id="sec.5-ssec.1" guid="_3cb4949b-428f-463e-9e1e-df82f5a3e8d3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The <defterm id="sec.5-def.shoppingcentreland" guid="_4a24280a-ca1c-48fe-b002-a1256e824771" type="definition">shopping centre land</defterm> is the land shown on the plan in <intref refid="sch.1" target.guid="_2c4e687c-2861-4d7a-8c0a-a066ea929a33" check="valid">schedule&#160;1</intref>, other than the excluded land.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_d369f8cc-2d5c-467e-b432-f1f90a547528" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The <defterm id="sec.5-def.excludedland" guid="_f4f29c4a-88ad-40f8-882b-8d3899f08af3" type="definition">excluded land</defterm> is the land shown on the plan in <intref refid="sch.1" target.guid="_2c4e687c-2861-4d7a-8c0a-a066ea929a33" and the excluded land that are, immediately before the commencement, dedicated as a road for public use.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_4bce07c6-1eaa-460c-9833-0c4ece3b7c25" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">On the commencement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a" guid="_5ac1c92b-8688-4717-8047-ba5534cccb65" provision.type="other"><no>(a)</no><block><txt break.before="0">the road is permanently closed; and</txt></block></li><li id="sec.6-ssec.2-para1.b" guid="_967fcab0-4b92-4cf7-808c-c00536480981" provision.type="other"><no>(b)</no><block><txt break.before="0">the land becomes unallocated State id="sec.7-ssec.1" guid="_0dcfe865-50ff-4714-b1ed-45f7956b7f42" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">On the commencement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_acc32c2d-1de0-4b98-acfa-3a9caad8781e" provision.type="other"><no>(a)</no><block><txt break.before="0">any part of the shopping centre land that was, immediately before the commencement, subject to a shopping centre lease becomes unallocated State land; and</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_54d6793c-2613-47e0-a051-d53705958183" provision.type="other"><no>(b)</no><block><txt break.before="0">a deed of grant issued before the commencement for any part of the shopping centre land is cancelled and the land becomes unallocated State land.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_1d267a4d-1632-45ad-9b07-e74f82ba1f1c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Governor in Council must issue to the State—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-para1.a" guid="_69c1f69a-206d-4be4-a42b-5d4a59c97086" provision.type="other"><no>(a)</no><block><txt break.before="0">a deed of grant for the shopping centre land; and</txt></block></li><li id="sec.7-ssec.2-para1.b" guid="_4ea87876-a542-420a-8077-444840481ada" provision.type="other"><no>(b)</no><block><txt break.before="0">a deed of grant for the excluded land.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.3" guid="_11e02746-23aa-4810-ac6f-5af1a8a83e0b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A deed of grant required under <intref refid="sec.7-ssec.2" target.guid="_1d267a4d-1632-45ad-9b07-e74f82ba1f1c" check="valid">subsection&#160;(2)</intref> to be issued—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.3-para1.a" guid="_662b12bb-b310-4aa0-8ba8-b551b2a31e10" provision.type="other"><no>(a)</no><block><txt break.before="0">must be issued under the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref>; and</txt></block></li><li id="sec.7-ssec.3-para1.b" guid="_67c5addb-3211-492b-a47f-277823abc7ce" provision.type="other"><no>(b)</no><block><txt break.before="0">subject to <legref jurisd="QLD" type="act" refid="sec.21" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" target.guid="_c9ea5ce7-dfb2-4991-8f4f-8a5ff09d39a8" check="valid">section&#160;21</legref> of that Act, is issued free of all of the interests to which the shopping centre land or the excluded land was subject immediately before the commencement.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.4" guid="_13869c20-1f6a-4e74-936b-51f2122802bf" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, the conversion of the shopping centre land to freehold land, and the issue of a deed of grant for the land, under this section does not terminate a shopping centre lease.</txt></block></subclause><subclause id="sec.7-ssec.5" guid="_d576d85f-464b-4616-9952-c4439e4566ca" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">To remove any doubt, it is declared that the <legref jurisd="QLD" type="act" target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" check="valid"><name emphasis="yes">Housing Act 2003</name></legref>, <legref jurisd="QLD" type="act" refid="sec.112" target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" target.guid="_ce315fc9-8e31-47d0-b968-8cd522246744" check="valid">section&#160;112</legref> continues to apply to a shopping centre lease until the lease is cancelled under <intref refid="sec.15" target.guid="_c70ff5c9-f695-414b-810b-e1fb4f1b1ad7" check="valid">section&#160;15</intref> or otherwise terminated.</txt></block></subclause><subclause id="sec.7-ssec.6" guid="_4353e103-a9a9-40bd-b933-15930e0940b4" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.7-ssec.6-def.deedofgrant_" guid="_d85befc1-a647-4741-ae5b-bf596f6133b3" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.6-def.deedofgrant" guid="_e4f52618-d6a5-47df-8ffb-f50c749f378e" type="definition">deed of grant</defterm> means a document evidencing the grant of land in fee simple under the <legref target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Act 1994</name></legref> that includes an indefeasible title under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="no">Land Title Act</name></legref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.8" guid="_d3dbcf4c-d6a5-45f6-885e-9e1a0db362fb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_6fd83d58-cbe7-4f0b-a96a-5fed42ff8c6c">Preparation and registration of plan of survey</heading><subclause id="sec.8-ssec.1" guid="_9e1ad405-38f8-4f45-b3f0-0d7773d9b79d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive must ensure a plan of survey creating 1 lot for the shopping centre land and 1 lot for the excluded land is prepared as soon as practicable after the commencement.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_3496ed2f-6c40-4e7f-b63e-645bfc6619f6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The plan of survey must generally correspond with the plan in <intref refid="sch.1" target.guid="_2c4e687c-2861-4d7a-8c0a-a066ea929a33" check="valid">schedule&#160;1</intref>.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_36a8ef01-9438-47c3-b189-c38342ae4f86" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive must ensure the plan of survey is registered under the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref>.</txt></block></subclause><subclause id="sec.8-ssec.4" guid="_02e3d930-732e-4fc8-96cf-4b5c2d2a4a14" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">No fee is payable for registering the plan of survey under the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" schemes</heading><clause id="sec.9" guid="_2b15eca1-fd8e-4d6b-86e4-2c6caf0787ec" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_8740ddc6-03c2-4459-8f1c-5191946f14ba">Plans of subdivision for community titles schemes</heading><subclause id="sec.9-ssec.1" guid="_a518892c-04a3-4173-bf2b-d0a71280de31" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">As soon as practicable after the plan of survey mentioned in <intref refid="sec.8" target.guid="_d3dbcf4c-d6a5-45f6-885e-9e1a0db362fb" check="valid">section&#160;8</intref> is registered, the chief executive must ensure the following plans of subdivision are prepared and lodged for registration under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="no">Land Title Act</name></legref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_78b3b17d-b592-4054-8442-6f614ab8ce02" provision.type="other"><no>(a)</no><block><txt break.before="0">plan of subdivision SP169871 (the <defterm id="sec.9-ssec.1-def.principalschemeplan" guid="_372317b5-2107-4400-80cf-77ea6b79862f" type="definition">principal scheme plan</defterm>), subdividing the shopping centre land into lots to be included in, and common property for, a community titles scheme;</txt></block></li><li id="sec.9-ssec.1-para1.b" guid="_0ebf1376-f7e1-4e1e-af7a-dd5e9f711757" provision.type="other"><no>(b)</no><block><txt break.before="0">plan of subdivision SP169873 (the <defterm id="sec.9-ssec.1-def.subsidiaryschemeplan" guid="_80a93499-65e4-4e20-aba5-ebad93597a21" type="definition">subsidiary scheme plan</defterm>), subdividing proposed lot 22 shown on the principal scheme plan into lots to be included in, and common property for, a community titles scheme.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_3d298994-ac23-470e-a708-a3c7f6a88b26" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The lots and common property, and the easements relating to the lots and common property, shown on the principal scheme plan must generally correspond with the lots, common property and easements shown on the plan in <intref refid="sch.2" target.guid="_4733d358-3a5d-460d-9bdf-66d0583cc03e" check="valid">schedule&#160;2</intref>.</txt></block></subclause><subclause id="sec.9-ssec.3" guid="_63423c87-0c18-4a55-8e3b-38698fb21566" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The lots and common property, and the easements relating to the lots and common property, shown on the subsidiary scheme plan must generally correspond with the lots, common property and easements shown on the plan in <intref refid="sch.3" target.guid="_1089c884-850c-420d-8a0c-215e4ecedd93" check="valid">schedule&#160;3</intref>.</txt></block></subclause><subclause id="sec.9-ssec.4" guid="_a9463134-e76a-4d09-b091-ebf764b7f461" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="no">Land Title Act</name></legref>, <legref refid="sec.50" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" target.guid="_876719a1-e0b4-43b1-b5d5-51deac171ee1" check="valid" jurisd="QLD" type="act">section&#160;50</legref>, a plan of subdivision prepared under this section is taken to have been approved by the Brisbane City Council.</txt></block></subclause><subclause id="sec.9-ssec.5" guid="_dbdb9383-97d4-41c5-9e72-b850f94e54e5" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">To remove any doubt, it is declared that <legref refid="sec.44" target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" target.guid="_06aa25a4-f4aa-453b-8cb8-0f58415e8ba3" check="valid" jurisd="QLD" type="act">section&#160;44</legref> of the <legref target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" check="valid" jurisd="QLD" type="act"><name emphasis="no">BCCM Act</name></legref> does not prevent the registration under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="no">Land Title Act</name></legref> of an easement shown on the principal scheme plan.</txt></block></subclause><subclause id="sec.9-ssec.6" guid="_bb61858a-3e05-45f3-bf01-5a2e448b7e70" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.9-ssec.6-def.commonproperty_" guid="_47044ef6-f52e-4607-be98-5e682e272395" <intref refid="sec.9-ssec.1-para1.b" target.guid="_0ebf1376-f7e1-4e1e-af7a-dd5e9f711757" check="valid">(b)</intref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.11" guid="_7290b03f-05ad-4bb3-82e7-8086889ddff2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.11-ssec.1" target.guid="_44e0ce60-b8bc-4578-9966-a5339b693c20" check="valid">Subsection&#160;(1)</intref> applies despite the <legref target.doc.id="act-1997-028" break.before="0">If the State grants an easement before the conversion day over land that will be scheme land for the principal scheme or subsidiary scheme, the easement takes effect in relation to the shopping centre land from the day the easement is created.</txt></block></subclause><subclause id="sec.11-ssec.4" guid="_196bebfa-06a8-4a42-9af5-bd8ccc2b6b2d" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, if an easement to which <intref refid="sec.11-ssec.3" target.guid="_add0bd52-a73c-48c5-b0e4-5d505db94d90" check="valid">subsection&#160;(3)</intref> applies is inconsistent with the terms of a shopping centre lease, the lease prevails to the extent of the inconsistency.</txt></block></subclause></clause><clause id="sec.12" guid="_10cf6e9a-b245-4392-9591-ba5acbfc11e3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_56e86b57-ec22-4b37-b01b-50949f572f82">State as original owner for community titles schemes</heading><subclause id="sec.12-ssec.1" guid="_d024fcec-aa0f-4783-a967-a9900101832a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The State can not be prosecuted for not complying with an obligation under the <legref target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" check="valid" jurisd="QLD" type="act"><name emphasis="no">BCCM Act</name></legref> in the State’s capacity as the original owner for the principal scheme or subsidiary scheme.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_d1573e71-d819-48ac-8635-5743a0b6add8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The <legref target.doc.id="sl-1997-0480" jurisd="QLD">(1)</legref><legref type="subordleg" refid="sec.49-ssec.1-para1.b" target.doc.id="sl-1997-0480" target.version.series="9d5580a3-3a33-4165-93c0-2be081f4babc" check="invalid" jurisd="QLD">(b)</legref> and <legref type="subordleg" refid="sec.49-ssec.1-para1.f" target.doc.id="sl-1997-0480" target.version.series="9d5580a3-3a33-4165-93c0-2be081f4babc" check="invalid" jurisd="QLD">(f)</legref>, does not apply to the State as the original owner for the principal scheme or subsidiary scheme.</txt></block></subclause></clause><clause id="sec.13" provision.type="other"><no>(1)</no><block><txt break.before="0">Within 7 days after the first community management statements for the principal scheme and subsidiary scheme are recorded, the chief executive must give each lessee of a shopping centre lease—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.a" guid="_27ea40a4-1e9e-45a0-b4ea-22cb87751ecc" provision.type="other"><no>(a)</no><block><txt break.before="0">a notice (a <defterm id="sec.13-ssec.1-def.conversionnotice" guid="_b556d7f0-5e03-41cd-9317-13e1fec3cc39" type="definition">conversion notice</defterm>) stating each of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.a-para2.i" guid="_273ddc13-8ac8-4b64-894b-768182ea800d" provision.type="other"><no>(i)</no><block><txt break.before="0">that community management statements for the principal scheme and subsidiary scheme have been recorded;</txt></block></li><li id="sec.13-ssec.1-para1.a-para2.ii" guid="_cda9ff02-db2b-4c47-84e8-3070b24c9cd7" provision.type="other"><no>(ii)</no><block><txt break.before="0">the conversion day;</txt></block></li><li id="sec.13-ssec.1-para1.a-para2.iii" guid="_70061478-6c4e-48a8-a776-3235bf904dde" provision.type="other"><no>(iii)</no><block><txt break.before="0">the information the lessee is required to give the chief executive before the conversion day; and</txt></block></li></list></block></li><li id="sec.13-ssec.1-para1.b" guid="_95babe63-8ba5-4ff2-ad0b-c3e84bfc7410" provision.type="other"><no>(b)</no><block><txt break.before="0">a tax invoice issued by the department that shows the conversion cost payable by the lessee.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.2" guid="_512c0158-58ea-49cb-9ef8-c6b93a9ad972" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The information stated in a conversion notice under <intref refid="sec.13-ssec.1" target.guid="_69b4001c-ea9c-4d68-9545-4a293a6380ff" check="valid">subsection&#160;(1)</intref><intref refid="sec.13-ssec.1-para1.a" target.guid="_27ea40a4-1e9e-45a0-b4ea-22cb87751ecc" check="valid">(a)</intref><intref refid="sec.13-ssec.1-para1.a-para2.iii" target.guid="_70061478-6c4e-48a8-a776-3235bf904dde" check="valid">(iii)</intref> must be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.a" guid="_897273f8-01e5-4fca-883f-c278a2c67cf4" provision.type="other"><no>(a)</no><block><txt break.before="0">information in, or to the effect of, the approved form for the <legref target.doc.id="act-1944-003" target.version.series="f1e7f0ac-fcc6-4910-9ffb-2e9ca0db5a53" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Valuation of Land Act 1944</name></legref>, <legref refid="sec.81" target.doc.id="act-1944-003" target.version.series="f1e7f0ac-fcc6-4910-9ffb-2e9ca0db5a53" check="invalid" jurisd="QLD" type="act">section&#160;81</legref><legref refid="sec.81-ssec.1" target.doc.id="act-1944-003" target.version.series="f1e7f0ac-fcc6-4910-9ffb-2e9ca0db5a53" check="invalid" jurisd="QLD" type="act">(1)</legref>; and</txt></block></li><li id="sec.13-ssec.2-para1.b" guid="_c3b9f2cb-4d21-45bd-b0bc-cfbb3b0f90df" provision.type="other"><no>(b)</no><block><txt break.before="0">any other information reasonably required by the chief executive information</heading><subclause id="sec.14-ssec.1" guid="_02c4a704-a91a-4c41-9e8b-1a272d66c49b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The lessee of a shopping centre lease must pay to the chief executive, before the conversion day, the total of the following amounts (the <defterm id="sec.14-def.conversioncost" guid="_c148f7f2-a0d9-490b-9e1f-abecbfa2d893" type="definition">conversion cost</defterm>)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-ssec.1-para1.a" guid="_930b91ae-75b5-4b85-bd8d-b75add98eb61" provision.type="other"><no>(a)</no><block><txt break.before="0">the unimproved value amount for each shopping centre lease held by the person immediately before the conversion day;</txt></block></li><li id="sec.14-ssec.1-para1.b" guid="_2d267bb3-363b-4698-80c7-919be2aee8ec" provision.type="other"><no>(b)</no><block><txt break.before="0">any GST payable on a supply relating to the vesting of a transfer lot in the person under <intref refid="sec.15" target.guid="_c70ff5c9-f695-414b-810b-e1fb4f1b1ad7" check="valid">section&#160;15</intref>;</txt></block></li><li id="sec.14-ssec.1-para1.c" guid="_ec79fbb8-2443-46a1-a45b-9b8c791c6bc8" provision.type="other"><no>(c)</no><block><txt id="sec.15-ssec.1-def.firstowner" guid="_a0e84a46-6e03-4357-ae07-f710f3448557" type="definition">first owner</defterm>) who was, immediately before the conversion day, a lessee of a relevant lease for check="valid">schedule&#160;4</intref>, column 2 opposite a transfer lot is a <defterm id="sec.15-def.relevantlease" guid="_b4a3ddd2-d7b5-427c-b787-d51c1d314557" type="definition">relevant lease</defterm> for the lot.</txt></block></subclause><subclause id="sec.15-ssec.3" guid="_70b7278a-6387-4c7e-b358-250aa6fb15e0" affected.by.uncommenced="0" break.before="0">the cancellation of the lease under this section does not terminate the sublease or other interest; and</txt></block></li><li id="sec.15-ssec.4-para1.b" guid="_54094a08-2374-47ff-9286-6239ad968276" provision.type="other"><no>(b)</no><block><txt break.before="0">on the conversion day, the sublease or other interest is taken to be held in relation to each lot vested under <intref refid="sec.15-ssec.1" target.guid="_1f8bca60-12ed-4115-8cca-c8db416b878b" check="valid">subsection&#160;(1)</intref> in the lessee of the lease.</txt></block></li></list></block></subclause><subclause id="sec.15-ssec.5" guid="_ecd95adf-de90-4a09-9e13-c16b6bba3887" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If there is an unregistered document in relation to a shopping centre lease cancelled under this section, the document must be relodged by the registrar of titles, for the person who lodged the document, against each transfer lot vested in the lessee of the lease.</txt></block></subclause><subclause id="sec.15-ssec.6" guid="_8dfa4b53-e45f-41df-b8e8-b02c4bce7b25" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The following do not apply in relation to the vesting of a transfer lot under this section—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.6-para1.a" guid="_36f717df-8545-40b9-b9b9-e990b8a7c0a5" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref> but has not been registered in the appropriate register under that Act; and</txt></block></li><li id="sec.15-ssec.7-def.unregistereddocument-para1.b" guid="_2a6de362-dad9-422e-91f4-83de1068b182" provision.type="other"><no>(b)</no><block><txt break.before="0">has not been rejected.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.16" guid="_079887d7-c8a7-4f8c-8009-f9e0efd9fbc9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_544b9ecd-408f-4c6b-b9d5-43820687d3b1">Transfer lot for which a relevant lease is not in force immediately before conversion day</heading><subclause id="sec.16-ssec.1" guid="_779e1190-d202-4065-a521-2381535f89ba" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a relevant lease for a transfer lot is not in force immediately before the conversion day.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_b0ce2d0b-fd3b-46b2-a744-a1f3b2fc59ed" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If there is another relevant lease for the transfer lot that is in force immediately before the conversion day (the <defterm id="sec.16-def.currentlease" guid="_219a5ff2-fb3d-4a3d-b00e-70ee929d69bc" type="definition">current lease</defterm>), the transfer lot is vested in each of the following persons (each a <defterm id="sec.16-def.firstowner" guid="_04f306e8-258f-419b-991e-7bf90ee22137" type="definition">first owner</defterm>)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.a" guid="_5e3c84a9-6cd8-4cd8-bf5f-c1a2ee53bcee" provision.type="other"><no>(a)</no><block><txt break.before="0">the persons who were, immediately before the conversion day, the lessees of the current lease;</txt></block></li><li id="sec.16-ssec.2-para1.b" guid="_ad18abb3-7031-4b8a-bfe0-4c9c8737a007" provision.type="other"><no>(b)</no><block><txt break.before="0">the persons who were the lessees of the lease mentioned in <intref refid="sec.16-ssec.1" target.guid="_779e1190-d202-4065-a521-2381535f89ba" check="valid">subsection&#160;(1)</intref> immediately before its termination.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.3" guid="_0f62438a-2460-477d-aa37-0b8b6a97b009" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If there is no relevant lease for the transfer lot in force immediately before the conversion day, the lot is not a transfer lot.</txt></block></subclause></clause><clause id="sec.17" guid="_46eea5ca-6600-44c4-9095-a78ad53009e7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>17</no><heading id="sec.17-he" guid="_2eee7e39-8394-47c9-9901-cdfffafb52b7">Co-ownership of transfer lots</heading><subclause id="sec.17-ssec.1" guid="_ebaf6fd3-5f9d-46bf-aaed-40e347fcad4c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a transfer lot is vested under <intref refid="sec.15" target.guid="_c70ff5c9-f695-414b-810b-e1fb4f1b1ad7" check="valid">section&#160;15</intref><intref refid="sec.15-ssec.1" target.guid="_1f8bca60-12ed-4115-8cca-c8db416b878b" check="valid">(1)</intref><intref refid="sec.15-ssec.1-para1.b" target.guid="_b4199d0f-4d2f-4838-ba58-bbc9f3e5d1aa" check="valid">(b)</intref> in more than 1 person.</txt></block></subclause><subclause id="sec.17-ssec.2" guid="_96dc12aa-4417-40f9-8a2c-b4f3ba8675a3" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For lot 3 of the subsidiary scheme, the persons take—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.2-para1.a" guid="_b32d20a0-d06d-498d-96ae-8a1c9aab49b1" provision.type="other"><no>(a)</no><block><txt break.before="0">if the lessees of SHPTL 1201, acting jointly, give notice to the chief executive before the conversion day of the individual interests in the lot they have agreed to take—the individual interests in the lot stated in the notice; or</txt></block></li><li id="sec.17-ssec.2-para1.b" guid="_611be740-9eb5-4efb-900c-19ec8df864e1" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—the same individual interests in the lot as they had in SHPTL 1201 immediately before its cancellation.</txt></block></li></list></block></subclause><subclause id="sec.17-ssec.3" guid="_7dac5ce7-8e1a-48ff-8ca1-8129a545b660" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For another transfer lot, the persons take the same individual interests in the lot as they had in the relevant lease or leases for the lot immediately before their cancellation.</txt></block></subclause></clause><clause id="sec.18" guid="_a413bf5d-6197-4b48-a60a-adf3ce86f497" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>18</no><heading id="sec.18-he" guid="_1aadeed7-1b73-4419-8f9e-b6e7066d6c57">Recording conversion of title etc.</heading><subclause id="sec.18-ssec.1" guid="_864910cd-9aa9-4d9e-b4d9-c10887cb0acf" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive must, as soon as practicable after the conversion day—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.1-para1.a" guid="_df0a663d-b8c6-4f2d-a773-a5e50cf5e6a0" provision.type="other"><no>(a)</no><block><txt break.before="0">give the chief executive (land) a notice asking that the chief executive note in the appropriate register under the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref> the cancellation under <intref refid="sec.15" target.guid="_c70ff5c9-f695-414b-810b-e1fb4f1b1ad7" check="valid">section&#160;15</intref><intref refid="sec.15-ssec.1" target.guid="_1f8bca60-12ed-4115-8cca-c8db416b878b" check="valid">(1)</intref><intref refid="sec.15-ssec.1-para1.a" target.guid="_4d466c89-b8ae-4caa-8545-cd847586e0b2" check="valid">(a)</intref> of the shopping centre leases to which the section applies; and</txt></block></li><li id="sec.18-ssec.1-para1.b" guid="_95620b5d-56e3-40fe-9cd8-ca7f60863e5d" provision.type="other"><no>(b)</no><block><txt break.before="0">give the registrar of titles a notice asking that the registrar record the vesting of the transfer lots under <intref refid="sec.15" target.guid="_c70ff5c9-f695-414b-810b-e1fb4f1b1ad7" check="valid">section&#160;15</intref><intref refid="sec.15-ssec.1" target.guid="_1f8bca60-12ed-4115-8cca-c8db416b878b" check="valid">(1)</intref><intref refid="sec.15-ssec.1-para1.b" target.guid="_b4199d0f-4d2f-4838-ba58-bbc9f3e5d1aa" check="valid">(b)</intref>, <intref refid="sec.16" target.guid="_079887d7-c8a7-4f8c-8009-f9e0efd9fbc9" check="valid">16</intref> or <intref refid="sec.17" target.guid="_46eea5ca-6600-44c4-9095-a78ad53009e7" check="valid">17</intref> and stating—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.1-para1.b-para2.i" guid="_9f72444d-c205-4aeb-ae75-9926cd42e4e7" provision.type="other"><no>(i)</no><block><txt break.before="0">the name of the first owner of each transfer lot and, if a transfer lot vests in co-owners, the interests taken by the co-owners; and</txt></block></li><li id="sec.18-ssec.1-para1.b-para2.ii" guid="_1ba1a86c-dcfd-43f6-b660-91d0e761edc9" provision.type="other"><no>(ii)</no><block><txt break.before="0">if a transfer lot vests subject to the chief executive’s charge—the lot vests subject to the charge and the conversion cost for the lot.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.18-ssec.2" guid="_013cc253-ae8b-45af-9ddb-840f35955ee8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The registrar of titles must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a" guid="_79793bd7-2917-4805-a74c-1cb7310fd130" provision.type="other"><no>(a)</no><block><txt break.before="0">record in the freehold land register—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a-para2.i" guid="_6c3edfe3-b1e6-4306-91a5-0ed38a570e0a" provision.type="other"><no>(i)</no><block><txt break.before="0">the vesting of the transfer lots; and</txt></block></li><li id="sec.18-ssec.2-para1.a-para2.ii" guid="_ab731c06-e0d6-4fab-bff4-e1bc6e870167" provision.type="other"><no>(ii)</no><block><txt break.before="0">the interests mentioned in <intref refid="sec.15" target.guid="_c70ff5c9-f695-414b-810b-e1fb4f1b1ad7" check="valid">section&#160;15</intref><intref refid="sec.15-ssec.4" target.guid="_96529112-44c1-492a-9952-ef1efd62e089" check="valid">(4)</intref><intref refid="sec.15-ssec.4-para1.b" target.guid="_54094a08-2374-47ff-9286-6239ad968276" check="valid">(b)</intref> in relation to the transfer lots; and</txt></block></li></list></block></li><li id="sec.18-ssec.2-para1.b" guid="_f1737c90-27d4-4324-8726-ba0340e175ec" provision.type="other"><no>(b)</no><block><txt break.before="0">if a transfer lot vests subject to the chief executive’s charge—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.b-para2.i" guid="_201b3ef2-5479-41c0-bc32-c2fa588c744a" provision.type="other"><no>(i)</no><block><txt break.before="0">record the chief executive’s charge in the freehold land register; and</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.ii" guid="_1594af06-bab2-4584-acf4-30a251087b4d" provision.type="other"><no>(ii)</no><block><txt break.before="0">while a chief executive’s charge is recorded in the freehold land register, keep a record of the conversion cost for the lot.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.18-ssec.3" guid="_ac6d1388-0a5d-4bf7-b2f9-defe22a903be" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Fees payable under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="no">Land Title Act</name></legref> for recording the vesting of a transfer lot under <intref refid="sec.15" target.guid="_c70ff5c9-f695-414b-810b-e1fb4f1b1ad7" check="valid">section&#160;15</intref><intref refid="sec.15-ssec.1" target.guid="_1f8bca60-12ed-4115-8cca-c8db416b878b" check="valid">(1)</intref><intref refid="sec.15-ssec.1-para1.b" target.guid="_b4199d0f-4d2f-4838-ba58-bbc9f3e5d1aa" check="valid">(b)</intref>, <intref refid="sec.16" target.guid="_079887d7-c8a7-4f8c-8009-f9e0efd9fbc9" check="valid">16</intref> or <intref refid="sec.17" target.guid="_46eea5ca-6600-44c4-9095-a78ad53009e7" check="valid">17</intref> must be paid by the department.</txt></block></subclause><subclause id="sec.18-ssec.4" guid="_ce5277ed-a58e-4515-b727-051162c29b2e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, no fee is payable for recording the chief executive’s charge under this section.</txt></block></subclause><subclause id="sec.18-ssec.5" guid="_13e3f354-20cd-442b-93ac-68c556d36785" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0"><intref refid="sec.18-ssec.6" target.guid="_91af2018-88ba-4787-890d-ca80e48e14fe" check="valid">Subsection&#160;(6)</intref> applies to an instrument of covenant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.5-para1.a" guid="_a622e1f8-93dd-4f65-9cb0-11c40966cdbe" provision.type="other"><no>(a)</no><block><txt break.before="0">in favour of the State relating to the use for a taxi rank of the part of lot 20 of the principal scheme identified on the principal scheme plan as ‘taxi rank covenant’; and</txt></block></li><li id="sec.18-ssec.5-para1.b" guid="_9b639c77-cb45-464a-be89-b93e778b1bce" provision.type="other"><no>(b)</no><block><txt break.before="0">executed before the conversion day by the chief executive.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.6" guid="_91af2018-88ba-4787-890d-ca80e48e14fe" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The instrument of covenant may be registered under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="no">Land Title Act</name></legref> even though the covenant is entered into by the State with the State.</txt></block></subclause><subclause id="sec.18-ssec.7" guid="_f3b31f9b-40c3-44a9-98a3-79ed85cdc98d" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The charge is binding on the first owner of the lot and the owner’s successors in title.</txt></block></subclause><subclause id="sec.19-ssec.4" guid="_529b631e-0299-4bc2-b7f2-996afb59b665" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For the <legref jurisd="QLD" type="act" number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.1-para1.a" guid="_92e2de03-d62b-43c8-93c1-9d396417e934" provision.type="other"><no>(a)</no><block><txt break.before="0">a transfer lot vests in the first owner subject to the chief executive’s charge; and</txt></block></li><li id="sec.20-ssec.1-para1.b" guid="_786108a0-4548-4a1b-81f9-5845221558e5" provision.type="other"><no>(b)</no><block><txt break.before="0">the chief executive decides the lot should be sold to recover the unpaid conversion cost.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.2" guid="_b05f6e81-fda7-4912-adb8-8232720b4c01" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive must give notice (a <defterm id="sec.20-def.noticeofintentiontosell" guid="_5b1acf9b-e244-4c29-b596-d581f4b2e703" type="definition">notice of intention to sell</defterm>) stating the matters mentioned in <intref refid="sec.20-ssec.3" target.guid="_0d9fbf57-b425-4a06-b799-4e7ca3fc5123" check="valid">subsection&#160;(3)</intref> to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.2-para1.a" guid="_a9385633-7cc3-43e8-b492-b03fd875cb0b" provision.type="other"><no>(a)</no><block><txt break.before="0">the registered owner of the lot; and</txt></block></li><li id="sec.20-ssec.2-para1.b" guid="_0d2ba785-1bea-4ce9-8420-c223acd4a918" provision.type="other"><no>(b)</no><block><txt break.before="0">each mortgagee of the lot.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.3" guid="_0d9fbf57-b425-4a06-b799-4e7ca3fc5123" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The matters are each of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.3-para1.a" guid="_ae8807b0-2f46-44d0-8e57-6e4b0b0456d8" provision.type="other"><no>(a)</no><block><txt break.before="0">the conversion day;</txt></block></li><li id="sec.20-ssec.3-para1.b" guid="_69af8753-3c49-4381-9125-e8e29ea5423a" provision.type="other"><no>(b)</no><block><txt break.before="0">the amount of the unpaid conversion cost;</txt></block></li><li id="sec.20-ssec.3-para1.c" guid="_3bbd1b3b-7b8d-4b7f-8149-6310cde91b53" provision.type="other"><no>(c)</no><block><txt break.before="0">that the chief executive may sell the lot if the registered owner does not pay to the chief executive within a stated period—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.3-para1.c-para2.i" guid="_81ee0d74-043e-4237-9894-76bda92e6578" provision.type="other"><no>(i)</no><block><txt break.before="0">the amount of the unpaid conversion cost; and</txt></block></li><li id="sec.20-ssec.3-para1.c-para2.ii" guid="_dd117278-fe8b-454c-91c7-1079579e9506" provision.type="other"><no>(ii)</no><block><txt break.before="0">if the chief executive requires interest on the unpaid conversion cost to be paid by the affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The total amount payable by the registered owner under <intref refid="sec.20-ssec.3" target.guid="_0d9fbf57-b425-4a06-b799-4e7ca3fc5123" check="valid">subsection&#160;(3)</intref><intref refid="sec.20-ssec.3-para1.c" target.guid="_3bbd1b3b-7b8d-4b7f-8149-6310cde91b53" check="valid">(c)</intref> is the <defterm id="sec.20-def.demandamount" guid="_d5b0aafb-5773-4d49-8474-337c69a6529f" type="definition">demand amount</defterm>.</txt></block></subclause><subclause id="sec.20-ssec.5" guid="_91770e9a-3835-4410-875b-387ec3d4dfec" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The period stated in the notice under provision.type="other"><no>(a)</no><block><txt break.before="0">for the period starting on the day after the conversion day and ending on the day the amount of the unpaid conversion cost is paid in break.before="0">If the chief executive may sell a transfer lot under <intref refid="sec.20" target.guid="_9754a79b-b2b3-4210-aef3-df9e27ec6ed4" check="valid">section&#160;20</intref><intref refid="sec.20-ssec.7" target.guid="_38c6906d-9933-45ed-b9cc-73b6942c135d" check="valid">(7)</intref><intref refid="sec.20-ssec.7-para1.a" target.guid="_04678ef2-429e-418a-8348-31535dbe2d89" guid="_0225198e-9c8d-4574-8366-d3e2d55d4555" provision.type="other"><no>(b)</no><block><txt break.before="0">secondly, in payment of the demand amount to the chief executive;</txt></block></li><li id="sec.22-ssec.2-para1.c" guid="_662c57dc-05fe-4217-add4-4509cd6a0a2b" provision.type="other"><no>(c)</no><block><txt break.before="0">thirdly, in payment of any amount owing to a mortgagee or, if there is more than 1 mortgagee, according to their priorities;</txt></block></li><li id="sec.22-ssec.2-para1.d" guid="_767b0f01-5ce7-43de-8947-3970a024dd1a" provision.type="other"><no>(d)</no><block><txt break.before="0">lastly, in payment to the previous registered owner of the lot.</txt></block></li></list></block></subclause><subclause id="sec.22-ssec.3" guid="_325eca58-890e-4b5f-ac03-89defe6483b4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">On the sale of the transfer lot, the chief executive must give the registrar of titles an instrument of transfer executed by the chief executive, in the approved form under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="no">Land Title Act</name></legref>, in relation to the sale.</txt></block></subclause><subclause id="sec.22-ssec.4" guid="_f752aae4-d53a-4915-8c51-8d07f10b72f4" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">On receiving the instrument of transfer, the registrar of titles must register the purchaser stated in the instrument for the interest held in the transfer lot by the previous registered owner, free of provision.type="other"><no>(9)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.22-ssec.9-def.encumbrance_" guid="_ff1e954f-1011-455c-869d-1d4e269eef0d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.22-ssec.9-def.encumbrance" guid="_de4fd21f-79ae-4261-a324-1a0158f5f5d2" type="definition">encumbrance</defterm>—</txt><list break.before="0">includes any of the following affecting land—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.9-def.encumbrance-para1.a-para2.i" guid="_75cbee2f-123f-40ba-9f1c-8467559d25f9" provision.type="other"><no>(i)</no><block><txt break.before="0">a mortgage, lien or charge;</txt></block></li><li id="sec.22-ssec.9-def.encumbrance-para1.a-para2.ii" guid="_6892042e-069c-4f43-a9bd-515a321a133a" provision.type="other"><no>(ii)</no><block><txt break.before="0">a caveat;</txt></block></li><li id="sec.22-ssec.9-def.encumbrance-para1.a-para2.iii" guid="_3ed3fbad-4476-4d4c-8bc3-9028c590c4b6" provision.type="other"><no>(iii)</no><block><txt break.before="0">an agreement;</txt></block></li><li id="sec.22-ssec.9-def.encumbrance-para1.a-para2.iv" guid="_1c4ec818-a213-41ef-97e0-5485bb6ab6c1" provision.type="other"><no>(iv)</no><block><txt break.before="0">a judgment, writ or process;</txt></block></li><li id="sec.22-ssec.9-def.encumbrance-para1.a-para2.v" guid="_fb640ffe-69ba-42ad-9645-7db722638536" provision.type="other"><no>(v)</no><block><txt break.before="0">an interest adverse to the interest of the land’s owner; but</txt></block></li></list></block></li><li id="sec.22-ssec.9-def.encumbrance-para1.b" guid="_72104c93-a45b-4558-bcdc-77bd47084806" provision.type="other"><no>(b)</no><block><txt break.before="0">does not include an easement.</txt></block></li></list></definition><definition id="sec.22-ssec.9-def.previousregisteredowner_" check="valid">section&#160;15</intref>.</txt></block></li></list></block></subclause><subclause id="sec.26-ssec.4" guid="_8f6212e6-a53a-46dd-b1b3-196701569699" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0"><intref refid="sec.26-ssec.5" target.guid="_1f262d7a-7f69-4040-a8d9-88e995a8981c" check="valid">Subsection&#160;(5)</intref> applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.4-para1.a" guid="_8cb75c36-053e-477b-8a96-6c2405f4f5ab" provision.type="other"><no>(a)</no><block><txt break.before="0">an easement order is made by the Supreme Court; and</txt></block></li><li id="sec.26-ssec.4-para1.b" guid="_239e0ce3-12aa-41f2-90d7-12e10372e39d" provision.type="other"><no>(b)</no><block><txt break.before="0">the relevant easement is not registered before the conversion day; and</txt></block></li><li id="sec.26-ssec.4-para1.c" guid="_be9a815d-3b9f-40b5-8589-8ad66c3db4da" provision.type="other"><no>(c)</no><block><txt break.before="0">the following approvals in relation to registration of the relevant easement have been obtained—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.4-para1.c-para2.i" guid="_8e5d1f8d-bcf8-40ea-ba16-616640ef70e9" provision.type="other"><no>(i)</no><block><txt break.before="0">the written approval of the Minister administering the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref>;</txt></block></li><li id="sec.26-ssec.4-para1.c-para2.ii" guid="_62e41bca-9ebf-451d-920e-328bd1d72774" provision.type="other"><no>(ii)</no><block><txt break.before="0">if the Supreme Court considers any other approval in relation to the easement is necessary to give effect to SHPTL 1803—any approval required to comply with an order of the court; and</txt></block></li></list></block></li><li id="sec.26-ssec.4-para1.d" guid="_0161e780-4b9d-449d-96a5-93466847ffed" provision.type="other"><no>(d)</no><block><txt break.before="0">the relevant easement would have been capable of registration under the <legref jurisd="QLD" type="act" target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid"><name emphasis="yes">Land Act 1994</name></legref> had the relevant leases not been cancelled.</txt></block></li></list></block></subclause><subclause id="sec.26-ssec.5" guid="_1f262d7a-7f69-4040-a8d9-88e995a8981c" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The relevant easement must be registered under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="no">Land Title Act</name></legref> as if the easement had been granted over lot 20 of the principal scheme in favour of lot 21 of the principal scheme.</txt></block></subclause><subclause id="sec.26-ssec.6" guid="_2a9c8e9b-05d9-49d9-b4e5-2117f6e0ba69" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.26-ssec.6-def.easementorder_" type="definition">easement order</defterm> means an order requiring the lessee of SHPTL 1803 to grant an easement over part of the land contained in the lease in favour of the lessee of SHPTL lessee of SHPTL 1252 against the lessee of SHPTL 1803 seeking an easement over, or a statutory right of user in respect of, part of the land contained in SHPTL 1803.</txt></definition><definition id="sec.26-ssec.6-def.relevanteasement_" guid="_4d277341-51f2-4d92-9cda-4b1f6caef3de" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.26-ssec.6-def.relevanteasement" guid="_11f1c3e7-1cdb-4eda-bc1f-76595195a4d9" type="definition">relevant easement</defterm> means an easement granted in compliance with an easement order.</txt></definition></deflist></block></subclause></clause><clause id="sec.27" guid="_695d3f6f-991b-4ade-aaac-355b95ce3a87" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>27</no><heading id="sec.27-he" guid="_04477679-0c6f-4289-aab8-e74c87b0b376">Accepted development</heading><subclause id="sec.27-ssec.1" guid="_6ebed8ad-b45e-4635-93dc-95b457040df5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if development under this Act would, other than for <intref refid="sec.27-ssec.2" target.guid="_4d23f743-30fa-4a8b-a683-2a5461ea1391" check="valid">subsection&#160;(2)</intref>, be prohibited development or assessable development under the <legref jurisd="QLD" type="act" target.doc.id="act-2016-025" target.version.series="d4a7e9d3-f73d-48a3-9459-9be0b66a1c15" check="valid"><name emphasis="yes">Planning Act
