Part 2 Amendment of Environmental Protection Regulation 2019 3 Regulation amended This part amends the Environmental Protection Regulation 2019. 4 Amendment of sch 7 (Approved ERA standards) Schedule 7, part 2, items 2 and 3, ‘version 2’— omit, insert— version 3 Part 3 Amendment of Nature Conservation (Animals) Regulation 2020 5 Regulation amended This part amends the Nature Conservation (Animals) Regulation 2020. 6 Amendment of s 7 (Scientific names) Section 7 (1) (b), ‘used’— omit, insert— accepted 7 Amendment of s 38 (Ways animals must be displayed) Section 38 (5), from ‘is taken’— omit, insert— complies with subsection (2)(b) if the museum or relevant person complies with the animal welfare standards, to the extent the standards are relevant to the way in which the animal should be displayed. 8 Amendment of s 61 (Local governments dealing with flying-foxes) Section 61 (2) (c), ‘flying fox’— omit, insert— flying-fox 9 Amendment of s 157 (Displaying animals) Section 157 (2), from ‘exhibition code’— omit, insert— animal welfare standards, to the extent the standards are relevant to the way in which the animal should be displayed. 10 Amendment of s 202 (Obtaining and keeping animals) (1) Section 202 (1) (a), ‘an authorised animal from the wild’— omit, insert— an animal that is an authorised animal (2) Section 202 (3), definition obtain— omit, insert— obtain, an animal, means—

(a) take the animal from the wild, other than hunt, shoot, wound, kill, skin, poison, spear, injure or harm the animal; or

(b) accept the animal from someone who has taken the animal from the wild in the State or another State. Note— See also section 55 in relation to dealing with sick, injured or orphaned protected animals.

11 Amendment of s 206 (Moving animals) (1) Section 206 (1), from ‘takes’ to ‘taken’— omit, insert— obtains a protected animal under the permit may move the animal from the place where the animal was obtained (2) Section 206 (2)— omit, insert— (2) However, the holder or relevant person may move the animal from another State into the State under subsection (1) only if—

(a) the rehabilitation permit states that the holder or relevant person may bring an animal obtained in the other State into the State for keeping the animal in the State; and

(b) the animal has, at all times, been lawfully taken, kept and used under the laws of the other State; and

(c) all approvals required for the movement under the laws of the other State have been granted.
