id="sec.2" guid="_ae650e1b-b190-4d88-b05b-7c293829c64e" affected.by.uncommenced="0" spent.amends="0" provision.type="commence"><no>2</no><heading id="sec.2-he" guid="_93b8f607-8661-42aa-9281-b63b7d3f1860">Commencement</heading><block><txt break.before="1">This regulation commences on 1 September 2016.</txt></block></clause><clause id="sec.3" guid="_d0b507ff-a771-44d7-b671-dea7b50878d8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_313e4d0e-a304-477f-b9b5-79317b1cadd4">Definitions</heading><block><txt break.before="1">The dictionary in <intref refid="sch.1" target.guid="_270809b9-dd0f-41eb-8c2e-7067f6afbb53" check="valid">schedule&#160;1</intref> defines particular words used in this regulation.</txt></block></clause></part><part id="pt.2" guid="_2ccf0d57-566f-4372-93fa-233f87be5474" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_8262e055-971c-4f06-a484-fa768190efde">Long service leave</heading><clause id="sec.4" guid="_bfec4302-7f75-4886-a94e-2bef42cdc1ec" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_270f8e7d-b711-4185-b82e-4f20ca59ed21">Who is entitled to long service leave</heading><subclause id="sec.4-ssec.1" guid="_43917b6e-b3ba-40e3-bd38-22384b9fce3b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An employee is entitled to long service leave if the employee completes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.1-para1.a" guid="_7aa97346-268a-4cd3-8637-cc5398e11d09" provision.type="other"><no> (a)</no><block><txt break.before="0">at least 10 years service; or</txt></block></li><li id="sec.4-ssec.1-para1.b" guid="_48109a34-1181-4fd1-a571-21795ef36653" provision.type="other"><no> (b)</no><block><txt break.before="0">at least 5 years service ending when the employee—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.1-para1.b-para2.i" guid="_c642139b-c647-4e7a-91a9-d9b2166abcaf" provision.type="other"><no> (i)</no><block><txt break.before="0">dies; or</txt></block></li><li id="sec.4-ssec.1-para1.b-para2.ii" guid="_eb814954-a693-40d4-8581-dab4de1b0992" provision.type="other"><no> (ii)</no><block><txt break.before="0">resigns on or after reaching 55 years; or</txt></block></li><li id="sec.4-ssec.1-para1.b-para2.iii" guid="_b9178c03-c099-4239-98ef-486e8d28157b" provision.type="other"><no> (iii)</no><block><txt break.before="0">resigns before reaching 55 years because of ill-health.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.4-ssec.2" guid="_5027d7fa-93a3-4136-9b86-10f9d7aa835a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, an employee mentioned in <intref refid="frnt-st" target.guid="_5befadb5-a91a-490d-9a50-4ca8882b87a5" check="valid">subsection&#160;(1)</intref><intref refid="frnt-st" target.guid="_5befadb5-a91a-490d-9a50-4ca8882b87a5" check="valid">(b)</intref><intref refid="frnt-st" target.guid="_5befadb5-a91a-490d-9a50-4ca8882b87a5" check="valid">(iii)</intref> is entitled to long service leave only if the employee gives the company a certificate from a doctor agreed between the employee and the company that states the employee can not continue employment because of ill-health.</txt></block></subclause></clause><clause id="sec.5" guid="_e843554b-11e0-4e9c-965d-ae09776f1770" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_ead0af2f-319d-42fb-96cb-f0feb1a44aa2">How long service leave is calculated</heading><block><txt break.before="1">An employee is entitled to long service leave calculated—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.a" guid="_d1b4ce6d-6c6e-4d07-9350-711767c2e0b8" provision.type="other"><no> (a)</no><block><txt break.before="0">for a full-time employee—at the rate of 1.3 weeks on full pay for each year of service and a proportionate amount for an incomplete year of service; or</txt></block></li><li id="sec.5-para1.b" guid="_a114226b-2fde-4ed6-bc33-5f5df37a7673" provision.type="other"><no> (b)</no><block><txt break.before="0">for a part-time or casual employee—at the rate mentioned in <intref refid="sec.5-para1.a" target.guid="_d1b4ce6d-6c6e-4d07-9350-711767c2e0b8" check="valid">paragraph&#160;(a)</intref> in the proportion that the hours worked by the employee bears to the hours worked by a full-time employee.</txt></block></li></list></block></clause><clause id="sec.6" guid="_2e06aba4-be9c-4faa-b36a-597fabe0a2bd" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_8be8f30b-f6af-4e87-9286-3b4559d6420b">Periods of absence without pay that count as service</heading><block><txt break.before="1">An employee’s period of service does not include a period when the employee is absent without pay, other than—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-para1.a" guid="_e49305d6-b19a-4187-973e-53f640221c47" provision.type="other"><no> (a)</no><block><txt break.before="0">a period during which the employee is receiving compensation under the <legref jurisd="QLD" type="act" target.doc.id="act-2003-027" target.version.series="b6537c36-4a2c-45c5-a2db-fe6d14a74c68" check="valid"><name emphasis="yes">Workers’ Compensation and Rehabilitation Act 2003</name></legref> for an injury, within the meaning of that Act, sustained by the employee; or</txt></block></li><li id="sec.6-para1.b" guid="_835679d8-8d7b-469c-b600-14b9a929ec8c" provision.type="other"><no> (b)</no><block><txt break.before="0">a period of authorised leave of not more than 2 weeks; or</txt></block></li><li id="sec.6-para1.c" guid="_cb15e645-cced-4229-be64-1cfc609a2f08" provision.type="other"><no> (c)</no><block><txt break.before="0">a period of leave that the company has approved as service for this part.</txt></block></li></list></block></clause><clause id="sec.7" guid="_26c47f9a-1eb2-4ff9-898c-72300c19b0bb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_0035a141-1a6c-40bb-b837-3c82d982cd59">Taking long service leave</heading><subclause id="sec.7-ssec.1" guid="_46ee04d9-0d2f-4f6a-9fb7-9a52669ff00e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An employee must apply for long service leave—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_33ea4229-f93b-49c3-8a93-85acbc1c1e97" provision.type="other"><no> (a)</no><block><txt break.before="0">in the form approved by the company; and</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_b2cb60a8-cf71-4162-acc8-a8ad19e5029f" provision.type="other"><no> (b)</no><block><txt break.before="0">at least 1 month before the leave is to be taken, unless the company agrees to accept a later application.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_7ed75779-f44d-4df5-9335-064198631e6e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An employee may take long service leave only when it is mutually convenient to the company and the employee.</txt></block></subclause></clause><clause id="sec.8" guid="_0e1c9346-d4ee-43c5-95a4-ec1f28556dac" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_e7e82c47-41ff-4ba1-a35a-64c77818f7a2">Minimum period of long service leave</heading><block><txt break.before="1">The minimum period of long service leave that an employee may take is 2 weeks.</txt></block></clause><clause id="sec.9" guid="_ad6dc487-1765-4c4a-a586-3f5efea679ea" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_c02f91e8-b82e-44e7-a6fe-cd4c3d775fa6">Public holidays during long service leave</heading><block><txt break.before="1">An employee’s long service leave must be credited for a public holiday that falls while the employee is on long service leave if the employee is usually scheduled to work on the day.</txt></block></clause><clause id="sec.10" guid="_58cbe607-843f-47d1-afa1-7c471626784c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_a3b3d281-0ab0-488d-ab1a-500879386dce">Illness during long service leave</heading><block><txt break.before="1">If an employee is granted sick leave of at least 1 week for an illness or injury that the employee suffers while on long service leave—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a" guid="_3001c059-62dd-490d-89a1-1a6d41074956" provision.type="other"><no> (a)</no><block><txt break.before="0">the employee’s long service leave must be credited for the number of days of the sick leave; and</txt></block></li><li id="sec.10-para1.b" guid="_8ed30889-e05d-4dff-a548-7208b65aa35e" provision.type="other"><no> (b)</no><block><txt break.before="0">the period of long service leave actually taken is not subject to the minimum period requirement under section <intref refid="frnt-st" target.guid="_5befadb5-a91a-490d-9a50-4ca8882b87a5" check="valid">8</intref>.</txt></block></li></list></block></clause><clause id="sec.11" guid="_9876bc31-2fa2-4328-b907-241ba3dada09" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_ae51524b-c9da-49cd-ad17-5597fc0813da">Rate of payment for long service leave</heading><subclause id="sec.11-ssec.1" guid="_c9584692-8c5f-46ec-ad9e-fecd673ea25a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The company must pay an employee for long service leave at—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.1-para1.a" guid="_d974620c-7c19-4954-a635-fd8704b5a868" provision.type="other"><no> (a)</no><block><txt break.before="0">for an employee who is a nominated relief shift worker—the highest of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.1-para1.a-para2.i" guid="_fa6f6fca-fa4b-43fd-8a55-418723159cd6" provision.type="other"><no> (i)</no><block><txt break.before="0">107.5% of the all purpose rate;</txt></block></li><li id="sec.11-ssec.1-para1.a-para2.ii" guid="_6cee7c64-a515-4869-a29f-5abd8add239c" provision.type="other"><no> (ii)</no><block><txt break.before="0">the all purpose rate plus the average percentage loading earned by the employee in the previous year;</txt></block></li><li id="sec.11-ssec.1-para1.a-para2.iii" guid="_14e7e289-ccdc-48d8-8452-a4e39327d001" provision.type="other"><no> (iii)</no><block><txt break.before="0">if the employee has worked 26 or more weeks of continuous shift work immediately before the leave is taken—the Station standard continuous shift roster rate; or</txt></block></li></list></block></li><li id="sec.11-ssec.1-para1.b" guid="_58e6b053-1a16-47b7-a6af-d5456aa1f459" provision.type="other"><no> (b)</no><block><txt break.before="0">for an employee who is a noncontinuous shift worker—the higher of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.1-para1.b-para2.i" guid="_bf69e722-c2a9-4547-9dc6-f377c0b97fb5" provision.type="other"><no> (i)</no><block><txt break.before="0">107.5% of the all purpose rate;</txt></block></li><li id="sec.11-ssec.1-para1.b-para2.ii" guid="_6567b692-f919-4a6e-b9bc-9b5eaa381ed2" provision.type="other"><no> (ii)</no><block><txt break.before="0">the all purpose rate plus the average percentage loading earned by the employee in the previous year; or</txt></block></li></list></block></li><li id="sec.11-ssec.1-para1.c" guid="_8a2e4341-4ed2-4968-a897-230857995ff8" provision.type="other"><no> (c)</no><block><txt break.before="0">for an employee who is a continuous shift worker—the projected roster rate; or</txt></block></li><li id="sec.11-ssec.1-para1.d" guid="_54a0d6c4-2bbe-4bb1-b077-762f2cbb18ef" provision.type="other"><no> (d)</no><block><txt break.before="0">for any other employee—the all purpose rate.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.2" guid="_dacf3f67-39ef-4883-a50f-4fbd2b6f6fd2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.11-ssec.2-def.projectedrosterrate_" guid="_8dfb4c19-3a06-42e9-b746-602b3d55b8ad" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.2-def.projectedrosterrate" guid="_f4216736-cf4e-4947-a561-0c4c0cfc5b33" type="definition">projected roster rate</defterm> means the all purpose rate plus the Station standard loading.</txt></definition><definition id="sec.11-ssec.2-def.Stationstandardcontinuousshiftroster_" guid="_09dffa72-dc78-47fd-b26c-fef3f22ba819" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.2-def.Stationstandardcontinuousshiftroster" guid="_047485de-eca0-4fb2-91b1-0477feb7bb62" type="definition">Station standard continuous shift roster</defterm> means the roster mentioned in <legref jurisd="QLD" type="act" check="invalid">section&#160;6.12.2</legref> of the award.</txt></definition><definition id="sec.11-ssec.2-def.Stationstandardloading_" guid="_77741bff-87d8-473c-9eca-efb992973bdb" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.2-def.Stationstandardloading" guid="_2dfa4ebb-dbe1-48ab-888d-c7493baa872c" type="definition">Station standard loading</defterm> means the average of all shift and weekend penalties (other than overtime) earned from the Station standard continuous shift roster.</txt></definition></deflist></block></subclause></clause><clause id="sec.12" guid="_b9667960-8f3d-445c-a594-7f19ba34beb1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_dd6f92ea-70c5-4362-a7e3-ba09eef8086e">Payment instead of long service leave not taken</heading><subclause id="sec.12-ssec.1" guid="_0827b76b-80c0-4e44-a3ea-5c016c3d68f9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.a" guid="_a526376e-5f1a-4846-92ec-8f13448f0861" provision.type="other"><no> (a)</no><block><txt break.before="0">an employee’s contract of employment with the company ends; or</txt></block></li><li id="sec.12-ssec.1-para1.b" guid="_79796465-bc5a-493f-bbf3-ec6fa7cc6195" provision.type="other"><no> (b)</no><block><txt break.before="0">an employee dies.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.2" guid="_157aa368-6da6-4b78-8b29-f57cad2606e4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The company must pay the employee or the deceased employee’s personal representative for the long service leave that the employee is entitled to.</txt></block></subclause><subclause id="sec.12-ssec.3" guid="_f14555e4-020b-4513-bc88-255db5a342fe" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Payment must be made at the all purpose rate.</txt></block></subclause><subclause id="sec.12-ssec.4" guid="_27be64e1-ba7c-46c6-9def-5ec45d4d3122" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The company must pay the employee for any long service leave that would have accrued had the employee taken the long service leave.</txt></block></subclause></clause></part><part id="pt.3" guid="_c84751f4-ad94-452a-ad9e-58944babbdc9" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_2054c623-399e-4c6a-95a6-c932f212e70c">Redundancy and retrenchment</heading><division id="pt.3-div.1" guid="_dac5e543-69bd-43a3-a30d-89a53093a04b" affected.by.uncommenced="0"><no>Division 1</no><heading id="pt.3-div.1-he" guid="_a5f9b7b4-af3f-4c28-9c8d-a19e89f6b5a2">Preliminary</heading><clause id="sec.13" guid="_88e1d992-6e75-4bfa-b88a-e11f97e69939" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_23e939a6-53f7-4d01-abe6-39cc6e912495">When a role becomes redundant</heading><block><txt break.before="1">A role becomes redundant when the company decides its need for the role has diminished or ceased.</txt></block></clause><clause id="sec.14" guid="_45383f77-df11-4029-b260-ea6161bbbe23" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_cebfe196-2ec8-4edf-a9d0-d63477b08dc8">Employees who are not entitled to benefits</heading><block><txt break.before="1">An employee who is retrenched because of a redundancy is not entitled to benefits under this part if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-para1.a" guid="_9961bb71-2d11-4b52-8a54-277a43547a0d" provision.type="other"><no> (a)</no><block><txt break.before="0"><intref refid="sec.18" target.guid="_90df3a68-1933-4628-87d1-cb9bd6340c10" check="valid">section&#160;18</intref><intref refid="sec.18-ssec.2" target.guid="_c46bc6e8-4eb7-4758-92d1-3af4c5395291" check="valid">(2)</intref> applies to the employee; or</txt></block></li><li id="sec.14-para1.b" guid="_f5deb0f8-d670-43e6-9065-e98ef2fdd50e" provision.type="other"><no> (b)</no><block><txt break.before="0">the employee—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-para1.b-para2.i" guid="_56ba1bb3-02c2-42b7-ab00-fd626a868142" provision.type="other"><no> (i)</no><block><txt break.before="0">dies or suffers a permanent injury or illness making the employee incapable of continuing employment with the company; or</txt></block></li><li id="sec.14-para1.b-para2.ii" guid="_a891bec6-d9d3-4289-9e48-c6c911ad8324" provision.type="other"><no> (ii)</no><block><txt break.before="0">is engaged in a casual capacity or for a specific task; or</txt></block></li><li id="sec.14-para1.b-para2.iii" guid="_029be700-8c2c-4f76-b000-0453cb3d6354" provision.type="other"><no> (iii)</no><block><txt break.before="0">has less than 1 year of service; or</txt></block></li><li id="sec.14-para1.b-para2.iv" guid="_bb7ca76f-8f2e-4b8c-8fa4-2dbbd92d3b72" provision.type="other"><no> (iv)</no><block><txt break.before="0">terminates employment during the period of notice given under <intref refid="sec.22" target.guid="_39799bae-1c1a-4081-9e03-c12625b54cb1" check="valid">section&#160;22</intref> without the company’s prior approval, unless the approval is unreasonably withheld.</txt></block></li></list></block></li></list></block></clause></division><division id="pt.3-div.2" guid="_692b4b53-4cf6-4170-a575-f9c15db47b73" affected.by.uncommenced="0"><no>Division 2</no><heading id="pt.3-div.2-he" guid="_a122a62e-d91e-4c68-b907-49fd40a28875">Redundancy and retrenchment procedures</heading><clause id="sec.15" guid="_7106f0f4-af2f-4ca4-b182-82f53c0eee18" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_6b57d778-0e4c-4de9-a543-f5d224a3f2f8">Redundancy notice</heading><block><txt the redundancy.</txt></block></li></list></block></clause><clause id="sec.16" guid="_fd80f005-7c08-481e-8654-17a6ca3435af" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_0b9078a3-afb0-480e-a557-28cfd9edf6b5">Consultation after redundancy notice</heading><block><txt break.before="1">Promptly after the redundancy notice is given, the company must consult with the employees and their representatives about the implementation of this part.</txt></block></clause><clause id="sec.17" guid="_ec1fb598-7ab4-492c-9d2a-ed12d1105fff" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>17</no><heading id="sec.17-he" guid="_8b95962d-1ef6-4158-a282-85116b8fbe67">Centrelink must be notified of redundancies</heading><subclause id="sec.17-ssec.1" guid="_aee2e20d-b6e9-405d-a299-d6ec8132c7fb" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">After consulting with the employees and their representatives, the company must notify Centrelink in accordance with the <legref jurisd="QLD" type="act" target.doc.id="act-2009-028" target.version.series="C2009A00028" check="valid"><name emphasis="yes">Fair Work Act 2009</name> (Cwlth)</legref>, <legref jurisd="QLD" type="act" refid="sec.530" target.doc.id="act-2009-028" target.version.series="C2009A00028" check="invalid">section&#160;530</legref> of the number and details of employees who will be affected by the redundancy.</txt></block></subclause><subclause id="sec.17-ssec.2" guid="_05433d72-82b1-4336-beb9-400e01db5cae" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.17-ssec.2-def.Centrelink_" guid="_47ab23b6-630b-46a5-a9ae-c39baf42fcdc" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.17-ssec.2-def.Centrelink" guid="_c1ed1815-e8c0-4b7e-bb80-dd345db81760" type="definition">Centrelink</defterm> means the Department of State of the Commonwealth that is administered by the Minister administering the <legref jurisd="QLD" type="act" target.doc.id="act-1997-031" target.version.series="C2004A05130" check="valid"><name emphasis="yes">Human Services (Centrelink) Act 1997</name> (Cwlth)</legref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.18" guid="_90df3a68-1933-4628-87d1-cb9bd6340c10" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>18</no><heading id="sec.18-he" guid="_a4596e39-7cc6-4d96-b4ef-e4472ba8eb5b">Consideration of employee’s competencies for another role</heading><subclause id="sec.18-ssec.1" guid="_21b0abc1-0502-4084-9665-7b3b636229eb" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Promptly after the redundancy notice is given, the company and each employee in the redundant role must together consider the employee’s competencies in the role to decide if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.1-para1.a" guid="_0611243b-8d45-4861-9b27-931cd93bfc36" provision.type="other"><no> (a)</no><block><txt break.before="0">the employee can perform work in a vacant role; or</txt></block></li><li id="sec.18-ssec.1-para1.b" guid="_57554fc9-7bcb-47db-9ebb-b02fe062873d" provision.type="other"><no> (b)</no><block><txt break.before="0">the employee, with reasonable retraining, could perform work in another role.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.2" guid="_c46bc6e8-4eb7-4758-92d1-3af4c5395291" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An employee is not entitled to benefits under this part if the employee—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a" guid="_fe49587b-f494-470a-b51d-def498d24cb0" provision.type="other"><no> (a)</no><block><txt break.before="0">agrees to perform another role; or</txt></block></li><li id="sec.18-ssec.2-para1.b" guid="_7250000e-5f04-4310-8372-e6fc4f23b5e8" provision.type="other"><no> (b)</no><block><txt break.before="0">unreasonably refuses to agree to perform another role.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.3" guid="_f053b95a-c1a9-46c0-b311-a29c8cb7131f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="frnt-st" target.guid="_5befadb5-a91a-490d-9a50-4ca8882b87a5" check="valid">Subsection&#160;(2)</intref> does not apply to an employee if within 3 months of performing the other role the employee or company finds the other role to be unsatisfactory for the employee’s competencies.</txt></block></subclause></clause><clause id="sec.19" guid="_28b8f82f-dafd-486a-9bf5-6bba56367a75" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sec.19-he" guid="_d9dd4fb3-a560-41d6-bbc4-8e71f9a566b7">Rate of pay for other role</heading><subclause id="sec.19-ssec.1" guid="_a10cfb26-ce73-4710-b61f-5c88248c5f7d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If an employee who has been given a redundancy notice agrees with the company to perform another role for which a rate of pay lower than the rate paid for the redundant role is paid, the company must pay the employee the rate for the redundant role.</txt></block></subclause><subclause id="sec.19-ssec.2" guid="_d722876a-208e-4aed-9654-4aa02d6351c8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Payment at the rate for the redundant role must be made until the earlier of the following events happens—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.2-para1.a" guid="_a9c6d5e6-1426-4d4f-af9f-741190ea3232" provision.type="other"><no> (a)</no><block><txt break.before="0">the end of 2 years from the employee starting work in the other role;</txt></block></li><li id="sec.19-ssec.2-para1.b" guid="_63bfb3bc-d140-42d0-b276-5aacdd667e60" provision.type="other"><no> (b)</no><block><txt break.before="0">the all purpose rate of pay for the other role becomes more than the rate for the redundant role.</txt></block></li></list></block></subclause></clause><clause id="sec.20" guid="_e7f16256-3b75-44f8-ba52-b4b2946e5eb6" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.20-he" guid="_4bf284b3-891c-481a-92c8-74a9f4f182b1">Time off to seek other employment</heading><subclause id="sec.20-ssec.1" guid="_60181630-a33d-4db4-bc7f-0a3850e301da" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An employee who has been given a redundancy notice must be given an appropriate amount of leave at full pay to seek other employment.</txt></block></subclause><subclause id="sec.20-ssec.2" guid="_57f0dc7e-80f4-41ef-bf31-ce81a83037c6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The leave is subject to the company’s normal approval procedures.</txt></block></subclause></clause><clause id="sec.21" guid="_a5694149-cd61-417b-bfb8-1840956b67b1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_1ef2049b-06f7-4a60-95a3-196a0364404c">Nomination and selection for retrenchment</heading><subclause id="sec.21-ssec.1" guid="_3b0d949c-90cc-4644-937b-d19753d56e6c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An employee who can demonstrate the necessary competencies to perform the redundant role may nominate to be considered for retrenchment.</txt></block></subclause><subclause id="sec.21-ssec.2" guid="_8786b6a5-2772-46f0-8156-7fd4147787ce" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If more than 1 employee nominates for retrenchment—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.2-para1.a" guid="_41094b7f-88f0-4e6f-9c8b-f7a576338bd1" provision.type="other"><no> (a)</no><block><txt break.before="0">the company must select the employee to be retrenched on the basis of demonstrated core competencies, assessed performance, demonstrated commitment to the company and equity; and</txt></block></li><li id="sec.21-ssec.2-para1.b" guid="_4b47f2d7-9fb1-48fd-b3fe-ed0c6666c30a" provision.type="other"><no> (b)</no><block><txt break.before="0">all employees who operate boiler and turbine units are taken—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.2-para1.b-para2.i" guid="_9e0c2a5d-7019-4efe-925a-60898d8478d7" provision.type="other"><no> (i)</no><block><txt break.before="0">to be the same classification; and</txt></block></li><li id="sec.21-ssec.2-para1.b-para2.ii" guid="_01307aa7-800a-4394-94b2-d28685aa2785" provision.type="other"><no> (ii)</no><block><txt break.before="0">to have the same demonstrated core competencies for <intref refid="sec.21-ssec.2-para1.a" target.guid="_41094b7f-88f0-4e6f-9c8b-f7a576338bd1" check="valid">paragraph&#160;(a)</intref>.</txt></block></li></list></block></li></list></block></subclause></clause><clause id="sec.22" guid="_39799bae-1c1a-4081-9e03-c12625b54cb1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>22</no><heading id="sec.22-he" guid="_dda5dfa7-32c5-4fd0-bdf6-a3feafcb9d2e">6 months notice of retrenchment must be given</heading><block><txt break.before="1">The company must give an employee who is to be retrenched at least 6 months written notice (a <defterm id="def.retrenchmentnotice" guid="_18b5d4df-296c-455a-b180-a353d5b053d6" type="definition">retrenchment notice</defterm>) of the day the employee is to be retrenched.</txt></block></clause><clause id="sec.23" guid="_358ad5c6-2319-4986-aaf4-35710d8f4654" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>23</no><heading id="sec.23-he" guid="_15f6bf55-056a-4d77-acce-f64c94b32ec0">Application for early separation</heading><subclause id="sec.23-ssec.1" guid="_dd6b3150-6a9e-4ab8-9f39-4fb3cda0d132" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An employee who has been given a retrenchment notice must apply to the company within 14 days after receiving the notice if the employee wants—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.1-para1.a" guid="_cf36972d-db5d-4564-92bf-8ac1c3d6a256" provision.type="other"><no> (a)</no><block><txt break.before="0">to terminate employment before the retrenchment day mentioned in the retrenchment notice; and</txt></block></li><li id="sec.23-ssec.1-para1.b" guid="_427f9bad-9df7-4a5a-a36e-535720cca92c" provision.type="other"><no> (b)</no><block><txt break.before="0">to be considered for an early separation incentive payment under <intref refid="sec.26" target.guid="_a21bfe87-eb17-47b5-a21b-fdc25379a7b2" check="valid">section&#160;26</intref>.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.2" guid="_88193d6d-7894-4347-a983-2baeb7764b9b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the company approves the early separation for the approves an employee’s early separation, the company must pay the employee an early separation incentive payment.</txt></block></subclause><subclause id="sec.26-ssec.2" provision.type="other"><no>27</no><heading id="sec.27-he" guid="_105d1946-24f2-42ad-8e4c-c1c6cbf2b465">Retrenchment of shift worker</heading><block><txt break.before="1">If an employee who is a shift worker is to be retrenched—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-para1.a" guid="_d4c86039-22fc-4c8a-b268-1c37deaf9e51" provision.type="other"><no> (a)</no><block><txt break.before="0">the employee must receive, until the retrenchment, at least the average loadings that applied to the roster the employee would have worked had the employee not been retrenched; and</txt></block></li><li id="sec.27-para1.b" guid="_cc0312cc-29b3-4eec-b1f4-4120993d8736" provision.type="other"><no> (b)</no><block><txt break.before="0">other payments to the employee under this part must also be based on this principle.</txt></block></li></list></block></clause><clause id="sec.28" guid="_12b668a3-05da-4236-99ef-1cf33734f698" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>28</no><heading id="sec.28-he" guid="_72bc4cb3-9a50-4a87-9293-1001a34a2cf8">Retrenchment payment</heading><subclause id="sec.28-ssec.1" guid="_369755f2-2e33-49bf-a37b-0df7f6b56648" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The company must pay an employee who has been retrenched an amount (a <defterm id="sec.28-def.retrenchmentpayment" guid="_b776102a-5327-48e7-985a-4c11f4987789" type="definition">retrenchment payment</defterm>) equal to the all purpose rate of pay for the because of the Power Station Sale Agreement.</txt></block></li></list></definition><definition id="sch.1-def.redundancynotice_" guid="_36ce3d88-0915-4fca-be6d-f58b7df0b796" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.1-def.redundancynotice" guid="_bf810145-b38a-4dc0-a90b-a6dbf70e3ad2" type="definition">redundancy notice</defterm> means a notice given under <intref refid="sec.15" target.guid="_7106f0f4-af2f-4ca4-b182-82f53c0eee18" check="valid">section&#160;15</intref>.</txt></definition><definition id="sch.1-def.representatives_"
