or</txt></block></li><li id="sec.4-ssec.3-def.lawfulauthority-para1.b" guid="_6cb0abfe-3062-4de7-a253-aebd064e7ed5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the Governor in Council; or</txt></block></li><li id="sec.4-ssec.3-def.lawfulauthority-para1.c" guid="_e1978dad-46cc-4aba-b5cf-d68e5a30635e" provision.type="other" and</txt></block></li><li id="sec.4-ssec.3-def.publish-para1.b" guid="_5a1c154d-0e44-45a6-9c9d-ba75c479943a" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">cause to be printed; and</txt></block></li><li id="sec.4-ssec.3-def.publish-para1.c" guid="_729f190f-7e1f-488f-b05e-933327de2450" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">distribute, deliver or send, electronically or otherwise; and</txt></block></li><li id="sec.4-ssec.3-def.publish-para1.d" guid="_7e42ddd3-8141-4563-a2ab-6c170732d025" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">cause to be distributed, delivered or sent, electronically or affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a club or association;</txt></block></li><li id="sec.4-ssec.3-def.relevantenterprise-para1.b" guid="_6af7e934-7213-4535-86c1-ed51999753f9" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a business;</txt></block></li><li id="sec.4-ssec.3-def.relevantenterprise-para1.c" guid="_b1eba57b-a7a1-4ef7-b14f-bc9f1225e5d1" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">a profession, break.before="1"><defterm id="sec.4-ssec.3-def.Statearms" guid="_9c212ee0-1abd-44f7-9c0f-17210a8cf1a8" type="definition">State arms</defterm> includes anything that depicts or substantially resembles the State arms.</txt></definition><definition id="sec.4-ssec.3-def.Statebadge_" guid="_3156c931-a2e1-41ff-b6ee-e5a3810da0af" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-ssec.3-def.Statebadge" guid="_2c90b6b8-5479-49c5-b44b-32500f98c274" type="definition">State badge</defterm> includes anything that depicts or substantially resembles the State badge, but does not include the State badge appearing as part of the State flag.</txt></definition></deflist></block></subclause></clause><clause id="sec.5" guid="_38c07ae2-c0e1-4d1e-a099-f4ad2fce6ab6" number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_1d823a49-6dd0-46e5-9791-f2369ebbc6d8" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">summarily under the <legref jurisd="QLD" type="act" target.doc.id="act-1886-017" target.version.series="506b5b47-5bcd-438c-b6a7-27cb65143289" check="valid"><name emphasis="yes">Justices Act 1886</name></legref>; and</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_1beca774-e83f-4b30-9d71-520d46e063bf" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">on the complaint of a person authorised in writing by the Minister to make the complaint.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_4d0c2d6c-d150-4cd8-83b0-41e8f8693bfe" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person who continues an offence against this Act after the person is convicted—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a" guid="_4ff9120d-ae1d-4393-b740-d4efb43fd2a5" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">may be charged in 1 or more complaints for periods the offence continues; and</txt></block></li><li id="sec.6-ssec.2-para1.b" guid="_780322d5-1e43-4295-969e-fe22d65af1f5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">is liable to a further penalty of not more than 10 penalty units for each day on which the person continues the guid="_62673664-7c57-41e6-97a9-acb2336a379f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Minister may delegate to an appropriately qualified officer of the department the Minister’s authority to authorise a person to assume, use or publish the State arms or State badge.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_c6a47c90-96b3-420f-b008-545173aa6691" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.7-ssec.2-def.appropriatelyqualified_" guid="_e47854f8-2fee-4bc8-90b3-21b8e5a9625b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.2-def.appropriatelyqualified" guid="_9c880152-9771-4ff0-a8a0-c2b9d336df67" type="definition">appropriately qualified</defterm>, in relation to the exercise of a power, means having the qualifications, experience or standing appropriate to the exercise of the power.</txt><note id="sec.7-ssec.2-def.appropriatelyqualified-note" guid="_d2deaebd-a194-430f-88d3-2aae151a7f30" type="example"><heading id="sec.7-ssec.2-def.appropriatelyqualified-note-he" guid="_5d1f46f4-dbdb-4216-af15-d032a934e984">Example of standing—</heading><block><txt break.before="1">an officer’s classification level in the guid="_f29d6f51-eb89-499e-8074-de44cb18c3fd" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if an armorial insignia, however described, is prescribed for use under an Act for a document, seal, or otherwise as a mark of authority relating to the State, whether the word ‘State’, ‘Queensland’ or ‘Crown’ is used.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_3582ba35-eff0-4bf0-8bec-7f1372ac7306" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The
