which the school provides special assistance.</txt></block></clause><clause id="sec.24" guid="_cb5a0e50-9487-4ae0-9fc6-ae216264c25f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>24</no><heading id="sec.24-he" guid="_6e01ac48-b5c5-45c9-a5aa-f9687b6bb97e">Limitation of period of special assistance at temporary site</heading><subclause id="sec.24-ssec.1" guid="_09e57dcd-7cf2-42cd-b2c5-13b9876d9fa7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <legref jurisd="QLD" type="act" refid="sec.49" target.doc.id="act-2017-024" target.version.series="ded642a2-afee-4666-ac2b-44c8da370746" target.guid="_0f9ce334-f8bc-4586-8d16-2481e27856ce" check="valid">section&#160;49</legref><legref jurisd="QLD" type="act" refid="sec.49-ssec.2" target.doc.id="act-2017-024" target.version.series="ded642a2-afee-4666-ac2b-44c8da370746" provision.type="other"><no>(2)</no><block><txt break.before="0">However, if the school’s governing body makes a site inclusion application for the temporary site before the end of the special assistance period for the site, the school may continue to provide special assistance at the site until the day mentioned in <intref refid="sec.24-ssec.3" target.guid="_67f8348f-1cc0-452c-bf29-fe1171e3b6de" check="valid">subsection&#160;(3)</intref>, <intref refid="sec.24-ssec.4" target.guid="_cccacb35-02ae-4057-a385-32cf3cfba8f9" check="valid">(4)</intref>, <intref refid="sec.24-ssec.5" target.guid="_267d0a5a-61e6-4f4b-86a8-9201c55f9cdb" check="valid">(5)</intref> or <intref refid="sec.24-ssec.6" target.guid="_a2cfd070-8de1-48f1-b268-811e1442a99a" check="valid">(6)</intref>.</txt></block></subclause><subclause id="sec.24-ssec.3" guid="_67f8348f-1cc0-452c-bf29-fe1171e3b6de" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the governing body withdraws the site inclusion application before the application is decided, for <intref refid="sec.24-ssec.2" target.guid="_df700b73-eca5-4505-82ba-9ce38d4d14a0" check="valid">subsection&#160;(2)</intref> the day is the later of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.3-para1.a" guid="_eea5b4d7-af24-4d47-b840-f8ce0b73e2f5" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the day the governing body withdraws the application; or</txt></block></li><li id="sec.24-ssec.3-para1.b" guid="_829e4231-8aad-45cc-a3a1-2ecc1501fec7" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the day the special assistance period for the temporary site ends.</txt></block></li></list></block></subclause><subclause id="sec.24-ssec.4" guid="_cccacb35-02ae-4057-a385-32cf3cfba8f9" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the board decides to refuse, or is taken to have decided to refuse, to grant the school’s site inclusion application and the governing body applies to QCAT for a review of the decision (the <defterm id="sec.24-def.originaldecision" guid="_9f21dc87-2496-43c3-8c23-d51da26f97bb" type="definition">original decision</defterm>), for <intref refid="sec.24-ssec.2" target.guid="_df700b73-eca5-4505-82ba-9ce38d4d14a0" check="valid">subsection&#160;(2)</intref> the day is the earlier of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.4-para1.a" guid="_5e0144d8-3b46-4931-a6d5-2910046cc5ec" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the day QCAT issues a decision in relation to the review of the original decision; or</txt></block></li><li id="sec.24-ssec.4-para1.b" guid="_fbcfd274-aefa-4953-9722-18ad25f8b337" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the day the governing body withdraws the application for review.</txt></block></li></list></block></subclause><subclause id="sec.24-ssec.5" guid="_267d0a5a-61e6-4f4b-86a8-9201c55f9cdb" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the board decides to refuse, or is taken to have decided to refuse, to grant the school’s site inclusion application and <intref refid="sec.24-ssec.4" target.guid="_cccacb35-02ae-4057-a385-32cf3cfba8f9" check="valid">subsection&#160;(4)</intref> does not apply, for <intref refid="sec.24-ssec.2" target.guid="_df700b73-eca5-4505-82ba-9ce38d4d14a0" check="valid">subsection&#160;(2)</intref> the day is the later of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.5-para1.a" guid="_f81f0891-2eee-4955-87e3-51f992d4eeb8" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the day the application period for the original decision ends; or</txt></block></li><li id="sec.24-ssec.5-para1.b" guid="_c9461208-8c98-4fee-8921-a0ce6171daa0" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the day the special assistance period for the temporary site ends.</txt></block></li></list></block></subclause><subclause id="sec.24-ssec.6" guid="_a2cfd070-8de1-48f1-b268-811e1442a99a" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">If <intref refid="sec.24-ssec.3" target.guid="_67f8348f-1cc0-452c-bf29-fe1171e3b6de" check="valid">subsections&#160;(3)</intref>, <intref refid="sec.24-ssec.4" target.guid="_cccacb35-02ae-4057-a385-32cf3cfba8f9" check="valid">(4)</intref> and <intref refid="sec.24-ssec.5" target.guid="_267d0a5a-61e6-4f4b-86a8-9201c55f9cdb" check="valid">(5)</intref> do not apply, for <intref refid="sec.24-ssec.2" target.guid="_df700b73-eca5-4505-82ba-9ce38d4d14a0" check="valid">subsection&#160;(2)</intref> the day is the change day for the application stated in a change notice about the site attribute given to the governing body under <legref jurisd="QLD" type="act" refid="sec.40" target.doc.id="act-2017-024" target.version.series="ded642a2-afee-4666-ac2b-44c8da370746" target.guid="_ad04e89c-e3fe-4dce-8d80-c86cc59f4ed7" check="valid">section&#160;40</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2017-024" target.version.series="ded642a2-afee-4666-ac2b-44c8da370746" check="valid">Act</legref>.</txt></block></subclause><subclause id="sec.24-ssec.7" guid="_54b01b60-6a06-4842-b045-b431c84982b9" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.24-ssec.7-def.applicationperiod_" guid="_f5acb723-0266-4e9b-9e68-3898b2470991" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.24-ssec.7-def.applicationperiod" guid="_6e871095-29b7-410d-8fcd-8c52124b8161" type="definition">application period</defterm>, for an original decision, means the period within which an application for review of the decision must be made under the <legref jurisd="QLD" type="act" target.doc.id="act-2009-023" target.version.series="c51aec25-167d-4389-82a2-012d28089e17" check="valid"><name emphasis="no">QCAT Act</name></legref>.</txt></definition><definition id="sec.24-ssec.7-def.schoolday_" guid="_3dcc8d9b-43ac-4149-b9d8-e2010dfbe140" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.24-ssec.7-def.schoolday" guid="_2ac587f8-3044-46f5-ae64-b0a9241516c7" type="definition">school day</defterm> means any day on which a school is operating as a school.</txt></definition><definition id="sec.24-ssec.7-def.siteattribute_" guid="_288f2cf6-7afb-4b7e-9fcf-30147c0231b9" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.24-ssec.7-def.siteattribute"
