pure act-1994-037 Fisheries Act 1994 sl-2025-0170 allinforce Department of Primary Industries 170 published 2025-12-23 website 1 declaration Fisheries (Spanish Mackerel) Amendment Declaration 2025 2025 2025 1 Short title This declaration may be cited as the Fisheries (Spanish Mackerel) Amendment Declaration 2025. 2 Commencement This declaration commences on 1 January 2026. 3 Declaration amended This declaration amends the Fisheries Declaration 2019. 4 Amendment of s 27A (Taking or possessing spanish mackerel in regulated periods—northern spanish mackerel waters) Section 27A (2)— omit, insert— (2) For subsection (1), each of the following periods is a regulated period—

(a) from 8 October 2026 to 29 October 2026;

(b) from 6 November 2026 to 27 November 2026;

(c) from 26 October 2027 to 16 November 2027;

(d) from 25 November 2027 to 16 December 2027;

(e) from 15 October 2028 to 5 November 2028;

(f) from 13 November 2028 to 4 December 2028;

(g) from 5 October 2029 to 26 October 2029;

(h) from 3 November 2029 to 24 November 2029.

5 Insertion of new s 109AA Before section 109A— insert— 109AA Definition for division In this division— recreational limit, for fish, means the number or volume of the fish that a recreational fisher may take or possess under this declaration. 6 Amendment of s 109A (Fish regulated by number or volume) (1) Section 109A (2) (h)— omit. (2) Section 109A (2) (i)— renumber as section 109A(2)(h). (3) Section 109A (3)— omit. 7 Insertion of new ss 109B and 109C After section 109A— insert— 109B Regulated number of spanish mackerel in particular waters (1) This section applies if—

(a) a boat is in tidal waters east of longitude 142º31'49'' east; and

(b) there are more than 4 recreational fishers on the boat; and

(c) the boat is not taking part in a licensed charter fishing trip.

(2) The person in control of the boat must ensure no more than 4 times the recreational limit for spanish mackerel is on the boat. 109C Regulated number of spanish mackerel in Gulf of Carpentaria waters (1) This section applies if—

(a) a boat is in the Gulf of Carpentaria waters; and

(b) there is more than 1 recreational fisher on the boat; and

(c) the boat is not taking part in a licensed charter fishing trip.

(2) The person in control of the boat must ensure no more than twice the recreational limit for spanish mackerel is on the boat. 8 Amendment of sch 5 (Dictionary) Schedule 5— insert— recreational limit, for chapter 3, part 3, division 2, see section 109AA.
